Supervisor Owens called an Emergency Special Town Board meeting to be held Thursday, February 28, 2007 at the Town Hall, 168 Enfield Main Road, Ithaca, New York at 7:00 p.m. with Deputy Supervisor David Bock presiding. The meeting was called to discuss extending the Enfield Volunteer Fire Company, Inc.’s contract as the previous two-month extension was due to expire at midnight, February 28, 2007. Present: Deputy Supervisor David Bock, Councilperson Peggy Hubbell, Councilperson Jennifer Fisher, Councilperson Sandra Small, Councilperson Robert Harvey, and Town Clerk Alice Laue. Supervisor Owens absent. Others Present: Diane Aramini, David Dimmick, Byron Smith, Tom Gunningsmith, Donald Gunning, John Rancich, Dennis Hubbell, R. J. Switzer, Art Howser, Greg Stilwell, Larry Lanning, Larry Stilwell, and Linda Stilwell. Deputy Supervisor Bock opened the meeting stating that it was an Emergency Special Town Board meeting for the purpose of considering a further extension to the Town’s contract with Enfield Volunteer Fire Company. Supervisor Owens notified the Town Clerk, Town Board and members of the Fire Company of the place and time of the meeting. Bock further stated that he had no official role other than to run the meeting and added that he had done some checking on the Internet to see what the rules of engagement were. He understood further that because this was an emergency meeting called without the minimum of 72 hours notice to the public, that the discussion tonight is limited to the one issue for which the meeting was called and discussion of other issues would have to wait until the next Town Board meeting. Further he added that at such a meeting there is no Privilege of the Floor, which is something that occurs at public hearings and regular Town Board meetings and that if Town Board members felt it necessary to talk with a member from the public, that would be permitted. Motion made by Councilperson Small, seconded by Councilperson Harvey that Privilege of the Floor be held and be opened to anyone wishing to speak. Discussion: Mr. Dimmick asked if Privilege of the Floor could be reserved for the end of the meeting as well. Deputy Supervisor responded that he could not guarantee this and said if anyone wished to speak, they should do so now. Vote: Councilperson Fisher aye, Councilperson Hubbell aye, Councilperson Small aye, Councilperson Harvey aye. Supervisor Owens absent. Motion carried. No one wished to speak Emergency Special Town Board Meeting Minutes – February 28, 2007 2 Extension of Fire Contract with Enfield Volunteer Fire Company, Inc. Councilperson Small asked Deputy Supervisor Bock if he had received Supervisor Owens’ email listing the option before the Board. Bock replied he had not and believed the issue on the floor is whether the current contract would be extended for some period of time so as not to lapse as of midnight tonight. Bock suggested that someone make a motion so discussion could begin. Councilperson Hubbell read the following resolution: RESOLUTION NUMBER 2007-12: FURTHER EXTENSION OF ENFIELD VOLUNTEER FIRE COMPANY, INC. FIRE PROTECTION CONTRACT WHEREAS, the Enfield Town Board and the Enfield Volunteer Fire Company, Inc. have not reached an agreement for a 2007 Fire Protection Contract; and WHEREAS, the Enfield Town Board feels that a sufficient, good faith two-month extension of the current contract was passed at the December 19, 2006 Special Town Board meeting; and WHEREAS, due to a delay on the part of the Fire Company, which may leave the Town without fire protection after midnight, February 28, 2007; and WHEREAS, the Enfield Town Board realizes the importance of continuing fire protection for the Town; and NOW, THEREFORE, be it RESOLVED, that the Town Board has agreed to offer another extension of time to allow for further contract negotiations to and including the next regular Town Board meeting of the Enfield Town Board scheduled for Wednesday, March 14, 2007; and it is further RESOLVED, that said prior agreement as extended will continue until midnight, March 14, 2007 and that no additional monies will be issued to the Fire Company; and it is further RESOLVED, that if and when an agreed upon further extension or a new contract has been approved, will the March payment be made retroactive to March 1, 2007; and it is further RESOLVED, that if no agreement has been reached to either extend the extended contract or approve a new contract, then the original fire contract and its extensions will no longer be in effect and thus no payment will be issued for March 1, 2007 through March 14, 2007. Resolution moved by Councilperson Hubbell, seconded by Councilperson Small. Discussion: Councilperson Harvey commented that he was fine with the resolution if the Fire Company was okay with it and felt it would give the Fire Company a couple more weeks to work on a contract. Vote: Councilperson Fisher aye, Councilperson Hubbell aye, Councilperson Small aye, Councilperson Harvey aye. Supervisor Owens absent. Resolution carried. Councilperson Small asked if the public wished to speak. No one wished to do so.
