The regular monthly Town Board Meeting was held Wednesday, October 10, 2007 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, N.Y. at 7:00 p.m. with Supervisor Owens presiding. Present: Supervisor Jean Owens, Councilperson Peggy Hubbell, Councilperson Sandra Small, Councilperson Robert Harvey, Councilperson Byron Smith and Town Clerk Alice Laue. Others Present: Amber Achlles, Gerhardt Achilles, Mildred Achilles, Douglas and Peg Willis, David Dimmick, David Albrecht, Mary Ellen Joy, Bruce Varner, Davis Cutting, John Rancich, Dee Murphy, Carolyn Tschanz, Theresa Guler, Joe Dawson, Roy Barriere, Dave Owens, Maine Lelik, Rebecca Coulter, Aaron Miller, Marguerite Wells, Herb Masser, Larry Lanning, Virginia Byrant, Ann Rider, Debbie and Alan Teeter, Frank Podufalski, Gary Fisher. Pledge of Allegiance to the Flag: Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag. Privilege of the Floor: A heated debate for and against the wind farm proposal was held. Committee/Board Reports: Tompkins County Legislature: County Legislators Stevenson and Dennis were present. Legislator Dennis complimented the Town Historians on the brochures recently presented to the Town. Town of Enfield brochure is available at the Town Hall. Money to pay for the publication of these brochures came from the room tax moneys. Legislator Dennis chairs the committee researching for a new County Administrator. County Administrator Whicher is retiring in 2008. Legislator Stevenson spoke about the: - SPCA dilemma and the need for the towns and county to work together on a solution. - County Budget – starting a series of informal votes to priorities requests. - 211 Land Line for community information and services. Call 211- Cell phone users call 877- 211-Comp. - October 12th Government Operations Committee looking at driver’s licenses for illegal aliens. - Rural Broad Band – adding funds to budget to look at what rural broad band infrastructure is available in the County. - Ethics Board – spoke with Dooley Keifer about Code of Ethics and was advised that if there is a Code of Ethics in the Town that Code of Ethics applies, if no Code of Ethics, State Code Regular Town Board Meeting Minutes – October 10, 2007 2 of Ethics applies. If a Board of Ethics is in a Town that Board of Ethics would apply, if Board of Ethics in a town is absent, the County Board of Ethics can act. Code Enforcement: Code Enforcement Officer Ron Clark highlighted on his written report. Elisha Drive is officially named Bostwick Run and is cross-referenced with 911. Beautification Committee: Debbie Teeter reported they are pursuing placement of the second “Welcome to Enfield” sign before cold weather. Enfield Community Council: Carolyn Tschanz thanked the community for helping with and supporting the Fall Harvest Festival. Raised approximately $4,000 this year for youth programs. October 12th is Enfield’s Science Night at Enfield Elementary School which is open to the community. Enfield Volunteer Fire Company: David Owens reported that the Fire Company held an open house, between 200-300 people attended and participated in the Fall Festival during the month of September. Supervisor Owens added that the Fire Company’s quarterly report is on file with the Town Clerk. Fire Advisory Board: Larry Lanning reported Fire Advisory Board working on radio system, possibly on the air end of the year. Planning Board: The Planning Board’s written report was submitted to the Supervisor. Councilperson Hubbell reported that at the last Planning Board meeting a motion was made and carried to hand the proposed wind farm project and local law over to the Town Board. Tompkins County Council of Government (TCCOG): Supervisor Owens reported there were two topics for discussion. The 2020 Census is progressing. The SPCA situation was the major topic of discussion. SPCA is requesting funding be doubled. Meeting scheduled to pool available options. Old Business Code of Ethics: Motion made by Councilperson Smith, seconded by Councilperson Hubbell that the Code of Ethics generated by the Town of Enfield’s Code of Ethics Committee and the Code of Ethics article in the Town Topics be sent to the Attorney for the Town for his review and recommendations and that his opinion be available for the November 14, 2007 Town Board meeting. Discussion: Discussed need of sending these documents to the Attorney for the Town for his review and opinion on making this a Town law. Vote: Councilperson Smith aye, Councilperson Small aye, Councilperson Hubbell aye, Councilperson Harvey aye, Supervisor Owens no. Four ayes – one no. Motion carried. New Business 2008 Tentative Budget: After starting the review of the tentative budget line by line and the lateness of the meeting the Board moved back to the regular meeting to conclude the rest of the Regular Town Board Meeting Minutes – October 10, 2007 3 night’s agenda and will schedule another meeting to continue with the budget. Tentative budget looks to be a 3% increase over previous year. RESOLUTION #2007-30 TOWN OF ENFIELD BUDGET AMENDMENT NO. 7 TRANSFER OF APPROPRIATIONS – CEMETERY LABORERS WHEREAS, the Town of Enfield has authorized the positions and salaries for the following Cemetery Laborers; Wayne A. Snyder at $1,520 per year; Wayne C. Snyder at $898 per year; and George Laue at $625 per year, and WHEREAS, through payroll accounting rounding an additional $17.79 was paid in salaries to the Cemetery Laborers, NOW, THEREFORE BE IT RESOLVED that General Fund Appropriations account A1990.4 titled “Contingency Contractual” be reduced $17.79 and General Fund Appropriations account A8810.1, title “Cemeteries – Personal” be increased $17.79. Resolution moved by Supervisor Owens, seconded by Councilperson Harvey. Discussion: Vote: Councilperson Smith aye, Councilperson Hubbell aye, Councilperson Small aye, Councilperson Harvey aye, Supervisor Owens aye. Motion carried. Audit Claims: Supervisor Owens presented monthly bills and vouchers for payment. Motion made by Councilperson Smith, seconded by Councilperson Harvey that the Town Board of the Town of Enfield authorizes the Supervisor pay: General Fund vouchers #192-210 in the amount of $7,849.67 Highway Fund vouchers #79-92 in the amount of $87,901.46 Discussion: Vote: Councilperson Smith aye, Councilperson Hubbell aye, Councilperson Small aye, Councilperson Harvey aye, Supervisor Owens aye. Motion carried. Privilege of the Floor: No one spoke. Calendar – Continuation of 2008 Tentative Budget Review: A Special Town Board Meeting was set for Monday, October 22, 2007 to finish reviewing the 2008 Tentative Budget. Announcements: Councilperson Small asked if the Town had heard anything further with respect to the 2007 Small Cities Housing Rehabilitation Grant. Supervisor Owens reported that the housing grant was turned down and said that a large number of grant applications were received and there were lack of funds.
