Sovocool, Councilman Daniel J. Carey, Councilman Donald N. Palmer, Councilman Fran Casullo, Attorney Also present: Liz Brennan, Leland Cornelius, Oley Houghtaling, George Senter All officials present took the oath of office. Correction to Resolution No. 43 dated November 4, 1996. Moved by Councilman Palmer, seconded by Councilman VanBenschoten, that the names of Michael Totman and Steve Foote be deleted from the appointments to the Tompkins County Fire, Disaster and Emergency Medical Service Board. Ayes - VanBenschoten, Sovocool, Palmer, Carey, Robinson. Moved by Councilman Palmer, seconded by Councilman Sovocool, that the minutes of December 9, 1996, be approved at mailed. Ayes - VanBenschoten, Sovocool, Palmer, Carey, Robinson. Claim Nos. 194 to 203 of the 1996 Highway Fund in the amount of $8,205.05; Claim No. 1 of the 1997 Highway Fund in the amount of $466.89; Claim Nos. 329 to 342 of the 1996 General Fund in the amount of $6,982.53; and Claim No. 1 of the 1997 General Fund in the amount of $226.00 were presented for audit. Ayes - VanBenschoten, Sovocool, Palmer, Carey, Robinson. LELAND CORNELIUS - HIGHWAY SUPERINTENDENT - Asked the Board for permission to purchase a used truck for Town's oil tanker. Our current truck is a 1957 Ford which parts are unavailable for. He would like to purchase a 1985 Ford 8000 diesel from Doug VanBenschoten for $4500 and our old truck. Doug will paint it the Town colors. We put the $4500 in the budget for an oil truck. That is all I have. Our fuel tanks are in. Wiring is being done. Our drain project is completed except replacing the concrete in the garage. RESOLUTION NO. 1 - AUTHORIZATION TO PURCHASE USED TRUCK FOR OIL TANKER Moved by Councilman VanBenschoten, seconded by Councilman Sovocool. Ayes - VanBenschoten, Sovocool, Palmer, Carey, Robinson. RESOLVED , that the Highway Superintendent is hereby authorized to purchase a used 1985 Ford 8000 diesel truck for $4500 and the Town's 1957 Ford as trade-in. LIZ BRENNAN - BOOKKEEPER - Handed out monthly reports. The bills are still trickling in. In fact we still have another payroll that has 1996 rates on 1 them. I can't close the books until we are finished with 1996. There are some transfers that I am going to need. From Unallocated Ins., $805.41 to Justice Court Clerk ($331.48), Buildings Personal Service ($151.55), and Medical Ins.($322.38). We talked about it, but I'm not sure if it's in resolution form, to modify the budget so that the money that we have in the capital project can be closed out completely and move that money into the general fund and that's for the fuel tanks. We don't have the bill yet for the fuel tanks but this way the money is here and we can move that money into next year to make sure we're paying for that. We have been getting bills in for the concrete slab and wiring but the bill for the tanks has not been received. I will need a resolution for the transfer and also to modify the budget showing the estimated revenues coming in from the capital project and the appropriation going to the garage. I did set it up in a separate garage account so that we could see just what we are spending. The capital project was an on going when we built the building and now there is no need for it so we can completely close that account and move the money into an operating fund. (After some discussion, consensus was that capital project money could be moved into operating fund without a hearing.) Liz explained that if we do not end up with the fund balance that we planned on at the close of the 1996 year, we would be operating in a deficit and must cut back on the appropriations for 1997 which would have to be done as soon as we know where we stand. RESOLUTION NO. 2 - MODIFY BUDGET - CLOSE CAPITAL PROJECT FUND Moved by Councilman Sovocool, seconded by Councilman VanBenschoten. Ayes - VanBenschoten, Sovocool, Palmer, Carey, Robinson. RESOLUTION NO. 5 - 1997 CONSORTIUM AGREEMENT Moved by Councilman Palmer, seconded by Councilman Sovocool Ayes - VanBenschoten, Sovocool, Palmer, Carey, Robinson RESOLVED , that the Town Board does hereby desire to enter into 1997 Agreement between Municipalities and the County of Tompkins know as the Tompkins County Consortium to implement and be in compliance with the Omnibus Transportation Employee Testing Act of 1991 mandating drug and alcohol testing for commercial motor vehicle drivers. appoint Moved by Councilman VanBenschoten, seconded by Councilman Carey, to Teresa Robinson and Leland Cornelius as contact people for Drug and Alcohol Testing Program. Councilman Palmer asked if we should go out to quote on that since there are other businesses that might be interested and secondly why would we extend it to a two year contract? Consensus of Board was to stay with Superior one year. My 6 concern is that we should be going by what our purchasing policy says. The fee is $100 per month or $1200 per year. RESOLUTION NO. 6 - SUPERIOR DISPOSAL SERVICE AGREEMENT Moved by Councilman VanBenschoten, seconded by Councilman Carey Ayes - VanBenschoten, Sovocool, Carey, Robinson Nay - Palmer RESOLVED , that the Town Board does hereby enter into Service Agreement with Superior Disposal Service for a period of 12 months, commencing January 1, 1997 and expiring December 31, 1997, with charges for basic services as outlined in Service Agreement at the rate of $100.00 per month, and FURTHER RESOLVED , that the Town will solicit bids for the year 1998. Discussed road name changes that are needed in order for the county to close out all needed information data for 911. Jack Miller, County Fire Coordinator has asked that the Town of Groton make two corrections, one being Peruville Road which runs from the Town of Lansing to McLean. Groton uses Peruville-South Lansing and Peruville-McLean. Lansing and Dryden use Peruville Road. All numbers are correct from Lansing to McLean. Groton needs to drop the words South Lansing and McLean, all is correct - Peruville Road. The second road is Old Peruville Road East and Old Peruville Road West. We need to drop the "East" and "West" and just use Old Peruville Road. There are six house numbers on the East side of Route 38 that will have to be reversed. Leland checked with Ward Hungerford of the County and he has no problem with it. Attorney Casullo advised that this could be achieved by a resolution of the Board. Within 10 days the Clerk has to notify the County Assessment Office, Planning Board, County Clerk, County Engineer, Board of Elections, all Fire Departments, Post Offices and residents that are affected. Attorney Casullo will prepare resolution for clerk to mail. RESOLUTION NO. 7 - APPROVE ROAD NAME CHANGES FOR 911 Moved by Councilman Sovocool, seconded by Councilman Palmer Ayes - VanBenschoten, Sovocool, Palmer, Carey, Robinson WHEREAS , The Town of Groton desires to assist the County of Tompkins in the implementation of a county wide 911 system by changing the names of certain roads within the Town; therefore be it RESOLVED , that the Town of Groton hereby changes the official name of the following roads as follows: OLD NAME NEW NAME 1. Old Peruville road East & West Old Peruville Road 2. McLean-Peruville Road Peruville Road 3. South Lansing-Peruville Road Peruville Road and be it further RESOLVED , that the Town Clerk of the Town of Groton is hereby authorized to inform all interested persons, departments and/or agencies of the above stated name changes; and be it further 7 RESOLVED , that the above stated name changes will take effect on March 1, 1997, or sooner if the 911 System is implemented on or before that date. Discussed upcoming audit of Financial Statements for the year ending December 31, 1996 including Town Justice Court. Supervisor Robinson said that so far Rick Beals who did our audit last year is going to do it, we understand, at the same price and he will do the Court for us, which Ciaschi, Dietershagen did for us last year, but he's going to do it for the same price that he did it for last year which was $3100. The Ciaschi, Dietershagen had done the Court for $500 last year but he will include the Court in the $3100 fee -- we are not exactly sure but it is possible. Last year the other was a lot higher than that. Consensus of Board was to get written quotes for performing annual audit and present at next Board Meeting. Supervisor Robinson said that we have another chance to get in a HUD Grant. This one is going to be more County wide too. It's helping small businesses grow and if we can get some small business to come into Groton, we'll be fine. I want you to know that this is something that is available to the public in this area. We want to know if you are interested in getting involved. Our HUD Grants for the housing have been very successful. We are on our third year now. Attorney Casullo said Teresa received a fax from Karl Heck but we can't read it. It looks like a family that received a HUD Grant went to the bank and the bank put together a subordination agreement that basically says that they are going to loan money provided that we become second mortgage holders in this $70,000 mortgage. It also appears that they have a $50,000 mortgage. Attorney Casullo wants the Board to hold off on this because the fax is not legible. These people had HUD work done on their house. Their loan is to rebuild their business that was destroyed by fire. HUD recipients have a lien against their property for a period of five years. Attorney Casullo advised the Board not to take any action until we have more information. Supervisor Robinson said that attendance records are kept for the Planning Board and the Appeals Board and that determines how much they get paid. We also passed a law saying that they had to attend most of the meetings unless they had a good reason for not attending and we also said that they should have some schooling. Of the Appeals Board I have Lyle Raymond, Mary Decker, John Pachai which have attended schools. Mary Adams was appointed later and I asked her about schooling and right now she can't attend since she is taking care of her brother. George Totman, Cecil Twigg, Monica Carey have all been to school and have all been in attendance. Verl Rankin, George VanSlyke, Sheldon Clark and Jeffrey Lewis have not been to all the meetings. George has been to most meetings. Sheldon has been to school once, George has not been to school at all. Jeffrey Lewis hasn't been to school. Verl I know in the past years has been to school but not lately. I don't know what you are going to do because you have the law that says they are out if they haven't been there or if they have a good reason for not being there. I wanted to get the consensus of what you want to do. Are you going to follow your law or if you are going to do something different. Do they attend meetings -- Jeffrey hasn't, he's attended a few but not --Jeff attended 3, Sheldon 6, George Totman 10, Monica 10, Cecil 10, Verl 8, George VanSlyke 9. Attorney Casullo suggested that each Town Board Member reflect upon the numbers, review Local Law and at the next Board Meeting go into executive session if you decide to take action or you don't have to take any action at all. This will be on the Agenda for the next Town Board Meeting. Supervisor Robinson said that we are going to have a meeting with the Planning Board and Appeals Board to discuss zoning changes before we bring it before the public. There are several things that we have to do yet and I think the best way to do it is if we're all together and we all go over these things and check them out before we put them out to the public again. The Attorney and Code Enforcement Officer are expected to be there also. Councilman Palmer asked why we didn't set a tentative date to target for so we could move it along. The Planning Board is meeting the third Thursday. They probably will have an agenda since they didn't meet in December. They meet on Thursday, January 16th at 8:00PM. It was suggested to give them a choice of two nights. 8 January 30th at 7:00PM or February 4th at 7:00PM. Clerk will have Carol contact Appeals Board Chairman and Planning Board Chairman. Supervisor Robinson and Attorney Casullo are meeting with Diversified Technologies at 3:00PM tomorrow to get progress report. Supervisor Robinson said the Recycling Drop Off Center in Peruville is one of the subjects that we are going to have. We have had petitions coming out of there. I had a quote that it would probably cost us $5000 a year. One of the reasons for the recycling down there, they have extended it until March, but I find that people in Freeville and I talked with Jim Shug and he told me that if I would give him the names of the Freeville and the Dryden people off that list...........we could split because their cost is only for the custodian. They aren't loosing any money down there, they are gaining a lot of money. A lot of the businesses don't want to take all their -- go all the way to Ithaca to get rid of it and they can't get rid of it in front of their places because they have too much and they will only pick up certain shares. One of the other things that I hadn't thought about but is one of the complaints is the people who live on Route 34 don't put their recycling out for the simple reason that every time they put their things out near the road the big trucks come by and throw it all over the place and if they put it back they don't pick it up. So they bring it down to the recycling. Councilman Carey said he talked to a trash hauler about that today and he said that a lot of the business that is generated down there is from Cayuga County, Summerhill and Locke, where they don't have curb side pickup. I don't know how much of that volume is from outside of Tompkins County but that kind of surprises me and I thought well maybe we don't need that service if we are going to subsidize another county. Supervisor Robinson said they are making money on that. Councilman Sovocool said Summerhill and Locke have trash pickup -- Rainbow Rubbish and they have recycle too. Anyway we have to start moving on this if we want it and I'd like to find out what that $5000 is going to include. The County wants us to take it over and make a contract with Superior. The people in Groton and Dryden would be taking it over. We can't wait until the last minute. I will be looking into it. Councilman Carey said maybe we should look into a user fee per car. Supervisor Robinson said our cost now is only for the people who are running it. We pay for it but they reimburse us. They sell all that cardboard and make money on it. They have roughly anywhere from 150 cars on any weekend. Supervisor Robinson received information from Jim Shug on the Draft of the Bridge Replacement Agreement. There idea is to have 20% for our part of the payment on bridges. I objected because we didn't have any input on whose going to build it or how it is going to be built. He said that they are having a company come out and they are going to set up an area so that they know which bridges that they want taken care of and they are going to do like four a year. Three of them they are definitely going to do. The fourth one if something falls through on one of them, they will do the fourth one. They are planning on making cement tops for them so that the water when it falls off will not go under the bridge and destroy the infrastructure which is the reason why all the bridges are rotting and corroding. They passed their agreement in Dryden. I told them that I'd like to talk about it a little longer. They did say that they would allow you to help with who was going to do it and the structure or whatever. Lila Pierce resigned from the Groton Youth Commission by letter dated December 5, 1996. Letters and notes from our Health Insurance on changes that are occurring. Information on the "The Right to Farm Law". Basically what it says is that the farmer was here first and if you want to move in you have to accept it. Consensus of the Town Board was that we should include this in our zoning and building permits. Roads - Minimum Maintenance Program - This is a result of a house being built on a seasonal road in the Town of Caroline and the Town having to improve road. Leland Cornelius didn't think any other Towns have gone with this program. 9 Flood Program - Groton Senior Citizens Complex, Village of Groton and Town of Groton - They had sent in their second application and it was turned down. What they are suggesting is that the Village and the Nursing Home combine their request because they both have legitimate requests but they don't have enough money to do the job. If they do it together they can request more money and a better possibility of being accepted. This was the suggestion of FEMA. They would like money but we don't have the money and the State and the Federal Government does have money for this cause. This is a reoccurring thing over there. They have had two near floods and one flood. They really have a problem. Some of this is outside and is our problem from water that comes off the hill.
