Town Supervisor Barriere opened the meeting at 6:45 p.m. by leading the assemblage in the Pledge of Allegiance to the Flag. Presentation by Ken Thompson – Six Town Energy Education Grant, Energy Coordinator Mr. Thompson explained he is helping municipalities save energy – for Enfield this could include LED street lights, upgrading lights in the town hall, community building and fire station. Grants are available and Ken can be contacted for more information. Privilege of the Floor: No one wished to speak. Approval of Minutes: Councilperson Owens moved to accept the minutes of the April 13, 2011 regular town board meeting. Second by Councilperson Hern. Vote: Councilperson Clark aye, Councilperson Hern aye, Councilperson Owens aye, Councilperson Teeter aye. Supervisor Barriere aye. Carried Correspondence: Information from Pat Podufalski, town bookkeeper, that she is looking into upgrading payroll software so direct deposit could be offered to employees. The upgrade for the payroll software, in order to allow for direct deposit, would cost $395; and the monthly fee for this feature is $30. This issue will be on the agenda of the next town board meeting. Copy of letter from TCCOG to NYS Department of Environmental Conservation requesting a ninety-day public comment period following promulgation of the Revised Draft SGEIS on the Oil, Gas, and Solution Mining Regulatory Program for the Marcellus Shale Gas Drilling. Notice of, and invitation to, the Annual Tompkins County Dairy Promotion Banquet on Saturday, June 4th, 7:00 p.m. at the Ramada Inn. Agenda for the Ithaca-Tompkins County Transportation Council Meeting to be held Tuesday, May 17, 2011 from 2-4 p.m. at 737 Willow Avenue, Ithaca. Memo from Board of Directors of Tompkins County Employees Federal Credit Union regarding possible move from current location. Letter from American Farmland Trust notifying the board of a free spring webinar series which is geared to town officials and others who might be interested in the topics which include “Exploring Alternate Ways to Protect Farmland” and “Buy Local First: How to Keep Public Food Dollars in Your Community”. Audit Claims: Supervisor Barriere mentioned Alarm Tech replaced batteries this week recertified the system. However, in the very near future, they will be monitoring the system instead of the 911 Center, and because of that, there will be an additional fee of approximately $200 per year.They are a certified alarm center. Councilperson Clark moved for the board to authorize the supervisor to pay General Fund vouchers #122-#146 dated May 11, 2011 in the amount of $17,722.17 and Highway Fund Enfield Town Board Meeting, May 11, 2011 2 vouchers #77-#97 dated May 11, 2011 in the amount of $26,568.38. Councilperson Teeter seconded the motion. Vote: Councilperson Clark aye, Councilperson Hern aye, Councilperson Owens aye, Councilperson Teeter aye, Supervisor Barriere aye. Carried County Legislator’s Report: No legislative representative present. Code Enforcement Officer’s Report: Alan Teeter reported 3 new building permits were issued, 1 for a new home; 1 certificate of occupancy was issued; 1 certificate of completion was issued; 1 foundation inspection was completed; 1 framing inspection was completed; 2 final inspections were completed; 11 progress checks were done; 2 meetings with owners and builders were held; 4 valid complaints were received with 3 complaints resolved; 1 letter of voluntary compliance was sent; and 1 house number was issued. Two mobile homes that were destroyed by fire in the last couple of months have now been cleaned up. A building permit has been issued for a house that sustained substantial fire damage. There was talk of a mobile home park on Mecklenburg Road, but a deed restriction prohibits that. Committee Reports: Planning Board : Alan Teeter reported that Jim McConkey is retiring from the Planning Board this month. The Board reviewed the Orson Ledger project on Mecklenburg Road, cell tower correspondence and the site plan review law. Health Insurance Consortium: No update. Enfield Community Council: Marnie Kirchgessner reported there are still applications available for the community garage sale to be held May 21. She met with the Enfield PTA and ICSD superintendent of schools Dr. Brown. The council is working with Enfield School to expand activities. The council is also working on a new logo for the organization. Lindsey Gray is the new rural youth leader for Enfield working with the Primitive Pursuits program for 20 hours per week. Enfield Volunteer Fire Company: Supervisor Barriere reported the first disaster planning meeting was held for all municipalities in the county. Facilities Manager: Councilperson Hern reported the Welcome to Town of Enfield sign is back up thanks to the highway department and a new bike rack has been installed. Communication Access Committee: Nothing to report this month. Facilities Development: Councilperson Owens reported a pre-construction meeting was held to discuss what contracts to sign. A well drilling quote was received from Randolph Well and Pump Co., Inc. After due diligence, another quote could not be obtained so Councilperson Owens suggested the town sign a contract with Randolph Well. Councilperson Hern questioned if Randolph Well uses a high-powered, high-speed drilling technique which he has heard is not good. Supervisor Barriere moved, with a second by Councilperson Teeter to use Randolph Well and Pump Co., Inc. to dig the well, making sure that Resource Associates is aware of our concern with the high-speed issue. Vote: Councilperson Clark aye, Councilperson Hern aye, Councilperson Owens aye, Councilperson Teeter aye, Supervisor Barriere aye. Carried Enfield Town Board Meeting, May 11, 2011 3 Councilperson Owens also reported that the SPDES permit would be signed on Friday, May 13 and a DOT permit will be obtained for the septic system. NYSEG forms have been sent in; contracts and bonds are in hand. Highway Superintendent Rollins had asked if Hillman will be producing item 4 gravel. He suggested we make sure that the item 4 meets standards. Number 10 may need to be added. He believes the trucking cost will about equal the cost of material. If item 4 is produced on site it could save about $50,000 with the final cost being about $50,000. The total cost for the crusher run for about 4300 cubic yards is around $100,000, which includes $50,000 for trucking. If there are no change orders, the construction should be about $50,000 under budg et without the cold storage which costs about $60,000. Councilperson Hern stated he feels adding the cold storage at this point will be cutting the costs too close since overruns are likely. Councilperson Clark added there are always overruns in a project of this size. Highway Supervisor Rollins asked how much crusher run would be needed. Councilperson Owens stated they had added more to the total as of today, bringing it to 6,000 cubic yards because of the fact that asphalt won’t be applied. Councilperson Teeter feels the cold storage will be needed down the road. Highway Supervisor Rollins added if there is money left at the end of the project, the cold storage could be added at that time. If a project is under $30,000 it doesn’t need to go out to bid, but bond money could be used for the project. Since contracts aren’t signed yet, a clause could be added at the end stating cold storage will be eliminated for now, but if funds are available at the end of the project cold storage could be added back in. Councilperson Teeter moved to eliminate cold storage from the project at this time and to authorize the town supervisor to sign the contracts, reserving the option to re-evaluate the cold storage at a later date. Second by Councilperson Owens. Vote: Councilperson Clark aye, Councilperson Hern aye, Councilperson Owens aye, Councilperson Teeter aye, Supervisor Barriere aye. Carried Personnel Committee: No report. TC Council of Governments: Supervisor Barriere reported NYMIR gave a presentation. The group reviewed the 2010 census report. Highway Superintendent’s Report: Buddy Rollins reported the Enfield clean-up week is going well. One dumpster was filled Tuesday and three today. He has received a letter that CHIPS funds are now available – the Town of Enfield will receive about the same amount as last year. All bridge work is completed except the Enfield Center Road bridge will be paved. Harvey Hill Road was recently flooded and 5 or 6 driveways washed out. The crew did a great job cleaning up and repairing pipes. There is still some more work to be done there. There was a question if construction materials should be accepted at the clean-up – small amounts seem to be OK. There has been a problem with landlords bringing truckloads of items from apartments. Once the new facility is completed, Buddy would like to have a place for brush to be dropped off and chipped. Enfield Town Board Meeting, May 11, 2011 4 Supervisor Barriere mentioned that the new radios for the highway department have been ordered. Old Business: Approval for Enfield Volunteer Fire Company to Refinance Report of Hearing Officer Dennis Hubbell, President of the Enfield Volunteer Fire Company, having been appointed hearing officer on April 13, 2011 by Roy Barriere, supervisor of the Town of Enfield, pursuant to a certain Notice of Public Hearing published in the Ithaca Journal on April 18, 2011, and such public hearing having been duly scheduled and held pursuant to such notice on May 3, 2011 at 7 p.m. at the Enfield Volunteer Fire Company, located at 172 Enfield Main Road, Ithaca, New York, now reports as follows: The hearing was open at 7 p.m. by the hearing officer and the following people appeared and were heard: no one The hearing duly closed at 7:10 p.m., there being no further appearances. A copy of the legal ad was attached to the Report of Hearing Officer. Resolution #2011-26 Approval for Enfield Volunteer Fire Company to Refinance RESOLVED, that the undersigned members of the Town Board of the Town of Enfield, Tompkins County, New York upon reading the Appointment of Hearing Officer executed by Roy Barriere, Supervisor dated April 13, 2011; the Notice of Public Hearing published on April 18, 2011 in the Ithaca Journal; and the Report of Hearing Officer dated May 3, 2011, hereby approve the "Approval to Purchase" attached hereto and further direct that the Enfield Town Supervisor execute such "Approval to Purchase" on behalf of the Town Board. Dated: May 11, 2011 TOWN BOARD OF THE TOWN OF ENFIELD _____________________________________ Supervisor, Roy Barriere _____________________________________ Debbie Teeter _____________________________________ Chris Hern _____________________________________ Jean Owens _____________________________________ Ronald Clark TOWN CLERK ________________________ Alice Linton APPROVAL OF PURCHASE BY ELECTED REPRESENTATIVE OF POLITICAL SUBDIVISION CONTRACTING FOR FIREFIGHTING SERVICES I, Roy Barriere, Supervisor of the Town of Enfield in accordance with the requirements of section 147 and related sections of, and regulations under, of the Internal Revenue Code, and in reliance upon certain recommendations and other information submitted to me, and subsequent to a duly conducted public hearing concerning the matter, do hereby approve borrowing and the Enfield Town Board Meeting, May 11, 2011 5 issuance of an obligation evidencing such indebtedness by the Enfield Volunteer Fire Company, Inc. from M&T Bank for the refinancing of the prior construction, reconstruction and improvement of a firehouse by such Volunteer Fire Department of a certain fire station located at 172 Enfield Main Road, Ithaca, New York. The proposed refinance of the prior construction, reconstruction and improvement is of the firehouse facility located at 172 Enfield Main Road, Ithaca, New York, which is used for housing and storage of firefighting apparatus, vehicles and related equipment as well as for training, administrative and related facilities in order to render fire protection service to the Town of Enfield pursuant to a contract for the period January 1, 2010 through December 31, 2014 between the Volunteer Fire Department and the Town of Enfield. The proposed refinance will be in the maximum face amount of $559,762.00. The Enfield Volunteer Fire Company, Inc. is the owner, operator and manager of the fire station facility described herein. Execution of this document in no way creates liability on the part of the Town of Enfield and the Town of Enfield is not responsible for the repayment of any bonds issued pursuant thereto. Carried New Business: Discussion on RUA/Road Preservation Supervisor Barriere stated the county is working on a road preservation law now. There are a few things the town needs to consider also. Buddy Rollins has been working on an inventory of what we have for town roads. Along with this we’ll need to include what bridges, culverts, etc. that we have and the condition of the roads. W e’ll need some mechanism to trigger a road use agreement. A few months ago the towns of Ulysses, Caroline and Enfield worked to put together an RFP to look into hiring someone to analyze our roads. We had 2 bids that came in and the towns met with ARA and LaBella. ARA would be best suited to help us put together a road use agreement. LaBella would be best suited for surveying our roads based on their expertise. Councilperson Teeter has seen the county law that is being worked on and feels it is thorough and we could model something after it. The issue seems to be what is a single use or what is unique. What they want to exempt seems to be causing most of the problems. Supervisor Barriere stated it would be best if all municipalities in the county could have a law that was very similar. He feels a road use agreement would come before the law. The board will need to work closely with the county on this and some legal fees may be incurred. Supervisor Barriere will meet next week with the other two municipalities. Highway superintendent Rollins will check with the county to see if we can borrow their traffic counter and use it for one week at a time on most possible haul routes – the roads in the best condition and straightest. Announcements: Councilperson Teeter is concerned about a resident on Mecklenburg Road that burns trash regularly. In the past the Tompkins County Health Department oversaw this, but as of January 1, 2011 they are no longer involved. Problems since then have been referred to the DEC. Councilperson Teeter will e-mail our county reps regarding this problem. Enfield Town Board Meeting, May 11, 2011 6 Councilperson Teeter attended a webinar which was very informative on gas leasing for agricultural land owners. She would like to see George Frantz give his presentation on agriculture planning in this community and invite Trumansburg and Newfield. Volunteer of the Month: The Enfield Valley Grange and Greg Stevenson nominated Jack Hubbell. Jack cleans up road-side litter, volunteers at the Grange by washing dishes, mowing the lawn, shoveling sidewalks in winter, putting up signs. He also volunteers at clean-up week, helps with recycling, coordinates the One Room School House Reunion and rakes cemeteries.
