Robinson, Supervisor Sovocool, Councilman Palmer, Councilman Carey, Councilman asullo, Attorney VanBenschoten, Councilman Also present: Leland Cornelius, Liz Brennan, Margaret Palmer, Oley Houghtaling, Robert Walpole, Mark Robinson, DeForest Hall, Phyllis Doyle Timmerman, Lee Shurtleff, Ithaca Journal Reporter Moved by Councilman Palmer, seconded by Councilman Sovocool, that the minutes of October 7, 21 and 24 be approved as mailed. Ayes - Sovocool, Palmer, Carey, Robinson. Claim Nos. 160 to 174 of the Highway Fund in the amount of $13,240.73 and Claim Nos. 245 to 260 of the General Fund were presented for audit. Moved by Councilman Palmer, seconded by Councilman Carey, that the bills be approved for payment. Ayes - Sovocool, Palmer, Carey, Robinson. Claim Nos. 65 to 67 of the Special Grant Fund (HUD) in the amount of $46,147.60 were presented for audit. Moved by Councilman Carey, seconded by Councilman Sovocool, that the bills be approved for payment. Ayes - Sovocool, Palmer, Carey, Robinson. LIZ BRENNAN - BOOKKEEPER - Handed out Monthly Reports including Revenues and Expenditures. Needs a resolution to transfer funds from contingency to brush, personal services and snow removal. RESOLUTION NO. 40 - AUTHORIZE TRANSFER OF FUNDS Moved by Councilman Palmer, seconded by Councilman Sovocool Ayes - Sovocool, Palmer, Carey, Robinson RESOLVED, that the Town Board does hereby authorize the following transfer of funds: From: Contingency DA1990.4 $223.13 To: Brush, Personal Serv. DA5140.1 $ 58.91 Snow Removal, Contr. DA5142.4 $164.22 1 GEORGE SENTER - CODE report: Building Permits issued 1995 9 Houses 1996 6 Houses Life Safety Inspections ENFORCEMENT OFFICER - Town Clerk read the following year -to -date 22 Mobile Homes 66 other 13 Mobile Homes 66 other are current through October LELAND CORNELIUS - HIGHWAY SUPERINTENDENT - The grease trap was set today. It is a two piece tank fastened together. Looking for man hole covers. Guys are cutting out concrete today for roof drains. ARLAND HEFFRON & ALTON ALEXANDER - TOWN JUSTICES - Monthly reports were reviewed by Board. COLLEEN D. PIERSON - TOWN CLERK /TAX COLLECTOR - Monthly report was reviewed by Board. Needs a Board resolution to continue free subscription to the 1997 State Register. RESOLUTION NO. 41 - SUBSCRIBE TO THE 1997 STATE REGISTER Moved by Councilman Palmer, seconded by Councilman Sovocool Ayes - Sovocool, Palmer, Carey, Robinson. RESOLVED, that the Town Board does hereby wish to subscribe to the weekly NEW YORK STATE REGISTER at no cost. Supervisor Robinson read the following letter from Ward Hungerford of the Tompkins County Highway Department regarding No Parking Ordinance: The Dryden School District requested a no parking zone in front of McLean School along CR105, School Street. The no parking zone request is from the Stop Sign northerly for approximately 140 linear fee. We installed temporary signs to establish the pattern as soon as the pavement and shoulder improvements were completed. Consistent with Vehicle and Traffic Law (V &T) a resolution for said no parking zone must be passed by the local Town Board. Obviously we support such a resolution. Please let me know if further explanation is necessary or if you would like to discuss the matter in any way." Supervisor, Town Attorney and Board Members discussed whether this should be a resolution, ordinance or local law. If an ordinance is required, Attorney Casullo will prepare and hearing will be held at December Board Meeting. If just a resolution is sufficient, Town Clerk will send to Tompkins County Highway Department. 2 RESOLUTION NO. 42 - ESTABLISH NO PARKING ZONE - MCLEAN ELEMENTARY SCHOOL Moved by Councilman Carey, seconded by Councilman Sovocool Ayes - Sovocool, Palmer, Carey, Robinson RESOLVED, that the Town Board of the Town of Groton does hereby request that a no parking zone be established in front of the McLean Elementary School along CR105, School Street, which will begin at the stop sign at the intersection of County Road 105 and 107, and proceed in a northerly direction a distance of approximately 140 linear feet. RESOLUTION NO. 43 - APPOINTMENTS TO TOMPKINS COUNTY FIRE, DISASTER AND EMERGENCY MEDICAL SERVICE BOARD Moved by Councilman Palmer, seconded by Councilman Carey Ayes - Sovocool, Palmer, Carey, Robinson RESOLVED, that the Town Board of the Town of Groton does hereby appoint the following members of the Groton Fire Department and the Town of Groton to serve on the Tompkins County Fire, Disaster and Emergency Medical Service Board: Lee Shurtleff - Delegate - Term expires December 31, 1999 Willis Sheldon - Alternate - Term expires December 31, 1999 Michael Totman - Delegate - Term expires December 31, 1998 Steve Foote - Alternate - Term expires December 31, 1998 Supervisor Robinson said the traffic signals are now in operation at the intersection of Route 38 and Route 34B. 8:OOPM - Public Hearing on proposed 1997 Town Budget. Minutes of public hearing will be filed with "1996 Public Hearing Minutes ". 8:30PM - Public Hearing on proposed 1997 Fire Budget. Minutes of public hearing will be filed with "1996 Public Hearing Minutes ". Councilman Palmer asked that item eight on the agenda be taken care of at this time. Councilman Palmer made the motion to adopt and take action of the Planning Board's Recommendation to amend the Land Use and Development Code. 3 Attorney Casullo said that the Town Board had to follow procedures to amend a Local Law which are noted on page 63, Section 410.3 of the Land Use and Development Code. A hearing must be held before final action to amend, supplement, change or repeal provisions of this code. Section 410.4 - A notice of hearing must be published at least ten days prior to the hearing. Written notice must be given to agencies if the land affected by the amendment lies within 500 feet of several jurisdictions. What the Board needs to do is to talk about the proposed amendments. Once you've come to the conclusion that you don't want to make any changes, then you've got to set up a public hearing that allows the public to come in and be heard about the proposed amendments. That's the process. That's the process that needs to be followed. That is what it says in the new code. So that's what I'm telling you, you Don and the rest of the Board Members, you need to talk about it and if that's the decision you want to take on the Planning Board's amendments as is, and I'm not say that there is nothing wrong with them, then say that is what you want to do or if you want to discuss or have any questions about any one of the amendments then you should discuss it as a Board. Once you make the decision that this is what you want to do with Amendments one through 12, then you set up your notice requirement for your public hearing for the public to come in and hear the amendments, then you pass the amendments then you publish the amendment and then it becomes part of the Land Use and Development Code. That's the process. It's in your own Land Use Code. Councilman Sovocool said to set up the hearing for the next meeting and accept them as they are. I see nothing wrong with them the way they are. Councilman Palmer moved that we accept the proposal from the Planning Board as presented and set up the public hearing for next month of December Regular Town Board Meeting at 8:30PM. (See second to motion below). Supervisor Robinson asked the Board if they wanted to discuss proposals or have you all checked them over and know exactly what they say and what they mean. That's what I want to know. When you go in there and vote, this is going to be it. Is everybody satisfied? Councilman Carey said yes. Councilman Sovocool said he was satisfied. Okay, then we'll have a resolution. Councilman Sovocool seconded Councilman Palmers motion. Ayes - Sovocool, Palmer, Carey, Robinson. Supervisor Robinson reported that we had a visitor to the community and her name was Leanor Becker. She came from Hungary. She came and talked to Gordon Klumpp, Mayor Toolan and two people from the Cornell Cooperative and Chuck Rankin and myself. She wanted to know about small communities and she had talked about Groton, she was here for about a month and she was out in Wisconsin then she came to the New York area and then she was leaving here to go to Virginia. I told Denise that if she was the Mayor instead of him, we'd have full cooperation in the Town because she is a very attractive young lady 4 and very intellectual and bright. She is a Mayor and also a local development manager. She is in charge of the vineyards and wine making. They have no money and they don't get any money from the County. They do have railroads. She had to buy a bus for the younger children to go to school. It takes the older ones 40 minutes on the train to get to school. They have very nice red wines. It was very interesting. 8:30PM - Hearing on Proposed 1997 Fire Budget Minutes of the Public Hearing will be filed in the "1996 Minutes of Public Hearings ". Mr. Robert Walpole moved that the Town Board accept the 1997 Proposed Budget as presented. Seconded by Mr. Mark Robinson. RESOLUTION NO. 44 - ADOPT 1997 TOWN BUDGET Moved by Councilman Sovocool, seconded by Councilman Carey Ayes - Sovocool, Palmer, Carey, Robinson RESOLVED, that the Groton Town Board does hereby adopted the Proposed 1997 Town Budget as presented at the hearing. Councilman Carey asked why the Workman's Comp credit goes back to 1989. Supervisor Robinson said they did not change it in New York. We had gone with another company and they did not recognize that they owe us. Councilman Sovocool asked where the $840.00 credit goes if we have gone with another company. Supervisor Robinson said they have to give us that back. Dempsey's are handling that for us. There being no further business, Councilman Sovocool moved to adjourn meeting, seconded by Councilman Palmer, at 8:40PM. Unanimous. Colleen D. Pierson Town Clerk MINUTES OF SPECIAL TOWN BOARD MEETING THURSDAY, NOVEMBER 7, 1996 AT 7:30 P.M. Those present: Teresa M. Robinson, Supervisor Ellard L. Sovocool, Councilman k, Donald N. Palmer, Councilman Daniel J. Carey, Councilman Fran Casullo, Attorney Absent: Gordon C. VanBenschoten, Councilman Also present: Leland Cornelius, Bouley Associates, Cortland Pump & Equipment Purpose of meeting was to open bids for one 8,000 gallon above ground dike tank for diesel fuel and one 2,000 gallon above ground dike tank for gasoline. Bid #1 - Bouley Associates, Inc. 113 Osborne Street Auburn, NY 13021 Total Bid - $34,400.00 Bid #2 - Cortland Pump & Equipment Inc. P. O. Box 550 182 Port Watson Street Cortland, NY 13045 Total Bid - $26,275.00 Town Attorney, Town Board Members and Highway Superintendent reviewed bids to see if all were in order. The bids specified that work must be completed within 30 days from the written receipt from the Town of the acceptance of the bid. It was the Highway Superintendents understanding that it would take four to six weeks to get the tanks. Neither bidder mentioned this in his bid. Everything else was in order on the bids. RESOLUTION NO. 45 - CONDITIONALLY ACCEPT LOW BID FOR ABOVE GROUND FUEL Moved by Councilman Sovocool, seconded by Councilman Carey Ayes - Sovocool, Palmer, Carey, Robinson RESOLVED, that the bid of Cortland Pump and Equipment Inc. is conditionally accepted provided that both the bids of Cortland Pump and Bouley Associates indicate that it will take four to six weeks to have the tanks delivered.
