TOWN OF ENFIELD
PUBLIC HEARING
and
REGULAR TOWN BOARD
MEETING MINUTES
WEDNESDAY, SEPTEMBER 9, 2009
6:00 P.M.
A public hearing was held on the Enfield Volunteer Fire Company contract
for the year 2010 – 2015 at the Enfield Community Building, 182 Enfield
Main Road, Wednesday, September 9th, 2009 at 6:00 p.m. Supervisor
Podufalski opened the public hearing by leading the assemblage in the
Pledge of Allegiance to the Flag. He also read the public hearing notice
published in the legal section of the Ithaca Journal.
Present: Supervisor Frank Podufalski, Town Councilperson Roy Barriere,
Town Councilperson Stephanie Gaynor, Town Councilperson Robert
Harvey, Highway Superintendent Barry Rollins, Town Clerk Alice Laue.
Town Councilperson Herb Masser was absent.
Questions expressed were: Snow plowing of fire station property and if
highway department would be compensated and shared services.
After all wishing to speak had spoken Supervisor Podufalski closed the
public hearing at 6:05 p.m.
REGULAR TOWN BOARD MEETING MINUTES
The regular town board meeting was opened at 6:06 p.m.
Privilege of the Floor:
David Dimmick spoke on Code of Ethics need a provision for citizens to file
a complaint and financial disclosure.
Correspondence:
Mile Miles resignation from the EMC Council.
Rich Neno’s resignation from the Enfield Planning Board.
Tompkins County Office of the Aging list of workshops.
NYState Public Service week of 9-14-20th Life Line Discount Telephone
Service Awareness Week.

Tompkins County Health Department letter and resolution concerning public
comment period for draft Supplemental EIS on oil, gas and solution mining.
NYMIR notice of proposed rate adjustment for 2010.
Employees Retirement System notice of rate increases.
Tompkins County Sheriff’s 2008 annual report.
NYMIR notification of policy change due to new International dump truck.
Invitation to join TCAD – Tompkins County Area of Development.
Keith Smith’s letter asking to be appointed to the Planning Board.
Audit Claims:
Motion made by Councilperson Gaynor, seconded by Councilperson
Barriere that the Town Board authorizes the supervisor to pay:
General Fund vouchers # 206-226, dated 9-9-2009, in the amount of
$8,105.22.
Highway Fund vouchers # 127-138, dated 9-9-2009, in the amount of
$204,088.17.
Discussion:
Vote: Councilperson Barriere aye, Councilperson Gaynor aye,
Councilperson Harvey aye, Supervisor Podufalski aye. Councilperson
Masser was absent. Motion carried.
Committee/Board Reports:
Tompkins County Board of Representatives – Communication from
Representative Stevenson busy working on budget.
Highway – Highway Superintendent Rollins
Read request from supervisor asking him to provide board with the
following: List of all culvert permits issued from 1-1-09 to present with fees
collected, a list of where crusher run gravel and stone have been used and
the tonnage used, a list of all culverts worked on since 1-1-2009, any work
logs that have been kept of afore mentioned work. Work logs available by
appointment at superintendent’s office for review or copying. Culvert
permits and fees available at clerk’s office and from bookkeeper.
Questioned board’s refusal of benefits and holiday pay for employee hired in
May, who works a 40 hour weeks 5 days a week even when board has been
advised by Attorney for the Town Guy Krogh that this employee is entitled
to benefits and holiday pay and is a full time employee. This might be a
repercussion against the town. In response to his requests to meet with the

Board to talk over issues about the town’s highways and superintendent
issues he received three responses from Councilperson Harvey and one from
Councilperson Barriere. None from any of the other board members.
Hope to pave Fish Road next week, on schedule with Suit-Kote to do.
Rumor Route 79 Bridge to open this Friday. Bostwick Road he is still
waiting to schedule paver from county.
Code Enforcement- Alan Teeter
Reviewed attached written report. Fence on Route 327- met with owner,
previous Code Officer asked that fence be put up, fence 26 feet from center
of road, Code Officer Teeter measured and fence is just over 26 feet from
center of road. Code Officer Teeter asked that board consider rewriting Mass
gathering Law. Present law requires a mass gathering permit for 1500 people
or more, he suggested that it be lowered.
Enfield Community Council – Ann Rider, Vice President
Biggest program of the year is Summer Camp. Camp finished with 99
campers, received positive comments on the site, great cooperation from
Treman Park superintendent and employees. ECC employed 30 people with
only two not being town residents and ECC ran over a $30,000.00 payroll
over the six week camp period. Harvest Festival September 19, 2009,
volunteers welcome.
Enfield Volunteer Fire Company – Chief Switzer\Open House at fire station
October 3rd from 10:00 a.m. to 2:00 p.m.
Facilities Building Manager – Councilperson Barriere had nothing to report.
Facilities Planning Committee –
Clearity Connect representative to be here tonight or at next board meeting
to report on broadband.
Planning Board – no report.
Tompkins County Council of Government – Councilperson Gaynor
Board of Directors met last Monday and talked about responsibilities of the
board, which will be to lower the administration budget.

Election of Officers -decided to have a nominating committee to come back
with nominations. Voted to authorize the start of the health plan and voted
to have Excellus Blue Cross – Blue Shield be the third party administrator.
Next meeting nominate officers, hire a prescription benefit manager, adopt
the plans, establish the rates, enter into an agreement with Excellus, and hire
an accountant. Meeting to be fourth Thursday of the month at 5:30 p.m.
Councilperson Barrieere reported that Ed Marx, County Planning working
with gas drilling committee on a local law.
Old Business:
Discussion Regarding Pay Scale for Newly Hired Highway Motor
Equipment Operators.
Town has a pay scale for part time seasonal workers, pay scale for full time
MEO’s but not newly hired MEO’s. Supervisor would like opinions from
the board on where we need to go on this. Discussed – need of having a plan
in place, pay scale - are we going to follow a job description or a time line?
Recommended that superintendent bring his plan to the board. Need to have
full board in attendance on any discussion. Supervisor recommended that
Councilperson Masser and Highway Superintendent Rollins meet and come
up with some kind of plan for the board to look at and possibly put into
effect. Supervisor to talk with Councilperson Masser.
Truck Issues:
Supervisor read a list of highway superintendent’s issues with the new truck
and dealership’s response to these concerns. Supervisor recommended that
we do what we can in house and not spend the money on the extras that are
not necessary at this time, but spend it later if necessary.
New Business:
Tompkins County Code of Ethics for Town of Enfield Possible Adoptions.
Copies of county’s Code of Ethics put in board members boxes. Supervisor
asked head of county board’s Code of Ethics if after we looked at their Code
of Ethics if it was possible for the Town of Enfield to adopt it and it was
recommended that the Town of Ithaca Code of Ethics be looked at also.
Consensus: Obtain a copy of Town of Ithaca’s Code of Ethics to look and
make some kind of decision to upgrade our Code of Ethics and at some point
possibly create a Board of Ethics that could serve Enfield and others as well.

Planning Board New Member:
Supervisor Podufalski nominated Keith Smith to fill one of the two
vacancies on the Enfield Planning Board.
Motion made by Supervisor Podufalski, seconded by Councilperson Harvey
that Keith Smith be appointed to the Town of Enfield Planning Board. Term
ending December 31, 2016.
Discussion:
Vote: Councilperson Barriere aye, Councilperson Gaynor aye,
Counmcilperson Harvey aye, Supervisor Podufalski aye, Councilperson
Masser was absent.
Enfield Volunteer Fire Company Contract:
Motion made by Councilperson Gaynor, seconded by Councilperson
Barriere that the Town Board accept the Enfield Volunteer Fire Company
five year contract and authorizes the supervisor to sign same.
Discussion: Shared services, Fire Company have shared services- mutual
aid. Any thing more is called a paid fire department.

Councilperson Harvey aye, Supervisor Podufalski aye, Councilperson
Masser was absent.
1988 Ford 6 Tractor:
Highway Superintendent Rollins presented a request to purchase a 1988
Ford 6 tractor owned by the county that is being sold at the Lansing Auction
September 12, 2009.
Discussed age of tractor, need for it to come out of this year’s line item –
Equipment line item. Amount of money in equipment line as of end of last
month, approximately $95,000.00 which does not include CHIPS money.
Consensus – Look at state bids for a tractor for next year. Research this item
so it can be taken out of Equipment Reserve next year.

Motion made by Councilperson Barriere, seconded by Supervisor Podufalsk
that the meeting adjourns.
