Town Supervisor Rider opened the meeting at 6:30 p.m. by leading the assemblage in the Pledge of Allegiance to the Flag. Supervisor Rider requested a moment of silence in memory of Town Justice James Varricchio who passed away in December, 2012. Supervisor Rider announced there were several additions to the agenda under new business: delegate to Association of Towns annual meeting and resolution regarding hydrofracking; and a change to the agenda: moving into executive session for a personnel issue at the very end of new business. TOWN OF ENFIELD 2013 ORGANIZATIONAL RESOLUTIONS Resolution #2013-1 Town Board Meeting Dates Resolved, the regular meeting of the Enfield Town Board shall be held monthly on the 2nd Wednesday of each month, at 6:30 p.m., at the Enfield Community Building, 182 Enfield Main Road. Supervisor Rider moved to adopt Resolution #2013-1, with a second by Councilperson Teeter. Vote: Councilperson Hern aye, Councilperson Howe-Strait aye, Councilperson Teeter aye, Supervisor Rider aye. Resolution #2013-2 Official Newspaper Resolved, the Ithaca Journal, a newspaper regularly published and having general circulation in the Town, is hereby designated as the Official Newspaper for the Town of Enfield. Further resolved, the Town Newsletter will be in conjunction with the Enfield Community Council Newsletter – 3-4 per year. Enfield Town Board Regular Meeting, January 9, 2013 5 Resolution #2013-11 Engineering Firm for the Town Whereas, the Town Board appointed Resource Associates of Cortland to provide engineering services for Site Plan Reviews, specifically for the proposed highway facility, and Whereas said engineering firm has provided such in a timely manner at reasonable prices, and is expert in designing municipal facilities. Therefore, be it resolved, the Town Board re-appoints Resource Associates of Cortland to be named the Engineering Firm for the Town. Supervisor Rider moved to adopt Resolution #2013-11, with a second by Councilperson Teeter. Discussion: Councilperson Teeter asked if this was binding. Supervisor Rider stated there is no plan for new construction so this firm will probably not be used this year. Enfield Town Board Regular Meeting, January 9, 2013 6 Resolution #2013-15 Public Officials/Town Employees Pay Schedule Resolved, the following salaries and pay schedule for all Town Officials and employees, is approved for 2013:  Town Supervisor - $15,300.00/year; paid monthly  Town Councilpersons - $2,782.40 each/year; paid quarterly  Town Clerk - $15,300.00/year; paid monthly  Town Justices - $11,031.24 each/year; paid monthly  Highway Superintendent - $51,681.84; paid monthly  Machine Equipment Operator - Motor Equipment Operator - Hiring rate $14.28 per hour; after 90 days, rate will be increased to $15.30 per hour. MEOs with three years or less of time in service, will receive an additional $1.00 per hour on his/her anniversary date of hire. Carried Privilege of the Floor: Cindy Vicedomni Besemer of South Applegate Road stated she is interested in the vacant town justice position. Art Godin of Woodard Road spoke about the Planning Board's Comprehensive Plan Ag sub-committee group. He was concerned that a meeting scheduled for January 17 did not give adequate time to invite all interested parties. He had hoped there could be a meeting on January 29 as that was when Monica Roth from Tompkins County Cooperative Extension could attend. Approval of Minutes: Supervisor Rider moved, with a second by Councilperson Hern to accept the minutes of the December 12, 2012 regular town board meeting. Carried Correspondence: Letter from Toni Albano stating interest in the vacant councilperson seat. Letter from Cindy Vicedomni stating interest in the vacant town justice position. Letter from Town of Ulysses notifying Town of Enfield they can no longer use their 2 way radio license. This is not a problem for Enfield as we now have upgraded radios. Notification from Andrew Campanelli that he offers wireless facility ordinance review services to local governments nationwide. Copy of resolution adopted by the Tompkins County Council of Governments at a meeting held on December 20, 2012 in support of the Tompkins County Legislature's Ban on the Use of Hydrofracking By-Product Brine on County Roads and Property. Copy of Town of Ulysses resolution regarding providing comment on the Department of Environmental Conservation revised regulations governing high volume hydraulic fracturing. Notice from Secretary of State announcing competitive grants through the Local Government Efficiency (LGE) Program to support local leaders in their efforts to reduce municipal expenses by developing new service delivery efficiencies. Budget Amendment: Councilperson Hern moved, with a second by Councilperson Teeter to approve Budget Amendment #2013-1. Enfield Town Board Regular Meeting, January 9, 2013 8 Budget Amendment #2013-1 WHEREAS, expenses have exceeded the budget in the General Fund Account, line item A1910.4, titled “Special Items - Unallocated Insurance”, now therefore be it RESOLVED, that the General Fund Account, line item A9040.8, titled “Employee Benefits – Workers Compensation”, be decreased by $1,000.00 and General Fund Account, line item A1910.4, titled “Special Items - Unallocated Insurance”, be increased by $1,000.00. Discussion: Councilperson Hern asked why money needed to be transferred so early in the year. Roy Barriere answered that our insurance company, NYMIR, had been giving refunds for the past few years. Carried Audit Claims: Councilperson Howe-Strait moved, with a second by Councilperson Hern to authorize the supervisor to pay General Fund vouchers #1 to #17 dated January 9, 2013 in the amount of $37,041.91, Highway Fund vouchers #1 to #17 dated January 9, 2013 in the amount of $36,399.03 and Special Fund vouchers #1 to #2 dated January 9, 2013 in the amount of $88,360.00. Vote: Councilperson Hern aye, Councilperson Howe-Strait aye, Councilperson Teeter aye, Supervisor Rider aye. Carried County Legislator's Report: No report. Highway Superintendent's Report: Superintendent Rollins presented his 284 Form for work he expects to be performed in 2013, which includes work on one mile of Aiken Road and one mile of East Enfield Center Road. This could change once spring comes and the condition of roads is evaluated. He was notified that the Soil and Water Conservation District had a problem with the grant being accepted for some of the work done by the county for the Enfield Center Road bridge project. They are wondering if the town could put in several thousand dollars towards the rock, which was the part of the project not accepted. This would come out of material funds. All the rock for the Bostwick Road job has been purchased, which was part of the grant. Supervisor Rider asked why, during the recent storm, roads weren't plowed until after noon. Superintendent Rollins explained that it was a judgment call and he felt plowing too early could cause ice to build up underneath the snow. He checked the roads, and there appeared to be no one having problems. If residents have concerns, he asked that they contact him. Code Enforcement Officer's Report: Alan Teeter reported in 2012 there were 70 building permits issued or renewed, 11 of which were new homes. There were 13 certificates of occupancy issued, 19 certificates of completion issued, 3 certificates of compliance issued, 31 foundation inspections, 25 framing inspections, 12 insulation/energy code inspections, 8 plumbing inspections, 45 final inspections, 172 progress checks, 11 meetings with owners/builders/state, 11 complaints received, 9 complaints valid, 10 complaints resolved, 5 court appearances, 2 letters of voluntary compliance sent, 5 orders to remedy, 3 property research for mortgage - finance - real estate - owners, 7 fire and safety inspections - public assemblies, 10 fire and safety inspections - multiple residences, 3 fire and safety inspections - general occupancies, 0 fire and safety inspections - re-inspections, 1 fire and safety inspection - owner requested, Enfield Town Board Regular Meeting, January 9, 2013 9 1 operating permit issued, 7 house numbers issued, 19 house numbers installed, 24 meetings attended, 30 training hours completed and $2,585,541 total cost of improvements. Alan requested permission from the board to attend in-service training in Syracuse, as he has done for the past few years. It is 24 hours of in-service training at a cost of $350 and there is money in his budget for this. Supervisor Rider moved, with a second by Councilperson Hern to authorize Alan Teeter to participate in in-service training in Syracuse, New York with a maximum budget of $500 for expenses that are allowed in his budget line. Discussion: Supervisor Rider asked when the training would be held. Code Enforcement Officer Teeter responded the training will be held in April. Carried Committee Reports: Planning Board: Dan Walker reported the board continues to work on the Comprehensive Plan. A site plan was reviewed and approved for a wind tower of about 140 feet on Bostwick Road. This will be an educational process for the Science Center also, as there will be a meter on it that will be connected to the web. There were no environmental concerns about the project. Supervisor Rider asked if there was an estimated time for completion of the Comprehensive Plan. Dan replied they are hoping for a draft in the next 3 months. Health Insurance Consortium: No report. Enfield Community Council: Deena Rambaum thanked the board for their steadfast support of youth programs. New officers will be elected in the next month. The next big project for the Council is planning for a new community building. JoAnn Huddle has taken on responsibility for the quilt to be made and raffled off at the Harvest Festival. The Council's annual meeting is scheduled for February 19 at 6:30 p.m. in the Community Building. Recreation Partnership: There will be a meeting coming up later in January. Youth Board: No report. Enfield Volunteer Fire Company: Art Howser reported in November there were a total of 34 calls: 21 EMS, 1 garage fire, 1 grass fire, 1 controlled burning, 1 smoke detector activation no fire, 1 motor vehicle accident, 1 severe weather tree in roadway and 7 mutual aids to Trumansburg. In December there were 33 calls: 25 EMS, 1 motor vehicle accident, 1 motor vehicle accident - no vehicle found, 1 car fire, 1 fire alarm activation - no fire found, 2 CO detector activation, 1severe weather wire arcing, 1 mutual aid to Trumansburg - canceled en-route. For the year of 2012, there were a total of 454 calls, 8,781 hours, and 60 volunteer members. BBQs are scheduled for 1/13, 2/10, 3/10 and 4/14. Blood drives are scheduled for 1/15, 3/19, 5/21, 7/16, 9/17 and 11/19. Enfield Town Board Regular Meeting, January 9, 2013 10 Facilities Manager: Councilperson Hern reported he is still collecting estimates for the town hall windows. He checked the underground fuel tank at the town hall and it is still about three-quarters full. Communication Access Committee: No report. Facilities Development: No report. Personnel Committee: No report. TC Council of Governments: Roy Barriere reported Kate Supron and Richard Driscoll are now co-chairs, but they have no vice-chair yet. Old Business: Update on Road Preservation Plan: Dan Walker reported the Caroline Road Committee continues to meet monthly. They have three public meetings scheduled to obtain input. The January 23 meeting will be on construction of roads at the Caroline Town Hall, 7 p.m. There will also be a meeting in February and one in March for public input. Local Law on Banning Hydro-Fracking/Public Hearing: A draft local law to effect a Prohibition Within The Town of Natural Gas and Petroleum Exploration and Extraction Activities, Underground Storage of Natural Gas, And Disposal of Natural Gas or Petroleum Extraction, Exploration, And Production Wastes has been prepared by attorney Slottje and forwarded to our town attorney, Guy Krogh who also reviewed the document. Councilperson Teeter stated she was concerned that the ban would cover all gas drilling in Enfield, not just drilling using the hydro-fracking method. Supervisor Rider will check with Don Barber, town of Caroline supervisor, and see if their law included all gas drilling. She will also check with our town attorney about that question. Councilperson Hern asked if a draft law should be prepared for the public to review before the public hearing. Supervisor Rider suggested the public hearing should be scheduled for a date other than a town board meeting and a draft law would be available prior to the hearing. Councilperson Hern moved, with a second by Councilperson Teeter to schedule a public hearing on a local law to effect a Prohibition Within The Town of Natural Gas and Petroleum Exploration and Extraction Activities, Underground Storage of Natural Gas, And Disposal of Natural Gas or Petroleum Extraction, Exploration, And Production Wastes for February 27 at 6:30 p.m. at the Enfield Community Building. Carried TCAT Park and Ride: A meeting with TCAT is scheduled for January 15 at 11:00 a.m. Enfield Town Board Regular Meeting, January 9, 2013 11 New Business: Town Justice checking accounts: Councilperson Teeter moved, with a second by Councilperson Howe- Strait to accept Resolution #2013-18. Resolution #2013-18 WHEREAS, James J. Varricchio died on December 13, 2012 while serving as Town Justice in the Town of Enfield, County of Tompkins, New York and WHEREAS, he was the sole signatory on two (2) Town Justice checking accounts #01-101-179375 and #01-101-179383 held at the Tompkins Trust Company, Ithaca, NY 14850 THEREFORE, Ann Rider, Town Supervisor, is authorized to become the signatory on these 2 accounts until December 31, 2013. Discussion: Tompkins Trust Company has stated this is the procedure needed to change signatures. Councilperson Howe-Strait asked if the person filling in for Justice Varricchio would become a signatory on the accounts. Justice Betty Poole responded the new Justice would open two new accounts and Supervisor Rider would authorize moving the funds from Justice Varricchio's accounts to the new accounts. Carried Schedule Audit of Justices, Town Clerk and Bookkeeper: Supervisor Rider moved, with a second by Councilperson Howe-Strait to hold the annual audit meeting on Thursday, January 17, 5:00 p.m., at the Enfield Town Hall. Vote: Councilperson Hern aye, Councilperson Howe-Strait aye, Councilperson Teeter aye, Supervisor Rider aye. Carried Association of Towns Delegate to Annual Meeting: Supervisor Rider stated the annual meeting of the Association of Towns will be held February 17-19, 2013 in New York City. She stated she would like to attend. Councilperson Teeter moved, with a second by Councilperson Hern to appoint Supervisor Ann Rider as the Town of Enfield delegate for voting powers to the 2013 annual meeting of the Association of Towns. Vote: Councilperson Hern aye, Councilperson Howe-Strait aye, Councilperson Teeter aye, Supervisor Rider aye. Carried Possible resolution regarding comments on high volume hydraulic fracturing: The Town of Ulysses asked Enfield to join them in providing comment on the Department of Environmental Conservation revised Regulations Governing High Volume Hydraulic Fracturing. Councilperson Teeter noted the deadline for submitting comments is January 11, 2013. Supervisor Rider stated she didn't feel the board was in a position to vote on a resolution due to the short time frame. The board has previously submitted comments in 2012. Enfield Town Board Regular Meeting, January 9, 2013 12 Aquifer Study Report: Nancy Spero stated there is some money, about $5,000, that the Tompkins County Soil and Water Conservation District has available for the Enfield aquifer study. She also reported $1,495 was donated in 2012 to Social Ventures, Inc. for the aquifer study. Those funds will be passed on to the town. Executive Session for Personnel Matter: At 8:22 p.m. the board moved into executive session for a personnel matter. At 9:00 p.m. the board reconvened for regular business. Justice of the Peace Vacancy: Councilperson Teeter moved, with a second by Councilperson Howe-Strait to accept Justice Betty Poole's gracious offer to continue as the sole justice through March 31, 2013 at a monthly pro-rated salary of Justice Varricchio's salary. Discussion: Councilperson Teeter stated at the March town board meeting the board will review this matter. This will give the board time to look into, and review, options. Vote: Councilperson Hern aye, Councilperson Howe-Strait aye, Councilperson Teeter aye, Supervisor Rider aye.
