TOWN OF GROTON –SPECIAL TOWN BOARD MEETING

The following notice of special meeting was read by the Town Clerk:
Please take notice,
that the Town Board of the Town of Groton, County of Tompkins has
scheduled a special meeting for December 27, 2004 at the Town Hall located at 101 Conger
Boulevard, Groton, NY 13073, for the purpose of discussing a possible violation of the Town of
Groton Unsafe Building Law.
The foregoing notice was posted on the Town Clerk’s bulletin board and at the Groton Post
Office and faxed as a news release to the Ithaca Journal on December 23, 2004.
A motion was made
by Supervisor Morey, seconded by Councilman Sovocool to enter into
Executive Session
with Code Enforcement Officer Coats and Clerk Scheffler to discuss
proposed litigation strategy regarding the property of Lewis and Alberta Thompson and an
alleged code violation.

by Supervisor Morey, seconded by Councilman Sovocool, to return to
Regular Session
at 7:17 PM.

A motion was made to rescind
by Councilman Sovocool, seconded by Councilman Scheffler,
Resolution #112,
made December 14, 2004, and replace it with Resolution #118.

RESOLUTION #118 – ORDER REMOVAL OF STRUCTURE FROM
LEWIS & ALBERTA THOMPSON PROPERTY

WHEREAS,
a building permit was issued to Lewis and Alberta Thompson to build the
garage/shed cited in this action, to wit: This structure is further defined as a garage/shed;

Building Permit Number 02-053; issued the 2 of July 2002.
WHEREAS,
the Code Enforcement Officer of the Town of Groton has filed his report in writing
with the Town Board of the Town of Groton containing his findings and recommendations
regarding a certain garage/shed situate on premises at 424 Smith Road in the Town of Groton,
County of Tompkins, State of New York, designated by Tax Map Number 22.-1-19.15, in which
report said Code Enforcement Officer states his opinion that said garage/shed is unsafe and
dangerous to the public and recommends the immediate securing or removal due to the following
reasons: 1) Support columns compromised. 2) Rafter span does not meet New York State Code
requirements. 3) Unsecured electrical wiring. 4) Improper framing of all doors and windows. 5)
Reduction of lumber to unsafe dimensions. 6) Sill plate missing. 7) Over spanning of rafters.
These are violations, with photos supplied to the Town of Groton Town Board by the Code
Enforcement Officer on October 28, 2004, and
WHEREAS,
the Town Board of the Town of Groton, after reviewing said report, and after
hearing said Code Enforcement Officer in regard thereto, and after having duly deliberated upon
the same, having determined that said report warrants the securing of said structure or its
removal
NOW, THEREFORE, BE IT RESOVED,
1)Notice shall be given to Lewis and Alberta Thompson, reputed owners of this
garage/shed, situate on premises at 424 Smith Road in the Town of Groton, County of
Tompkins, State of New York, designated by Tax Map Number 22.-1-19.15, in the form
required by Section Six (6) of the Town of Groton Local Law Number 1 for the Year
1981.
2)Said notice to be served personally upon Lewis and Alberta Thompson. If such persons
cannot reasonably be found, service shall be completed by registered mail to their last
known residence as shown by the records of the Tax Collector or the County Clerk and
by affixing a copy thereof upon said structure.
3)Said notice shall order the securing of said structure in the following manner, to wit: All
entrances shall be secured closed with no entry possible by any person and that such
structure shall be removed from the premises or corrected to current code standards. If it
is deemed that the structure is incapable of being safely repaired, the removal shall be
commenced within thirty (30) days of the service of said notice and to be completed
within sixty (60) days thereafter.

4)A Public Hearing has been scheduled on the 11 day of January 2005 at 8:00 PM at the
Town Hall located at 101 Conger Boulevard, Groton, NY 13073, in relation to such
dangerous or unsafe garage/shed.

5)The Town Clerk of the Town of Groton is hereby directed to prepare said notice and
arrange for the service thereof in accordance with the requirements of said Local Law and
by filing in the Office of the County Clerk.
There being no further business, Councilman Sovocool moved to adjourn, seconded by
Councilman Scheffler, at 7:23PM. Unanimous.
