HomeMy WebLinkAbout2-9-11 Regular Meeting.pdf Town of Enfield Regular Town Board Meeting Minutes Enfield Community Building Wednesday, February 9, 2011 6:45 p.m. Present: Deputy Town Supervisor Debbie Teeter, Town Councilperson Chris Hern, Town Councilperson Jean Owens, Town Highway Superintendent Barry Rollins, Town Clerk Alice Linton. Absent: Town Supervisor Roy Barriere, Town Councilperson Ron Clark. Deputy Town Supervisor Teeter opened the meeting at 6:45 p.m. by leading the assemblage in the Pledge of Allegiance to the Flag. Presentation by Darby Kiley, Tompkins County Planning Department. Ms. Kiley explained she is employed by Tompkins County as a Gas Drilling Planner for the municipalities of Tompkins County dealing with impacts of gas drilling. She gave a slide presentation explaining the work she is doing and the goals for her one year position funded by the Park Foundation. She is working on technical support to the gas drilling task force, developing a best practices list and reaching out to the towns to see what their priorities are. Ms. Kiley has been working with Enfield, Caroline and Ulysses to obtain proposals for a contract for a consulting firm to examine existing conditions of roadways, and do some core sampling and traffic counts in order to determine what the load carrying capabilities are of the town roads. She stated she is a resource for the town and the town board should feel free to contact her with any questions they may have. Privilege of the Floor: Judy Heyman of Enfield Neighbors for Safe Air and Water (ENSAW) stated the group is hoping to hold an educational event regarding roads. The group has a list of gas leases in Enfield that will be expiring this year. She suggested some landowners may want to let their lease expire and renegotiate a better deal. Approval of Minutes: Councilperson Owens moved to accept the minutes of the audit meeting held January 19, 2011, with a second by Councilperson Hern. Vote: Councilperson Hern aye, Councilperson Owens aye, Deputy Supervisor Teeter aye. Supervisor Barriere and Councilperson Clark absent. Carried Approval of Annual Audit: Deputy Supervisor Teeter moved to accept the audit held January 19, 2011. Councilperson Hern seconded the motion. Vote: Councilperson Hern aye, Councilperson Owens aye, Deputy Supervisor Teeter aye. Supervisor Barriere and Councilperson Clark absent. Carried Correspondence: Notice from Cornell Cooperative Extension regarding a workshop on the Emerald Ash Borer to be held Tuesday, February 15 from 7:00 – 8:30 p.m. at Cornell Cooperative Extension of Tompkins County. Budget Amendment: BA# 2011-1 Resolution to Transfer the Capital Improvement Fund for the New Highway Facility WHEREAS, The Town of Enfield has the approval of the voters as of the 2010 General Elections to expend up to $504,000 from the Capital Improvement Fund and to bond up to $1,100,000 for the construction of the new Town of Enfield Highway Facility, NOW THEREFORE BE IT RESOLVED, that the following lines be added to the 2011 Budget: General Fund Revenue Account A5710 titled, “Proceeds of Capital Improvement Fund”, General Fund Appropriation Account A5197.2 titled, “Highway Capital Project”, the creation of the H Fund, H Fund Revenue Account H5710 titled, “Proceeds of Bond”, H Fund Account H2401 titled, “Interest Capital Project” and H Fund Appropriations Account H5197.2 titled, “Highway Capital Project”, and further be it RESOLVED, that $504,000 be moved from the Capital Improvement Fund to increase line item A5710, titled “Proceeds of Capital Improvement Fund” by $504,000 and increase line item A5197.2, titled “Highway Capital Project” by $504,000. Deputy Supervisor Teeter moved, with a second by Councilperson Owens to adopt Budget Amendment #2011-1. Vote: Councilperson Hern aye, Councilperson Owens aye, Deputy Supervisor Teeter aye. Supervisor Barriere and Councilperson Clark absent. Carried Resolution #2011-20 Resolution to Transfer the Balance of the “Capital Improvement Fund” to the “Town of Enfield Town Hall Reserve Fund” WHEREAS, the balance of the Capital Improvement Fund exceeds the $504,000 to be transferred for the Highway Facility, NOW THEREFORE BE IT Enfield Town Board Meeting, February 9, 2011 3 RESOLVED, that the remaining balance of $995.15 be transferred to the “Town of Enfield Town Hall Reserve Fund”. PUBLIC NOTICE TO RESIDENTS OF THE TOWN OF ENFIELD NOTICE is hereby given that the Town Board of the Town of Enfield, New York, at a public meeting duly noticed and held upon February 9, 2011, adopted a resolution entitled “RESOLUTION TO TRANSFER THE BALANCE OF THE “CAPITAL IMPROVEMENT FUND” TO THE “TOWN OF ENFIELD TOWN HALL RESERVE FUND”, which resolution authorizes the Town Supervisor to transfer the remaining funds $995.15 from the current “Capital Improvement Fund” to the newly established “Town of Enfield Town Hall Reserve Fund”. This resolution is subject to permissive referendum pursuant to General Municipal Law § 6-c and Town Law Article 7. Carried Annual Association of Towns Training: Councilperson Owens moved, with a second by Councilperson Hern, to authorize Supervisor Barriere to attend the annual Association of Towns Training to be held in February in New York City and to appoint him our delegate for the Town of Enfield and to authorize the Code Enforcement Officers Alan Teeter and Carl Staley to attend required code enforcement training. Vote: Councilperson Hern aye, Councilperson Owens aye, Deputy Supervisor Teeter aye. Supervisor Barriere and Councilperson Clark absent. Carried Audit Claims: Councilperson Owens moved for the board to authorize the supervisor to pay General Fund vouchers #41-#70 dated February 9, 2011 in the amount of $27,923.24, Highway Fund vouchers #24-#38 dated February 9, 2011 in the amount of $14,304.05 and Fire Department Fund voucher #3 dated February 9, 2011 in the amount of $225,600.00. Councilperson Hern seconded the motion. Vote: Councilperson Hern aye, Councilperson Owens aye, Deputy Supervisor Teeter aye. Supervisor Barriere and Councilperson Clark absent. Carried County Legislator’s Report: Jim Dennis reported Dave McKenna has been appointed to the broadband committee. There will be a meeting February 14 regarding new cell towers for the county. Jim chairs the budget committee. Every department is looking at ways to deal with less funding next year. There were no salary increases for 2011. The governor has proposed a 2% tax cap. For Tompkins County that would amount to $680,000. Supervisor Barriere arrived at this time. Highway Superintendent’s Report: Enfield Town Board Meeting, February 9, 2011 4 Buddy Rollins stated mailboxes have been a major issue this month. Guidelines from the United States Postal Service are available on the town’s website and at the clerk’s office. Mailboxes are often neglected by property owners, and as they age posts may lean towards the road and be hit by a plow. A new broom for the tractor will be delivered this week. A chain broke on a sand spreader and tore up the inside of the spreader, so a new spreader will probably need to be purchased. A bell housing broke on the oldest truck – it is out being repaired. Buddy is pleased with the job his men have done this winter – only one truck has a wing man now. Five people called to compliment the department this week. County Legislator Jim Dennis also received two calls this week saying what a good job the highway department has done this year. Approval of Minutes – January 12, 2011 Regular Meeting: Councilperson Teeter moved, with a second by Supervisor Barriere to approve the minutes of the January 12, 2011 regular town board meeting. Vote: Councilperson Hern abstain, Councilperson Owens aye, Councilperson Teeter aye, Supervisor Barriere aye. Councilperson Clark absent. Carried Code Enforcement Officer’s Report: Alan Teeter reported that in January there were 2 building permits issued or renewed, 3 framing inspections were completed, 1 insulation/energy code inspection was completed, 1 final inspection was completed, 12 progress checks were completed, 1 valid complaint was received, 2 fire and safety inspections were completed and 1 house number was issued. He also mentioned that Sandy Hagin of the Tompkins County Assessment Office was laid off so Gary Bortz is now assigned to Enfield. Committee Reports: Planning Board: Did not meet. Health Insurance Consortium: No update. Enfield Community Council: Marnie Kirchgessner reported the annual meeting was held February 1. Officers were elected as follows: Marnie Kirchgessner, president; Terri Harris, vice- president; Carol Given, treasurer; Sue Howser, secretary. She also reported that cuts in the county budget are expected to impact the teen program. Marnie will be meeting with Cooperative Extension to discuss this problem. Summer camp needs will be a priority in the Community Council’ budget. The Harvest Festival is scheduled for September 17 with a theme of Celebrating and Protecting Enfield’s Natural Wonders. Enfield Volunteer Fire Company: Art Howser reported that in December, 2010 there were 27 calls of which 17 were EMS, 4 motor vehicle accidents, 2 carbon monoxide detector investigations, 1 false 911 call, and 3 mutual aid calls. Training in December included gear inventory, SCBA training, truck and equipment checking, OSHA training. The department sponsored Pack 22 Cub Scout open house along with Schuyler ambulance. Chicken BBQ’s are scheduled for 1/9, 2/13, 3/13 and 4/10. The county put on line the fax notification of fire and rescue calls. Art presented the 2010 Annual Report showing 52 active members, 13 emergency medical technicians and 2 certified first responders. The total responses for 2010 was 337 which included 25 fires, 20 motor vehicle accidents, 237 rescue and EMS calls, 9 service calls, 18 severe weather calls, and 28 mutual aid provided. Personnel hours totaled 7,773 with 2,073 training hours, 2,033 Enfield Town Board Meeting, February 9, 2011 5 response hours and 3,667 station hours. Motor fuel consumed was 228 gallons gasoline and 1,026 gallons diesel. In January, 2011 there were 36 calls of which 26 were EMS, 1 trailer fire, 1 car fire, 1 snowmobile fire, 1 smoke condition, 1 controlled burn of wood pallets, 1 motor vehicle accident, 1 carbon monoxide detector investigation, 1 911 false alarm, 2 mutual aid calls. Training included SCBA training, ice rescue, ropes and knots, backboard, KED and EMS. The department is looking for a car for future extrication training. Four members attended the 2011 Winter Games at Greek Peak. Facilities Manager: Chris Hern stated the awning outside the Community Building will be replaced in the spring. Communication Access Committee: Nothing to report. Facilities Development: Councilperson Owens reported we are out to bid and inquiries have been received. Information is available at the town hall. Personnel Committee: No report. Tompkins County Council of Governments: Councilperson Teeter attended the last meeting and reported Janice Johnson of the Recreation Youth Partnership gave a presentation on the importance of youth programming. Old Business: Deferred Compensation Update: Next Wednesday Dan Kaim will be at the Community Building at 5 p.m. to meet with any town employees interested in more information or signing up. New Business: Amendment for the Dog Control Law: Councilperson Teeter moved to pass the amendment to Local Law #3 of 2010 with a second by Town Supervisor Barriere. Discussion: Councilperson Owens stated we need to hold a public hearing before changing the law, even when it is just an amendment. Councilperson Teeter withdrew her motion. Supervisor Barriere moved, with a second by Councilperson Teeter, to hold a public hearing on the amendment to the Dog Control Law #3 of 2010 at the March meeting beginning at 6:45 p.m. Vote: Councilperson Hern aye, Councilperson Owens aye, Councilperson Teeter aye, Supervisor Barriere aye. Councilperson Clark absent. Carried Planning Board Vacancy: Supervisor Barriere stated he received a recommendation from the Planning Board for Dan Walker who is interested in filling the vacancy on the board. Supervisor Barriere moved to amend Resolution #2011-4 of the Organizational Resolutions to add Dan Walker to the Planning Board filling the vacancy with a term ending December 31, 2015. Councilperson Teeter seconded the motion. Vote: Councilperson Hern aye, Councilperson Owens aye, Councilperson Teeter aye, Supervisor Barriere aye. Councilperson Clark absent. Carried Enfield Town Board Meeting, February 9, 2011 6 Announcements: Supervisor Barriere received a nomination from Ann Rider for Helen W illis Hetherington as the February Volunteer of the Month. Helen has been instrumental in organizing bake sales at fire department chicken BBQs, planting and maintaining planters for the Beautification Committee and volunteering at the food pantry. She makes everyone feel welcome and comfortable when they join the fire company. Highway superintendent Rollins asked when the spring clean up will be held. He wants to make sure it gets in the newsletter this year. Supervisor Barriere replied it will be on the March agenda. Art Howser mentioned the fire company has mailed out the 2011 calendars.
