HomeMy WebLinkAbout07-1993 & Special 07-22-1993MINUTES OF TOWN BOARD MEETING MONDAY, JULY 12, 1993 AT 7:30 P.M. Those present: Teresa M. Robinson, Supervisor Gordon C. VanBenschoten, Councilman Donald E. Cummings, Councilman Carl E. Haynes, Councilman Jack Fitzgerald, Town Attorney Absent: Ellard L. Sovocool, Councilman Also present: Leland Cornelius, Liz Brennan, George Senter, Betty Sperger, Helen Douglas, Harold Bernhardt, Dennis Toolan Moved by Mr. VanBenschoten, seconded by Mr. Cummings, that the minutes of June 14th and June 23rd be approved as mailed. Ayes - VanBenschoten, Cummings, Robinson. Absent - Haynes and Sovocool. Claim Nos. 129 to 147 of the Highway Fund in the amount of $100,582.66; Claim Nos. 160 to 179 of the General Fund in the amount of $12,212.60 and Claim Nos. 108 to 109 of the Capital Reserve Fund in the amount of $183.42 were presented for audit. Moved by Mr. Haynes, seconded by Mr. VanBenschoten, that the bills be approved for payment. Ayes - VanBenschoten, Cummings, Haynes, Robinson. LIZ BRENNAN - BOOKKEEPER - Handed out Report of Expenditures and Revenues and also Report of Accounts. The roof is done and we'll be liquidating the $1000 encumbrance we had from last year. The additional $100 will come out of this years account. LELAND CORNELIUS - HIGHWAY SUPERINTENDENT - Paving is completed. The next thing is to get them sealed. The shoulders on Sears Road will be completed pretty quick. I like to let the pavement cure before doing the shoulders. Councilman Cummings asked if we have enough CHIPS money to pay for all of this? CHIPS money will be used up plus other budgeted monies. I received a letter today saying that we will be receiving our CHIPS money. Correspondence consisted of 1) Letter from DOT denying our request to lower the speed limit on Elm Street Extension just outside the Village speed limit; 2) Letter from Helen Douglas regarding Joseph Wilbur residence on Lick Street which is a fifth - wheeler which has been lived in for several years; 3) Notice of lawsuit against the State Board of Equalization and Assessment by New York State Electric and Gas Corporation. 4) Groton Business Association Annual Golf and Clambake Day is being held on July 21st. Discussed Joe Wilbur problem. In 1987 he asked for a variance and was denied. We do have others in the Town that are living in recreational vehicles seasonally. Mrs. Douglas felt that since she had to comply with the mobile home ordinance, so should everyone else in the Town. George Senter was asked to look into situation. 1 GEORGE SENTER - CODE ENFORCEMENT OFFICER - Year -to -date building permits issued: 1992 - 39 6 houses 4 mobile homes 29 others 1993 - 43 9 houses 7 mobile homes 27 others Unlicensed vehicles - We're down to four of the original 50 letters sent out. Working with three which have requested additional time. Attended a seminar last month on general plumbing and will be attending another one this month on water supplies. Will look into problem with Sherwood on Spring St. Extension. The trailer on Smith Road owned by Lacey Griep - I have told Lacey that if they can get documentation from a licensed architect or engineer in the State of New York that it meets the NYS Building Code and Energy Code, then I would okay a building permit. The required size is 840 square feet and they can put an addition on it if they have to. What we need to do is see if we can't get some kind of documentation in our Land Use Regulations saying that the only mobile home allowed in the Town of Groton would be one the is approved by HUD. That means that it must be at least a 1976 or newer model. That would solve a lot of our problems. We've got one out on Old Stage Road that the Town of Summerhill wouldn't allow in. Updated Board Members on status of Motor Vehicle Repair Shops in the Town. Monthly reports from the Town Clerk and Town Justices were reviewed. DENNIS TOOLAN - You wanted to discuss the electrical specifications. Your original specifications were very vague and could have resulted in different quotations. Do you want it brought up to the code in 1961 or the present 1993 code? I will have to get together with Floyd Ferris. I need the original set of plans so that I can number each one and what we want at that location. If you use some sealoffs you would only be putting a BandAid on it. It seems that going overhead would be the best. We also need to establish what kind of lights you want in the garage. Suggested two or three different types. Suggested Leland look at lights at Genoa Agway Building. Will meet with Leland and Floyd Ferris while preparing specifications. Will have specs ready for Board to review in ten days. Supervisor Robinson had a visit from a gentlemen on Locke Road that is interested in extending TV cable down that way. He has been investigating it. Our current franchise states that you must have a certain number of houses within a mile in order to extend cable to that location. Clerk indicated that we already had a price quotation for the people in that area which was turned down due to the high cost per residence -- approximately $2000. Moved by Mr. Haynes, seconded by Mr. Cummings, that we go into executive session to discuss personnel at 8:42PM. Unanimous Board meeting reconvened at 9:15PM. Supervisor Robinson stated that each one of you will go and check on Supervisor's salaries for the next meeting. A special meeting will be held on July 22, 1993 at S:OOPM for the purpose of reviewing electrical specifications and discussing Supervisor's salaries with no action to be taken until the August Board Meeting. 2 There being no further business, Mr. VanBenschoten moved to adjourn meeting, seconded by Mr. Cummings, at 9:25 P.M. Unanimous Colleen D. Pierson Town Clerk MINUTES OF SPECIAL TOWN BOARD MEETING THURSDAY, JULY 22, 1993 AT 5:00 P.M. Those present: Teresa M. Robinson, Supervisor Gordon C. VanBenschoten, Councilman Carl E. Haynes, Councilman Absent: Ellard L. Sovocool, Councilman Absent: Donald E. Cummings, Councilman Also present: Leland Cornelius, Dennis Toolan Purpose of meeting was to review electrical specifications for the Highway Garage with Dennis Toolan. Mr. Toolan read the specifications that he had drawn up for the Highway Garage rewiring and new lighting system that is to be installed to meet the NYS Building and Fire Code. Leland said he wanted white lights in the garage as opposed to orange. These lights would be a GE light or equivalent light that is readily available. The Simplex Fire Control box will not be changed at this time. Mr. Toolan will have specs typed up and to the Town Clerk by Monday at which time a new legal notice will be published advertizing for bids for this project to be received sometime after our regular meeting in August. This is to provide ample time to contractors to look over project and prepare 3 their bids. Mr. Toolan asked what was the difference between a materials bond and a performance bond. Supervisor will ask Attorney what the difference is and also if we can stipulate brand names in the specifications. Mr. Toolan will contact Floyd Ferris to go over specs. Moved by Mr. Haynes, seconded by Mr. VanBenschoten, to schedule a Special Town Board Meeting for electrical bid opening to be held on Monday, August 30, 1993, at 5:00 P.M. Ayes - Haynes, VanBenschoten, Robinson. Discussed petition that is supposedly being circulated regarding electrical problem in Highway Garage, sound system in Board Room, etc. Also discussed what is going on with the SCM lot, Village sidewalk problem, Rod & Gun Club problem and the new Solid Waste and recycling facilities in Tompkins County. Discussed changing Supervisor's salary for 1994. Councilman Haynes reported the following salaries for Supervisors in surrounding Towns: Caroline - $5,000; Danby - $9,000; Dryden - $8,500; Lansing - $14,000; Ulysses - $5,600; Homer - $7,700. The middle range is around $8,500. We need to set a rate so people running for office know what their salary is going to be. Supervisor Robinson said Leland's paving is completed but roads need to be sealed. The following roads should be sealed this year - Sovocool Hill Road below Cobb St. - .7 mile; Sovocool Hill Road - .9 mile; Lick St. 222 End - .4 mile; Elm St. Ext. Hill - .3 mile; Wood Road - .7 mile. He also would like to do Devlen Road - .6 mile; Lick St - 1 mile; and Old Stage Road - .9 mile. Total cost would be around $23,000. Leland said we are going to run out of money budgeted. Supervisor Robinson said we're going to be very tight, but she had talked with Liz and they thought we would probably be able to about make it. Leland said what he really wanted was will we be able to go all the way or do we do just the ones that really ought to be sealed. He didn't want to go way over the budget without the Board knowing about it. He said Liz thinks we can handle it. Supervisor Robinson said we would try to do it with what we have. Consensus of Board was that they have no problem with it as long as it is within the budget. Supervisor Robinson reported on meeting of Illegal Dumping and Open Burning of Solid Waste Advisory Group. Possible ways to proceed with illegally dumped loads and bags (as distinguished from highway litter) are: 1. The location of illegally dumped material will be reported to the Solid Waste Division Investigator who will investigate to see if the perpetrator can be identified. (The person reporting can be anyone.) An official of the municipality will be notified by the Solid Waste Division. 2) If the perpetrator can be identified and located, he /she is required to pick up material and dispose of it properly. (How much time are we willing to allow for this process ?) 3) If the perpetrator cannot be located or does not within a reasonable period of time remove the trash, the municipal forces will pick up and deliver the material to the County transfer station. 4) The County will waive the disposal fee. 4 There being no further business, Mr. Haynes moved to adjourn meeting, seconded by Mr. VanBenschoten, at 6:10 P.M.
