GROTON TOWN 'PUNNING BOARD MEETING

Mr . Totman called the meeting to order at 8 : 10pm .
C . Twigg : When should you obtain a zoning permit instead of. a - building
permit ?
G . Evans : State Building Code . . . . . . . issuing permit under the . . . . . called
a building permit . The Town of Groton does not enforce that
code . Since it does not , it is misleading . If an existing
building is being attached to for such building activity , you
only need a zoning permit .
Let ' s go over the list of what I have given you .
G . Totman : If there are no questions , let ' s proceed .
G . Evans : Part of zoning regulations . . . . . . . . substitute appendix 1 and
2 . There are four . articles . The qualifications part has been
given and the definitions part are being worked on . Appendix
2 - eight part only . . . . of additional work is part 7 . . . . There
was a question about what substantial economic injury was .
G . Totman : - - - - - - - - - - - - - - -
G . Evans : Zoning regulations Article 2 Section 200 - 203 - General Regula-
tions : Different catagories under Section 202 , There are
four different ; classes of things which are allowed and per -
mitted with a special permit and things that are prohibited .
Under catagories allowed ; this is definable as anything built
or established without any permit or whatever . Under Section

board reviewing a special permit might find it of specific
scale or importance - - - - - find it cannot be a special permit
- must be under Planning and Development .
R . Gleason : Could a large dairy operation come under this ?
G . Evans : They don ' t require a special permit . They are exempt . . . . .
Section 202 - What this means is that the zoning regulations
not only apply to building something , but to establishing
some activity even though no building involved at all .
Article 3 - Establishment of Districts - What districts are :
Districts are divided into back districts and combining dis -
tricts : low intensity , low industrial . Combining districts :
- Flood hazard combining districts . These are exempt in com -
pliance with the National Flood Insurance Act of 1978 . Flood
hazard areas to be maped right on your zoning map .
C . Twiggs What are they?
G . Evans : Rough maps - It is the currently applicable flood hazard map
for the Town of Groton . The shaded areas are identified as
Zone Area A . This is the flood hazard area according to the
National Flood Insurance Administration . More detail and
more accurate maps are on the way , but it may be years in
coming . Regulation of the - - - - - - - - by the locality is a require -
ment for the town residents to qualify for the flood subsidy
insurance program . A town can say , ' Yes , we are going to
recommend the flood development ' and they are qualified by the
Flood Insurance Administration . - - - - - - -have not done a careful
job in checking with the regulations they have . It is left
up to the DEC . Basically what they are is that you don ' t
build anything in this area which will obstruct the flow of
water . Don ' t construct anything which is going to be inhab -
ited . If you do , have all - - - - systems at least one foot
above flood level .
C . Twigga - - - - - - - - - - - - - - - - - - - -
G . Evans : NFI Maps . Later on maps and reports which show - - - - - - sections
indicating the rate of flow , - - - - , maps showing reference
points . There are two different - - - - - - - - - : 1 - where water
actually flows , and 2 - where water is actually standing - -
back water . The second map , called Flood Insurance Rate Map .
An insurance underwriter can figure out what rate to charge .
First , note , you want to know where it is and prevent people
from huilding in it . The main force comes from lending insti
tutions .
G . Totman : You can obtain a copy of the flood hazard areas from insurance
people .
G . Evanss And from HUD .

G . Evans : There was one other question in regard to combined zoning
districts . Since one doing the flood area and having
just recently attended a hearing where - - - - - - - - - - - -to us , on
other types of regulations which - - - - - - - - - -property occurred . ;
R . Gleason : Why not include water shed districts ?
G . . Evans : - - - - -Types of uses , types of construction . Fragile natural
resources , flood hazard , structures of ` particular historical
significance . Structure has a - - - - use . They . are subject to
additional review before - - - - - - . Maps included where these j
points are_ - have been numbered .
Article 4 Section 400 - Purpose . Back districts , combining
districts . Two general kinds regulating dimensional - - - - - - -
- - - - - - - - - - - - - and land - use regulations . The importance of - - -
can hardly be stressed to much , dimensional regulations - - - -
_ _ _ _ _ _ _ _ _ _ _ _ * _ _ _ _ _ _ _ _ _ are one type of variance which have
a list of criteria for granting the land - use regulation and
_ _ criteria for granting .

R . Gleason : The material presented from the Town of Dryden is easier to
read - - in ' layman ' s language .
G . Evans : A - - -which houses these terms would be preferable to having
it repeated for each district .
Chart 401 . 5 given by the - - -Board . What were their intentions ?
G . Totman : What is referred to in the ordinance is that a mobile home
must meet the zoning ordinance . Otherwise , it ' s classified
as a one - unit - - - - - - . If - - - - - -then it must comply with the
mobile home ordinance .
R . Gleason : But , is that clear to anybody ; even the enforcement officer?

G . Evans : Classification section under Residential Building - Appendix 1
Section 323 , There is listed a separate mobile home catagory .
R . Gleason : There is a need for a special provision , calling attention to
the special regulations .
G . Evans : General Regulations - are an appropriate place to put - - - - - -
UnderSection 204 - Permits Required . Add subsection to the
affect that mobile homes - - - - - - - -
R . Gleason : Or , put the # after the mobile home section . Also , make the
chart easier to look at .

G . Totman : Some people don ' t like to have special qualifications . They
like to call it a home .

C . Twigg : Where can you pick that ( chart ) up ?
G . Totman : At the Town Clerk ' s Office ,
G . Evans : 323 - - - - but as applicable to the type of building . Why not
keep the catagory " Mobile Home . " Then , if you wish , at the
bottom put * Note - Must also comply with the Mobile Home
Ordinance .

G . Evans : 402 . 2 - I am unclear on " Agricultural Activities 35 . 5 •
G . Totman : We exempted all the way through ,
: G . Evans : Under Civic Activity Type 332 . 13 - - - - - - - - - - - - - - -
R . Gleason : - - - -Special permit with PUD optional .
G . Evans : Section 403 . 4- - - - - - - -Section 332 - - - - - I can ' t tell what it is .
G . Totman : Zoning permit on industrial . Special permit for the first
three .
G . Evans : 403 . 5 - Commercial - 30 . 63 and 64 .
G . Totman : I crossed out and inserted special permit .
G . Evans : I have a regulation on flood hazard area and combined districts .
The ag district does not include any land - use regulations .
G . Totman : How I have taken this is for ag districts then- - - - - does not
need any zoning ordinance ?
G . Evans : No - - - - - - - - - -
G . Gleason : This indicated that farming is a desired use and people should
recognize this in coming in . If putting in something is not
compatible with agriculture - - - - - - -meet certain things before
you can do it .
G . Totman : From this point where do we stand ?
G . Evans : Ok . Under Section 410 : 1 - States that the proposed rela-
tionship between this and Flood Hazard Insurance Act of 1968 .
Statutory references , applicability - - - - - - - - - - - - -
410 . 4 , second page says if something is permitted in the back
regulations , then it being in a flood hazard area simply means
it is permitted with a special permit according to Section 503 ,

but - - - - - of the alternative - - - - - - submitted . - - - - - - - the type
of facilities that are permitted in the flood hazard area .
If the agricultural - - - - - - being in a flood hazard area , makes
no difference . - - - -
Section 503 - Requirements - - - - - - that apply . Flood hazard
area . - _ _ _ _ _ _ _ _ _ set of regulations with DEC . If you want to
build ' . s. omething in the flood hazard area in Section 503 . 5 ,
it lists the requirements that you must meets 1 . A map of
the lot ; 2 . Plans and elevations with dimensions : 3 . Speci -
fications for the - - - - - - - flood proofing .
Regulations are not to completely prohibit construction in
that area , but so that not to cause flooding . If you prove
it won ' t cause such , there is no reason why the permit cannot
be granted .
503 . 6 - Lists facilities .
503 . 7 - Conditions for construction or alter;ationss 1 . = General
requirements - not to increase water velocity . 2 . Electri -
cal and heating should be above the one - - -- - - foot flood level
elevation ; and , 3 . - - - - - - - - - - - - - - -
503 . 9' - Requirements which in affect prohibits - - - - - - - - for
human habitation .
When it comes tothe final maps , they will be sent to the
Town . The Town will then review them for 30 days . A public
hearing will be held ; take suggestions , or if they disagree ,
they will tell HUD officials . They will then respond and
turn out the final maps . Only the Village of Dryden and the
City of Ithaca have received final maps .
Everyone thought it might be awhile before the Town of Groton
received theirs .
G . Evans : I will be writing up the text the way I think it should be and
present it to you , then review the definitions . There is a
list of - - - - - - - -pages - map of contents . The most discussion
will have to be on the definition section . As yet , I haven ' t
looked at it al all .
G . Totma.n : So when ' s a good time to meet again ? In two weeks on the 16th ? '
G . Evans : No , the 23rd .
