The second public hearing on the purposed Enfield Volunteer Fire Protection District Contract was held Thursday, March 26, 2009 at the Enfield Community Building,1 82 Enfield Main Road, Ithaca, N. Y. at 7:00 p.m. with Supervisor Podufalski presiding. Present: Supervisor Frank Podufalski, Town Councilperson Roy Barriere, Town Councilperson Stephanie Gaynor, Town clerk Alice Laue. Town Councilperson Herb Masser and Town Councilperson Robert Harvey were absent. Supervisor Podufalski opened the public hearing by leading the assemblage in the Pledge of Allegiance to the Flag. He also read the notice of the public hearing published in the Ithaca Journal. Supervisor Podufalski announced to the assemblage that the public hearing was for comments only and they, the board, were not there for interrogation. Contract has not changed, fourth paragraph of the four paragraphs in question states if none of the above happens then the contract will go forward and after speaking with the Town Attorney he didn’t feel it was worth the extra cost to have them taken out when it does nothing to the contract. He also announced that we have had one public hearing on this and opened the public hearing for comments only no questions, one turn to speak and once everyone has had an opportunity to speak and make comments then we will move forward. Comments: Diane Aramini - When he took office in January, you told us as long as you were in office he was going to do everything the right way and that he should be looking out for the taxpayer. She feels he isn’t doing this. Supervisor responded that he has tried to do so to the best of his ability and he was not there to argue over his ability of what he has done. David Dimmick – He would like the fire company to stand up and answer his concerns and was told by Councilperson Gaynor that it was a public hearing and the fire company didn’t have to do so. Ann Rider – Urged the Town Board to go forward and make sure there is legal fire protection for the residents of the Town of Enfield. Jerry Achilles has concerns about the fire company budget and was directed to put them in writing and send them to the Town Board and they will answer them to the best of their ability and they will be answered when we they get it, not necessarily the night of a Public Hearing & Special Town Board Minutes 3-26-2009 2 board meeting. Fire company questions or concerns should have been asked of them before this hearing. Jack Hubbell – Commented, for the record, that the $280,000 in this contract is not the true figure the taxpayers are paying for fire protection it is nearer to $300,000. After everyone wishing to speak had their one turn Supervisor Podufalski closed the public hearing. Public hearing closed at 7:10 p.m.. SPECIAL TOWN BOARD MEETING MINUTES: Audit Claims: Motion was made by Councilperson Gaynor, seconded by Councilperson Barriere that the Town Board authorizes the Supervisor to pay General Fund vouchers #82 and 83, dated March 26, 2009, in the amount of $26,228.77 and Highway Fund vouchers # 46 and #47, dated March 26, 2009, in the amount of $10,752.00. Discussion: Vote: Councilperson Barriere aye, Councilperson Gaynor aye, Supervisor Podufalski aye, Councilperson Masser and Councilperson Harvey were absent. Three aye votes – two absentees. Motion carried. Old Business: 2009 Enfield Fire Protection Contract. Consensus of the Town Board members present was that the 2009 Enfield Fire Protection District Contract was valid. Motion made by Councilperson Barriere, seconded by Councilperson Gaynor that the Town Board approve the adoption of the 2009 Enfield Fire Protection District Contract and authorizes Supervisor Podufalski to sign the 2009 Enfield Fire Protection District contract. Discussion: Vote: Councilperson Barriere aye, Councilperson Gaynor aye, Supervisor Podufalski aye, Councilperson Masser and Councilperson Harvey were absent. Vote three ayes – two absentees. Adjournment: Motion was made by Supervisor Podufalski, seconded by Councilperson Gaynor that the March 26th, 2009 Special Town Board meeting adjourns. Discussion: Vote: Councilperson Barriere aye, Councilperson Gaynor aye, Supervisor Podufalski aye, Councilperson Masser and Councilperson Harvey were absent. Meeting adjourned at 7:15 p.m...
