HomeMy WebLinkAboutTown Board Minutes 2013 12 11.pdf Town of Enfield Regular Town Board Meeting Minutes Enfield Community Building Wednesday, December 11, 2013 6:30 p.m. Present: Town Supervisor Ann Rider, Town Councilperson Mike Carpenter, Town Councilperson Chris Hern, Town Councilperson Vera Howe-Strait, Town Councilperson Debbie Teeter, Town Highway Superintendent Barry Rollins, Town Clerk Alice Linton. Supervisor Rider opened the meeting at 6:30 p.m. by leading the assemblage in the Pledge of Allegiance to the Flag. Privilege of the Floor: Beverly Rollins of 139 South Applegate Road stated she was concerned about the ethics and conduct of board members in reference to an e-mail sent by Supervisor Rider just prior to the November elections. She asked board members if they felt the information contained in the e- mail was true, specifically if the highway department didn't plow or sand the town roads until 10 a.m. on weekday mornings and sometimes not until 1 p.m. on weekends and sometimes roads are rarely plowed because the current highway superintendent deems it low priority. Councilperson Carpenter replied he didn't know if this was true. Councilperson Teeter replied she believes the whole thing is a true statement. Councilperson Hern stated the plow goes by his house before buses go through in the early morning. Beverly Rollins asked for an apology, or at least fact finding, to see that the plows do go out before the buses. Approval of Minutes: Councilperson Teeter moved, with a second by Councilperson Howe-Strait, to approve the minutes of the November 13, 2013 meeting. Discussion: Councilperson Carpenter stated NYSERTA should be NYSERDA for New York State Energy Research and Development Authority. Vote: Councilperson Carpenter aye, Councilperson Hern aye, Councilperson Howe-Strait aye, Councilperson Teeter aye, Supervisor Rider aye. Carried. Correspondence: Letter from Standard Security Life Insurance Company, the company Sprague Insurance contracts with for disability coverage for the town, asking if the town wanted to look into a richer disability plan. Budget Amendments: Supervisor Rider moved, with a second by Councilperson Teeter to adopt Budget Amendment #2013-16. Budget Amendment #2013-16 WHEREAS, expenses have exceeded the budget in the General Fund Account, line item A1420.4, titled “Attorney-Contractual”, now therefore be it RESOLVED, that the General Fund Account, line item A9710.6, titled “Serial Bond-Principle”, be decreased by $300.00 and General Fund Account, line item A1420.4, titled “Attorney- Contractual”, be increased by $300.00. Discussion: Supervisor Rider stated more funds were needed in this line due to attorney involving a landlord who was out of compliance with building codes. This matter has now been settled. Enfield Town Board Regular Meeting, December 11, 2013 2 Vote: Councilperson Carpenter aye, Councilperson Hern aye, Councilperson Howe-Strait aye, Councilperson Teeter aye, Supervisor Rider aye. Carried. Supervisor Rider moved, with a second by Councilperson Howe-Strait to adopt Budget Amendment #2013-17. Budget Amendment #2013-17 WHEREAS, expenses have exceeded the budget in the General Fund Account, line item A1220.42 titled “Supervisor-Contractual (Bookkeeper)”, now therefore be it RESOLVED, that the General Fund Account, line item A9710.6 titled "Serial Bond-Principle" be decreased by $500.00 and General Fund Account, line item 1220.42 titled “Supervisor-Contractual (Bookkeeper)”, be increased by $500.00. Discussion: Supervisor Rider stated additional funds were needed to replace the bookkeeper's laptop, which was no longer adequate. Supervisor Rider moved, with a second by Councilperson Hern to adopt Budget Amendment #2013- 18. Budget Amendment #2013-18 WHEREAS, expenses have exceeded the budget in the General Fund Account, line item A9010.8, titled “Employee Benefits-State Retirement” now therefore be it RESOLVED, that the General Fund Account, line item A9710.6 titled "Serial Bond-Principle" be decreased by $5,600.00 and General Fund Account, line item A9010.8 titled "Employee Benefits- State Retirement" be increased by$5,600.00. Discussion: Supervisor Rider stated state retirement billings were more than anticipated. She checked with the NYS Retirement System and they felt the billings were just and right. Supervisor Rider moved, with a second by Councilperson Howe-Strait, to adopt Budget Amendment #2013-19. Budget Amendment #2013-19 WHEREAS, expenses have exceeded the budget in the General Fund Account, line item A9060.81, titled “Employee Benefits-Medical Insurance”, now therefore be it RESOLVED, that the General Fund Account, line item A9710.6 titled "Serial Bond-Principle" be decreased by $550.00 and General Fund Account, line item A9060.81 titled "Employee Benefits- Medical Insurance", be increased by $550.00. Enfield Town Board Regular Meeting, December 11, 2013 3 Discussion: Supervisor Rider stated the January premium will be paid this month, as scheduled, but the 2014 payments due have been increased. Supervisor Rider moved, with a second by Councilperson Teeter to adopt Budget Amendment #2013- 20. Budget Amendment #2013-20 WHEREAS, expenses have exceeded the budget in the Highway Fund in line item DA9010.8, titled “Employee Benefits-State Retirement” by $4,581.00, now therefore be it RESOLVED, that the Highway Fund Account, line item DA9050.8 titled “Employee Benefits- Unemployment Insurance” be decreased by $1,000.00, line item DA9020.8 titled “Employee Benefits-Medicare” be decreased by $500.00, line item DA9040.8, titled “Employee Benefits- Worker’s Comp.” be decreased by $2,500.00, line item DA9070.8 titled “Drug Tests” be reduced by $300.00, line item DA9950.9 titled “Capital Funds-Equipment Reserve” be reduced by $281.00 and line item DA9010.8 titled “Employee Benefits-State Retirement” be increased by $4,581.00. Discussion: Supervisor Rider stated this is for state retirement for highway employees which was more than anticipated. Councilperson Hern asked if Highway Superintendent Rollins had been consulted about this budget amendment. Supervisor Rider stated she had figured out the employee benefit expenses and given a copy of this information to Superintendent Rollins before the meeting, but was unclear how drug tests were administered. Highway Superintendent Rollins stated this budget amendment was acceptable to him, and he agreed that there would probably be no drug test expense in the next few weeks. The testing is done randomly. The town is part of the county consortium and the testing is contracted out. Supervisor Rider moved, with a second by Councilperson Teeter to adopt Resolution #2013-21. Budget Amendment #2013-21 WHEREAS, expenses have exceeded the budget in the General Fund Account, line item A1670.4 titled “Central Printing and Mailing-Contractual”, now therefore be it RESOLVED, that the General Fund Account, line item A9710.6 titled “Serial Bond-Principal” be decreased by $130.00 and General Fund Account, line item A1670.4 titled “Central Printing and Mailing-Contractual”, be increased by $130.00. Discussion: Supervisor Rider stated this was for the town's share of the Enfield Community Council newsletter. This year there were 4 newsletters instead of 3 as in the past. Carried. Budget Amendment #2013-22 Supervisor Rider moved, with a second by Councilperson Teeter to adopt Budget Amendment #2013- 22. WHEREAS, the Town Board allocated funds for capital reserve in the 2013 General Fund budget, now therefore be it RESOLVED, that the Town Board authorizes the Town Supervisor to transfer the unused balance of $5,000.00 from A9950.9 (which account will be added to the 2013 budget by amendment at a future meeting) to the General Fund Building Reserve Account. Discussion: Supervisor Rider stated this is procedure for reserving money to be used for a specific purpose. Budget Amendment #2013-23 Supervisor Rider moved, with a second by Councilperson Howe-Strait to adopt Budget Amendment #2012-23. WHEREAS, expenses have exceeded the budget in the Highway Fund Account, line item DA9060.8, titled “Employee Benefits-Medical Insurance”, now therefore be it RESOLVED, that the Highway Fund Account line item DA9030.8 titled “Employee Benefits-Social Security” be decreased by $1,770.00 and Highway Fund Account, line item DA9060.8, titled “Employee Benefits-Medical Insurance” be increased by $1,770.00. Discussion: Supervisor Rider stated the January premium will be paid this month, as scheduled, but the 2014 payments due have been increased. Budget Amendment #2013-24 - tabled Supervisor Rider moved, with a second by Councilperson Hern to adopt Budget Amendment #2013- 24. WHEREAS, the Town Board allocated funds for equipment reserve in the 2013 Highway Fund budget, now therefore be it RESOLVED, that the Town Board authorizes the Town Supervisor to transfer the unused balance of $12,460.00 from DA9950.9, titled "Interfund Transfer-Equipment Reserve" to the Highway Fund Enfield Town Board Regular Meeting, December 11, 2013 5 Equipment Reserve Account if personnel costs do not exceed line item DA5142.1, titled “Snow Removal-Personnel Services" in the payroll dated December 20, 2013. Discussion: Highway Superintendent Rollins stated $15,500 was taken from this line item in September to cover storm damage and it was not taken off the report, so there is not a $12,460 balance in this line. Councilperson Teeter moved, with a second by Councilperson Hern to table this motion for further research. Budget Amendment #2013-24 - tabled Supervisor Rider moved, with a second by Councilperson Teeter to adopt Budget Amendment #2013- 24. WHEREAS, expenses have exceeded the budget in the Highway Fund Account, line item DA5130.4 titled “Machinery-Contractual”, now therefore be it RESOLVED, that the Highway Fund Account line item DA9950.9 titled "Interfund Transfer - Equipment Reserve" be reduced by $7,475.00 and line item DA5130.4 titled “Machinery-Contractual” be increased by $7,475.00. Discussion: Highway Superintendent Rollins stated there are not sufficient funds in this line item for the transfer. In August the board voted to move $15,000, but that was never reported, which is why the line item has been in the negative. As of November, line item DA5130.4 had $8,291.06, and after the December warrant there will be $1,372.46. Councilperson Teeter moved, with a second by Councilperson Hern to table this motion. Budget Amendment #2013-24 - tabled Supervisor Rider moved, with a second by Councilperson Teeter to adopt Budget Amendment #2013- 24. WHEREAS, expenses have exceeded the budget in the Highway Fund Account, line item DA5140.1, titled “Brush and Weed Removal-Personnel Services”, now therefore be it RESOLVED, that the Highway Fund Account line item DA9950.9 titled "Interfund Transfer- Equipment Reserve be reduced by $615.00 and line item DA5140.1 titled “Brush and Weed Removal- Personnel Services” be increased by $615.00. Discussion: Highway Superintendent Rollins stated $611.07 was taken from the wrong line item in April. The board approved the voucher with funds coming from line item DA5142.4 titled "Snow Enfield Town Board Regular Meeting, December 11, 2013 6 Removal-Contractual", but funds were taken from line item DA5140.4 titled "Miscellaneous Expense". Councilperson Teeter moved, with a second by Councilperson Hern to table this motion. Budget Amendment #2013-24 - tabled Supervisor Rider moved, with a second by Councilperson Teeter to adopt Budget Amendment #2013- 24. WHEREAS, expenses have exceeded the budget in the Highway Fund Account, line item DA5110.1, titled “General Repairs-Personnel Services”, now therefore be it RESOLVED, that the Highway Fund Account line item DA5142.1 titled "Snow Removal-Personnel Services" be reduced by $10,908.39 and line item DA5110.1 titled "General Repairs-Personnel Services" be increased by $10,908.39. Discussion: Highway Superintendent Rollins stated the clothing allowance was taken from payroll this year. In the past it has come out of the coverall and rag line item in the General Fund. He also stated at the beginning of the year the snow and ice line item has been used in the past and then the regular payroll line item. Overtime is not separate. There is still over $20,000 left in payroll lines, so there should not need to be a budget amendment. Councilperson Teeter moved, with a second by Councilperson Howe-Strait to table this motion. Audit Claims: Councilperson Carpenter moved, with a second by Councilperson Hern to authorize the supervisor to pay General Fund vouchers #314 to #342 dated December 11, 2013 in the amount of $68,383.37 and Highway Fund vouchers #208 to #222 dated December 11, 2013 in the amount of $46,311.82. Vote: Councilperson Carpenter aye, Councilperson Hern aye, Councilperson Howe-Strait aye, Councilperson Teeter aye, Supervisor Rider aye. Carried. Supervisor Rider stated she would be adding an additional agenda item: Discussion of Town Insurance: Supervisor Rider stated John Kuehn, representative of Sprague Insurance, met with her and Highway Superintendent Rollins to discuss general liability for buildings and equipment, along with bonding for employees who handle money. The equipment inventory and values have been updated, but the insurance premium has not been figured yet. The town's insurance expires December 31, 2013. A special meeting may need to be held to approve paying at least 10% of the insurance premium for 2014. County Legislator's Report: No representative was present. Enfield Town Board Regular Meeting, December 11, 2013 7 Highway Superintendent's Report: Highway Superintendent Rollins reported Harvey Hill Road has been completed as far as ditches and shoulders. He mentioned he is discouraged with this board and their handling of bond funds. They have done an injustice by using leftover bond funds to pay monthly bills. There was close to $130,000 left of the money borrowed for the new highway facility that he feels should be used for a salt barn, pavement, spreader hanger and/or equipment as was listed on the ballot for the public to vote on. The town has a savings account and contingency fund that could be used to pay the monthly bills. Supervisor Rider asked if Superintendent Rollins knew anything about a grant through Soil and Water for remediation work on Trumbull Corners Road. Superintendent Rollins stated this is a county road and the town probably wouldn't benefit from a grant. Councilperson Teeter asked why the town would be asked to join in the grant if there was no value for us. Highway Superintendent Rollins replied it would involve the creek that took out Hubbell Drive, but that's a dead end road and it is armored and walled back up and it's now being filled in. They were also to investigate if the work already done would count for work-in-kind, but there has been no answer on that. His understanding was there would be help with Harvey Hill Road and Fish Road, but now they are just doing Trumbull Corners Road. Code Enforcement Officer's Report: Code Enforcement Officer Alan Teeter reported for November there were 3 building permits issued or renewed, which brings the total for the year to 65. There was 1 certificate of occupancy issued, and 2 certificates of compliance issued. There were 5 inspections completed, 16 progress checks, and 1 valid complaint received. There were 2 fire and safety inspections completed, 2 property numbers issued and 1 house number sign installed. He asked the board for approval to dispose of two old laptops that haven't been used since 2003 when they were wiped clean, along with 2 printers. He would like to purchase a laptop in the future to take to job sites. Councilperson Teeter moved, with a second by Councilperson Hern to authorize the Code Enforcement Officer to dispose of 2 antiquated, unusable laptops with printers. Supervisor's Report: Supervisor Rider reported she attended two meetings to discuss Association of Town annual meeting business, and attended an animal control meeting. There are 9 municipalities who are cooperating on dog enumeration. Contract wording is being put together on how it will be funded. The plan now is to have a rolling census, preferably done by one person or group in all municipalities so there are similarities in standards of gathering information. This will be done over a 3 year period. There was no TCCOG meeting in November. She will be going to a training on what the criteria are for measuring fiscal stress in local government. Enfield Town Board Regular Meeting, December 11, 2013 8 Committee Reports: Planning Board: Planning Board Chairperson Virginia Bryant stated the board has been provided with a draft of the Comprehensive Plan. There are a few more statistics needed to be plugged in. Councilperson Teeter stated she is working to get more information from the county assessment department and more information from the federal census of agriculture. She feels the assessment department should be asked for all needed information at one time. Supervisor Rider stated at the December Planning Board meeting they did not discuss vacancies on their board. Planning Board Chairperson Virginia Bryant is drafting a short article to go in the upcoming newsletter to ask for more applications or interest. Councilperson Carpenter asked how many applicants the Planning Board had so far. Virginia replied three. Health Insurance Consortium: No recent meeting. Enfield Community Council: Cortney Bailey, president, stated they are pushing forward with a new community building. They are looking at various fundraising projects and there is an architect that has been hired. The teen and youth programs are going well, with 4th and 5th grade basketball starting. The ECC annual meeting will be held February 25, 6 p.m. at the Community Building. Recreation Partnership: No meeting. County Youth Board: Supervisor Rider is looking for an Enfield resident to serve on the board. Enfield Volunteer Fire Company: Councilperson Teeter stated Roger Lauper has been elected the new chief and Art Howser is now deputy chief. Facilities Manager: Councilperson Hern stated 2 new windows have been installed at the town hall. A new fuel tank has been installed inside the garage area, so the old fuel tank can now be removed. Communications Access Committee: No report. Aquifer Study Fundraising Group: Councilperson Howe-Strait stated they have taken in $370 from the year end donations for the matching grant of $1,000. There should be an article in the Watershed Newsletter, coming out soon, to ask for more donations. She is in the process of putting something together for the Enfield Community Newsletter. The USGS is willing to do a presentation for the board to give an update on what has been accomplished in 2013 and what the plans are for 2014 on the study. Supervisor Rider will tentatively schedule the presentation for February. Facilities Development: No report. Personnel Committee: No report. Enfield Town Board Regular Meeting, December 11, 2013 9 TC Council of Governments: Supervisor Rider reported the meeting was cancelled for lack of an agenda. New Business: Introduction of New Board Members: Supervisor Rider introduced Virginia Bryant, new board member for 2014-2017. Supervisor Rider stated it has been a pleasure working with outgoing board members Chris Hern and Debbie Teeter. She expects they will be volunteering in other capacities in the community after taking a vacation. She asked for thoughts of what had been important in the past 4 years and what they saw as still important to do in the future for new board members. Councilperson Teeter stated in the past 4 years a new highway facility was built, and they got the wind farm underway. Councilperson Hern mentioned the board passed a fracking moratorium and ban. Councilperson Teeter stated she feels it important that everyone has an opportunity to review and comment on the Comprehensive Plan. She also hopes board members will be respectful and keep egos out of things. Councilperson Howe-Strait feels it will be important to focus on the budget, which is always an issue. See if money can be found elsewhere instead of working on tight strings all the time. New York State Unified Solar Permit: Supervisor Rider stated Alan Teeter, Code Enforcement Officer attended a training and came back with current information on the need for municipalities to pay attention to solar permits. Supervisor Rider moved, with a second by Councilperson Hern to adopt Resolution #2013-38. Resolution #2013-38 To Adopt the NYS Unified Solar Permit Application Whereas the Town of Enfield supports alternative energy and solar installations in the Town and, Whereas the Town of Enfield Code Enforcement Officer recommends the adoption of the New York State Unified Solar Permit Application, Now Therefore, be it resolved that the Town of Enfield adopts the New York State Unified Solar Permit Application as written as the Town's official application form for solar installations of 12 kW or less with a standard fee of $100.00. Discussion: Code Enforcement Teeter stated New York State is hoping to have one permit application which is standard for the entire state with the thought that it would be easier for installers and home owners to get a building permit for solar installations. The cost savings would be passed on to homeowners to make it more affordable for solar energy. It's just a standard permit application with a set fee. It would only cover 12 kW or less. If it is a larger system, the current permit would be used. There is an incentive for using the NYS permit of $2,500 for municipalities that adopt this, but there is a limit available, so the fund could run out quickly. He would like to get this done as soon as possible and put in for the grant of $2,500. Enfield Town Board Regular Meeting, December 11, 2013 10 Councilperson Carpenter asked to add for "qualifying photovoltaic" solar installations to the language. There was agreement to do this. Hiring of Assistant Bookkeeper: Supervisor Rider stated the current bookkeeper asked for an assistant bookkeeper so she can go on vacation for two consecutive weeks. Our insurance agent also stated it is prudent to have bookkeepers take two consecutive weeks off from a security standpoint. In the 2014 budget, funds were set aside for an assistant bookkeeper. Cortney Bailey has said she would be interested in this job. Supervisor Rider moved, with a second by Councilperson Teeter to hire Cortney Bailey as part-time assistant bookkeeper. Discussion: Councilperson Hern stated this is the kind of thing that would be taken care of at the organizational meeting in January. Supervisor Rider replied there is some overlap needed before the end of the year since the bookkeeper wants to go away before the end of the year and some training is needed. She suggested that the assistant bookkeeper be paid $15.50 per hour. Town Clerk Alice Linton mentioned that is substantially more than the deputy town clerk receives per hour. Councilperson Carpenter asked what the criteria are to decide how much each employee should receive as an hourly rate at the organizational meeting. Supervisor Rider responded it is past precedent. Councilperson Teeter stated the deputy town clerk works consistently throughout the year and the assistant bookkeeper would only work for two weeks. This amount may be needed to find someone qualified to work for only two weeks. Councilperson Carpenter asked if this would be only for two weeks per year and stated if someone had to take two weeks off from another job, paying them a little more would be in keeping with what the job entails. Supervisor Rider responded that is what was budgeted. Highway Superintendent Rollins stated in a two week period there would only be payroll for 5 employees. Supervisor Rider stated there are often quarterly and monthly reports that have to be pulled. Councilperson Carpenter stated he feels the assistant bookkeeper will need some training and $15.50 per hour is a fair amount. Enfield Town Board Regular Meeting, December 11, 2013 11 Custodial Position: Supervisor Rider stated Andrew Thompson no longer has time to perform custodial duties for the town and has resigned his position. Sue Thompson is willing to take on the position. Supervisor Rider moved, with a second from Councilperson Teeter to appoint Sue Thompson as town custodian at a rate of $10.50 per hour, to be paid monthly. Vote: Councilperson Carpenter aye, Councilperson Hern aye, Councilperson Howe-Strait aye, Councilperson Teeter aye, Supervisor Rider aye. Carried. 2014 Agreement for Legal Representation between the Town of Enfield and Guy K. Krogh, Esq.: Supervisor Rider stated she spoke with town attorney, Guy Krogh, and he is willing to represent the town in 2014 at the rate of $175.00 per hour. He did indicate that his rates will be raised in 2015. Supervisor Rider moved, with a second by Councilperson Carpenter to authorize the supervisor to sign the Agreement for legal services with Guy Krogh for the period January 1, 2014 to December 31, 2014. Early December Payroll: Supervisor Rider asked that the board approve an early payroll for December. Councilperson Teeter moved, with a second by Councilperson Hern, to authorize payroll for everyone paid quarterly and monthly on December 20, 2013. Planning Board Discussion: Councilperson Carpenter asked for some discussion on Planning Board matters. He mentioned law states that no person who is part of the legislative body should be eligible to serve on the Planning Board. The board members were in agreement with this. He also mentioned that in the absence of a Planning Board chair, the Town Board could appoint a chair. Councilperson Teeter agreed that the Town Board appoints members to the Planning Board. However the Planning Board interviews and makes recommendations and typically that person is approved. She feels it would be a mistake to remove the Planning Board from any involvement in the process. Councilperson Carpenter feels the choice of a Planning Board chairperson is given to the Town Board and not the Planning Board. Councilperson Teeter stated it is respectful and appropriate to ask the Planning Board for recommendations and then the Town Board can make the final appointment. Councilperson Carpenter stated there have been 3 applicants for the 2 open positions on the Planning Board. He feels it is important to keep with the laws that are made. Enfield Town Board Regular Meeting, December 11, 2013 12 Supervisor Rider stated she will read the law again and be sure the Town Board is in compliance with state law. There is mandated training for Planning Board members and she will request a list of all trainings completed by members. Executive Session: The meeting was adjourned at 8:50 p.m. for an executive session. The meeting reconvened at 9:12 with no action being taken in executive session.
