Clark, Councilman Duane T. Randall II, Councilman James J. Baranello, Town Attorney Absent: Donald F. Scheffler, Councilman Also present: Rick Case, Liz Brennan, Jerry Holl, George Senter, April Scheffler MOVED by Councilman Randall, seconded by Councilman Sovocool, to approve the minutes of the June, 2002 meeting as presented. Ayes - Sovocool, Randall, Clark, Morey. General Fund Claim Numbers 178-198 of the in the amount of $8,869.79 were presented for audit. MOVED by Councilman Sovocool, seconded by Councilman Clark, to approve the General Bills for payment. Ayes - Sovocool, Randall, Clark, Morey. Highway Fund Claim Numbers116-133 of the in the amount of $57,108.99 were presented for audit. MOVED by Councilman Clark, seconded by Councilman Randall, to approve the Highway Bills for payment. Ayes - Sovocool, Randall, Clark, Morey. Special Grant (HUD) Fund Claim Number 244 of the in the amount of $21,809.00 was presented for audit. MOVED by Councilman Sovocool, seconded by Councilman Clark, to approve the HUD bill for payment. Ayes - Sovocool, Randall, Clark, Morey. Supervisor Morey offered privilege of the floor. There was no response. Town Board Meeting 2 of 4 July 9, 2002 Monthly Reports: Elizabeth Brennan, Bookkeeper – Presented her monthly report for the Board’s Review, announced that the auditors were reviewing the 2001 books, and requested a transfer. RESOLUTION #77 – TRANSFER OF FUNDS MOVED by Supervisor Morey, seconded by Councilman Sovocool Ayes - Sovocool, Randall, Clark, Morey RESOLVED, that the Town Board does hereby authorize the following transfer of funds: Highway Fund – Town Wide: From: Service to Other Govt., Pers. DA5148.1………………..$1,224.04 To: Brush & Weed, Pers DA5140.4…………………………$1,224.04 Richard C. Case, Jr., Highway Superintendent – Reported that recent storm damage had put them behind on other projects. Roadside mowing was continuing. Advertising for sealed bids th on Ford 46-30 Tractor had been posted with bid opening on August 5. The Old Stage Road Bridge project was completed other than some signs that the County had to do. Highway Department is on vacation. April L. Scheffler, Town Clerk/Tax Collector – Submitted her monthly report for the Board’s review. James J. Baranello, Town Attorney – Said that he was happy to be representing the Town of Groton while Francis Casullo was unable to be here. Arland Heffron & Alton Alexander, Town Justices – Were not present but had presented their monthly report for the Board’s Review. MOVED by Supervisor Morey, seconded by Councilman Sovocool, to open a Public Hearing for the purpose of reviewing Local Law #2 or the Year 2002 at 7:45 PM PUBLIC HEARING LOCAL LAW #2 OF THE YEAR 2002 – RETIREMENT INCENTIVE The legal notice was read by Clerk Scheffler, which had been published in the Town’s legal paper, the Groton Independent, on June 26, 2002. There was very little discussion or comment on the proposed local law. It was indicated that one employee was interested in taking the retirement incentive. Town Board Meeting 3 of 4 July 9, 2002 MOVED by Supervisor Morey, seconded by Councilman Clark, to close the Public Hearing for Local Law #2 of the Year 2002 at 7:50 PM. Supervisor Morey announced that there was no SEQRA review required. RESOLUTION # 78 – ADOPTION OF LOCAL LAW #2 – 2002 RETIREMENT INCENTIVE MOVED by Supervisor Morey, seconded by Councilman Randall ADOPTED by ROLL CALL VOTE: Ellard L. Sovocool…….Aye Total: 4 Yes Donald F. Scheffler……Absent 0 No Duane T. Randall, II…...Aye 1Absent Sheldon C. Clark…….…Aye Glenn E. Morey………..Aye RESOLVED, that the Town Board does hereby adopt a Local Law electing a retirement incentive program as authorized by Chapter 69, Laws of 2002 for the eligible employees of the Town of Groton. BE IT ENACTED by the Town Board of the Town of Groton as follows: Section 1. The Town of Groton hereby elects to provide all of its eligible employees with a retirement incentive program authorized by Chapter 69, Laws of 200s. Section 2. The commencement Date of the retirement incentive program shall be October 1, 2002. Section 3. The open period during which eligible employees may retire and receive the additional retirement benefit, shall be eighty-five (85) days in length, but shall expire no later than December 31, 2002. Section 4. The actuarial present value of the additional retirement benefits payable pursuant to the provisions of this local law shall be paid as one lump sum, or in five annual installments. The amount of the annual payment shall be determined by the Actuary of the New York State and Local Employees’ Retirement System, and it shall be paid by the Town of Groton for each employee who receives the retirement benefits payable under this local law. Section 5. This act shall take effect immediately upon filing with the office of the Secretary of State in accordance with section twenty-seven of the Municipal Home Rule Law. Town Board Meeting 4 of 4 July 9, 2002 Continuation of Monthly Reports: George R. Senter, Sr., Code/Fire Enforcement Officer – Reported that for the month of June there were 13 building permits issued, one house and one duplex. There were 7 Certificates of Occupancy issued. Life Safety Inspections are current through June. Out of 46 violations sent out, there are 6 left to remedy. Mr. Senter reported that there had been an inquiry about a possible placement of a telecommunications tower within the Town. He expressed concern about height, placement and fall zones and had passed his concerns on to Attorney Baranello. Discussion took place and it was suggested that we “get something on the books” before an application comes in. RESOLUTION #79 – PERMISSION FOR MARGARET PALMER TO ATTEND SEMINAR MOVED by Supervisor Morey, seconded by Councilman Sovocool Ayes - Sovocool, Randall, Clark, Morey RESOLVED , that the Town Board does hereby give permission for Margaret Palmer, Court Clerk, to attend a seminar for town and village court clerks at SUNY Potsdam, Potsdam, NY from July 22-July 23, 2002. Announcements: th  Town of Groton Planning Board – Meeting July 11 at 7:30 PM th  Municipal Official Meeting – July 16 at Lehigh Valley House, 6 PM th  Tompkins County Farm City Days – Saturday, August 10, 11 AM – 4 PM at the Hardie Farms in Lansing.
