Totman - Vice- Chairman* D . Payne* R . Gleason* M . Adams * D . Snell - Zoning Enforcement Officer* C . Twigg* M . E . Dempsey - Cortland Standard* J . Bell - Recording Clerk* - Denotes those present H . Fink opened the hearing by reading aloud the Notice of Public Hearing which was published in the Journal and Courier on the 20th day of October 1976 regarding Roger Gleason ' s proposed minor subdivision . (A copy of this Notice is on file in the Town Clerk ' s Office . ) H . Fink : Seeing no members of the public from the town here this evening , I ' ll now close this hearing . The hearing was closed at 20 to 8 PM . H . Fink : 0 . K . , Mr . Gleason is here and since Don wasn ' t here at our last meeting , are there any questions on your part , Don ? R . Gleason : That shows where it is . H . Fink : It wouldn ' t be a bad idea if Dana looked at it , too . ( Both Mr . Snell and Mrs . Dempsey looked at the map also . ) D . Payne : Are these changes from the original map ? R . Gleason : Yes , so I have to submit new ones of these . H . Fink : At our last meeting we told him to have the corrected maps here - - R . Gleason : Yes , and it ' s my fault , I plumb forgot . Mr . Gleason described to Mr . Snell and Mr . Payne where the proposed subdivision is planned . R . Gleason : That ' s the only change , - - to give him another quarter of an acre . It ' s to an individual and has the restriction it ' s to be a house , no trailers . It ' s all on the application . D . Payne : 0 . K . , - - I wasn ' t here the last time . - 1 - C . Twigg : Where is the Old Stage Road ? D . Payne : Over here some place . C . Twigg : I see . D . Snell : You ' re selling this one . R . Gleason : That shaded one , - -yes . D . Snell : This one is Debbie ' s ? R . Gleason : Yes , and up here it was Wright but he sold it to a Guy something or other . D . Payne : This doesn ' t have all the area on it that is being sold . R . Gleason : Yes , this is it right here and I ' m selling right here . This is what I swapped with Bob Wright . C . Twigg : That ' s the field there? R . Gleason : Yes , there ' s corn in it . C . Twigg ; That don ' t go all the - - where ' s Goodale - - where would his house be ? R . Gleason : Right here . D . Snell : Well , - -what this is , - - is an enlargement of this piece here . R . Gleason : Yes , H . Fink : About 600 ft . road frontage , right Roger ? R . Gleason : Right . This is what Bob Wright , - - I swapped with him , - - O .K . , - - here ' s where Goodale would be right here and this is the part I ' m selling . C . Twigg : Is someone living down in here ? R . Gleason : They put in a driveway . C . Twigg : That ' s all they done ? R . Gleason : That ' s right . Guy , - - the one that owns Guy ' s Cafe , - -bought the whole piece there , around 16 acres , and built a driveway in there , - - that ' s all I can tell you about it . H . Fink : Any other questions ? C . Twigg : This here is it the rest of the cornfield ? R . Gleason : Yes . C . Twigg : Who does that belong to ? R . Gleason : Debbie Lumbert , H . Fink ; Well , - - I will entertain a motion for approval or disapproval . 2 _ M . Adams : I make a motion we approve Mr . Gleason ' s minor subdivision with the stipulation that he provide us a revised survey map . C . Twigg : I second the motion . H . Fink : All in favor ? Those opposed ? The motion was carried unanimously that Mr . Gleason ' s minor subdivision be approved with the stipulation that he provide a revised survey map . AT THIS POINT MR . GLEASON JOINED THE REST OF THE PLANNING BOARD MEMBERS FOR A REGULAR PLANNING BOARD MEETING . H . Fink : To get back to old business , - - let ' s go back to the Minutes of Thursday , October 14th , - - they ' re short and let ' s take a few minutes and read them and they will be the only ones I can ask you to approve at this time , - - the other meetings that haven ' t been approved are too lengthy . (Mr . Snell left for another meeting elsewhere at 10 to8PM . ) R . Gleason : There should be a correction made on page 2 of these minutes , - - the correct acreage is 6 . 2 acres . (Everyone corrected their copies to this effect . ) R . Gleason : I move the minutes be approved , as corrected . G . Totman : I second the motion . Motion carried unanimously . H . Fink : In reading the minutes , is there any discussion on any part of the minutes at all ? What I ' m thinking is one statement here about inviting , - mwhich I didn ' t do , - - inviting Hicks to a Planning Board meeting ? D . Payne : At the present time are any copies of the Planning Board meetings being given to Hicks Dow ? I would like to make the suggestion that that be done . H . Fink : Of all the meetings ? D . . Payne : In the future . R . Gleason : If we are going to do that , - mit would seem to me , - - they ought to be given to him before our next meeting if it ' s going to do any good . G . Totman : When we pass out our own copies we should lay one on his desk and he would have it then before our next meeting . D . Payne : The minutes have to be approved before we can give them to him . Mrs . Dempsey asked if she could speak and said she thought the things the Planning Board are doing are important and if the Board would tell J . Bell anytime they want to - 3 - M . Adams : The people that live here , - - that isn ' t even their name , - - their name is Swiger . . And there ' s a trailer in here somewheres . R . Gleason : I don ' t see how we can decide anything unless someone is down here to tell us something . G . Totman : He has to make a regular application . D . Payne : That ' s right and the old one , I feel , has run out and is not applicable to the submission . H . Fink : Last year Mr . Hora was in Florida and I went and saw Ben Bucko and he wanted the subdivision approved before he left for Florida and I told Ben no way we could accept it and we needed a new map and this is what we get 9 or 10 months later ! D . Payne : How about a year and a half later ? R . Gleason : Mr . Chairman , I move that we write a letter to Mr . Bucko , Mr . Hora ' s attorney , informing him the material is not satisfactory and that they resubmit their application with a new fee and appropriate maps and set up an appointment with us to discuss the subdivision . D . Payne : I would also suggest that the Zoning Enforcement Officer and the Town Supervisor be copied with this letter . H . Fink : The fee is lost in the Town Treasury whether it is rejected or accepted . But the point is before he comes to a meeting , - - to apply for a subdivision it has to be 10 days before regular meeting with application and fee beforehand . D . Payne : His attorney should have knowledge of what he is applying for . Either he should or his attorney should . If they don ' t , then apparently they aren ' t ready to apply fora subdivision . H . Fink : So it would have to be dated from July 6 , 1970 . R . Gleason : There could be one that could be excluded . C . Twigg : If it ' s in his , - - if this is Briece ' s it shouldn ' t even be on Joe Hora ' s map . R . Gleason : That ' s right but at this point we don ' t know that , - -we don ' t know anything . D . Payne : I think someone has to clear this up for us before we can take any further action . G . Totman : Did we ever officially take action to disapprove his application ? R . Gleason : I don ' t think we did . D . Payne : I believe we did act . Some discussion was held on this by all present . R . Gleason : I made that as a motion , - -we write a polite letter . - 5 - Y D . Payne : I really feel that since Ben Bucko was representing the Town at that hearing the letter should go to Mr . Hora and a copy to Ben Bucko and the Town Supervisor and also to Dana Snell . R . Gleason : I make a motion that a letter be written to Mr . Hora stating that he should reapply for a major subdivision of his fifteen lots with appropriate application form , fees and survey maps and that a copy of this letter also be sent to Ben Bucko , Hicks Dow and Dana Snell . C . Twigg : I second the motion . H . Fink : All in favor - those opposed ? The motion was carried unanimously . H . Fink : In Article 2 , Subdivision book , it has definition of a subdivision which says ; " the division of any parcel of land into two or more lots . . . . . . .. " Now in Article 3 , the heading is Procedure in Filing Subdivision Applications it says : "When any subdivision of land is proposed to be made ( and I stress the word "proposed " ) and before any contract for the sale of , or any offer to sell lots in such subdivision , or any part thereof is made , and before any permit for the erection of a structure is given . . . . . the subdivider or his duly authorized agent shall apply in writing for approval of such subdivision . . . . . " So a subdivision actually is a new plan , - - that ' s when you need a subdivision . That ' s my interpretation of this book . R . Gleason : I know what it says . H . Fink : I designate Don Payne to write the letter , with 5 or 6 copies and submit it to me for signature and we ' ll mail it out . D . Payne : I would like copy of this meeting before I write the letter , though . R . Gleason : Mr . Chairman , I have to be excused unless you have something rather important - - I have to leave now . H . Fink : How about our next meeting . Is Tuesday better than Thursday or is Thursday better than Tuesday for everyone ? Since our only function at this time is subdivisions , not zoning , I think we should minimize our meetings to once a month , is that agreeable ? C . Twigg : It ' s fine with me . G . Totman : Except for a special call . H . Fink : Our next meeting will be Tuesday night , November 16 , 1976 at 7 : 30 PM . G . Totman moved the meeting be adjourned which was seconded by R .
