The Public Hearing was opened at 7:30 p.m. by Chairman Edward Neuhauser with the Board Secretary reading aloud the Legal Notice as duly published in the Finger Lakes Community Newspapers. Proof of Publication has been placed on file for the record. PUBLIC HEARING Erich Haesche (dba Lubricants & Fuel Solutions), Applicant/Reputed Owner – 97 Ogden Road – TM #28.-1-34.305 – Final Site Plan Review – Proposed Warehouse Facility (Note: Reference is made to the 15 September, 20 October, and 17 November 2016 Minutes of this Board regarding this application.) Chairman Neuhauser recognized the applicant who once again advised those present of his plans to utilize the building on this property for a warehouse facility for his business. The Board had no questions regarding this matter. Chairman Neuhauser asked if there was anyone present from the public who wished to speak on this appeal; there was no one. With everyone being heard who wished to be heard, at 7:33 p.m. a motion was made by Member Leon Brockway to close the Public Hearing, seconded by Member Monica Carey, with all Board Members voting in favor. (T) Groton Planning Board Minutes of Public Hearing & Regular Meeting 22 December 2016 Page 2 of 8 REGULAR MEETING The Regular Meeting of the Town of Groton Planning Board was called to order by Chairman Ed Neuhauser at 7:34 p.m. APPROVAL OF MINUTES – 17 NOVEMBER 2016 A motion was made by Member Lisa Maloney Hahn to approve the Minutes of the 17 November 2016 Planning Board meeting, as submitted. The motion was seconded by Member Barbara Clark, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Maloney Hahn Member Wyllie Member Brockway Motion carried. This becomes Action #78 of 2016. OLD BUSINESS Erich Haesche (dba Lubricants & Fuel Solutions), Applicant/Reputed Owner – 97 Ogden Road – TM #28.-1-34.305 – Final Site Plan Review – Proposed Warehouse Facility Chairman Neuhauser asked the Board if they had any further questions for the applicant regarding this application. There were none. With no further discussion, a motion was then made by Member Mark Baxendell that the Town of Groton Planning Board declares itself Lead Agency under SEQRA for the proposed Warehouse Facility. The motion was seconded by Member Bret Wyllie, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Maloney Hahn Member Wyllie Member Brockway Motion carried. This becomes Action #79 of 2016. Chair Neuhauser then read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Clark that, based on the information and analysis of the SEQR concerning this application, the Town of Groton Planning Board has determined that the proposed action will not result in any significant adverse environmental impact, resulting in a Negative Declaration. The motion was seconded by Member Brockway, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Maloney Hahn Abstain: Member Baxendell Member Wyllie Member Brockway Motion carried. This becomes Action #80 of 2016. (T) Groton Planning Board Minutes of Public Hearing & Regular Meeting 22 December 2016 Page 3 of 8 Town Code Enforcement Officer Rick Fritz advised the applicant of the inspection requirements with which he must comply. With no further discussion, a motion was then made by Member Carey to approve the Final Site Plan for the proposed Warehouse Facility, as requested. The motion was seconded by Member Baxendell, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Maloney Hahn Member Wyllie Member Brockway Motion carried. This becomes Action #81 of 2016. NEW BUSINESS Cynthia L. Hill, Applicant/Reputed Owner – 792 Sovocool Hill Road – TM #25.-1-29 – Proposed Minor Subdivision Chairman Neuhauser recognized the applicant who was seeking approval to subdivide a 5±-acre parcel from the subject 50±-acre parcel, as shown on the maps accompanying the application. Chair Neuhauser asked the Board if they had any questions for the applicant regarding this application. There were none. With no further discussion, a motion was then made by Member Maloney Hahn that the Town of Groton Planning Board declares itself Lead Agency under SEQRA for the proposed Minor Subdivision. The motion was seconded by Member Clark, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Maloney Hahn Member Wyllie Member Brockway Motion carried. Bruce DeForrest, Applicant/Reputed Owner – 449 West Groton Road – TM #22.-1-4.32 – Proposed Minor Subdivision Chairman Neuhauser recognized the applicant who was seeking approval to subdivide a 2±-acre parcel from his 19±-acre subject parcel to give to his son, as shown on the maps accompanying the application. Chairman Neuhauser asked the Board if they had any further questions for the applicant regarding this application. There were none. With no further discussion, a motion was then made by Member Bret Wyllie that the Town of Groton Planning Board declares itself Lead Agency under SEQRA for the proposed Minor Subdivision. The motion was seconded by Member Brockway, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Maloney Hahn Member Wyllie Member Brockway Motion carried. Eric DeForrest, Applicant/Reputed Owner – 429 West Groton Road – TM #22.-1-1.32 – Proposed Boundary Line Change Chairman Neuhauser recognized the applicant who was seeking approval of a Boundary Line Change, as shown on the portion of the tax map accompanying the application. Chairman Neuhauser asked the Board if they had any further questions for the applicant regarding this application. There were none. With no further discussion, a motion was then made by Member Maloney Hahn that the Town of Groton Planning Board declares itself Lead Agency under SEQRA for the proposed Boundary Line Change. The motion was seconded by Member Brockway, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Maloney Hahn Member Wyllie Member Brockway Motion carried. This becomes Action #90 of 2016. Donald N. Palmer, Trustee, Applicant/The Palmer Family Living Trust, Reputed Owner – 320 Pleasant Valley Road – TM #32.-1-25.1 – Proposed Minor Subdivision Chairman Neuhauser recognized Mr. Palmer who was seeking approval to subdivide a 0.7± parcel from this 5.4±-acre parcel, as shown on the map accompanying the application, to sell to adjacent land owners to straighten out the existing property lines. Chair Neuhauser asked the Board members if they had any questions for the applicant; they had none. With no further discussion, a motion was then made by Member Maloney Hahn that the Town of Groton Planning Board declares itself Lead Agency under SEQRA for the proposed Minor Subdivision. This becomes Action #93 of 2016. Robert Strickland & Deborah Bennett, Applicants/Reputed Owners – 308 Pleasant Valley Road – TM #32.-1-25.2 – Proposed Boundary Line Change Chairman Neuhauser recognized the applicants who were seeking approval of a Boundary Line Change, as shown on the map accompanying the application, resulting in the Palmer Trust parcel (Action #93 above) being consolidated with their subject parcel. Chairman Neuhauser asked the Board if they had any further questions for the applicant regarding this application. There were none. With no further discussion, a motion was then made by Member Brockway that the Town of Groton Planning Board declares itself Lead Agency under SEQRA for the proposed Boundary Line Change. The motion was seconded by Member Maloney Hahn, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Maloney Hahn Member Wyllie Member Brockway Motion carried. OTHER BUSINESS • Chairman Neuhauser advised Board members to check the Training Record in the file to make sure that their training credits were complete and up to date. • Chair Neuhauser stated this Board will meet next month (19 January 2017) for Organizational Matters, in addition to any application(s) that may be received.
