MINUTES OF SPECIAL TOWN BOARD MEETING
WEDNESDAY, APRIL 29, 1998 AT 7:30 P.M.

PURPOSE OF MEETING-
To award bids for vibratory roller.
The bid opening was held on April 28, 1998 at 4:00 PM at the Town of Groton
Highway Garage, for a 1990 or newer Vibratory Roller.
Present: Richard C. Case, Jr., Highway Superintendent, Teresa Robinson,
Supervisor, Attorney Fran Casullo, Richard C. Case, III, Marty Loefstedt from
Rupp Rental, and Elizabeth Brennan, Recording Secretary.
RICK CASE, HIGHWAY SUPERINTENDENT
- We had the bid opening yesterday at 4:00
o'clock. You have a copy of the results. We reviewed the specs and the low
bidder as you can see was Rupp Rental/Anderson Equipment. They met and
exceeded the specifications that I had. They also included a 200 hour or 60
day drive train warranty which none of the rest of them included.
That bid is for $27,198. It is my recommendation that the Town purchase a
1990 Ingersoll-Rand DA-50 Vibratory Roller from Rupp Rental for a net price of
$27,198 and trading in a 1975 Gallion Hydrostatic 10-15 Ton Roller. Board
Members and Rick reviewed bids, specs and quotations. Tracey didn't sign the
non-collusive bidding form.

- What you will have to do if you are taking this out
of the capital reserve equipment fund, I think it is subject to a permissive
referendum, which means once you accept the bid, whatever bid you accept
tonight, I'll get together with Colleen and we'll have to put a notice in the
paper making this accepted subject to a permissive referendum. If anyone wants
to put together a petition, they will have 30 days to do it. If they don't,
then at the end of the 30 days from the date that it goes in the notice then
you are all set to take the money out of the account and purchase the roller.
Rick Case asked if you could take possession of the roller before the 30 days
was up. Attorney Casullo advised not but possibly he could rent machine.
Board Members discussed further the bids, specs and costs.
RESOLUTI0N NO. 23 - ACCEPT BID FOR 1990 VIBRATORY ROLLER

Ayes - Sovocool, Scheffler, Palmer, Carey, Robinson
RESOLVED
, that the Town Board does hereby accept the bid of Rupp Rental
(Anderson Equipment) to purchase a 1990 Ingersoll-Rand DA-50 Vibratory
Roller for a net price of $27,198 subject to permissive referendum.
FRAN CASULLO, ATTORNEY
- We need to get going on this second annexation
petition. The Village Attorney called me today. They are looking to want to
do this on Thursday, May 28th at 7:00 P.M. That's about the only time you
could do it without bringing this into June and still staying with the
statutory requirements. If this is okay with you, we need to get this in the
paper for the hearing. I don't think we will have a problem doing this at
this meeting as long as we are just scheduling a public hearing for the Talbot
Annexation.
Moved by Councilman Palmer, seconded by Councilman Carey, that we schedule a
public hearing on George and Brenda Talbot's petition for annexation to be

held on Thursday, May 28, 1998, at 7:00 PM at the Town Hall, Conger Boulevard,
Groton, NY. Ayes - Sovocool, Scheffler, Palmer, Carey, Robinson.
TERESA ROBINSON, SUPERVISOR
- I have one more question. Can we do the
appointment of the Zoning Officer at this meeting or not?

- No, you have to wait for your regular meeting to do
that. I'll get the notices over to you Colleen in the morning.
There being no further business, Councilman Scheffler moved to adjourn
meeting, seconded by Councilman Palmer, at 8:00 P.M.
