Case, Jr., April Scheffler. MOVED by Councilman Sovocool, seconded by Councilman Scheffler, to approve the minutes of the 2006 meeting as presented. Ayes - Sovocool, Scheffler, Gamel, Clark, Morey. Claim Numbers 157-194 of the General Fund in the amount of$26,914.20 were presented for audit. MOVED by Councilman Gamel, seconded by Councilman Sovocool, to approve the General Bills for payment. Ayes - Sovocool, Scheffler, Gamel, Clark, Morey. Claim Numbers 83-105 of the Highway Fund in the amount of$191,709.97 were presented for audit. MOVED by Councilman Clark, seconded by Councilman Scheffler, to approve the Highway Bills for payment. Ayes - Sovocool, Scheffler, Gamel, Clark, Morey. Claim Numbers 15-22 of the Special Grant (HUD) Fund in the amount of $79,686.54 were presented for audit. Town Board Minutes Page 2 June 13, 2006 Privilege of the Floor: Peg Palmer — Represented Town employees in making a request that health insurance and retirement be taken out of their paychecks pretax. This would increase the amount of take-home pay and reduce the amount that the employees and the Town pay in to state and federal income taxes. Supervisor Morey agreed and explained that they had been trying to do that. They has upgraded to the Williamson Law Windows program so that they could do this but it had a lot of bugs and viruses in it and they were forced to revert to the DOS version. They are on the list to have the program fixed but do not know when that will be, hopefully within the next few months. Clerk Scheffler said that she had spoken to the bookkeeper in Danby, who also works for Williamson Law and he said that he would be happy to help out. Supervisor Morey said that they would call him the next day. Joe Graham — Was there representing the McLean Community Council. The Council was wondering if the Town was going to come up with an ordinance for winter maintenance of the new sidewalks that would be going in as part of the road project. No one knew if the property owners were going to be responsible or what was going to happen and they wondered if that could be done before the sidewalks were completed. Supervisor Morey asked if they had any suggestions and Mr. Graham said no, that there was just a concern because nobody knew how it would be handled. Monthly Reports: Elizabeth Brennan, Bookkeeper/Highway Clerk — Presented monthly report and requested a budget transfer. She said that the auditor is finishing up and should have a report for next month. RESOLUTION#06-052—2006 BUDGET TRANSFER MOVED by Supervisor Morey, seconded by Councilman Gamel Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED,that the Town Board hereby approves the follow 2006 Budget transfer: General Fund— Town Wide: From: Contingency A1990.4 $1,489.00 To: Unallocated Insurance A1910.4 .1,489.00 Gary Coats, Code/Fire Enforcement Officer—There had been a lot of building permits issued. A new project he is starting is to go through all the old building permits on which no certificate of occupation or completion was issued and try to get them all cleaned up. There had been quite a few people caught building without a permit. One of the things discussed at the beginning of the year was to charge an additional fee for people building without a permit. No word had been received concerning the Muka property. The deadline for submitting plans is July 1st as set by the court. Al Maccou's apartment house would be getting a certificate of occupancy very soon. Town Board Minutes Page 3 June 13, 2006 Life Safety Inspections on places of public assembly were almost complete. After some discussion, the Board and Mr. Coats felt that the extra charge was not needed for building without a permit as this could be handled with a zoning violation and in court if necessary. RESOLUTION#06-053—RESCIND FINE FOR BUILDING WITHOUT PERMIT MOVED by Supervisor Morey, seconded by Councilman Sovocool Ayes - Sovocool, Scheffler, Gamel, Clark, Morey WHEREAS, the Town Board had set a fine for building without first getting a building permit during its 2006 Organizational Meeting and WHEREAS, after further deliberation and discussion the Town Board concurs that they do not wish to enforce this extra fee or fine, therefore be it RESOLVED, that the Town Board hereby rescinds part of Resolution #06-001 - 2006 Organizational Items/Appointments, specifically, Item 20-Set Fees for Town Services; Part 18- Town of Groton Zoning Fee Schedule; Additional Fees: d) Building without a permit fine: Double the building permit fee, not to exceed$100.00. Richard C. Case, Jr., Highway Superintendent — At the present time, the Highway Department is dedicated to summer road maintenance. All intersections and hills have been broomed. May's annual Town & Village clean-up day went very well. The Town Highway and Village DPW crews are to be commended for a job well done. May and June have been very productive. The gravel work on Jacob's Ladder has been finalized. Paving of Old Stage Road, from Salt Road to Champlin Road, and Lick Street, from Old Stage Road to Clark Street, has been completed. Shoulders will be applied after the asphalt has had some time to cure. I received notice that Nan Nelson, DEC Mine Reclamation Specialist, had inspected the Spring Street mine site on May 11, 2006. Nan's inspection is in regards to the reclamation taking place at that site. There were four areas of concern to her. We have spent the last two weeks addressing these concerns and hope that the closure permit is near. I think the site has turned out to blend well with the esthetics of the area and has proven that the Town has contained all surface water runoff. I would like to thank Joe Graham, Pete Carr and the entire Highway Crew for their dedication to this project. In-house, I would like to report that the boiler has been fixed. I will be filing the paperwork with the NYS Division of Safety & Health in hopes of coming in compliance with that department. The floor drains have been cleaned and washed. The holding tanks in this system are scheduled to be pumped tomorrow. The orders for the tandem trucks have been received and confirmed by both International an NYSOGS. The Town has received the pickup truck that was ordered through OGS and this vehicle has been placed in service. Town Board Minutes Page 4 June 13, 2006 Mr. Case asked to put some thought into the subject of sidewalks in McLean as the Highway Department does not have the manpower or the equipment to plow or maintain sidewalks. Supervisor Morey asked him to come up with suggestions for a policy. Councilman Clark — I think you and your employees deserve a great thank you for the fine paving job on Old Stage Road. If everyone hasn't seen it, it's worth the drive. With the base you put in, it's such a good job and then the finish, with the pull-offs. I think the County ought to take a look at that. That road will be there. Mr. Case—You did notice the cost though. Escalation, the blacktop, is bid on an escalation/de- escalation clause and it just worked out that from the last day in May to the first day in June, when we finished, it jumped$3.00 a ton. I've never seen that happen in my time. PUBLIC HEARING ON FIRE DEPARTMENT INCORPORATION Supervisor Morey opened the Public Hearing at 8:00 PM. The Town Clerk read the notice of public hearing which was published in the Town's official paper, the Groton Independent, on May 31, 2006 and June 7, 2006. Ric VanDonsel— One of the things that has happened within the volunteer Fire Department is a desire to build a building and expand and recruit volunteers, all very natural expansions of any good volunteer fire department. When I asked to help them review and help them in the financing and the construction part and the legal stuff that needs to go along with that, one of the things that was discovered very early on was that an intended creation of an incorportation some 20 or 30 years ago really wasn't one at all. So, it didn't give them some of the flexibility that they thought they had. Some of that flexibility obviously is the ability, under the Federal laws, to create what's called tax-free corporations. The goal obviously is the ability for donors to provide donations to a volunteer fire company that is a charitable organization under these kinds of things and get the tax benefits that that donation provides for them. That certainly encourages those kinds of donations. Secondarily, it also provides an opportunity for the fire department to have more flexibility in their financing of the construction costs related to any building that they may go to. You may have noticed in reviewing some of the contracts that you have signed over the course of many years, they listed as the Groton Fire Department, Inc. The intention, obviously by having this incorporation is to provide some of the flexibility that I discussed, that is, the ability to look into different types of financing, look into the ability to apply for grants, to get donations from a variety of sources and have them properly applied but not really change their approach and the relationship that the Fire Department, as it exists now, has had with either the Town or the Village. The intentions is to enter into those same and similar contracts, subject to your review and the Village's review of the budget and finance and the appropriate management of the Fire Department during the course of things and continue to enter into the same agreements that we have presented and you have signed and they have signed over the course of the other things. This is really simply, first of all, creating the thing that they wanted to create 30 years ago, properly and to continue the kind of relationship that they've had and get the flexibility of the financing and charitable contributions as I've described. Supervisor Morey—I understand the Village hasn't met on the public hearing yet? Town Board Minutes Page 5 June 13, 2006 Mr. VanDonsel — They have not. We had a false start about a month ago so we stepped back and made some corrections based upon their attorney's request and we're prepared to go forward with everything on the 19th. It looks good. I think we've been able to respond to their questions. Supervisor Morey—I don't think my Board feels comfortable in making this resolution until the Village tells us what they're going to agree with. Ed Smith, Fire Chief — The only thing that's holding the Village up is that it was only advertised one week instead of two. Supervisor Morey — Chuck told me he was going to make conditions of approval of acquired debt load and also a limit of purchases up to $100,000. Mr. VanDonsel — You're the first one to tell us that. So, it's unfortunate that they haven't communicated with me to answer those questions. But if the Board's pleasure is not to do it tonight and we'll have to re-advertise it, I guess. Supervisor Morey — I don't think we have to re-advertise,just table the resolution. Any other concerns that the Village has talked to you about? Mr. VanDonsel — No. We have provided them a memorandum of understanding, kind of outlining all of this and we dealt with that over a couple of months and I think we responded to them. This is the first I've heard of those sorts of things. Supervisor Morey — We've always had a fantastic fire department and rescue squad and I'm sure it's going to be continued over the next couple of years, but is there any assurances that it's going to be the same for the future? Mr. VanDonsel — The things that are good about the Fire Department certainly aren't going to change because the entity is now properly formed. If anything, the goal, obviously, is to improve, that is to make the volunteers have a good place to be in order to preserve equipment that they have purchased and will upgrade as the Town upgrades and flourishes. The volunteer Fire Department obviously has to keep up with that. New facilities provide that opportunity as equipment improves and becomes larger and responses change. I think that you'll find that the goal, obviously, of the Department is to improve and this is one way they are seeing to improve the service. It's your neighbors and community that provide the services. I don't know that the administrative sense and the contracts and how the finances will run will change the dedication that the volunteers have and want to provide. Supervisor Morey—What happens with this delay, if we don't act on the resolution? Mr. VanDonsel — I don't know that the delay would be at all a problem. The land hasn't been purchased. We haven't gone forward, obviously, with the financing so we're not putting you under any pressure. You act, then we'll take them to the next step. As much as I would like to have this part of completed, that's really just a convenience to me and if I have to come back next month, I'll come back next month. Councilman Sovocool—I think I'd rather wait and see what the Village does. Town Board Minutes Page 6 June 13, 2006 Lester Coit, Fire Department — I just wanted the Board to know that basically everything is going to stay the same with the Fire Department. The Town Board will still continue annual contractual negotiations. There's no loss of control to the Town Board or the Village Board. It's basically helping us out. We can apply for grants that we can't apply for as a municipal department. We can hire contractors on the new building. It actually cuts the price down by a third by not having to pay union rate. We'll still be a municipal organization. All it is is incorporating membership. The Village will still have contractual control. It's just holding our assets that we have. Supervisor Morey—Do you acquire the Village assets too? Mr. Coit—That was done back in 1985. Supervisor Morey—Really? Mr. Coit—Yes. Mr.VanDonsel—There is some cleaning up that we need to do because there wasn't anything to acquire the property and there will be. Some of the items that are thought to be Groton Fire Department and personal or real property will have to go through a proper transfer but I think we've worked those out with the Village. Mr. Coit — The Village still owns one fire truck, which allows us to remain a municipal fire department. The Fire Department owns everything else. Supervisor Morey—But it's not critical that we don't act tonight. Councilman Gamel — I just want to throw out a concern for me. I think you guys do a phenomenal job; you always have and I think that as long as you guys are in place, you always will. My concern is for the future that if something happens that monetarily the incorporation runs into financial troubles, are we as a town going to have to come up with the cash to cover that to keep our Fire Department? That's my only concern is that down the road when you guys who have been doing this for ever and ever and ever, aren't in charge anymore who's to say what can happen when it's incorporated. You know how things change over the years and when new people come in with new ideas and all of a sudden they want six new fire trucks and all of a sudden there's this huge debt load, who's responsible for that? It's inevitably going to fall back on the Town and the Village that, look, if we want to keep this fire department we've got to come up with the funds to cover this. And like I said, I think you guys do a phenomenal job and I think that Fire Department you guys are in are way overdue by about 50 years of being replaced with something new and I think it's an excellent step forward. That's my only concern is for down the road somewhere where all of a sudden my taxes go up about 75%because we've got to pay for whatever. I don't how you guys have an answer for that. It's just my concern. Mr. VanDonsel — I think there is an answer and one of the controls that you obviously have is that the most significant contracts that the Groton Fire Department, Inc. will have is the Village contract and the Town contract. That's the source of revenue that they have. Without those contracts and without the input that the Town officials and the Village officials, who may change as well, they don't function and can't buy the sorts of things that they have. No one can willy- nilly buy five or six fire trucks without considering the source of their revenue and income and that is from the Town and Village. Town Board Minutes Page 7 June 13, 2006 Councilman Gamel — I agree with that to a point because there's a lot of people who get credit cards and loans and can't afford to pay them back every single day of the week and as a corporation you can borrow money, you can get loans, and like I said it's not today that's concerning me, it's down the road, ten years, fifteen years, twenty years. That's just my concern. And like I said, I don't know that you have an answer for it and none of us can predict the future. I'm just throwing my concern out. Mr. Coit — I can tell you right here and now, as of today, we work on a line-item budget from day to day. We do have money put ahead for the purchase of equipment and so on and so forth. We've put enough away so that we have a schedule of replacement of trucks twelve years down the road. So, that plan is already in place. Councilman Sovocool—How about a building fund? Mr. Coit — We have a capital reserve fund put aside for a building fund. We also have a donation building fund that was started by Butch Neville and has been added to since he passed away. Several deceased people have willed money to that fund. Mr. Smith — We are about the only fire department around here that I know of that is not fully incorporated. Our biggest reason is that we want to file for some grants. There's money out there and we'd like to replace one 1977 truck. We went to a seminar in Homer, put on by the State, and the first thing out of their mouth was, if you've got a fire truck with round headlights you qualify real high on list for grants; if you've got square headlights you're wasting your time. We're just trying to get some money and we can't file for any of them until we're incorporated. Homer jumped right on to that as soon as they heard it because they have a ladder truck with round headlights on it. I don't see where this is going to change down the road. It has been run pretty near this way all its time. All we're trying to do is get some of the Federal money and State money out there that we can't touch now. That's the reason for incorporation. Moravia just did it awhile ago because they had the same problem and since they have incorporated they have a grant for a new fire station and new fire truck. Supervisor Morey—This is no reflection of our faith and trust in all you guys. Mr. Smith—I don't see how it's going to change down the road because we have to come to you people for a contract and if you don't sign the contract Supervisor Morey — Well you're the only choice we've got. That's the problem; we have no choice whatsoever or recourse. Councilman Gamel— That's my only concern is that ten years down the road somebody new is in charge and there's a whole new group of volunteers up there and it's incorporated and all of the sudden the contract that we normally got, which increases by x percent each year, has gone up by 22%. As a Town Board, what choice do we have other than pay that 22% increase when we've been doing a 3 or 4% increase. That's my only concern. Mr. Smith—You can turn it down just like any.... Councilman Gamel — But we can't. That's what I'm saying. Once it's incorporated we don't have a choice. Well, we have two choices. We can say yes, and pay it or we can say no, and Town Board Minutes Page 8 June 13, 2006 have no fire service. That's not much of a choice. That was my only concern. Like I said, I don't know that there's a good answer for that. Mr. VanDonsel — I don't agree that that is the only choice. There are fire contracts that you could enter into with any number of other fire companies that adjoin the Town of Groton that would provide fire service to meet your responsibilities. You would simply enter into a contract with the McLean or Dryden or Cortlandville. The law allows for those sorts of.... Councilman Gamel—Okay. That's why I asked,because I didn't know that. Mr. VanDonsel - ....just like your contract with the Village, you have ability to contract with another fire district. That ability does exist. Supervisor Morey — But if we did that, the response time would go through the roof, number one and number two our fire insurance would go through roof too. Mr. VanDonsel — It's only hypothetical, obviously there's always negatives to that. If the contract where worthwhile there are stations and ways to solve response time problems. It is not a black and white option that you have fire service with this fire station or you have no service at all. I wanted to add that. Mr. Smith—If it did come to that.....(not using microphone)... Mr. Coit—You already contract with the McLean Fire District. Mr. Smith — And they set their own tax rate and everything in a district. We don't want to a district. We want to just stay the way we are and just get incorporated. That's what we're after. Mr. VanDonsel — We'll let you know what happens next Monday and hope that we can move forward. Supervisor Morey moved to close the Public Hearing and return to Regular Session, seconded by Councilman Scheffler, at 8:18 PM. Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RETURN TO REGULAR SESSION RESOLUTION #06-054—TABLE DECISION ON FIRE DEPARTMENT INCORPORATION MOVED by Councilman Sovocool, seconded by Councilman Gamel Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby tables its decision on the incorporation of the Groton Fire Department until the July 11, 2006 meeting. Town Board Minutes Page 9 June 13, 2006 John Lampman, from Tompkins County Highway, was there to discuss issues pertaining to construction of the Spring Street Bridge and road construction in McLean. The Board had received an estimate of what the cost would be and a draft agreement on Spring Street Bridge, outlining responsibilities of the Town, Village and County and cost breakdown for each. The concrete wall by the bowling alley was brought up and Mr. Lampman said that he considered this part of the wing wall of the bridge and that he did not want to disturb it. Supervisor Morey asked about dredging of the creek because of a rise in the creek at that area which often was the cause of flooding in the Village. Mr. Lampman said there would be some shaping of the stream bed within the area of the bridge. There is also some concern about the location of the sewer line. Mr. Lampman had provided information and maps to the Board pertaining to the McLean road project. At issue are present no-parking zones in front of the Cassavant School and on Church Street. The County plan would create parking spaces in these areas and a resolution from the Town Board would be needed to change them from no-parking to parking areas. The Town Clerk had researched both areas and found that the no-parking area in front of the school was established by resolution and could therefore be changed by resolution. The area on Church Street was established by local law and would require local law procedures, including a public hearing, to change it. Supervisor Morey asked when a decision was needed and Mr. Lampman said that probably not immediately but it would be good to know what the Board wanted to do before they proceeded too far in widening the streets. Supervisor Morey said that they would like to take it to the McLean Community Council before making a decision. The other issue is the proposed sidewalks. Mr. Lampman described where the sidewalks would be and told of certain areas that would be colored and imprinted to have a brick paver appearance. The County was looking to have the Town pick up 5% of the cost of the sidewalks, which would be $2,671.50. Rick Case wondered if in helping to pay for the sidewalks, the Town would assume any responsibility for maintenance or incur any liability. Councilman Sovocool asked if they would be on Town or private property and Mr. Lampman said that they would be in the County right-of-way. Councilman Sovocool explained that where he lives, in the Village of Groton, he is responsible for maintenance, replacement, snow removal, etc., to the sidewalk in front of his home. Also, if people fail to do needed replacements, the Village can have it done and assess the cost to the homeowner's taxes. Councilman Gamel pointed out that the sidewalks in McLean would be more of a main thoroughfare rather than private homeowners and that might created more of a problem in deciding who would be responsible. Mr. Case said that he believed it was part of Highway Law that once a sidewalk has been installed, they become the responsibility of the Town. He thought the sidewalks were a good idea but that his department did not have manpower or equipment for snow removal. Further discussion followed and it was decided that the Town Attorney should look into the legal aspects of the situation before the Board made a decision. April L. Scheffler, Town Clerk/Tax Collector — Presented monthly report for the Board's review. The State law that will reform the dog law so that licenses would not expire at the same time as the rabies vaccinations was due to be signed or vetoed by the Governor on June 8th but no word had yet been received about what he had done. The Board of Elections will be showing examples of new voting machines on June 14 and June 20 at the Ithaca Town Hall. Request was made by the Olde Home Days for a donation to help with the printing of the event maps or for something else. Town Clerk and Court Clerk had attended records management school the previous week and had come back with a lot of ideas for preserving our records. Town Board Minutes Page 10 June 13, 2006 RESOLUTION #06-055—DONATION TO OLDE HOME DAYS MOVED by Councilman Gamel, seconded by Councilman Sovocool Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby approves a donation to the Olde Home Days Committee of$175.00 to be used at the Committee's discretions. John Norman & A. D. Dawson, Town Justices — Submitted monthly reports for the Board's review. RESOLUTION #06-056—JUDGE & COURT CLERK TO ATTEND TRAINING MOVED by Supervisor Morey, seconded by Councilman Gamel Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby approves the payment of expenses for Judge Dawson and Peg Palmer to attend training in Potsdam, NY, July 23 —26. Councilman Donald Scheffler, as Recreation Coordinator — Everything is going great. Summer brochures are out. Duane Randall, County Legislature — Explained the Distinguished Youth Award, which he is in charge of this time around, and that anyone could nominated a youth or group. Criteria is available on the website. Elevations had been shot on Spring Street Extension and plans are being made to help alleviate the erosion problems there. He gave paperwork to the Board concerning an alternative Veterans' tax exemption. The Legislature was again discussing the possibility of a joint jail with Cortland County as a way to address the boarding out issues. The County has hired a second County Administrator, a new Public Relations Officer, and appointed Athena Kalandros to the Planning Advisory Board. RESOLUTION#06-057—ACCEPT COMMUNITY BEAUTIFICATION GRANT MOVED by Supervisor Morey, seconded by Councilman Gamel Ayes - Sovocool, Scheffler, Gamel, Clark, Morey RESOLVED, that the Town Board hereby accepts the Community Beautification Grant and the conditions of the funding. Town Board Minutes Page 11 June 13, 2006 RESOLUTION #06-058—APPROVAL OF THE TOMPKINS COUNTY COUNCIL OF GOVERNMENTS (TCCOG)INTERIM BYLAWS AND APPONTMENT TO THE TCCOG MOVED by Supervisor Morey, seconded by Councilman Clark Ayes - Sovocool, Scheffler, Gamel, Clark, Morey WHEREAS, the Tompkins County Intermunicipal Steering Committee has been meeting to discuss ways the local governments could work together to reduce costs to the residents, and WHEREAS, the Committee discovered that other Counties have created a Council of Governments made up of local government officials, and WHEREAS, the Tompkins County Council of Governments would be an association of local governments organized to provide a forum for discussion and negotiation leading to agreements for more efficient and fiscally responsible delivery of government services, and WHEREAS, the Town of Groton desires to be a member of the Tompkins County Council of Governments, and has reviewed the Interim Bylaws, NOW THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Groton does hereby approve becoming a member of the Tompkins County Council of Governments and agrees to the terms outlined in the Interim Bylaws, and be it further RESOLVED, that Glenn Morey is appointed as the voting member and Don Scheffler as the alternate member. Motion was made by Councilman Scheffler, seconded by Councilman Clark, to table a planned discussion on Time Warner Cable Franchise fee payment errors.
