LOCAL LAW INCREASING THE TERM OF OFFICE OF THE
TOWN CLERK FROM TWO (2) YEARS to FOUR (4) YEARS
BE IT ENACTED: by the Town Board of the Town of Enfield, as follows:
Section 1- Purpose:
The purpose of this Local Law is to extend the term of the elected office of the Enfield Town
Clerk from two (2) to four (4) years. The Town Board recognizes that the Office of Town Clerk
is predominately a clerical position within Town Government, not one of general legislative
policy formulation. Since the responsibilities of Town Clerk are more service-oriented and less
political in nature, they may not require the frequency of voter affirmation and review as do
some other Town Offices. Therefore, the public may benefit from the greater permanence and
continuity of a four (4) year Town Clerk’s position while still retaining the voters’ ultimate
electoral control over the office.
Section 2 - Statutory Authority:
This Local Law is adopted pursuant to the provisions of the Municipal Home Rule Law Sections
10(1)(ii)(a) and 23 (2)(e) of the State of New York.
Section 3- Increase in Term of Office:
The term of office of the elected Town Clerk shall be four years. Such four (4) year term shall
apply to the person elected at the first General Election after January 1, 2025 provided a
proposition submitted pursuant to Section 4 below is approved.
Section 4- Mandatory Referendum:
This Local Law is adopted subject to a Mandatory Referendum and shall be submitted for
approval of the qualified voters of the Town of Enfield at the General Election to be held on
November 5, 2024. A proposition in the following form shall be included in the ballot at such
General Election and the increased term of office shall not take effect until the next General
Election held after January 1, 2025, and only upon such proposition being approved by the
majority vote of the qualified voters voting thereon.

Town Clerk from two (2) Years to four (4) Years” be approved?)
Section 5- Supersession:
This Local Law shall supersede Town Law §24 relating to the term of office for Town Clerk of
the Town of Enfield.
Section 6- Effective Date:
This Local Law shall become effective on January 1, 2025 upon being filed in the office of the
Secretary of State after approval by the qualified voters.
