MONDAY, JUNE 13, 1994, AT 7:30 P.M.

Moved by Mr. VanBenschoten, seconded by Mr. Cummings, to approve minutes of
April 11th and May 9th as mailed. Ayes - VanBenschoten, Cummings, Haynes,
Robinson.
Claim Nos. 79 to 101 of the Highway Department in the amount of $16,008.06 and
Claim Nos. 117 to 145 of the General Fund in the amount of $11,198.36 were
presented for audit. Moved by Mr. Haynes, seconded by Mr. VanBenschoten, that
the bills be approved for payment. Ayes - VanBenschoten, Cummings, Haynes,
Robinson.
LIZ BRENNAN - BOOKKEEPER - Handed out copies of monthly report. Also left a
copy of total expenditures and revenues to date for board to look at. Handed
out copies of amendments to budget for board to look at. Revenues less than
budget estimates due to changes in accounting for youth programs (Joint
program with Village of Groton). Funds for Summer Jobs Program remain
unchanged with Rev. $750 and Exp. $1,500. Highway DA funds received for
damaged equipment in building which collapsed under weight of snow. Board and
Liz discussed joint Youth Programs with the Village which are listed as items
7 and 8 on the agenda and will be discussed and acted on later in the evening.
RESOLUTION NO.34 - AUTHORIZE AMENDMENTS TO 1994 BUDGET

Still visiting John Anderson on Brown Road. He has planted garden in back
yard. The Town of Dryden runs an ad in the Shopper about anyone seen dumping
trash in Dryden should call Paul Cowles the Solid Waste Management. This is
something we might want to consider doing with the Village on a bi- weekly
basis. The Village would be willing to share cost. Of the 50 or so letters

that we sent out on unlicensed vehicles there is 12 remaining which have 14
days to comply. Then they go before the ZBA. Attended meeting on ADA
requirements. We need to spend some time on a self - evaluation of the Town in
relation to accessibility. We have to have this done by January 26, 1995.
Some of the things listed in this self - evaluation are listening systems,
handicapped signs for the parking area, etc. Fran and I and possibly one of
the Board Members should sit down and review project.
8:00 P.M. - Bid opening for Equipment Storage Building. Clerk read legal
notice that was published May 25, 1994.

Supervisor Robinson thanked bidders and stated that Attorney and Highway
Superintendent would review bids for compliance before any action is taken.
LELAND CORNELIUS - HIGHWAY SUPERINTENDENT - Nothing to report this month.
COLLEEN PIERSON - TOWN CLERK - Monthly reports for Town Clerk were submitted
to Supervisor. Also, all delinquent taxes were turned over to Tompkins County
on June 9th. Would like permission from Board to obtain quotations to have

all the carpets in the Town Hall Cleaned.
Moved by Mrs. Robinson, seconded by Mr. VanBenschoten, to authorize Town Clerk
to obtain quotations to have all carpets in the Town Hall cleaned. Ayes -
VanBenschoten, Cummings, Haynes, Robinson.
KARL HECK - TOMPKINS COUNTY PLANNING DEPARTMENT - Present to address the Board
on preparing an application to the U.S. Department of Housing and Urban
Development (HUD) for a grant to implement a Small Cities Community
Development Block Grant for housing rehabilitation in the Town outside the
Village. This program is available to income qualified residents with serious
housing needs such as replacing roofs, wells, septic systems, electrical
systems, plumbing and heating systems. Applications must be submitted by July
26th. We can apply for funds up to $400,000. If the project is funded, up to
25 households in the Town will be able to benefit from this program. The
funds are provided on a five -year deferred loan basis, with people who live in
their homes for more than five years receiving 100% grant assistance through
the Program. There are no fees or charges to the applicants as part of the
Program, and all homeowners in the Town of Groton outside the Village are
welcome to apply. The Counties cost to put the application together is
between $6000 and $7000. The Town's fee would be $3000 and no more. The
County would handle everything. The Town Board would approve all bills.
RESOLUTION NO. 35 AUTHORIZATION FOR TOMPKINS COUNTY PLANNING
DEPT.TO PROCEED WITH HUD GRANT PROPOSAL

RESOLVED, that the Town Board does hereby authorize Tompkins County
Planning Department to prepare proposal for the Town to submit to U. S.
Department of Housing and Urban Development (HUD) for a Small Cities
Community Development Block Grant (CDBG) Program in the amount of
$400,000, and
FURTHER RESOLVED, to authorize the expenditure of $3000 which represents
50% of the total cost for the County to administer this program.
Board Meeting recessed at 8:50 P.M. for hearing on Local Law No. 2 for the
year 1994.
Clerk read legal notice of hearing on Proposed Local Law No. 2 for the year
1994 which was published on May 25, 1994. This Local Law establishes minimum
attendance and continuing education requirements for members of the Town of
Groton Zoning Appeals and Planning Board.
T. Robinson - Does anybody have any questions or comments? Since no one from
the public was present to speak for or against proposed law, hearing was
closed at 9:00 P.M.

RESOLUTION NO. 36 - ADOPT LOCAL LAW #2 FOR THE YEAR 1994

RESOLVED, that the Town Board does hereby adopt Local Law No. 2 for the
year 1994 establishing minimum attendance and continuing education
requirements for members of the Town of Groton Board of Zoning Appeals
and Planning Board.

A letter of resignation was received from Nial Smith resigning from the Town
of Groton Zoning Board of Appeals effective June 1, 1994. His schedule does
not permit him the time to do this job effectively at the present time.
Moved by Mr. VanBenschoten, seconded by Mr. Cummings, to accept the
resignation of Nial Smith from the Zoning Board of Appeals with regret. Ayes

RESOLUTION NO. 37 - ACCEPT 1994 CHILD DEVELOPMENT CENTER CONTRACT

RESOLVED, that the Town Board does hereby authorize the Supervisor to
sign the 1994 Child Development Center Contract and to make payment in
the amount of $4,500.00.
Discussed County Youth Bureau Agreement and also Joint Village and Town Youth
Activity Contracts. Orlando Houghtaling, who is the Chairman of the Youth
Commission, explained that so far program was working very well. The Village
and Town would have a joint activity account with the Village taking care of
the administration. The paper work is a lot less time consuming. Atty.
Casullo has reviewed contract and the only thing that he felt the Town might
want is a monthly report on how the money is being spent. Family and
Childrens Service will not be working with us after July 31. The County Youth
Bureau has offered to do the coordinating until January 1 with the
understanding that Cooperative Extension will be in place to take over what
the County is doing. We are working with both to coordinate what is done. We
have hired a youth worker who is on the Village payroll.

RESOLUTION NO. 38 - CONTRACT WITH COUNTY YOUTH BUREAU

RESOLVED, that the Town Board does hereby agree to contract with the
County Youth Bureau for provisions of youth activities in the community.
RESOLUTION NO. 39 - APPROVE JOINT VILLAGE AND TOWN YOUTH ACTIVITY
CONTRACT

RESOLVED, that the Town Board does hereby agree to consolidate with the
Village of Groton for provisions of Youth Activities in the Village and
Town of Groton.
RESOLUTION NO. 40 - APPROVAL OF SUMMER YOUTH WORKERS

RESOLVED, that the Town Board does hereby authorize that two summer
youth works be employed by the Town.
A copy of Tompkins County Department of Public Works Five Year Bridge Plan was
received. It indicates that Walpole Road bridge will be done in 1994. Our
Franchise Fee from American Community Cablevision for 1993 is $1,060.09.
Received an information subpoena with restraining notice pertaining to
Diversified T.E.S.T Technologies, Inc.
RESOLUTION NO. 41 - DELAY DECISION ON COUNTY TRASH TRANSFER

WHEREAS, the United States Supreme Court has recently rendered a
decision concerning the constitutionality of flow control laws for the

regulation of trash hauling; and
WHEREAS, the impact of the Court's decision may well seriously affect
the trash hauling system within Tompkins County; and
WHEREAS, the Tompkins County Board of Representatives is considering the
construction of a county trash transfer station in the City of Ithaca;
it is
RESOLVED, that the Town Board of the Town of Groton respectfully request
the Tompkins County Board of Representatives delay a decision on the
construction of the County trash transfer station until such time as the
County may assess the effect of the recent United States Supreme Court
decision on trash hauling within the County.
Supervisor Robinson requested that her Memo written to Town Board Members and
dated June 13, 1994, regarding Smoking Policy be entered into the minutes.
Its contents are as follows: "The majority of public buildings totally ban
smoking. I am requesting the Town Hall become a smoke free building. Due to
the inadequate ventilation, any smoking in the building, travels throughout
the building. I propose a smoke free environment for the health and welfare
of all employees."
Supervisor, Town Board Members and Town Clerk discussed the above policy. Any
smoking in the building is done in areas already designated as smoking areas
by the Town Board. These include Town Clerk's personal office, Highway
Superintendent's personal office and the Kitchenette. Consensus was that we
have to offer a designated area. If there is still a problem, ventilation
system should be checked.
Discussed bids that were received for storage building. Decided to allow more
time for Town Attorney and Highway Superintendent to look over bids.
Moved by Mr. Haynes to adjourn meeting at 10:00 P.M. until Monday, June 20 at
5:00 P.M. at which time bids will be acted on. Seconded by Mr. Cummings.

Purpose of meeting was to take action on bids for storage building submitted
on June 13, 1994.
Dennis Portzline and Board Members discussed gray areas in bidding.
Motion was made by Mr. Haynes, seconded by Mr. VanBenschoten, to go into
executive session at 5:30 P.M. to discuss legal procedures.
Ayes - VanBenschoten, Cummings, Haynes, Robinson.
Board Meeting reconvened at 6:00 P.M.
Motion made by Mr. Haynes, seconded by Mr. VanBenschoten, to reject all bids
and notify bidders. Ayes - VanBenschoten, Cummings, Haynes, Robinson.
Motion made by Mr. Haynes, seconded by Mr. Cummings, to hire an independent
engineer to assist in re- drafting bid specifications.

Motion made by Mrs. Robinson, seconded by Mr. Haynes, to schedule hearing on
HUD project for July 11, 1994, at 8:00 P.M. Ayes - VanBenschoten, Cummings,

There being no further business, Mr. Cummings moved to adjourn meeting,
