Sovocool, Councilman Gordon C. VanBenschoten, Councilman Donald E. Cummings, Councilman Carl E. Haynes, Councilman Jack Fitzgerald, Attorney Also present: Leland Cornelius, Liz Brennan, Bob Bernhardt, Betty Sperger, Lyle Raymond, George Senter, George Totman Moved by Mr. Cummings, seconded by Mr. VanBenschoten, that the minutes of September 13th, 23rd, and 29th be approved as mailed. Ayes - Sovocool, VanBenschoten, Cummings, Haynes, Robinson. Claim Nos. 178 to 187 of the Highway Fund in the amount of $2,850.74 and Claim Nos. 232 to 251 of the General Fund in the amount of $7,632.26 were presented for audit. Moved by Mr. Haynes. seconded by Mr. Sovocool, that the bills be approved for payment. Ayes - Sovocool, VanBenschoten, Cummings, Haynes, Robinson. LIZ BRENNAN - BOOKKEEPER - This is a listing of expenditures and revenues and I've also incorporated those in the preliminary budget so you'll be up to date as of September 30. It will give you a better idea of what monies we have spent. I also gave Teresa an estimate of the appropriated fund balances for use when working with the budget. LELAND CORNELIUS - HIGHWAY SUPERINTENDENT - I have a repeat performance. We didn't have time to advertise for pickup truck bids. I'd like to accept bids at our next regular meeting. Cinder box is not in yet. At the Association of Towns meeting we learned that when exchanging work with other municipalities, we should have an agreement with them basically for insurance purposes. Dryden has been helping us haul gravel on Brown Road. RESOLUTION NO. 49 - ACCEPT BIDS FOR PICKUP TRUCK IN NOVEMBER Moved by Mr. Haynes, seconded by Mr. VanBenschoten Ayes - Sovocool, VanBenschoten, Cummings, Haynes, Robinson RESOLVED that the Town Board does hereby authorize the Highway Superintendent to advertize for bids for a one -half ton pickup truck with bids being received at next scheduled board meeting in November. (Bids will be opened at 7:45 P.M. on November 1st.) 1 GEORGE SENTER - CODE ENFORCEMENT OFFICER - Year -to -date building permits issued: 1992 78 13 houses 11 Mobile Homes 54 others 1993 77 13 houses 11 Mobile Homes 53 others We went out to John Anderson's today. He was not home. Bertha said he had a heart attack. Fran Casullo asked if he was in the hospital and Bertha said no he was going tomorrow. Fran is going to set up a meeting with Les Cohen, Solid Waste and myself and we are going to resolve this whole thing. They are not adding to it, but it just stays there. Took a picture of foundation of the house and the concrete blocks are ready to tip over. It's scary. I also cited Cheryl Searles on Old Stage Road for not having a building permit, an undersize mobile home and they are living in it. They will go before the Appeals Board. Mr. Locke on Chipmans Corners Road is moving to Richford. I'm going to revoke Sherry O'Brien's MVR permit. He has been given every opportunity to comply with the regulations and he's not doing it. He is allowed around 14 vehicles as long as he places them in an orderly fashion as he agreed to with the Planning Board. He has many more than that and they are all over. I'd like to say that we're having a public hearing on the 14th 7:30 P.M. on the Comprehensive Plan that we've been working on We have to hold this hearing before submitting it to the Town BETTY SPERGER - How are we progressing with the electric? T. Robinson - As of now Dennis hasn't started. He has another big job that he is finishing up. B. Sperger - Do you have any idea when he might start? T. Robinson - I left a message, but I didn't hear. L. Cornelius - I saw him this morning and he said about another week. B. Sperger - Wasn't he supposed to start it in one week? T. Robinson - Yes, but he notified us at the time that he had another job to finish up. BOB BERNHARDT - Are we doing anything about our sound system? T. Robinson - Yes, I talked with the company and he was going to get back to me and if he did, I wasn't here that day. I talked with him the last of the week and I went home early and I don't know it he got back to me or not. He wasn't in the office when I called him. Supervisor Robinson said she had talked with Diversified Technologies about the loan agreement. We talked about this before and I talked with the bank and they think it would be nice to have it some place that we agreed that they would pay weekly and put it in our minutes so that we can put it in with our 2 agreement papers. We also talked about dropping the $50,000 from the modified loan agreement. This is okay with the bank and Diversified. RESOLUTION NO. 50 - AMEND PREVIOUS RESOLUTION NO. 24 REGARDING MODIFICATION OF LOAN AGREEMENT WITH DIVERSIFIED T.E.S.T. TECHNOLOGIES, INC. Moved by Mr. Haynes, seconded by Mr. Sovocool Ayes - Sovocool, VanBenschoten, Cummings, Haynes, Robinson RESOLVED, that the Town Board of the Town of Groton does hereby amend previous Resolution No. 24 regarding the modification of Loan and Security Agreement with Diversified T.E.S.T. Technologies, Inc. by deleting paragraph number five dealing with the penalty in the event Diversified Technologies, Inc. leaves the Town of Groton; and FURTHER RESOLVED, that Supervisor Robinson be authorized to write a letter to the bank allowing them to receive the monthly payment in weekly installments paid in advance. Supervisor Robinson handed out proposed budget for 1994. Board Members discussed when they would meet to go over budget. Budget hearing can be held no later than the first Thursday following Election or November 4th. Board must hold work session early enough to allow Town Clerk to get legal notice of Preliminary Budget Hearing in paper. Moved by Mr. Haynes, seconded by Mr. Cummings, to schedule Budget Work Session for Thursday, October 14, 1993, at 4:30 P.M. Ayes - Sovocool, VanBenschoten, Cummings, Haynes, Robinson. Moved by Mr. Sovocool, seconded by Mr. Cummings, to reschedule the November Town Board Meeting to Monday, November 1, 1993, at 7:30 P.M. Ayes - Sovocool, VanBenschoten, Cummings, Haynes, Robinson. Moved by Mr. Sovocool, seconded by Mr. Cummings, to schedule budget hearing for Monday, November 1st at 8:00 P.M. followed by fire budget hearing at 8:30 P.M. Ayes - Sovocool, VanBenschoten, Cummings, Haynes, Robinson. Supervisor Robinson has not received the proposed 1994 Dog Contract from the SPCA. The Groton Fire Department Annual Clambake will be held on October 10th at 1:00 P.M. Received a check from the County in leu of taxes for the Garden Apartments on Main Street which amounted to $565.32. Five Town people attended the "Local Government Forum" seminar in Newark Valley on October 2nd. Congratulations to George Totman -- it was quite successful with 82 people attending. Board Members each received a letter from Lyle Raymond regarding travel trailers. This will be discussed at a later meeting. 3 There being no further business, Mr. Sovocool moved to adjourn meeting, seconded by Mr. VanBenschoten, at 8:35 P.M. Unanimous. Colleen D. Pierson Town Clerk MINUTES OF SPECIAL TOWN BOARD MEETING THURSDAY, OCTOBER 14, 1993, AT 4:30 P.M. Those present: Teresa M. Robinson, Supervisor Gordon C. VanBenschoten, Councilman Ellard L. Sovoc000l, Councilman Carl E. Haynes, Councilman Absent: Donald E. Cummings, Councilman Also present: Leland Cornelius, Liz Brennan Purpose of meeting was to work on tentative budget. Supervisor Robinson handed out new copies of proposed budget and pointed out where she had made changes. She indicated that the rate is down 29 cents compared to 1993. Board and Bookkeeper discussed appropriated fund balances and unappropriated fund balances in General and Highway accounts. Supervisor Robinson stated that the Town received $5600.00 from the Federal Government for the 1993 blizzard. We applied for $8000.00 but didn't expect to get anything. Supervisor Robinson needed another resolution reguesting the Department of Transportation to install a light at the intersection of Rt. 38 and Route 34B in Peruville. (See Resolution No. 39) 4 RESOLUTION NO. 51 - REQUEST TRAFFIC SIGNAL AT INTERSECTION OF ROUTE 38 AND ROUTE 34B Moved by Mr. Haynes, seconded by Mr. VanBenschoten Ayes - Sovocool, VanBenschoten, Haynes, Robinson RESOLVED, that the Town Board of the Town of Groton does hereby request the New York State Department of Transportation to install a light at the intersection of Route 38, Route 34B and County Road #107 (Peruville Road). The Town requests a caution light on Route 38 and a flashing red light on Route 34B and County Road #107 (Peruville Road). RESOLUTION NO. 52 - ACCEPT TENTATIVE BUDGET AS PRELIMINARY BUDGET Moved by Mr. Haynes, seconded by Mr. Sovocool Ayes - Sovocool, VanBenschoten, Haynes, Robinson RESOLVED, that the Town Board does hereby accept the tentative budget as the Preliminary Budget to be presented at a Public Hearing to be held on November 1, 1993.
