BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF ENFIELD AS
FOLLOWS:
Section 1.0
Law
Title, Statutory Authorization and Purpose
1.1 TITLE
This local law shall be known as “A local law to opt back into, pursuant to Real Property
Tax Law (“RPTL”) § 487, to the Tax Exemption granted to certain types of renewable energy
facilities”
1.2 STATUTORY AUTHORIZATION
This local law is adopted pursuant to the authority and provisions of §10 of the Municipal
Home Rule Law, §10 of the Statute of Local Governments, and Town Law Article 16.
1.3 PURPOSE & INTENT
It is the purpose and intent of this local law to revoke its election to opt out of RPTL
§487. The Town has determined it is in the best interests of its residents, farms and businesses
that install renewable energy systems to benefit from a tax reduction by opting back in to RPTL
§487.
Section 2.0
Revocation of Opt Out Election
2.1 The Town Board of the Town of Enfield hereby revokes its opt out of §487 of the Real
Property Tax Law
2.2 A copy of this Law shall be filed with the President of the New York State Energy
Research and Development Authority and the Office of Real Property Services.
Section 3.0
Savings Clause
3.1 If any section, paragraph, subdivision or provision of this local law shall be adjudged
invalid or held unconstitutional, the same shall not affect the validity of this local law as a whole
or any part or provision thereof other than the part so decided to be invalid or unconstitutional.
Section 4.0
Effective Date
4.1 This law shall take effect upon its filing with the Secretary of State.
