HomeMy WebLinkAboutdec 9 2009.pdfTown of Enfield Public Hearings and Regular Town Board Meeting Minutes Wednesday, December 9, 2009 6:50 p.m. and 6:55 p.m. A public hearing regarding the Enfield Senior Citizens Contract was held Wednesday, December 9, 2009 at 6:52 p.m. at the Enfield Community Building, 182 Enfield Main Road, Ithaca, New York with Supervisor Podufalski presiding. Present: Supervisor Frank Podufalski, Town Councilperson Roy Barriere, Town Councilperson Robert Harvey, and Town Councilperson Herb Masser and Town Clerk Alice Laue Absent: Town Councilperson Stephanie Gaynor and Highway Superintendent Barry Rollins Supervisor Podufalski opened the public hearing by leading the assemblage in the Pledge of Allegiance to the Flag. Supervisor Podufalski also read the notice of the public hearing published in the Ithaca Journal and limited those wishing to speak to a three minute time limit. No one wished to speak and the hearing was closed. A public hearing regarding the Tompkins County Animal Control Contract was held Wednesday, December 9, 2009 at 6:54 p.m. at the Enfield Community Building, 182 Enfield Main Road, Ithaca, New York with Supervisor presiding. Supervisor Podufalski read the notice of the public hearing published in the Ithaca Journal and limited those wishing to speak to a three minute time limit. No one wished to speak and the hearing was closed. REGULAR TOWN BOARD MEETING MINUTES The regular monthly Town Board meeting was held directly after the close of the public hearings with Supervisor Podufalski presiding. Privilege of the Floor: Nancy Spero of 68 N. VanDorn Road spoke regarding her concerns about proposed gas drilling. Charlie Elrod of 101 Rockwell Road spoke of concerns about development of the Marcellus Shale. John Rancich of 367 Hines Road requested the Board sign a one year simple land lease with him for property he owns that the town uses across from the Town Highway Department. Presentation of Permit Application by Enfield Energy Wind Project: John Rancich and Marguerite Wells presented 6 copies of an application to the town for the Black Oak Wind Farm. The town clerk will review the application and bring it back to the Board within 30 days. Approval of Minutes: October 14, 2009 Regular Town Board Minutes: Motion made by Councilperson Barriere, seconded by Councilperson Harvey that the October 14, 2009 regular Town Board Meeting Minutes be approved as written. November 11, 2009 Regular Town Board Minutes: Motion made by Councilperson Barriere, seconded by Councilperson Harvey that the November 11, 2009 regular Town Board Meeting Minutes be approved as written. November 18, 2009 Town Board Workshop Meeting Minutes: Motion made by Councilperson Barriere, seconded by Supervisor Podufalski that the November 18, 2009 Town Board Workshop Meeting Minutes be approved as written. Discussion: Vote: Councilperson Barriere, aye, Councilperson Masser aye, Councilperson Harvey abstain, Supervisor Podufalski aye. Councilperson Gaynor absent. Motion carried. Correspondence: Department of Assessment – Letter regarding personnel changes and request to receive Enfield Town Board Minutes Copy of Dryden Town Board Resolution – Draft supplemental generic environmental impact statement in the Marcellus Shale matter College of Architecture, Art and Planning at Cornell University – Letter regarding summer internships Youth Services Department – County youth services claims for 2009: $5,585 awarded, $723.31 balance left Budget Amendments and Resolutions: Resolution #28 (BA #6) Amending general fund budget lines to allocate monies where they are most needed in the 2009 Enfield Town Budget. Resolution #29 (BA #7) Amending highway fund budget lines to allocate monies where they are most needed in the 2009 Enfield Town Budget. Resolution #30 (BA #8) Transfer of funds from the Highway Fund Account to the Equipment Reserve Fund (Resolution Attached) Moved by Councilperson Barriere, seconded by Councilperson Harvey. Resolution carried. Audit Claims: Motion made by Councilperson Barriere, seconded by Councilperson Masser that the Town Board authorizes the supervisor to pay: General Fund Vouchers #269-291, dated December 9, 2009 in the amount of $12,724.72, excluding the sales tax on the Halco voucher #278 in the amount of $74.40 for a final total of $12,650.32 and Highway Fund Vouchers #175-193, dated December 2, 2009 in the amount of $72,240.62. Committee/Board Reports: Tompkins County Board of Representatives: Letter received from Enfield County Legislator Greg Stevenson expressing pleasure in working with the Enfield Town Board over the last 4 years. Enfield County Legislator-Elect David McKenna reported the Tompkins County Transportation Council is working on a 20 year plan for 40% carbon reduction by 2030. The legislature is proposing wording changes to legislative rules and procedures and made changes to five policies in the administration manual. Highway – No report. Code Enforcement – Alan Teeter Reviewed attached written report. While working on updating records, it was discovered a refund is due a homeowner from 1986. Enfield Community Council – No report. The Community Council submitted a quarterly report and annual report to the supervisor this month. Enfield Volunteer Fire Company – Alan Teeter Reviewed attached written report. Facilities Building Manager – Roy Barriere The furnaces in Community Building and Town Hall are all set. Town would like to switch electric service to MEGA (Municipal Electric and Gas Alliance) since rates will be less expensive. Motion made by Supervisor Podufalski, seconded by Councilperson Harvey to switch electric service to MEGA. Facilities Planning Committee – Councilperson Masser Enfield Town Board Minutes December 9, 2009 4 Reported that January 1, 2010 Enfield will be joining other towns to form the Greater Tompkins County Health Consortium, an organization created for the sole purpose of providing insurance benefits to employees and retirees that are equal to or greater than those now received, and at a lower cost to taxpayers. Planning Board – James McConkey The Planning Board will be reviewing the whole site plan review law and then present changes to the Town Board. The Planning Board has received an initial sketch review on a proposed subdivision development on Route 327 between the Upper Treman Park entrance and Hines Road. The Planning Board is looking at possible hazards of gas drilling proposals, especially aquifer concerns – want to protect our natural resources. Tompkins County Council of Governments – Supervisor Podufalski Reported the Council is looking at Marcellus Shale gas drilling issues, the health consortium contract and the dog control contract. Old Business: Motion made by Councilperson Barriere, seconded by Supervisor Podufalski to authorize Supervisor Podufalski to sign the three year Animal Control Services Agreement with the SPCA of Tompkins County dba: Tompkins County Animal Control (TCAC) for dog control at a price of $10,608 in 2010 and the price in 2011 and 2012 to be determined by TCAC. (Agreement attached) Discussion: This is an agreement, not a contract. A dog enumeration is planned for 2010. As of January 1 Enfield will receive the town share of dog license fees collected instead of Dryden. Motion made by Councilperson Barriere, seconded by Supervisor Podufalski to authorize Supervisor Podufalski to enter into a contract with the Enfield Senior Citizens and authorize the supervisor to sign the contract with the Enfield Senior Citizens (contract attached) to become effective January 1, 2010. Discussion: Town is asking for a report one time per year that is required by law. Vote: Councilperson Barriere aye, Councilperson Masser aye, Councilperson Harvey aye, Supervisor Podufalski aye. Councilperson Gaynor absent. Motion carried. New Business: Scheduling of Hearing on Site Plan Review Law is postponed until further notice as the Planning Board would like to further refine the law. Department of Environmental Conservation Environmental Impact Statement on Gas Drilling: Resolution #31 Motion made by Councilperson Masser, seconded by Councilperson Harvey to request Governor David A. Paterson to withdraw the draft Supplemental Generic Environmental Impact Statement Related to Horizontal Drilling and High-Volume Hydraulic Fracturing to Develop Marcellus Shale and Other Low- Permeability Gas Reservoirs. Discussion: This request needs to be submitted by December 31, 2009. Motion carried. Mass Gathering Permit Changes: Currently a gathering of over 1,500 needs a permit. After discussion the Code Enforcement Officer was asked to check the difference between a gathering of 400 and 1,500 and do a presentation to the Board in January if possible. Building Permit Refund: Motion made by Supervisor Podufalski, seconded by Councilperson Masser to refund the owner of 100 North Applegate Road the $100 application fee for a building permit issued September 30, 1986 for construction begun in 1984 before a building permit was required. Announcements: Alice Laue was thanked for her 16 years as Enfield Town Clerk. Councilperson Masser, Councilperson Harvey and Supervisor Podufalski will be leaving the board as of December 31, 2009. Councilperson Barriere will become supervisor January 1, 2010 and is calling a Special Board Meeting at 6:30 p.m. on January 6, 2010 for a short presentation by TCAT regarding feeder bus service for Enfield and Newfield followed by an organizational meeting at which time the Board will go over organizational resolutions and will review applicants who have submitted letters of interest for the Town Board vacancy. The Enfield Beautification Committee was thanked for making the town look good this winter. A Certificate of Appreciation was presented to Town Clerk, Alice Laue for her service from 1994-2009.
