The regular monthly meeting of the Town of Enfield Town Board was held Wednesday, April 8th, 2009 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, NY at 7:00 p.m. with Supervisor Podufalski presiding. Present: Supervisor Frank Podufalski, Town Councilperson Roy Barriere, Town Councilperson Stephanie Gayner, Town Councilperson Robert Harvey, Town Councilperson Herb Masser, Highway Superintendent Barry Rollins, Town Clerk Alice Laue and Deputy Town Clerk Pat Dougherty. Pledge of Allegiance to the Flag: Supervisor Podufalski led the assemblage in the Pledge of Allegiance to the Flag. HUD Grant: John Spence from Better Housing spoke about resubmitting a housing development grant for the Town of Enfield. Grant needs to be submitted by April 24th, 2009. Approval of 3/11/2009 and 3/26/2009 Minutes: Correction to 3/11/2009 Minutes – Delete entire section regarding Executive Session minutes. Motion made by Councilperson Harvey, seconded by Supervisor Podufalski that the Town Board approve the adoption of the 3/11/2009 minutes as amended and approve the adoption of the 3/26/2009 minutes. Discussion: Vote: Councilperson Barriere aye, Councilperson Masser aye, Councilperson Harvey aye, Councilperson Gayner aye, Supervisor Podufalski aye, Motion carried Correspondence: Request from Sue Thompson in regards to Celebration Grant 2008 asking that the $300.00 grant be returned to the Strategic Tourism Planning Board. Grant was for WCTU of Enfield meeting and tea. Motion made by Supervisor Podufalski, seconded by Councilperson Harvey that the Town of Enfield return the $300.00 Celebration Grant 2008 money to the Strategic Tourism Planning Board. Bishop Sheen Housing looking to do work in Enfield area. Retired Employees Association, Inc.-Finger Lakes New York holding a free pre- retirement seminar May 20, 2009. Regular 4/8/2009 Town Board Meeting Minutes 2 New York State Emergency Management Office – Public Assistance Workshop – 4/16/2009. Excellus letter regarding COBRA health insurance premium. Assessment Review – May 6, 2009 – Town Hall 3-6 p.m. Audit Claims: Motion made by Councilperson Gayner, seconded by Councilperson Harvey that the Town Board authorizes the Town Supervisor to pay: General Fund vouchers # 84 – 110, dated 4/8/2009, in the amount of $10.099.63. Highway Fund vouchers #46-62, dated 4/8/2009, in the amount of $6,272.92. Discussion: Vote: Councilperson Barriere aye, Councilperson Masser aye, Councilperson Harvey aye, Councilperson Gayner aye, Supervisor Podufalski aye. Motion carried. Committers/Reports: Tompkins County Board Representative Stevenson reported that the finance director advised the county board that the March sales tax payment to the county was down about 5 percent. Also, he was keeping an eye on the stimulus efforts and the state budget. County board approved the submission of an application for the Sheriff’s Department to request three deputies under a Cops Grant with federal stimulus funding. Funds pay around 90 percent for the deputies for three years then the county is responsible and obligated for the fourth year. Passed a resolution asking the State Legislature’s permission to increase excess line surcharge on land line phones to $1.00. Highway: Superintendent Rollins Cutting brush, Griffin Road cleared away. Working with Town of Newfield on a joint ditching project on Van Ostrand Road. New housing development didn’t put in driveway pipes and water is eating away the road. Town of Enfield and Town of Newfield own this road. Soil and Water helping with project by providing materials to fill in ditch. Soil and Water to look at Fish Road and may be able to help with erosion problem on Fish Road. Ordered parts for brush mower. Superintendent did a recap of the past three months. Enfield Community Council: No report. Enfield Volunteer Fire Company: Larry Stilwell Few calls this month. Held last chicken barbeque. Code Enforcement: Alan Teeter Reviewed written report, busy doing fire inspections. Facilities Building Manager: Councilperson Barriere Still working on obtaining bids for counter for town hall. Asked Night Owl to resubmit bid and to include a drawing. Regular 4/8/2009 Town Board Meeting Minutes 3 Facilities Planning – Councilperson Masser Broadband meeting with county May 1, 2009. Planning Board: No meeting. Tompkins County Council of Governments: Supervisor Podufalski Discussed cell towers locations. Still working on insurance consortium, questions about voting power, discussed need to be working on dog control issue. County Advisory Board Vacancy list – Enfield has a vacancy on the Fire Disaster and EMS Advisory Board and a vacancy on the Youth Services Board. Old Business: New Business: Spring Clean Up Discussed holding Spring Clean Up and discussed including tires in clean up. Consensus – Spring Clean Up needs to be held and tires need to be included in the clean up. Date of Spring Clean Up – May 11th – May 14th, 12:00 noon to 7:00 p.m... Highway Superintendent to contact Teeter’s for containers for metal and tires on rims. Supervisor Podufalski to contact Casella for trash containers and to contact Waste Management about tires. Motion made by Councilperson Barriere, seconded by Supervisor Podufalski that the Town of Enfield hold the annual Spring Clean Up the week of May 11th, - May 14th, 2009 and that tires be included in the clean up. Motion carried. 1718 Mecklenburg Road: Letter from County Planning regarding apartments going in at 1718 Mecklenburg Road. A Site Plan Review needs to be done by the town and a County Planning Review also needs to be done. Health Dept. issues need to be addressed. Motion made by Councilperson Barriere, seconded by Councilperson Masser that the Town Board instructs the Code Office to immediately issued a Stop Work order for 1718 Mecklenburg Road pending completion of Site Plan Reviews and Health Department approval. Discussion: Vote: Councilperson Barriere aye, Councilperson Masser aye, Councilperson Harvey aye, Councilperson Gayner aye, Supervisor Podufalski aye. Motion carried. TCAT Bus Stop – Corner Route 79 and Enfield Main Road: Highway Superintendent has had inquires about maintains of this stop. Supervisor Podufalski has talked with the property owners who are not happy with this bus stop Regular 4/8/2009 Town Board Meeting Minutes 4 being there. Tompkins Transit has no written agreement with VanDeMark’s, who own the property and he recommended that any inquires be directed to the property owners. Privilege of the Floor: Risa Sokolsky - Spoke on DEC issuing permits for horizontal hydro-fracturing gas well drilling in New York State. Diane Aramini asked if hold on the truck was going to cost the tax payers money and was answered by the Supervisor that he was not aware of it at this point. David Dimmick would like to take exception to Supervisor Podufalski and Councilperson Gayners comments at the March 26th, 2009 public hearing on the fire contract. They stated they were there only for comments not questions and it was not an interrogation. His wants or needs of clarification on several issues were denied and he feels this was not legal to do and if done again he would seek legal regress in one form or another. Sandra Small asked if the annual report had been filed with the State Comptrollers Office and was answered yes. She also asked about the Enfield Creek project. Work is scheduled by Soil and Water for August. Highway Superintendent Rollins asked about what was going on with the new highway facilities and why as Highway Superintendent he was not included on the Facilities Committee and was told by the Supervisor that he had authorized perk tests to be done and the architect was looking at location of power lines, not ready to go out for bids and once out for bid and a price is received it will be determined if we can to ahead with the project. Questions of why he wasn’t included in the committee were not answered. Highway Superintendent feels it’s a little too late for his opinion or input on this facility. Beverly Berggren asked why truck was put on hold and if board members knew about this and was told her question could not be answered at this point. Pat Dougherty stated that it sounded like the Highway Superintendent was not on the Highway Building Committee. Question was asked if this was an open floor and was told it was not an open meeting but was for comments only not a question and answer period. Adjournment: Motion was made by Supervisor Podufalski, seconded by Councilperson Masser that the April 8th, 2009 regular meeting adjourns. Regular town board meeting adjourned at 8:55 p.m... After adjournment Supervisor Podufalski announced that the Town Board would move into Executive Session and they would not be going back into a meeting. Motion made by Supervisor Podufalski, seconded by Councilperson Masser that the Town Board moves into Executive Session. Motion carried. Moved into Executive Session at 8:55 p.m Motion made by Councilperson Gayner, seconded by Councilperson Masser that the Town Board move out of Executive Session. Discussion: Vote: Councilperson Barriere aye, Councilperson Masser aye, Councilperson Harvey aye, Councilperson Gayner aye, Supervisor Podufalsksi aye. Motion carried.
