Supervisor Morey invited Privilege of the Floor. When no one responded the Board moved on to
monthly reports.
Liz Brennan, Bookkeeper
– You’ve got your report in front of you. There is only one transfer
from Contingency to Youth Summer Help, $287.36 and this is to finish up that account. We will
use all the money. We needed some more money in there, but we will be getting an extra
amount back. I think it’s $865 that we’ll be receiving back on that.

Mark Gunn, Code Enforcement Officer
– My report for building permits for last month was
relatively slow. I had one mobile home and four permits total.
violations notices
However, I was real busy in zoning. I had last month for a property on West
Groton Road where I was holding a certificate of occupancy for an old mobile home and an
addition that had to come down. It took me awhile to get that, but she has hired somebody and is
taking it down now. So, that is one thing that was solved.
William Bartlett
I had gotten in touch with a about a new structure that had been started several
years ago, back in ’96. It was never finished and the place started falling down and the
foundation is falling in. He since has gone out and got another mortgage on the place and has
hired Hatch Builders to go and redo it. Chris Hatch is coming in tomorrow to get a new permit
and they will finish the house. So, that will be done.

We had a problem with a with some land that was being subdivided on
Road
and I spoke with the woman and said that we couldn’t issue another building permit until
the proper subdivision paperwork was filled, which she did. So, that was taken care of.
Michael and Maryanne Reagan
I am happy to say that the case with the old demolished
structure that was never taken out of there, and we had Mr. Hinkle here a couple of times. They
have cleaned everything up and did a nice job doing it. I sent them a letter saying that I am
happy with the results.
Robert Totman
The property on McLean-Cortland road was really strange and I thought it was
taken care of. Mr. Totman, I ticketed him and made him come into Court. I didn’t do a proper
job writing the ticket so they kind of, without prejudice, dismissed that one, because I didn’t

have the proper evidence. I in turn ticketed Gerald Cornell who is the gentleman who had the
life-use through a Supreme Court document. I brought him into Court last week and he
relinquished all his rights to that building. Now Mr. Totman has been ordered to remove the
structure within 30 days, which Robert Totman had told me he was willing to do. He turned
around and came and visited me last night and tells me now that he is going to turn everything
over to his attorney. He is not quite sure he’s responsible for the teardown. So, now I’m not
sure where that stands. I’m waiting for a contact from his attorney. To be continued on that one.
Supervisor Morey
– When did you hear this Mark, last night?
Mark Gunn
– Yes, he stopped in last night. I told him I was worried about the structure, not
what was inside. If somebody had used motor oil or a gas tank in the ground, get the walls down
around it and worry about what’s there after the walls down. It would appease everybody. In
my line of work, it would take care of his tenant getting his property damaged.
Supervisor Morey
– Did you talk to the tenant yesterday or today?
Mark Gunn
– I have not talked to the tenant. If it doesn’t come down in 30 days I imagine he’s
probably going to be back next month. There’s nothing more I can do there until I hear from his
attorney to find out what exactly is going on.
I had a gentleman who I had told would not get another building permit until he finished his barn
that he had started building. He has given me trouble since ’98 on it. Since the letter, he went
out and painted it and did the rest of the work on it and has wrapped that project up.
Ed McKane
The case which has been going on since April of ’99, I was ordered by the Court to
go and inspect the property where his son met us at the end of the property, us meaning me and
the Deputy. He refused us entry to the property, wanted to argue a little more but we refused, so
we left. I took the report to the Judge the next day and there Fran Casullo and the Town
Supervisor are going to finish out the case and see what kind of luck they have with it. At first,
I’ll be honest, I wasn’t sure if that was a blessing in disguise or what. I’ve talked a little more
and I see the way Fran sees it. He saw the aggressiveness of Mr. McKane that night, saw the
verbal attacks on me and my family that night, there in Court, and he expressed his concern and
said that’s exactly why he took it over and he will see it through from there. I’m happy with that
now that I’ve got that kind of understanding about it. I just kind of felt like I had the rug pulled
out from under me, but seeing it in that light, I thank you for that.
Supervisor Morey
– We certainly don’t want you hurt.
Mark Gunn
– I appreciate that. It was a long time, a lot of work and a lot of pressure. I’d gone
through Court nights like that for the last year and a half. The only thing that I do ask is that next
time I get into a Court case like this, that I get some physical support from a Board Member or
two or the Attorney and get some people in here to show that it’s not me, it is my job but there is
a reason for this sort of thing, and I’ve got people behind me. I kind of felt a little alone on this
one for quite awhile, but I feel I got the support I needed now.
Bernie Douka
I just spoke with Mr. Casullo about the property, formerly Dick Clark property on

162 Pleasant Valley Road. He’s been issued a deadline, which was the 30 of August to get
some junk cars taken care of which is against his Special Permit. He is basically running a junk
yard, not a repair business. I’ve gone by, noted that he hasn’t done anything that I can see. I

kind of wanted to see how this McKane thing played itself out before I made any kind of moves
on that. I’m going to make another visual inspection on that tomorrow and contact Mr. Casullo
to let him know and he said he would forward a letter if they have not made any further progress.
And that was my month.
Supervisor Morey
– Okay, any questions?
Councilman Scheffler
– That’s seven for nine. That’s pretty good.
Mark Gunn
– Yes, it’s been tough getting there, but I’m slowly chipping away.
Supervisor Morey
– Mark, you’re saying that you’d like some Board Members at the Court trial.
Is this a common thing? It isn’t, is it? This is one of very few instances that we have. The
majority of people you do write letters to do take care of it right away.
Mark Gunn
- Yes, and when I get to a point where I’m banging my head against a wall and I’ve
got the aggressive people in here, or someone who just doesn’t want to comply, I can let a Board
Member know or two Board Members and basically get some, honestly, I’m not sure how their
voice would even be brought into a Court, I’m not sure. I don’t know if I can call them up and
say this …..
Supervisor Morey
– Okay, you do have the list of, every Board Member who is supposed to
meet with the Planning and ZBA and they have taken at least two months out of the year. If you
can contact that person, I’m sure they would be more than happy to come.
Richard Case, Highway Superintendent
– As of this date the Highway Department has
paving
completed Cobb Street from Pleasant Valley Road to NYS Route34B and Sharpsteen
Road from Pleasant Valley Road to NYS Route 34B. Torok Road was trued and leveled and a
section of Sincerbeaux Road was paved while the paver was available. I don’t know if you’re
familiar with that section of road that’s right in front of Houston’s barn where the milk truck has
a tendency to keep pushing the road out of shape. So, we tried to beef that up a little bit. These
projects are not totally completed but they will be as soon as we can borrow a shoulder machine
from another municipality.
Lansing Municipal Auction
The machinery taken to the sold for around $4,100 before the
auctioneer fees. I would like to request that these moneys, when received, be placed in the
machinery equipment account 5130.2.
The auction did not produce any equipment that fit our needs and therefore nothing was
purchase, leaving the $10,000 in the machinery account.
Mark Kirchgraber
has now been in the Town of Groton’s employment for three months. Mark
has proven to be very knowledgeable and comfortable with highway construction and
maintenance procedures that are performed on a daily basis. Mark has displayed a strong work
ethic and the ability to work well with the public and other employees. It is my determination
50 cent pay
that he has successfully completed his probationary period and should receive the
raise
that we talked about when he was hired.

timber sale
In regards to the on Spring Street gravel mine property, I’ve received some quotes
for surveying and have given the results to Glenn and Sheldon.
Frank
On behalf of the Town of Groton Highway Department I would like to congratulate
Satterly
on his announcement of his retirement from the Groton DPW. Frank’s commitment to
municipal cooperation between the Town and Village has been greatly appreciated. In the same

light, I would like to congratulate on his appointment and look forward to working
with him in the future.
Supervisor Morey
– There was a nice article about Frank in the Ithaca Journal as well as Margie
Albern who is a crossing guard in McLean. Very nice article.
Do we need a resolution for the transfer of money? And you also said the pay raise. And the
survey, you want to do that now?
Richard Case
– That’s up to you fellows. We have two proposals. I just want to make sure……
Supervisor Morey
– Was there a third one? Did you call anybody?
Richard Case
– I haven’t found anybody as yet. But I think in our procurement policy …….
Supervisor Morey
– So, the total cost is $1,750?
Richard Case
– I can’t remember, the cheapest one was $1,700, which brings us within the two
quotes…..
Supervisor Morey
– Did you ever use Manzari and Reagan?
Richard Case
– Personally, no. But I have heard nothing but good about them.
Councilman Clark
– I’m very familiar with them.
Richard Case
– The Town of Dryden, Sheldon worked with them. I’ve had three or four people
tell me that they’re very good.

– Well, there’s three resolutions here.
RESOLUTION #65 - TRANSFER MONEY FROM EQUIPMENT AUCTION

RESOLUTION #66 - AUTHORIZE PAY RAISE FOR MARK KIRCHGRABER

, that the Town Board does hereby recognize that Mark Kirchgraber has completed
the three month probationary period and authorizes a 50 cent raise for him.
Supervisor Morey
– And also, the survey is for the property up on the barn. The survey stakes
are not properly set and we can’t do a forestry until we get the proper survey lines.
Councilman Scheffler
– So, we’ve got to survey it first.
Councilman Randall
– Where’s this money coming out of though? I mean it’s something above
and beyond, this is a new item; it’s not budgeted. Where’s that come from?
Supervisor Morey
– Do you want to table it?
Councilman Randall
– I’m just asking a question because I don’t know the answer.
Supervisor Morey
– Neither do I.
Councilman Clark
– We agreed to pay for it from the future timber sale, which will plentifully
cover it.
Supervisor Morey
– He doesn’t have to do it this month does he?
Richard Case
– No, but within, and Colleen can probably correct me, but within our budget, in
the General Fund, we do put away money in case we need consulting engineers. I think this
would fall under that heading. That’s why I started out with C.T. Male because that’s who we’ve
used previously. I can’t tell you the item number…………..

– Yes, account number A1440.4.

– Is the $10,000 in there?
Supervisor Morey
– Yes.

– We set that aside in case of an emergency that we need an engineering
consultant.
Supervisor Morey
– So, we do have money in there.
Councilman Clark
– I think it would be a good investment for the Town.

– Are we doing them both?

– I just got the proposal for the gravel mine side. After I saw the first quote I was
a little concerned about price and I thought maybe just to expedite the timber sale, I continued on
and just presented it to the surveyors as the one piece of property for now.
RESOLUTION #67 - HIRE MANZARI & REAGAN TO SURVEY TOWN LAND

, that the Town Board does hereby authorize the hiring of Manzari & Reagan, Land
Surveyors, to survey land belonging to the Town of Groton know as Gravel Pit #2, located on the
South side of Spring Street and identified as Tax Map Parcel #321.-4-2 for the agreed upon price
of $1,750.00.

– Two things. On , just to back Mark up a little bit.
When we appeared in Court, Mr. McKane started using some language that wasn’t appropriate
and it started getting into Mark’s family. Quite frankly, Mark doesn’t get paid enough to listen
to that kind of stuff and I just figured, and I should have explained myself better that night, but I
just figured at the time that it’s best that I handle it. He doesn’t know me; doesn’t have a grudge
against me; doesn’t have a grudge my family. I’ll handle it from this point on. Hopefully we do
this rarely. I just think it would be a lot better for Mark if he doesn’t have to put up this kind of
stuff. You know, no one has to listen to that stuff in public, so I’ll handle the rest of this case.
And I should have explained it to Mark and I didn’t. That was my rational for it. I apologize
that I didn’t do it that night.
The second thing, Glenn, I think we’re going to need a motion, because I have prepared a release
diminishing lien agreementRobert and Kathleen Morey
or discharge for that . executed that in
1995 with the Town of Groton. It was from the HUD or Community Development Fund.
Apparently they’ve paid it, so we’re going to need a resolution authorizing you as Supervisor to
sign that discharge of that agreement.
Supervisor Morey
– By the way, they’re no relation to me. May I have a motion please?
Clerk Pierson
– How do all the rest of them get this taken care of? The County did them and
sent them up here, Teresa signed them, and I notarized them.

– This is the first time it’s happened.

– But what’s the big deal? There’s new staff down there, I know, but I couldn’t
find anyone who knew what was happening.
RESOLUTIION #68 - DISCHARGE OF DIMINISHING LIEN AGREEMENT
OF ROBERT & KATHLEEN MOREY

, that the Town Board of the Town of Groton recognizes that the Robert & Kathleen
Morey diminishing lien agreement has been paid in full and hereby authorizes the discharge of
the lien from public record.

Justice Heffron
– I have three or four things that I would like to bring to the attention of the
McKane case
Board. For one thing, let’s review the as it’s actually happening. There was an

article in the paper here on August 16 about the case being put off for another month and the
case has dragged on for over a year, which is more or less true. And the Code Enforcement
Officer tells the Court that they’re more interested in getting Court fees instead of resolving the
case. Well, that’s not true. We don’t want to collect money, we want compliance. And I’m
going back here to the time when the case was handed to me.
Supervisor Morey
– Is this public information?
Attorney Casullo
– That’s what I was just beginning to think. As a matter of fact the case is
still….it’s public information. I understand where the Judge is coming from, and I think he’s a
little upset about…. I think, Judge, the one thing that I can tell you is that I’ll be taking a more
active roll in this case. And I think at that point the Board knows that and I think that’s all that
really needs to be said.
Justice Heffron
– Well, perhaps a little bit does. Mr. McKane was in Court and he pled guilty to
the charge of not complying and he was fined an appropriate penalty, which he paid. To make a
long story short, he was in Court last Wednesday night and refused Mr. Gunn admission to his
property. And at that time Mr. Casullo stepped in and asked if he would allow him to inspect the
property and that agreement was made. The case was adjourned to another 60 days for that
inspection to take place. I don’t know what they set up for an appointment, but I understand that
it is going to come about. This case was handed to me as a result of Mr. Dawson becoming
biased in the case and he didn’t feel that he could do justice to it. I didn’t get the case until last
April. I have progressed with it from there.

Supervisor Morey
– Arland, let me stop you there. We hold no ill feelings about you. Hopefully
we will be able to take care of this. I think it’s in the proper hands right now.
Justice Heffron
– Mr. McKane was in Court last week and he did show some progress and
hopefully it will be resolved. It has been going on a long time, but I haven’t had the case except
st
for from about the 1 of last April.
Another thing I would like to bring up: according to Town Law, Section 31, also under the
annual audit
Uniform Justice Court Act, we are required to have an . Does the Board want us to
do that or do you want to engage an outside auditor? And if you do, will you set a date where we
can have the material ready?
Supervisor Morey
– All right. Rick Beals is now doing the Town audit. I’ll call him tomorrow
and set it up for you. He usually does it for you, doesn’t he?
Justice Heffron
– We do need an audit. I want to go back to one thing more about Mr. McKane.
The Enforcement Officer brought up the legality of a fence. The Court cannot do anything about
that because…………….
Supervisor Morey
– Arland, we’ll take care of that, okay? We’ll take care of it, find out what it
is and try to resolve this problem, okay? It’s gone on too much and we know that. I promise you
it will be taken care of.
Justice Heffron
– One last thing, I believe the door was approved for the courtroom. Where do
we stand on that?
Councilman Randall
– We needed another bid, which I asked somebody and they didn’t come
forward. It was a matter of the procurement policy. I talked to Frank yesterday. He is pretty
busy, so…… I haven’t forgotten it.
Supervisor Morey
– Arland, all the good ones are really busy and you have to stand in line and
wait.
Justice Heffron
– Thank you.
Supervisor Morey
– David Buck, Police Officer in charge of the Village of Groton Police
Court Constable
Department would like to come and discuss this situation about the . Hi, David.
Officer Buck
– Thank you. I think maybe we’ve gotten somewhere with this with a person who
could possibly help you out. The situation being that even with the Village Court, for me to
attempt to put in a Court Officer is even tough for me, mainly because everyone that I have
who’s employed is part time. To bring somebody in for Court, not knowing how long they are
going to be there is even tough on us. It may come down to the point where we are going to talk
too about using the same person, if we can. Judge Heffron, I think at this point, is happy with the
Court Officer.
Justice Heffron
– I was going to bring that up, but I thought you would.
Supervisor Morey
– That’s one of the agenda items.

Officer Buck
– The unfortunate part was that Judge Heffron called us a couple of months ago for
a Court Officer because they were ready, I think at that time, to charge the Jury. It was expected,
we thought, by the other agency that was actually having the trial, that it would be handled by
them. Come to find out, there is no obligation on their part to do it. We only found that out by
having a meeting with Glenn, the two judges and myself meeting with the Resource Center for
the Magistrates. If Arland can use us, we’d loved to help you out. But at this point I can’t
guarantee because even if we have Village trial, I’m going to have a hard time getting somebody
in here too. The other thing with the wages, I guess there’s a difference in the wages. Whether
you work that out or not, I don’t know. For me to send a man over here, it’s going to cost $11.00
an hour, if I can get a man. I guess there was some problem with that. But like I said, for
myself, we may even try and use this person too, if it’s possible. I know that the part of whether
he is going to be a Constable or a Court Officer is of course going to be for you to decide. I also
know that there are different ways to do it. Another Court actually employs them. They are an
employee of the Town. Others don’t, it all comes out of the Court budget. So, there are
certainly different options and different ways to do it. The other situation which you have is
where we sent our officer over to cover because there was just absolutely nobody there and they
couldn’t go any further unless they had a Court Officer. We sent the officer that was working the
Village that day over here and it turned out to be an hour and a half. I don’t mind accepting that
hour and a half. We’re here to help each other and I don’t mind that one bit. If it became a
situation that could have been used, then I would have, but certainly to help the Town out, I
don’t have a problem with that. It is just something that I can’t foresee being able to do. I guess
that’s about all I really have to say, or to address you. There may be some point where I am
going to have to go back to my Village Board, or if Judge Heffron and Judge Dawson are going
to be able to handle this themselves. Possibly at this point you do have a Court Officer which up
until a week or so ago, we didn’t have anybody.
Supervisor Morey
– And you highly recommend this person?
Officer Buck
– I do, yes, I personally know him. He enjoyed it and he is one who is available
because your hours for your Court trials, you can’t determine them, you won’t know until then.
I know that day it went from 11 o’clock in the morning until 10 o’clock at night and I just can’t
guarantee because I have officers who are working full time jobs somewhere else. We just
couldn’t put somebody in there for that. It would be hard to do.
Supervisor Morey
– Does the Board have any questions about the job or the responsibilities?
Councilman Scheffler
– He’d be basically a bailiff in Court and then go pass out summonses or
whatever he had to? That’s the way I understand it.
Supervisor Morey
– Well, you should have gotten a copy of the job description too. All right,
thank you David.
Officer Buck
– The only thing I have to say is if for some reason you get caught in a bind, we’d
be glad to help you out if we can. We know you’ve got to have somebody there and if others
don’t feel that there is an obligation, to me if there is a request from the Court I would feel that
we would have to act upon it somehow. If I can help you, if you are caught in a bind, just let me
know and I’m sure we can work something out.

– Next item on the agenda is action on the Constable position. The rate,
Colleen, is $10.00 an hour, or what do you want?
Clerk Pierson
– That’s what Arland put on the voucher. The Town Board had set $10.25 for the
previous one. So, if he accepted that $10.00, maybe $10.00 is okay.

Town Constable at the rate of $10.00 per hour.

– I’m sorry, you said Constable? I don’t think he’s going to accept the position as
Constable. It would be as Court Officer only.
Supervisor Morey
– Okay. The next item on the agenda is resolution to approve Tompkins
County Recreation Partnership. I’ve handed out all the information to everyone. It is on its final
draft with the addendum to the final proposal. Is there any discussion on this?

meetings on budget. It’s an open meeting and anyone is welcome, but the Board has got to be
there.

ACCOUNTING FOR BACK PAY AND TIME

RESOLVED
, that the Town Board, after discussing the back pay, back vacation time, back sick
time, and back holiday time for April Scheffler, the Town Board has decided to make no further
monetary payments and will grant no additional vacation, sick time, or holiday time.

Everybody has a copy of it. Is there any questions on it? We’ll be doing this

Retirement Seminar
, September 19, 6:30 – 8:45 at the Cooperative Extension.

will be having a retirement party on September 16.
Planning Board has decided, to fill the two vacancies, to invite the people to come to the
Planning Board Meeting, find out what they want, and then present it to the Board. The Board
will be invited. That will happen that month.
Part of the Planning Board also wanted me to bring to the Board, we’re not going to make a

motion tonight, but there is an and a copy of the Local Law of 1977.
That has to do with when agricultural land is taken for residential land or commercial land.
There is going to be a seminar in September that we’re going to be going to find out a little bit
more about it. But what they’d like to do is include this with the application for everybody
coming into town.

about doing the Court at a later date.

– I’d just like to thank the Board and Rick Case for helping us out with
Days
. You did a lot of advertising for us in the newspaper and I really appreciate that, Ann and I
do and the family. I know Rick came up and had his fellows do a lot of site work along the
highway and put up signs and I really appreciate that. The event went good. Sheldon was there,
he can tell you. We’re really happy and would like to thank everybody for cooperating and
getting it done.

– The ZBA, they looked through the Comprehensive Plan and I’d like to
give them a vote of confidence because I think they’re really eager about attacking that and they
had a lot of good suggestions.
