REGULAR TOWN BOARD
MEETING MINUTES
WEDNESDAY, JUNE 10TH, 2009
7:00 P.M.
The regular monthly meeting of the Town of Enfield Town Board was held Wednesday,
June 10th, 2009 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, N.Y.
at 7:00 p.m... with Supervisor Podufalski presiding.
Present: Supervisor Frank Podufalski, Town Councilperson Roy Barriere, Town
Councilperson Herb Masser, Town Councilperson Robert Harvey, Highway
Superintendent Barry Rollins, Town Clerk Alice Laue. Town Councilperson Stephanie
Gaynor was absent.
Pledge of Allegiance to the Flag:
Supervisor Podufalski led the assemblage in the Pledge of Allegiance to the Flag.
Privilege of the Floor:
Supervisor Podufalski read the rules and guidelines concerning Privilege of the Floor.
Privilege of the Floor to be held after the Pledge of Allegiance to the Flag with a three
minute per person speaking time. Beginning at the next board meeting a Privilege of the
Floor sign in sheet will be available before the meeting and anyone wishing to speak
needs to sign in giving their name and a brief description of what they are going to be
speaking about.
Scottish Games Festival – Mary Bishop
Second annual festival to be held July 11th, 2009 at Pine Creek Campgrounds. Festival to
include bagpipe competition, dancing, athletic games, food, crafts and more. Festival
starting at 8:00 a.m. Insurance certificate still needs to be obtained.
Motion made by Supervisor Podufalski, seconded by Councilperson Barriere that the
board approve the issuance of a mass gathering permit and authorizes the Code
Enforcement Office to issue this permit with the restriction that the insurance certificate
be in place by the July 8th, 2009 board meeting.
Discussion:
Vote: Councilperson Barriere aye, Councilperson Masser aye, Councilperson Harvey aye,
Supervisor Podufalski aye. Councilperson Gaynor was absent. Motion carried.
Approval of the May 13th, 2009 Minutes:
Motion made Councilperson Masser, seconded by Supervisor Podufalski that the Town
Board approves the May 13, 2009 regular Town Board minutes.
Discussion:
Vote: Councilperson Barriere abstained, Councilperson Masser aye, Councilperson
Harvey aye, Supervisor Podufalski aye, Councilperson Gaynor was absent. Motion
carried.

Correspondence:
Sue Thompson, Historian, e-mail – Enfield Historical Society meeting Wednesday, July
17th at 7:00 p.m. at the community building.
Enfield Volunteer Fire Company Ladies Auxiliary – Developing a Fire Prevention Safety
Calendar to be distributed to all Enfield residents.
TCAD fax memo – Resolution supporting county’s grant application to research Water
and Sewage Treatment facilities countywide. – Consensus of the board was Supervisor
Podufalski to support resolution at TCCOG meeting.
Motion made by Councilperson Barriere, seconded by Councilperson Masser that
Supervisor Podufalski supports this resolution at the next TCCOG meeting.
Discussion:
Vote: Councilperson Barriere aye, Councilperson Masser aye, Councilperson Harvey aye,
Supervisor Podufalski aye, Councilperson Gaynor was absent. Motion carried.
Audit Claims:
Motion made by Councilperson Barriere, seconded by Councilperson Harvey that the
Town Board authorizes Supervisor Podufalski to pay:
General Fund Vouchers # 143 – 162, dated June 10, 2009, in the amount of
$25,677.60.
Highway Fund Vouchers # 63 – 95, dated June 10, 2009, in the amount of
$22,057.82.
Discussion: Bill description needs to be on all vouchers, i.e. Highway vouchers pipe-
what kind and where used. Replacement of windshield and back window, do we have
glass insurance coverage? Supervisor Podufalski stated Highway Superintendent needed
to answer these questions.

Supervisor Podufalski aye, Councilperson Gaynor was absent. Motion carried.
Committees/Reports:
Enfield Tompkins County Board of Legislation Representative Dennis.
Sales tax has diminished eight percent a quarter this year, spending more money in social
services areas, i.e. food stamps demand has gone up due to economy. Legislation this
year fixed a three percent levy increase. Urged town to join Health Consortium.
Highway: - Superintendent Rollins.
Superintendent Rollins presented the 284 Agreement to Spend Highway Funds.
Agreement doesn’t require a resolution; it requires three signatures from board members.
Only thing that is not to be paid if agreement isn’t signed is materials for road
maintenance, all other bills should be paid.
E-mailed Town Board members four times last month to meet to get agreement signed
and received only two responses ( Harvey and Barriere). Agreement last year was done
under 44.5 miles instead of projects.
Superintendent Rollins asked for a resolution allowing him to participate in the county’s
bidding process. He also requested a resolution allowing him to purchase a plate tamper.

Discussed purchasing a plate tamper or renting/ borrowing one. If purchased it would be
available when needed where renting/ borrowing one has its draw backs, availability
when needed, and waste of man time going to and returning a rented or borrowed one.
Priced one at $1,450.00 from Volvo Rentals.
Asked about amending CHIPS fund budget line and was advised by the Supervisor that
CHIPS would be amended when funds were received.
Concerned about $750.00 taken out of Traffic Control budget line last month. When he
ordered new signs using $479.00 grant money he was advised that you had to order all
the signs being replaced at one time in order to use grant money. Grant money is applied
to signs ordered and doesn’t go through town funds.
Concerned about roller, there are safety issues. Need to look at replacing the roller
possibly next year. Supervisor Podufalski suggested that at budget time a proposal is put
together and a price be put in budget as an equipment line item and see what the town can
afford to do.
To answer questions: Pipe (culvert) is sometimes purchased ahead of time to have on
hand, gravel is stock piled for road projects, we don’t have the time or means to go after
individual loads of gravel when doing a road project. Glass replacement was in pick up
truck. Replaced windshield because it was badly scratched and back window hit with a
board and shattered. So had windshield replaced at the same time as back window and
also have two dump trucks that need window replacements. Called insurance company
and there is no glass coverage all they cover under glass coverage is police cars.
Plate Tamper – Supervisor Podufalski asked Highway Superintendent Rollins to get a
couple of quotes on a plate tamper. Supervisor Podufalski will bring up a resolution at the
next board meeting for which ever one is the best price for plate tamper.
Aiken Road – Traffic complaints, Highway Superintendent contacted bridge contractor
and he will put up no through traffic signs. Also contacted the Sheriff’s Department and
Sheriff’s Department to up patrol.
Code Enforcement – Alan Teeter
Reviewed written report – Issued or renewed 8 building permits for a total of 28 this year.
11 Certificated of Occupancy for completion, 24 inspections, received 1 complaint listing
multiple violations, investigated complaint, some were valid and all have been resolved.
4 faxes, issued 10 Orders to Remedy, received 61 phone calls, performed 5 Fire Safety
inspections at public assemblies, 2 Fire Safety inspections at multiple residents, installed
2 house numbers. Mecklenburg Road apartment project still on hold, waiting for a Site
Plan Approval and Septic and Water permits form Health Department. Public Hearing
two weeks from tonight on Site Plan Review.
Enfield Community Council – Ann Rider
Summer Camp starts July 6, 2009, still taking applications. Camp to be held at Treman
Park. Paid positions at camp for Junior Counselors are available.
Beautification Committee – Missing Welcome to Enfield sigh has been returned. Will not
pursue prosecution and those who contributed to the reward fund will be reimbursed.

Enfield Volunteer Fire Company – Art Howser
Reviewed written report – 22 calls – 14 EMS calls – 4 MVA calls – 3 times requested
Medical Health Helicopter – 1 House fire , out on arrival - 3 severe weather calls – 106
calls at the end of May.
Facilities Manager – Councilperson Barriere
All community building issues taken care of. Night Owl Construction starting counter
work in town hall around June 24, 2009.
Facilities Planning Committee – Councilperson Masser
Still working on broadband. Need county working with provider to get funding.
Highway Facilities – Supervisor Podufalski
Looking into financing available. Trying to schedule a meeting with RWR Funding to
find out what it would cost. Estimate of price on building, close to being able to go out to
bid, biggest concern now is can we afford it, what will it cost in the long run to get it
done and paid for. As soon as he has information regarding financing he will let board
members know. Doesn’t know if we will have to bond, depends on amount we are
financing. At this point looking at about 1.5 million dollars total which is all site work
septic systems, providing actual highway facilities, salt shed, wash bay. Overall picture
we may have half the money on hand. Bare bone design, Morton type structure.
Planning Board – Debbie Teeter
Met with Orson Ledger to start Site Plan Review process for Mecklenburg Road project.
Waiting for Water and Septic permits from Health Department. Public hearing scheduled
for June 24, 2009 at 7:00 p.m...
Tompkins County Council of Government – Councilperson Barriere
TCCOG passed a resolution to move forward with Health Consortium setting a sign on
date for 8/1/2009. Steve Locey to be at our next board meeting.
Animal Control – SPCA continuing with animal control for another year at the same rate
we paid this year.
Sub Committee working on Cell Towers chaired by Martha Robinson. She would like
input from each municipality.
Old Business:
284 Agreement to Spend Highway Funds
Basic agreement showing what is going to be done and cost involved. Majority of work
on Fish, Bostwick and Harvey Hill Roads.
Supervisor Podufalsk made a motion to accept the agreement as written. Seconded by
Councilperson Barriere.
Discussion:

Resolution #16-2009
Authorization of Town Officials to Contact Attorney for the Town.
Moved by Supervisor Podufalski, seconded by Councilperson Barriere.
WHEREAS, it is the responsibility of the Enfield Town Board to spend taxpayer funds in
a responsible manner, and
WHEREAS, attorney costs for the town are increasing at a rapid rate,
Now, Therefore Be It Resolved, that all Town of Enfield officials will get authorization
from the Supervisor before contacting the Attorney for the Town, effective immediately,
and the Supervisor shall contact one councilperson prior to contacting the Town’s
Attorney,
Be It Further Resolved, that this resolution supersedes all resolutions and policies
adopted by the Town Board addressing the procedures for contacting the Attorney for the
Town prior to this date.
Discussion: Who the Supervisor contacts prior to contacting the Attorney for the Town.
Supervisor is to contact one councilperson for authorization to contact the Attorney for
the Town.

Hiring of Legal Firm with Expertise in Wind Farm Development: - Supervisor Podufalski
John Rancich is to present Site Plan Review at July board meeting.
To protect the Town’s interest in legal work needing to be done on the Wind Farm
Development as the law states most towns that have gone through this process hire a
legal firm or an engineering firm specializing in Wind Farm development procedures to
do the paperwork, permits, SEQR, reviews, any testing that needs to be done ahead of
time, development agreement, making sure everything is done according to the law.
Supervisor has scheduled a meeting with four different firms that specialize in this type
of work, LaBella Associates, an engineering firm out of Rochester, Harris Beach, a legal
firm and Delaney Group out of Gloversville, N.Y. who not only installs but does prep
work also. Supervisor Podufalski asked Councilperson Barriere to accompany him to
look at their presentations and after looking at presentations they will come back to the
board with their recommendation on who best fits the town’s needs. Any costs to the
town for all the services will be born by the developer.
Public Hearing: - Proposed Amendment to Town of Enfield Site Plan Review Law.
Proposal amendment concerns amending Section 2.1 of Local Law #1 of the year 1999
which amended Local Law #1 of the year 1998. Attorney for the Town to put together the
public hearing notice for the paper regarding the amendment.

Motion made by Supervisor Podufalski, seconded by Councilperson Masser that the
Town Board hold a public hearing on the Proposed Amendment to Town of Enfield Site
Plan Review Law on July 8, 2009 at 6:45 p.m..
Discussion:
Vote: Councilperson Barriere aye, Councilperson Masser aye, Councilperson Harvey aye,
Supervisor Podufalski aye, Councilperson Gaynor was absent. Motion carried.
Executive Session:
Supervisor Podufalski entertained a motion to go into Executive Session to discuss a
personnel issue involving a possible legal action. Motion made by Councilperson Masser,
seconded by Supervisor Podufalski.
Discussion:
Vote: Councilperson Barriere aye, Councilperson Masser aye, Councilperson Harvey aye,
Supervisor Podufalsk aye, Counsilperson Gaynor was absent. Motion carried.
Supervisor Podufalsk appointed Councilperson Barriere to take minutes of Executive
Session
Board to come back into regular session following the Executive Session.
