MINUTES OF TOWN BOARD MEETING
TUESDAY, JULY 8, 1997 AT 7:30 P.M.

Moved by Councilman Palmer, seconded by Councilman VanBenschoten, that the
minutes of June 10, 1997 be approved as submitted. Ayes - Sovocool,
VanBenschoten, Palmer, Carey, Robinson.
Claim Nos. 97 to 110 of the Highway Fund in the amount of $88,650.42 and Claim
Nos. 139 - 159 of the General Fund in the amount of $7,281.91 were presented
for audit. Moved by Councilman Carey, seconded by Councilman Sovocool, that
the bills be approved for payment. Ayes - Sovocool, VanBenschoten, Palmer,
Carey, Robinson.
Claim No. 102 of the Special Grant Fund (HUD) in the amount of $24,535.00 was
presented for audit. Moved by Councilman VanBenschoten, seconded by
Councilman Carey, that the bill be approved for payment. Ayes - Sovocool,
VanBenschoten, Palmer, Carey, Robinson.
LIZ BRENNAN - BOOKKEEPER
- June is the end of the quarter so you all have a
listing of all expenditures and revenues. We need two transfers, one from
Townwide Highway Fund from Contingency to Bridges in the amount of $128.42.
We had $1,000 budgeted in the bridge account and we were over just a little.
In the Part Town Highway Fund from Contingency to CHIPS in the amount of
$431.64 and you will also see in your file a sheet from the State as long as
the budget goes through that our apportionment is $50,431.64 and the budget
has $50,000 so we are raising it and putting in the $431.64 so we can use the
full amount to be reimbursed.

- The Retirement Incentive Program - Jerry wanted to

know if you have intentions of passing it. I know we brought it up last
month. Figures were given out last month. I think it was around $5,000.
Those that are eligible are Jerry and Carol. Elected officials are not
eligible for this particular retirement incentive. The local law has to be
passed not later than September 3, 1997. You would need to schedule a hearing
for this proposed local law by our next months meeting.
Open period has to be between September and December. (Estimated annual cost
is $6,762 and estimated five year total cost is $33,812 which includes both
Carol and Jerry). New employees hired to fill these positions would be in
Tier 4 and paid a lower salary and the Town wouldn't be paying out near the
money that is paid out now. Consensus of the Board was that they had no
objection to this.
RESOLUTION NO. 34 - SCHEDULE PUBLIC HEARING FOR PROPOSED
LOCAL LAW NO. 3 OF 1997 - THE 1997 RETIREMENT
INCENTIVE PROGRAM

, that the Town Board does hereby schedule a public hearing for
proposed Local Law No. 3 for the year 1997 titled "The 1997 Retirement
Incentive Program" to be held on Tuesday, August 12, 1997 at 8:00 P.M.
LELAND CORNELIUS - HIGHWAY SUPERINTENDENT
- Gave Board an update on the
removal of fuel tanks which included a memorandum from David A. Fritts of C.T.
Male Associates. This memo was a summary of the current status regarding
former 2,000 and 10,000 gallon underground petroleum bulk storage tanks that
were removed on May 27, 1997. Petroleum contaminated soil was stockpiled. In
regards to the removal and disposal of the soil, C.T.Male talked with Mr. Roth
of Environmental Products and received a quote of $52/ton to perform this
service. This price is contingent upon analytical results of a composite soil
sample taken from the contaminated stockpile. For example, if the soil
contains high levels of lead (from leaded gasoline) the disposal costs would
be higher. For estimating purposes, C.T.Male has assumed that the $52/ton
quote will apply and considering approximately 160 tons of contaminated soils
were removed, removal and disposal costs should not exceed $10,000.
SUPERVISOR ROBINSON - GRAVEL BANK PERMIT APPLICATION
- Supervisor Robinson
spoke with all Board Members with the exception of Councilman Sovocool about
the Application Permit that we had to sign with Jon Harrington. Leland said
that we had to apply for a new permit and Mr. Harrington had to remap it.
What he tells us is that he has to remap it around that area up there and it
has to be marked so that no one digs in it again. He is working on
..........................(Mr. Cornelius does not speak into mic and recorder
will not pick up.) This area is where the contractor dumped fill from the
school. We never did hear from DEC. They let our permit run out so we would
have to reapply for it. Leland said we did apply for it but because we had
that shut down up there they had that big investigation and they shut us off
two years ago and told us not to dump any more and stay out of that area. It
didn't affect our mining but January 1st our permit ran out so we had to
reapply for a permit. Now we just have to wait.
Councilman Palmer asked Leland if he knew how much we have spent all together
on the gas tank project? Leland said about $30,000 on the new tanks.
Councilman Palmer meant the total cost to date on the gas tank removal.
Leland said that so far we have only paid the $2900 for the Environmental part
and we have not yet received a bill from C.T.Male but in the beginning that
figure was $5000. Atty. Casullo said that it looks like another $10,000 to
remove contaminated soil. We might be getting into an area where we might
have to bid some of this out. What happens is that we get this figure for
this expense, then this expense and then this expense. Councilman Palmer said
he is trying to get a handle on this to try and get a figure on how much we've
spent on this project since we have the potential for another $10,000
depending on the results of that test. Clerk Pierson said we've paid out

$3,023.25 to Environmental Products & Service for disposal of gas tanks and
waste and $2995.86 to C.T.Male for environmental oversight activities during
the closure by removal of underground storage tanks. Harrington Associates is
the one that is getting a permit for us to mine gravel and has nothing to do
with the gas tank removal. DEC is involved with both projects however. Atty.
Casullo said that the approval of contract with Harrington Associates should
be ratified by the Board since only telephone approval was given to Supervisor
to sign agreement in order to meet deadline of 105 days. Leland will get
total gas tank removal project expenses for Councilman Palmer by the next
meeting.
LELAND CORNELIUS - HWY SUPERINTENDENT
- We had to replace some decking on the
bridge on Old Stage Road that we built in 1977. It developed a hole and had
to be fixed. We had $1000 in our bridge fund. We went over budget a little
bit.
RESOLUTION NO. 35 - APPROVE CONTRACT FOR GRAVEL MINE PERMIT
RENEWAL WITH HARRINGTON ASSOCIATES
Moved by Councilman Carey, seconded by Councilman VanBenschoten

RESOLVED
, that the Town Board does hereby authorize Supervisor to sign
contract with Jon Harrington of Harrington Associates to prepare
application for NYS-DEC Mining Permit Renewal for Pit #2 at a cost not
to exceed $3500.
Leland Cornelius felt that the school should be responsible for the debris
that was put in our mine by the contractor. Supervisor Robinson mentioned it
but they said the contractor is the one that hired this company and the
company is the one that did it so all they said was when you ask them for the
money, let us know how you make out. That's the answer I got. Leland said
that Harrington does all the gravel banks around here. This is a five year
permit. Supervisor Robinson said that after we have this settled with DEC we
should still try and get some money out of the companies that dumped it.
Atty. Casullo suggested that we get our permit squared away and then we can
think about possibly recovering monetary losses.
Since Bernie Thoma was not present, Attorney Casullo explained letter from
Thoma Development Consultants regarding proposal for loan workout and loan
monitoring involving Diversified Technology. Karl Heck of the Tompkins County
Department of Planning is unable to provide the type of assistance the Town
requires. One thing the Town Board needs to do is to create a Board to set up
a revolving fund to let people know that there is money available and that
they can apply and we can go from there. We need to get this in place by the
end of the summer. Consensus of Board was to get a Board of five people to
review applicants and work with Thoma in loaning funds and monitoring
payments. Attorney Casullo will ask Bernie Thoma to attend next months Board
Meeting.
Councilman Palmer said that George Totman called and apologized for not being
able to make meeting this evening due to a public hearing in Lansing.
There being no further business, Councilman Sovocool moved to adjourn meeting,
seconded by Councilman VanBenschoten, at 8:55 P.M. Unanimous.
