HomeMy WebLinkAboutJanuary 14, 2026 - Town Board Meeting Minutes1 Town of Enfield Regular & Organizational Meeting Wednesday, January 14, 2026 6 PM In-Person at the Enfield Town Courthouse and Via the Zoom Meeting Platform Present: Town Supervisor Stephanie Redmond; Town Councilperson Jude Lemke, Robert Lynch, Melissa Millspaugh, and Cassandra Hinkle; Town Clerk Mary Cornell; Highway Superintendent Barry “Buddy” Rollins. Call to Order: Supervisor Redmond called the meeting to order at 6 PM Executive Session: Councilperson Lemke motioned to go into executive session to discuss a matter of personnel and Councilperson Millspaugh seconded. All Aye. Carried. The Board entered Executive Session at 6:02 PM. The Board returned from Executive Session at 615 PM The Board resumed public session at 6:30 PM Privilege of the Floor: Rosie Carpenter led the assemblage in the Pledge of Allegiance. Additions and Changes to the Agenda: NYSEG Flair Project as a discussion only topic. Correspondence: Councilperson Lemke read a letter from former County Legislator Dan Klein that was emailed to the Town Board. She mentioned that it was a Town Board decision to read this letter into record. Monthly Reports County Legislature –Randy Brown. The full report is on file with the Town Clerks office. There are eight new legislators. They are looking at options for a new County Building space. Randy is concerned with the reduction in County revenue by possibly millions of dollars. The homeless shelter is doing well with an average 45 individuals a night. The new assessment software BEACON is very convenient. Councilperson Lynch shared that effective immediately he will no longer be reporting on the Tompkins County Legislature, as it is time to back away and let other people do it. This seems to be a night for constructive criticism. When he watched the legislatures meeting from last week, he was disturbed and embarrassed on how the meeting was run. It seemed the chair had lost control. What that meeting turned into was basically a union rally with a legislative meeting stuck into it. He thought it looked like a taping of “The View.”. It is hard to control a crowd from clapping, but legislators were clapping as well. Councilperson Lynch would like Randy to take this feedback to his colleagues. Town Supervisors Report – Stephanie Redmond. Deck the Halls that went well. We are going to do it earlier next year. She met with other town supervisors and has been focused on grants. Highway Superintendent Report – Barry “Buddy” Rollins. They received the new plow truck a couple of weeks ago. They ran it for the first time this week. They replaced all of the 4’ lights in all of the buildings and needed to replace a light fixture in the courthouse. They still have to do the bays in the Highway Department and they 2 are looking at renting the lift one week is $300 and a month is $450. He will be renting it for the month and doing regular work at the same time. They are still waiting on the other new truck which is having the final equipment added, he is hopeful to have it by the spring. They had the tank pumped again and have not been cleaning the shop or rinsing the trucks like they are supposed to. The last pumping cost $4,000. Code Enforcement Report – Alan Teeter. He issued 75 permits last year. 8 were for new or replacement homes. He will be submitting his report to the state in the next couple of months. He had his annual meeting with County Code, Assessment, and other programs. He heard that they will be doing away with the Beacon program in the next year or so when they get their final program. He will take an April training on new codes. Supervisor Redmond asked if other Code Enforcement Officers were doing annual inspectio ns of short term rentals. There is a new state law that short term rentals will need to be filed with the state. Some towns are talking of charging a fee to do these inspections. Alan agrees that this may be a consideration. Planning Board Report – Dan Walker. We met last week. We have no actions going on in the town. He will be setting up trainings during meeting times for board members to meet their 4 hours of annual training. Which will be the plan unless a big action comes up. Supervisor Redmond asked if the Planning Board was done reviewing the Comprehensive Plan. Dan is still working on it at this time. He saw Stephanie’s email about the billboards. Dan stated that you cannot ban billboards without a town law. We have one billboard on route 79, which is on the side of a building. She asked if this is something that the Town Board should review at a meeting. Councilperson Lynch asked if it should start with the Planning Board. Dan will bring it back to the Planning Board. Tompkins County Council of Govts – Robert Lynch. The full report is on file with the Town Clerks Office. January 22 is their next meeting. Consent Agenda: Audit Claims: Abstract #13 – General Fund vouchers #277-298 dated January 14, 2026 in the amount of $17,839.27 Highway Fund vouchers #210-220 dated January 14, 2026 in the amount of $10,846.85 Abstract #1 – General Fund vouchers #1-7 dated January 14, 2026 in the amount of $70,325.70 Highway Fund vouchers #1-6 dated January 14, 2026 in the amount of $16,075.27 Supervisor Redmond moved, and Councilperson Lynch seconded. Vote: Aye, Hinkle, Lemke, Lynch, Millspaugh, and Redmond Nay, 0 Carried. Approval of December 10, 2025 Minutes Supervisor Redmond moved, and Councilperson Millspaugh seconded. Vote: Aye, Hinkle, Lemke, Lynch, Millspaugh, and Redmond Nay, 0 Carried. 3 Business: 284 Agreement – Supervisor Redmond moved and councilperson Millspaugh seconded. Discussion: Councilperson Lynch read the proposed road projects. He then had the following comments. Will the improvements of Harvey hill/Buck hill correct the issue at that intersection. Buddy, we will be cutting out the pavement and grass will grow there. Lynch, so it will be cleaned up? yes, it will be. Lynch asked why it was cut back. The farmers took the sign down and the property owner complained that it wasn’t in the right-of-way, so they put the sign back up in the right-of-way. Lynch then asked if the two roads being worked on will have any tree cutting done. Buddy responded that some may be done, but nothing major as most of it has already been done. Lynch, Is Hector responsible for any of the work to be done? Buddy responded that it is a Town Road, so we are responsible for it and we get Chips funding for it. There are other roads with this same issue. Supervisor Redmond moved, and Councilperson Millspaugh seconded to approve the 284-agreement. Vote: Aye, Hinkle, Lemke, Lynch, Millspaugh, and Redmond Nay, 0 Carried. Resolution #____-2026 Authorize Supervisor to Execute Contract with ___________________ for Delivery of Precast Concrete Box Culvert with Stamped Drawings. Discussion: Supervisor Redmond, since we were awarded the grant from the DEC, they have imposed that all culverts need to be 10% larger than originally planned. Angel Hinickle gave an overview of where we are with the project. She wrote the grant with Stephanie and Buddy. In total we have $698,000 of grant funds. They decided to bid this as a concrete box culvert. The other option would have been an arched metal structure. She gave a breakdown of the 3 quotes that we had received : Lakeland Concrete Products at $684,514.00. Jefferson Concrete Corp. at $471,600.00. Binghamton Precast & Supply Corp. at $705,800.00. The best option would be to go with Jefferson. Brian did some estimates. The concrete box will be about $200,000 more than going with the aluminum multi plate box. The County may be able to supply some funds for the stream work. Dan Walker a concrete box is pretty much fabricated. You still have the installation contractor. The plate installation may be more for the contractor to install it. Buddy, why do we care if the County takes i t over. It’s a flip of a coin. They are both projected to last 75 years. The County does not like the aluminum structures as they have several of them as they are failing. The structural plate would require fill, where the concrete box would not. Councilperson Lynch, the best cost value to the Town would be to consider the aluminum plate. We would have to go through the whole RFP again. Angel confirmed that we have until the end of 2027 to complete the project, but we could ask for an extension. Supervisor Redmond moved that Angel check into the lowest bid and research it more. Angel asked for clarification on what she should check into? Supervisor Redmond commented that we have 30 days to decide if we want to take the bid from Jefferson. We do have funds in the bridge reserve. Councilperson Lynch asked Buddy what he would have recommended. Buddy responded that he had originally looked at the Aluminum Arch. If you are just spending $300,000 more to see if the County would take it over it may not be worth it. He does not believe that the Aluminum will last the 75 years. Supervisor Redmond asked Angel if she would check to see if the DOT will accept the Aluminum plate and get back to her as we can add this to the Audit meeting agenda. 4 Discussion: RFP for Drain Cleanout/Pumping Supervisor Redmond read the RFP and shared it on screen for those present and online. The board discussed the language and added a clause at the end that the contract can be voided if the Ithaca Wastewater Treatment plant will once again allow us to bring our waste there. The addition of a bid submission date of March 10th by 5 PM for submission of bids. The RFP will be su bmitted for publication after the January 20th Audit meeting, giving it time for review by Town Legal counsel. The Town Board will open t he bids at the March 11th Regular Town Board meeting, and Supervisor Redmond will read them into the record. Resolution #____- 2026 A Resolution toward engaging consultant service, H.F. wastewater disposal – Tabled. Councilperson Lynch moved and Councilperson Lemke seconded. Discussion: Councilperson Lynch would like to know why they take Newfield’s but they will not take Enfield’s. Buddy asked Councilperson Lynch to go back down and talk to them and ask them why as he didn’t ask them this question when speaking with them. Councilperson Lynch responded that If the board wants him to arrange for a conversation with someone at Ithaca Wastewater to see why they will not take ours he will. Buddy had asked them why they would not accept ours. He got a permit from them one time back in 2012 and since then we had had a local hauler that took it. Newfield has a contract with them that may be running out soon and they have multiple tanks and do not have to pump often. They do a lab test and a private person hauls it for them. Councilperson Lynch thought a consultant may have more information and clean-up of the sludge that would allow us to then dump with them. Supervisor Redmond with her limited knowledge of toxic water it is no t that simple. She would like him to spend more time talking to Ed and or Newfield to see how it goes with that route. Ithaca is struggling with their own plant which is why they may be limiting what can be taken there. Councilperson Lynch moved, and Councilperson Hinkle seconded to table this resolution until next month. Vote: Aye, Hinkle, Lemke, Lynch, Millspaugh, and Redmond Nay, 0 Carried. Resolution #1-2026 Authorization to Apply for 2026 Transportation Alternatives Program (TAP) Funding and Assure Local Match for the Rumsey Hill Bridge Replacement Project WHEREAS, the New York State Department of Transportation (NYSDOT) has announced the availability of Transportation Alternatives Program (TAP) funding for eligible active transportation-related projects, and applications are due March 12, 2026; and WHEREAS, the Town of Enfield proposes to replace the Rumsey Hill Bridge on Rumsey Hill Road (approx. coordinates 42.4062504, -76.6413066) with a new concrete box culvert structure to improve safety, accessibility for pedestrians, bicycles and vehicles, support emergency response, and connect to the Finger Lakes Trail, Stevenson Preserve, and other community amenities (the “Project”); and WHEREAS, the Project scope includes scoping/design, final design, construction, and construction inspection 5 with an estimated total project cost of $2,500,000 and a proposed construction schedule and phases as described in the Project Plan; and WHEREAS, TAP funding may reimburse up to 80% of eligible project costs and requires a minimum 20% local match and that the sponsor pay expenditures initially and request reimbursement; and WHEREAS, the Town of Enfield is prepared to serve as Project Sponsor and commit the required local match and initial funding for the Project as described below, and the Town has determined that no right-of-way acquisition is anticipated for the Project (ROW needs to be confirmed during design and required documentation will be provided as part of the application and subsequent approvals); NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Enfield as follows: 1. The Town of Enfield hereby authorizes and directs the Town Supervisor (or their designee) to submit an application to the New York State Department of Transportation for TAP funding for the Rumsey Hill Bridge Replacement Project. 2. The Town of Enfield certifies that the estimated total project cost is $2,500,000 and that the Town will initially fund 100% of project expenditures, and requests reimbursement of eligible costs up to 80% from TAP, with the Town providing the required minimum 20% local match (or greater, if required by award conditions). The Town affirms that these matching funds are available and will be budgeted or otherwise provided when required. 3. The Town of Enfield acknowledges that award of TAP funds will be subject to compliance with NYSDOT and FHWA requirements, and the Town agrees to provide all necessary documentation, agreements, assurances, and certifications required by NYSDOT, includin g but not limited to local funding commitments, procurement requirements, environmental compliance, and right-of-way evidence as the Project advances. 4. The Town Supervisor (or designee) is authorized to execute and submit the Application Pre -Review Coversheet and all application materials, sign all documents and agreements required by NYSDOT, and to take all actions necessary to secure TAP funding, accept a TAP award if offered, and administer the Project consistent with the award and applicable requirements. Supervisor Redmond moved and Councilperson Lemke seconded. Discussion: This is like the WQIP grant with a 20% match. However, she does not think that we will get the grant as it may not qualify. Buddy asked where she got the culvert construction quote from and she stated she spoke with former Highway Director Jeff Smith before he left the County and he had stated that it should be closer to 2.5 million for the bridge. Dan Walker that structure is exceedingly tall with a very big gorge. Councilperson Lynch asked for verbiage clarification if it should be a bridge or a culvert. She listed it as the Rumsey hill bridge. Should she call it a box culvert. Buddy confirmed that it should stay Rumsey Hill Culvert. Buddy stated the state lists it as a box culvert. Rob ert Lynch, there is a person in Ulysses and she explained the difference, and because of its size, it is a culvert. Councilperson Lynch, this does not commit us to building it? No, it does not. Vote: Aye, Hinkle, Lemke, Lynch, Millspaugh, and Redmond Nay, 0 Carried. 6 Resolution #2- 2026 Authorization for the Supervisor to Sign a Contract with Tompkins County Youth Services WHEREAS, Tompkins County Youth Services provides financial support for the youth summer camps run by the Enfield Community Council, therefore be it; RESOLVED, the Enfield Town Board authorizes Supervisor Redmond to sign a contract with Tompkins County Youth Services. ‘ Supervisor Redmond moved, and Councilperson Hinkle seconded. Audit Meeting – Supervisor Redmond moved and Councilperson Millspaugh seconded to hold the audit meeting on January 20, 2026 at 6:30 PM. Town of Enfield 2026 Organizational Resolutions Resolution #3-2026 Town Board Meeting Dates RESOLVED, the regular meeting of the Enfield Town Board shall be held monthly on the 2nd Wednesday of each month, at 6:30 pm, at the Enfield Town Courthouse, 182 Enfield Main Road, Ithaca, NY 14850 Supervisor Redmond moved, and Councilperson Lemke seconded. Resolution # 4-2026 Department Hours RESOLVED, the Town Board hereby establishes the work hours of the: • Highway Department to be from 6:00 AM to 2:30 PM, Monday through Friday. • Town Clerk to be Mon. through Thurs. from 11 AM to 4 PM • Code Enforcement Office to be from 9:00 AM to 11:30 AM Monday through Thursday and Wednesday from 5 PM to 7 PM, • Town Court to commence at 5:00 PM on Tuesdays unless it is a holiday. • The Court Clerk is to be 4 PM to 8 PM on Tuesdays unless it is a holiday. Vote: Aye, Hinkle, Lemke, Lynch, Millspaugh, and Redmond Nay, 0 Carried. 8 Resolution # 6-2026 General Rules for Procedure and Guidelines for Public Comment RESOLVED, in an effort to foster an orderly meeting process, the following rules and guidelines will be used and enforced at all Town Board meetings: GENERAL GUIDE FOR PROCEDURE The Supervisor shall preside at meetings. In the Supervisor’s absence the Deputy Supervisor shall preside. The presiding officer may debate, move and take other action that may be taken by other members of the Board. Board members are not required to rise but must be recognized by the presiding officer before making motions. A member, once recognized, shall not be interrupted when speaking unless it is to call him/her to order. If a member, while speaking, be called to order, according to the agreed upon pu rposes set forth in this resolution, they shall cease speaking until the question of order is determined by vote of the entire board. If determined to be in order, they shall be permitted to proceed. The board commits to adhere to Resolution #2017-50, Town of Enfield Chooses Civility Resolution, in all discussions to achieve the purpose of fairness and reasonable discourse. For purposes of process, organization, and legal requirements, parliamentary procedure will guide the Town Board in its work. There is no limit to the number of times a member may speak on a question. Motions to close or limit debate may be entertained but shall require a two-thirds vote. GUIDELINES FOR PUBLIC COMMENT The public shall be allowed to speak only during the Public Comment / Privilege of the Floor period of the meeting or at such other time as a majority of the Board shall allow. • Speakers may stand at their seats if they are able. • Speakers must give their name, address and organization, if any. • Speakers must be recognized by the presiding officer. • Speakers must limit their remarks to 3 minutes on a given topic. • Speakers may not yield any remaining time they may have to another speaker. • Board members may, with the permission of the Supervisor, interrupt a speaker during their remarks, but only for the purpose of clarification or information. • All remarks shall be addressed to the Board as a body and not to any member thereof. • Speakers shall observe the commonly accepted rules of courtesy, decorum, dignity and good taste. Resolution #9-2026 Town E-Mail Accounts RESOLVED, the Town Board has official e-mail accounts for all Town employees and elected officials for use in their official capacities. These e-mail accounts will be connected to our official website domain, townofenfield.org. Ownership of and access to these communications will be with the Town of Enfield. All employees and elected officials will set up accounts and use their account for Town business after it is set up for as long as they work for or serve the Town of Enfield. Resolution #10-2026 Official Newspaper Whereas, The Enfield Town Board must annually designate an official newspaper; and Whereas, The Ithaca Journal, a daily newspaper regularly published and having general circulation in the Town, is the only newspaper that fulfills New York State Requirements for the official publication of legal notices by this Town; and Whereas, despite that legal distinction, The Ithaca Journal in recent years has continually neglected to cover the news of Enfield, including that of this Town Board, a dereliction of journalistic duty for which this Board wishes to express its displeasure; and Whereas, the nature of local journalism has changed measurably since New York State adopted current state requirements for legal notice publication, including the advent of online news publications and print/online hybrids, several of which hold wider circulation within the local community than does The Ithaca Journal, publications that include Tompkins Weekly; and Whereas, legislative efforts at the state level have been undertaken, but have so far failed to revise the legal definition of an “official newspaper” so as to broaden the opportunities available to municipalities for the publication of legal notices; and Whereas, this Board supports renewed efforts to revise that legal definition; therefore be it 11 RESOLVED, that the Enfield Town Board designates The Ithaca Journal, a daily newspaper regularly published and having general circulation in the Town, as the Official Newspaper for the Town of Enfield, the only publication meeting state requirements; and be it further RESOLVED, that this Town Board encourages the New York State Senate and Assembly to adopt, and for the Governor to sign legislation that amends whatever law or laws are deemed applicable to broaden the definition of an “official newspaper” to also include regularly-published weekly, online, or print/online hybrid news publications circulated within the municipality’s community; and be it further RESOLVED, that this Town Board directs the Clerk to forward a copy of this Resolution and its call for legislative change to: New York State Governor Kathy Hochul, State Senator Lea Webb, State Assemblymember Dr. Anna Kelles, and to the leaders of the New York State Senate and New York State Assembly; and be it further RESOLVED, that should such revised legislation be adopted, signed and become effective within calendar year 2026, the Supervisor shall bring to this Town Board a Resolution to discontinue The Ithaca Journal as its official newspaper and instead designate Tompkins Weekly as its official newspaper for the balance of calendar year 2026; and be it further RESOLVED, that in addition to publication in the official newspaper, the Town will post all Public Notices on the town website at www.townofenfieldny.gov. Resolution # 11-2026 Code of Ethics RESOLVED, all Public Officials, appointees, and employees for the Town of Enfield are subject to the Code of Ethics as adopted by the Town, which is written in the Policies and Procedures Manual in the Employee Handbook. Resolution #12-2026 Records Access Officer RESOLVED, that the Town Clerk Mary Cornell, shall be appointed as the Town's Record Access Officer and; RESOLVED, that the Town Clerk will serve as the person who receives all FOIL requests. 12 Supervisor Redmond moved, and Councilperson Hinkle seconded. Discussion: ECC Newsletter Topics: Supervisor Redmond, we have the Conservation Advisor Committee. Town Clean-up at the Highway? The board, with Buddy’s input, set the date for May 14-16, 2026. Road Clean-up is set for May 9th. Cemetery clean-up is set for April 25th. Discussion continued. NYSEG FLAIR Project Discussion: Councilperson Lynch. In Newfield a large number of the public came to their Town Board meeting. He has been talking to Mike Allinger the Supervisor for the Town of Newfield and they are working on a resolution that he is hopeful to have completed by the January 20th Special Town Board Meeting. He thinks a consistent opinion of two municipalities will be helpful. These new poles may decrease property value and compensation may help ease that burden. The board's consensus was that this is the direction that they would like Councilperson Lynch to go in and to complete the Resolution and bring it to the Audit meeting. Discussion: Review Site Plan Regulations: Supervisor Redmond asked Bord members if they had looked at the emailed materials she had sent regarding lighting. Councilpersons Lynch’s argument here is that lighting regulations can be added after the regulations have been adopted. We do not have to leaden the site plan review with these laws. Supervisor Redmond is hopeful all of these can be looked at while they finish going through the regulations. Councilperson Lemke we are almost to the end of the regulations. Supervisor Redmond directed the board to finish reviewing the regulations for the February meeting. Privilege of the Floor: Councilperson Millspaugh, the EMC is looking for additional membership if anyone is interested. Councilperson Hinkle the Kwanza event went well, they are looking to have more volunteers for next year and everyone is invited. Rosie Carpenter asked about the Conservation Committee and what it involves and what it is about.
