The regular monthly meeting of the Town of Enfield Town Board was held Wednesday, August 12, 2009 at 7:00 p.m. at the Enfield Community Building, 182 Enfield Main Road, Ithaca, N. Y. with Supervisor Podufalski presiding. Present: Supervisor Frank Podufalski, Town Councilperson Roy Barriere, Town Councilperson Herb Masser, Highway Superintendent Barry Rollins and Town Clerk Alice Laue. Town Councilperson Stephanie Gaynor and Town Councilperson Robert Harvey were absent. Pledge of Allegiance to the Flag: Supervisor Podufalski led the assemblage in the Pledge of Allegiance to the Flag. Privilege of the Floor: No one wished to speak. Correspondence: Tompkins County Water Resource Council letter seeking application from representatives of municipal governments. State of New York Unified Court System letter asking for copies of justices audit reports. Public Employee Risk Management Association, Inc. invitation to join PERM. Resolution #21-2009 – Budget Amendment. (Attached). Moved by: Councilperson Barriere , seconded by Councilperson Masser. Discussion: Vote: Coucilperson Barriere aye, Councilperson Masser aye, Supervisor Podufalski aye. Councilperson Gaynor and Councilperson Harvey were absent. Resolution carried. Audit Claims: Motion made by Councilperson Barriere, seconded by Councilperson Masser authorizing the Supervisor to pay General Fund vouchers #176-205, dated August 12, 2009, in the amount of $33,308.91 and Highway Fund vouchers # 115-125, dated August 12, 2009, in the amount of $19,326.04. Discussion: Vote: Councilperson Barriere aye, Councilperson Masser aye, Supervisor Podufalsk aye. Councilperson Gaynor and Councilperson Harvey were absent. Motion carried. Committees/Reports: Tompkins County Board of Representatives – no report. Regular Town Board Meeting Minutes 8-12-2009 2 Highway – Superintendent Rollins Superintendent Rollins presented an Amended 284 – Agreement to Spend Highway Funds. Amended 284 cancels work on Harvey Hill Road and adds money to Bostwick and Fish Road. Motion made by Councilperson Barriee, seconded by Councilperson Masser that the Town Board accept the Amended 284 – Agreement to Spend Highway Funds. Discussion: Vote: Councilperson Barriere aye, Councilperson Masser aye, Supervisor Podufalski aye. Councilperson Gaynor and Councilperson Harvey were absent. Motion carried. Waiting to hear from the County about using their paver. Cost to rent a paver may be around $2,000.00 a day. T and L’d first and second miles of Harvey Hill Road and T and L’d Griffin Road past lodge with cold mix. T and L’d last mile of Harvey Hill Road, Griffin Road, VanDorn Road. Cutting shoulders on Porter Hill and Stone House Road. Highway Superintendent asked about pay scale for MEO he requested in March. There was a pay scale that was dropped in 2006. Code Enforcement – Alan Teeter Reviewed attached written report. Orson Ledger has received approval from Department of Health for his sewage system and water system and has permits for same. He has Site Plan approval from the town’s Planning Board and DEC. Enfield Community Council – no report. Enfield Volunteer Fire Company – Art Howser Reviewed attached written report. Facilities Building Manager – Councilperson Roy Barriere Received an e-mail about applying for an energy audit of town facilities and he will be looking into this. Facilities Planning - Councilperson Masser After attending the last TCCOG meeting and presented what Enfield has on broadband, he feels he is back at square one on broad banding but is checking out other areas that show promise for good affordable broadband. Recreational Partnership – Marnie Kirchgessner Because of increased rates of participation of Enfield children in partnership programs for 2008 this year’s request for the Town of Enfield will go down from $5,734.00 to $5,546.00. Planning Board – no report. Regular Town Board Meeting Minutes 8-12-2009 3 Tompkins County Council of Governments – Supervisor Podufalski Health Insurance at point where ready to put together a Board of Directors. Supervisor has a resolution to appoint a director and alternate to the Board of Directors of the greater Tompkins County Health Insurance Consortium. Natural gas drilling discussed. Animal Control – Cornell University and SPCA collaborating on a new vet clinic. SPCA will be separated into two separate units. 1- Cruelty to Animals 2. Tompkins County Animal Control not for Profit. Contract for 2010 same as this year. Cell Tower issues brought up; there are certain areas in the County with excellent services and others with none. Water Sewer Infrastructure Grant- TCCOG working on getting a supporting resolution. Old Business: Resolution #22-2009 Appoint Director and Alternate to Board of Directors of the greater Tompkins County Health Insurance Consortium. Moved by: Supervisor Podufalski Seconded by: Councilperson Barriere WHEREAS, in 2007 the County on behalf of Tompkins County Council of Governments Health Insurance Consortium accepted a grant award under New York State Shared Municipality program, and WHEREAS, the grant assisted the municipalities in Tompkins County to create a local health insurance consortium with the intent to provide a net savings to the taxpayers of Tompkins County, and WHEREAS, Town of Enfield joined the greater Tompkins County Health Insurance Consortium via a resolution dated 7-8-2009, and WHERERAS, the resolution includes the provision for this municipality to enter into an inter-municipal agreement that outlines duties of the Board of Directors which is charged with the operation of the consortium, and WHEREAS, each participating municipality must appoint a director to the Board of Directors who can vote on behalf of the municipality, now therefore be it RESOLVED, on recommendation of the Town Board that the Town of Enfield hereby appoints Herb Masser to serve as this municipality’s voting director of the Board of directors and appoints Stephanie Gaynor to serve as an alternate who can vote in the absence of the director Discussion: Vote: Councilperson Barriere aye, Councilperson Masser aye, Supervisor Podufalski aye, Councilperson Gaynor and Councilperson Harvey were absent. Resolution carried. Resolution #23-2009 – Enforcement of Memorandum of Understanding and Pledge to Work with Economic Development Collaborative for County-Wide Evaluation of Existing Water and Sewer Infrastructure ( Resolution attached.). Moved by: Supervisor Podufaski Seconded by: Councilperson Barriere Discussion: Regular Town Board Meeting Minutes 8-12-2009 4 Vote: Councilperson Barriere aye, Councilperson Masser aye, Supervisor Podufalski aye, Councilperson Gaynor and Councilperson Harvey were absent. Resolution #24-2009 – Amendment to Local Law #1-1999 Moved by: Councilperson Masser Seconded by: Coucilperson Barriere WHERES, the Enfield Planning Board unanimously passed a motion at their September 3, 2008 meeting to send a proposed draft amendment for review and incorporation into the current Site Plan Review law of the year 1999, and WHEREAS, the Enfield Town Board has reviewed the proposed draft amendment and has held a public hearing on the proposed amendment, now therefore be it RESOLVED, Local Law #2 of the year 2009 Site Plan Review Law be enacted by the Enfield Town Board as follows: Section 1. Purpose This law is necessary to amend Section 2.1 of Local Law No. 1 of 1999 to add the following paragraph 6, which contains the following provisions: Any communication or other tower more than 100’ (feet) above ground level, except for temporary towers having negligible or no permanent impact on the environment and for which permits have been granted, Section 2. Amendment Section 2.1 of Local Law No. 1 of 1999 is hereby amended to add the following paragraph 6. #6. Any communication or other tower more than 100’ (feet) above ground level, except for temporary towers having negligible or no permanent impact on the environment and for which permits have been granted. Section 3. Effective Date This law shall become effective upon filing in the Office of the Secretary of State. Discussion: Vote: Councilperson Barriere aye, Councilperson Masser aye, Supervisor Podufalski aye, Councilperson Gaynor and Councilperson Harvey were absent. Resolution carried. New Business: Fire Protection Contract – Five year contract with no increase in 2010, two percent increase each year after that until 2014. Rest of contract is same as this year. Motion made by Councilperson Barriere, seconded by Councilperson Masser that the Town Board hold a public hearing on the Fire Protection Contract Wednesday, September 9, 2009 at 6:00 p.m. Public hearing to be followed by the regular monthly town board meeting. Discussion: Vote: Councilperson Barriere aye, Councilperson Masser aye, Supervisor Podufalski aye, Councilperson Gaynor and Councilperson Harvey were absent. Motion carried. Regular Town Board Meeting Minutes 8-12-2009 5 Budget: Supervisor requesting budget numbers from all departments and is asking for no pay increases in wages and zero increases in budget lines if possible. New Truck: Truck approved by Town Board in November 2008 at a cost of $194,215.20. Supervisor Podufalski asked for a motion to pay for truck out of Highway Equipment Reserve Fund. Motion made by Councilperson Barriere, seconded by Councilperson Masser authorizing the Supervisor to pay for the truck in the amo9unt of $194,215.20 with payment to be made from Highway Equipment Reserve Fund. Discussion: Vote: Councilperson Barriere aye, Councilperson Masser aye, Supervisor Podufalski aye, Councilperson Gaynor and Councilperson Harvey were absent. Motion carried. Supervisor Podufalski turned paperwork on truck over to the Highway Superintendent. Adjournment: Motion made by Councilperson Barriere, seconded by Councilperson Masser that the meeting adjourns.
