Present: Supervisor Gary Fisher Councilperson Peggy Hubbell Councilperson Jean Owens Town Clerk Alice Laue Absent Councilperson Sandra Small Councilperson Greg Stevenson Others present: Deputy Town Clerk: Pat Dougherty, Tompkins County Legislature: Daniel Winch, Enfield Community Council President: Carolyn Tschanz, Suzy Finne Frock, Judy Rosen, Craig Beierle and Debbie Teeter Pledge of Allegiance: Supervisor Fisher led the assemblage in the Pledge of Allegiance. Privilege of the Floor: There was no one who wished to speak at this time. County Legislator’s Report: Dan Winch reported that a new man has been hired for the County from Broome County. Work Camp 2005 is doing about 62 houses in Tompkins with nine or ten of those right here in Enfield. The Tompkins County Budget and Capital Gains Committee is not pursuing the proposed 10% income tax surcharge. Steve Whicher, Tompkins County Administrator, is putting together his 2006 budget proposal for the County Legislature. Sales tax is up this quarter. It was down last quarter. Mortgage tax is down right now. 2004 was a banner year for mortgage taxes. Approval of Minutes: Councilpersons Stevenson and Small were absent so the June 8, 2005, November and December 2004 minutes were tabled until the August 10, 2005 meeting. 2 Communications: * SPCA report for June 2005. There have been no impoundments so far this year. * The Towns of Ulysses and Ithaca are redoing and amending some of their zoning laws. The Board members were given a copy of the Town of Ithaca Law. * The County Board of Elections sent a letter to each Town stating that Albany has approved and passed the Federal requirements to purchase electronic voting machines effective in 2006. * Forums and public statement hearings on two merger proposals, (1) Verizon and MCI and (2) SBC Communications and AT&T, will be held in Buffalo, NYC and Albany. * New York State Office of Technology regarding statewide network telephone number changes. Website address will remain the same. * Cancellation and non renewal of Certificate of Bonding for Phillips Production Company right-of-way along Bostwick Road. * Notice from Environmental Management Council of their next meeting. They meet the same night that the Enfield Town Board meets…the second Wednesday of each month. Committee Reports: Code Enforcement. Supervisor Fisher received a written report from the Code Enforcement Officers, Ron Clarke and Ed Hetherington, which is included in the Town of Enfield Minutes’ book for July 13, 2005. Highway Superintendent. Supervisor Fisher received a written report from the Highway Superintendent, David Miller, which is included in the Town of Enfield Minutes’ book for July 13, 2005. Personnel. Councilperson Small was not present but Supervisor Fisher stated that Wayne A. Snyder would mow around the Town buildings. Technology Committee. See “Old Business” -- Website Digital Towpath. Cemetery Committee. Councilperson Hubbell suggested to Wayne Snyder that if “push came to shove” he could skip mowing Rolfe Cemetery, because of health reasons. The grass is growing slowly because of a lack of rain. She also noted that the illegally parked truck that used to be at Budd Cemetery was not there as much now. Economic Committee. Councilperson Owens says she is still in the process of setting up a meeting. 3 Facilities Committee. Supervisor Fisher would like to have meetings twice a month. Ownership of a small piece of property needs to be determined. There has been some review of deeds to Town property. The next two meetings are July 14 and July 28 at 7:00 PM at the Town Hall. Planning Board. Councilperson Hubbell, who has been attending the Planning Board meetings, told the Town Board that Planning Board member Debbie Teeter came up with a nice map of farms. There was not a quorum at this meeting. Discussion ensued regarding non attendance of some members. Cooperative Extension Meeting. Councilperson Hubbell attended the meeting on “Purchase of Development Rights.” Old Business: Community Building. Supervisor Fisher reported a fault on the heat/smoke detector in the Code Office. There was an open circuit on the heat detector. It was replaced this past week. Website – Digital Towpath. Supervisor Fisher noted that the Town has a web site that is up and running. Eugene Lovelace started putting information into it. Supervisor Fisher is polling Town officials to see what information they might want on the Town’s website. Look us up under www.townofenfield.org Lower case sensitive. Dog Control Law. Supervisor Fisher has looked at other Towns’ laws. He asked the Board members for any input/ideas/suggestions they might have. Enfield Community Council (ECC). Carolyn Tschanz, president, said that the ECC executive board had met to discuss their inability to meet the additional $3,000 cost for liability insurance. She presented the Board with a financial accounting. Very little budget cutting can be done at this time. Options discussed were minimizing field trips, reducing presentations and increasing program fees and attendance fees…all of which would be detrimental to the program. One important factor in ECC’s operation is to include those people who might otherwise not be able to send their children to the camp. Supervisor Fisher explained that there was approximately $1,500 from Recreation that could be used but he felt a public hearing should take place due to the fact that this will cause a “change of contract.” A public hearing has been slated for Wednesday, August 10, 2005 at 7:00 PM, just prior to the regular Town Board Meeting. New Business: Housing Rehabilitation. A cistern was found in a basement that needs to be filled in. Work Camp 2005 staff will carry it to the cistern area. Different options for storing and moving gravel to fill the cistern were discussed. The Highway Superintendent does not want the gravel dumped on site as it would impinge on the highway right-of-way. 4 It was motioned to approve the gravel be dumped on Town property and to authorize the Highway Superintendent to move gravel to the Enfield Center site via a front-end loader. Motion carried. ************* Resolution Number 2005-37 Increases in Health Insurance Premiums Budget Amendment No. 13 WHEREAS, health insurance premiums increased more than the 15 percent budgeted increase in the 2005 town of Enfield Budget, now there be it RESOLVED that appropriation account code A9060.81 titled “Medical Insurance Highway Superintendent” is increased by $144.84 from $13,080.00 to $13,224.84. RESOLVED that appropriation account code A9060.821 titled “Health Insurance Retirees -- Updike” is increased by $109.64 from $5,542.00 to $5,651.64. RESOLVED that appropriation account code DA9060.81 titled “Health Insurance Current” is increased by $284.68 from $26,165.00 to $26,449.68. RESOLVED that appropriation account code DA9060.821 titled “Health Insurance Retirees -- Jon Hubbell” is increased by $230.08 from $800.00 to $1,030.08. RESOLVED that appropriation account code DA9060.822 titled “Health Insurance Retirees -- Richard Hubbell” is decreased by $99.60 from $1,500.00 to $1,400.40. 5 RESOLVED that appropriation account code DA9060.831 titled “Health Insurance Cash-in-Lieu -- Poole” is increased by $29.76 from $2,796.00 to $2,825.76. RESOLVED that appropriation account code DA9030.831 titled “Social Security – Cash-in-Lieu -- Poole” is increased by $1.19 from $174.00 to $175.19. Resolution carried. ************ Resolution Number 2005-38 Court Records SARA Grant Appropriations Budget Amendment No. 14 WHEREAS, the Town of Enfield applied for and received a State Archives Regional Advisory Office grant for $1,247.00 to inventory and organize town justice court records, and WHEREAS, after completion of the 65 hours of court records management work authorized by the SARA grant, $60.44 remained unspent, and WHEREAS, the grant administrator indicates that the unspent grant funds may be used for appropriate court records management work as specified in the grant, now therefore be it RESOLVED that the appropriation in General Fund expenditure account code A1460.43 is reduced by $24.00 to $0.00, and General Fund expenditure account code appropriation A1460.11 is increased by $20.07 from $1,073.00 to $1,093.07; and expenditure account code A9020.8 titled “Medicare” is decreased by $.15 from $1,979.00 to $1,978.85; and expenditure account code A9030.8 titled “Social Security” is increased by $.77 from $8,458.00 to $8,458.77; and A9040.8 titled 6 “Workers’ Compensation” is increased by $2.47 from $1,650.00 to $1,652.47 and A9050.8 titled “Unemployment” is increased by $.84 from $17.00 to $17.84. Resolution carried. ************* Resolution Number 2005-39 Local Funds for Court Records Management Budget Amendment No. 15 WHEREAS, the Town of Enfield applied for and received a State Archives Regional Advisory Office grant for $1,247.00 to inventory and organize town justice courts records, and WHEREAS, after use of all SARA grant funds an estimated 40 percent of the court records management grant project remains uncompleted, and WHEREAS, the Town Board desires to complete the inventory, organization, as well as disposal of unneeded court records, now therefore be it RESOLVED that the appropriation in General Fund expenditure account code #A1460.42 is reduced by $947.56 to $52.44, and General Fund expenditure account code appropriation A1460.11 is increased by $832.00 from $1,093.07 to $1,925.07; and expenditure account code A9020.8 titled “Medicare” is increased by $12.06 from $1,978.85 to $1,990.91; and expenditure account code A9030.8 titled “Social Security” is increased by $51.58 from $8,458.77 to $8,510.35; and A9040.8 titled “Workers’ Compensation” is increased by $38.77 from $1,652.77 to $1,691.54 and A9050.8 titled “Unemployment” is increased by $13.15 from $17.84 to $30.99 and further be it RESOLVED that the Town Board approves the continued employment of Leslie Phelps as a part-time records management typist to complete the court records management project. 7 MOTIONED: Supervisor Fisher SECONDED: Councilperson Hubbell Discussion: Approximately 35 more hours are needed to complete the project. Resolution carried. ************* Resolution Number 2005-40 Appropriation of Funds to Pay Laborer for Mowing/Trimming around buildings. Budget Amendment No. 16 WHEREAS, the Town Board approved hiring a laborer to mow/trim around town buildings at the June 6, 2005 Town Board meeting, now therefore be it RESOLVED that expenditure account code A1620.1 titled “Building -- Personal” be added to the Town of Enfield 2005 General Fund Budget with an appropriation of $300.00, and further be it RESOLVED that appropriate account code A9020.8 titled “Medicare” be increased by $4.35; that appropriation account code A9030.8 titled “Social Security” is increased by $18.60; that expenditure account code A9040.8 titled “Workers’ Compensation” is increased by $13.98; that expenditure account code A9050.8 titled “Unemployment” is increased by $4.74 and further be it RESOLVED that expenditure account code A1620.4 titled “Building -- Contractual” is decreased by $341.67. Resolution carried. 8 ************* Resolution Number 2005-41 Set Cemetery Laborer Salary WHEREAS, Roger Laue was paid $573.00 for cemetery mowing in 2004, and WHEREAS, the Town Board increased salaries by 2.8 percent from 2004 to 2005, and WHEREAS, the $552.00 salary set for Roger Laue at the March 9, 2005 regular town board meeting was computed on $537.00 rather than $573.00, now therefore be it RESOLVED that Roger Laue’s 2005 salary as cemetery laborer to mow the Christian Cemetery is set at $589.00. Resolution carried. ************* Audit Claims: It was motioned that Supervisor Fisher, on behalf of the Town Board of the Town of Enfield, be authorized to pay the following: - General Fund Vouchers #122-#142 dated July 13, 2005 in the amount of $9,543.64. -Highway Fund voucher #54-#76 dated July 13, 2005 in the amount of $30,675.02. -Community Development Grant voucher #8 and #9 dated July 13, 2005 in the amount of $48,964.22. A motion was made to have prior authorization from the Town, for insurance coverage purposes, when taking the Code Enforcement vehicle out of the Town of Enfield. MOTIONED: Supervisor Fisher SECONDED: Councilperson Owens Discussion: Code Enforcement Officer, Ed Hetherington, gave Supervisor Fisher a list of dates when he would be out of town…through 2005. Announcements: Supervisor Fisher stated that 3 units of the housing grant had been completed during the past quarter. It appears the Town will have enough funds for an additional project. Town Clerk Laue reported that the Judah Baker historical cemetery marker arrived 7/12/05. Privilege of the Floor: Craig Beierle, who renovated and sold the Stevenson place at 111 Harvey Hill Road, has now made a home at 103 Harvey Hill Road. He asked about the Phillips Production Company on Bostwick Road, ECC summer camp, and “junk” issues. He said he had a problem selling his place because of surrounding areas that were not very presentable. Adjournment: At 8:35 PM.
