SPECIAL TOWN BOARD MEETING
TUESDAY, MARCH 3, 1998 AT 7:30 P.M.
Those present: Daniel J. Carey, Deputy Supervisor
Ellard L. Sovocool, Councilman
Donald N. Palmer, Councilman
Donald F. Scheffler, Councilman
Francis Casullo, Attorney for Town
Absent: Teresa M. Robinson, Supervisor
Also present: Teresa Hunter, DeForest Hall, Francis Ciccoricco
Purpose of meeting was to hold public hearing on Proposed Local Law No. 1 for
the year 1998 - Extend Moratorium for the establishment of adult uses/adult
businesses for another 120 day period and to take Board action on same.
Clerk read notice of special meeting and public hearing.
Deputy Supervisor Carey opened hearing and asked if there were any comments.
This local law is to extend our current moratorium regarding adult
entertainment facilities and business for an additional 120 days.
F. Ciccoricco - Thank you.
L. Sovocool - Is this the same thing as we previously adopted?
F. Casullo - We cannot pass a law until we have completed a study. We need to
talk with neighboring towns and all work together to complete a study.
Deputy Supervisor Carey - We will close hearing if there are no more
questions.
D. Hall - Are there distances from property lines in there?
Deputy Supervisor Carey - This extends the moratorium. The ordinance is
written and we need to do a study prior to adopting.
F. Casullo - Most of local laws have distances.
D. Hall - How far from residential people?
Deputy Supervisor Carey - Any one else? If not we will close the hearing.
Hearing closed at 7:40PM.
Deputy Supervisor Carey asked for a motion to adopt local law.
RESOLUTION NO. 12 - ADOPT LOCAL LAW NO. 1 FOR THE YEAR 1998
A LOCAL LAW EXTENDING THE MORATORIUM FOR
THE ESTABLISHMENT OF ADULT USES/ADULT
BUSINESSES FOR ANOTHER 120 DAY PERIOD
Moved by Councilman Sovocool, seconded by Councilman Palmer
Ayes - Sovocool, Scheffler, Palmer, Carey (Absent -Robinson)
Resolved, that the Town Board does hereby adopt Local Law No. 1 for the
Year 1998 Extending the Moratorium for the Establishment of Adult
Uses/Adult Businesses for another 120 day period.
There being no further business, Councilman Scheffler moved to adjourn
meeting, seconded by Councilman Sovocool, at 7:41 P.M.Unanimous.
