REGULAR MEETING
The Regular Meeting of the Town of Groton Planning Board was called to order by
Chairman Mark Baxendell at 7:30 p.m.
APPROVAL OF MINUTES - 16 MARCH 2017
A motion was made by Member Monica Carey to approve the Minutes of the 16 March 2017
Planning Board meeting, as submitted. The motion was seconded by Member Lisa Maloney
Hahn, with the vote recorded as follows:

OLD BUSINESS
Randolph Well & Pump Co., Inc., Applicant/ Reputed Owner - 41 Gulf Hill Road - TM #38.-6-9 -
Minor Subdivision of Land & Boundary Change
(Note: At this Board's meetings of 16 February and 16 March 2017, the Board advised the applicant
that they should start with the survey map first, then go to the Town of Dryden, and then come back
before this Board. Reference is made to those Minutes for additional details.)
Applicant rep, Larry Converse, was recognized by Chairman Baxendell who stated that he had heard
from the town of Dryden and the surveys were all set. Member Carey asked to look at the new map
which was the same, but now had been before the Town of Dryden who was satisfied with what was
being proposed and there would be no landlocked property.

With no further discussion, a motion was made by Member Maloney Hahn that the Town of
Groton Planning Board hereby declares itself Lead Agency under SEQRA. The motion was
seconded by Member Leon Brockway, with the vote recorded as follows:

Member Leon Brockway, Jr., then read aloud Part II of the Short Environmental Assessment Form.
Negative responses were obtained to all questions in Part II.
A motion was then made by Member Carey that, based on the information and analysis of the
SEQR concerning this application, the Town of Groton Planning Board has determined that the
proposed action will not result in any significant adverse environmental impact, resulting in a
Negative Declaration. The motion was seconded by Member Barbara Clark, with the vote
recorded as follows:

With no further discussion, a motion was then made by Member Carey to waive the public

subdivision and combining it with the other parcel, as requested.

NEW BUSINESS
Tanner Treacv. Applicant/ Reputed Owner (dba TMT Lawn Mowing) - 1031 Cortland Road - TM
#28.-1-3.2 - Site Plan for Proposed Pole Barn
Chairman Baxendell recognized the applicant who was seeking approval to construct a 40 ft. by 80 ft.
pole barn on the subject parcel, as shown on the maps/sketches accompanying the application. The
pole barn would be used to store and maintain equipment of his business, TMT Lawn Mowing; the
building, which will have full utilities, would also have a small area inside for use as an office. There
would also be one full bathroom and one half bathroom. His business will also sell bulk mulch,

topsoil, stone, and firewood to the public from 8 a.m. thru 5 p.m., April 15111 until 1 November. From
2 November until 14 April, hours will be 8 a.m. until 1 p.m. Heat would be provided by an outside
wood boiler. The Board reviewed the Site Plan provided.
Chairman Baxendell commented that Deputy Clerk Robin Cargian will need to forward the
application to the State DOT and County Planning for their review.
At the conclusion of their discussion, a motion was made by Member Carey to approve the
Preliminary Site Plan for the proposed pole bar, with the plan to be forwarded to the Tompkins
County Department of Planning and the NYSDOT for their review, with a Public Hearing set for
18 May 2017 at 7:30 p.m. The motion was seconded by Member Wyllie, with the vote recorded
as follows:

Groton Golf & Recreation Assoc., Inc., Applicant/ Reputed Owner - 549 Stevens Road - TM #37.-
1-1.2 - Maior Subdivision of Land - Level 1
(Reference is made to this Board's Meeting Minutes of 16 March 2017 for additional details regarding
the approval of a Major Subdivision, Level 1, for the subject tax map parcel.)
Chairman Mark Baxendell recognized Terry Walpole who explained that after this Board approved the
proposed Major Subdivision, they discovered that the County considered it as a Realty Subdivision
which would require soil tests, percolation tests, site plan w/stormwater runoff, proposed driveways,
septic systems, etc.—something they did not want to get into as they would not be developing the
lots. Therefore they were seeking to reduce this to a Minor Subdivision with four lots on the
southwest corner. He then asked if this could be done with an option of combining the four lots into
two and then, possibly, combining those two with the other two at the other end. Chairman
Baxendell responded that they could not do options. He advised the applicant to return before this
Board at the time they proposed to change the configuration.
At the close of the discussion, a motion was made by Member Brockway to rescind its Action #19
of 16 March 2017 which gave conditional approval of a Major Subdivision, Level 1. The motion
was seconded by Member Wyllie, with the vote recorded as follows:

Mr. Walpole stated that the applicant will still stipulate that there be no mobile homes allowed in the
Minor Subdivision, only quality homes, as before in the Major Subdivision.
It was noted by Chairman Baxendell that Part II of the Short Environmental Assessment Form had
been completed previously, so was not required.

A motion was then made by Member Carey to waive the public hearing and approve the Minor
Subdivision as requested, conditioned upon no development will occur on the southernmost
proposed parcel within the 50 -foot buffer to the stream on adjacent Tax Parcel #37.-1-19.2.
The motion was seconded by Member Brockway, with the vote recorded as follows:

Chairman Baxendell recognized the applicant who explained that she would like to subdivide this
3.48± -acre parcel into one parcel of 2.374± A. and one parcel of 1.12± A., selling the larger parcel to a
neighbor, Dustin Snyder.
With no further discussion, a motion was made by Member Clark that the Town of Groton
Planning Board hereby declares itself Lead Agency under SEQRA. The motion was seconded by
Member Maloney Hahn, with the vote recorded as follows:

Chairman Baxendell recognized the applicant who explained that he would like approval of a
Boundary Line Change as he was purchasing a portion of his neighbor's property (Phyllis Dague) and
would like the subject purchased parcel combined/ consolidated with his adjacent parcel, all as
shown on the maps accompanying the application.
With no further discussion, a motion was made by Member Maloney Hahn to approve the
Boundary Line Change, as requested. The motion was seconded by Member Clark, with the
vote recorded as follows:

OTHER BUSINESS
• Chair Baxendell reminded Board Members of Planning/Zoning Training to be held on 25 May
2017, 4:30 to 8:45 p.m. in Norwich, NY.
• Paul Fouts updated the Board on the installation of his farm's proposed manure system. Pipe
burial started today. Will be two lined storage units; two ponds, one of 5 -million gallons, one of
3 -million gallons. Will be boring under Elm Street. Storage will not be visible from the roads.
Hopes for fall completion. Chair Baxendell thanked Paul for keeping the Board apprised of his
progress.
