REGULAR TOWN BOARD
MEETING MINUTES
WEDNESDAY, MAY 14th, 2003
6:30 P.M.
The regular monthly meeting of the Town of Enfield Town Board was held Wednesday,
May 14th, 2003 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, NY
at 6:30 p.m. with Supervisor Owens presiding.
Present: Supervisor Jean Owens. Town Councilperson Greg Stevenson, Town
Councilperson Peggy Hubbell. Town Councilperson Pat Gumaer was absent. Town
Councilperson R J Switzer was not present at the beginning of the meeting. Others
present were Town Attorney Scott Miller, Highway Superintendent David Miller and
Town Clerk Alice Laue.
Pledge of Allegiance to the Flag
Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag.
Unfinished Business
Appointment of Advisory Board to Assessment Review Hearing
To be appointed to the Advisory Board to the Assessment Review Hearing are Town
Councilperson Pat Gumaer and Larry Lanning.
Motion made by Town Councilperson Stevenson, seconded by Supervisor Owens that the
Town Board approve the appointment of Town Councilperson Gumaer and Larry
Lanning to the Advisory Board to the Assessment Review Hearing.
Discussion – none
Vote – Supervisor Owens aye. Town Councilperson Stevenson aye. Town
Councilperson Hubbell no. Town Councilpersons Gumaer and Switzer were absent.
Vote was two ayes and one no. Issue to be revisited when Town Councilperson Switzer
arrives.
Water Sterilization System for the Community Building.
Vera Strait from the Community Council reported that Summer Camp would be held at
the Community Building July 7th through August 15th, 2003.
In the past Community Council has had concerns about the E-Coli in the water system
but it has been slight enough that with chlorination it has passed the Health Department
inspection.

This year there has been a State crack down on all camps and their water systems and
they are asking that Enfield install a chlorinating water system in the community
building. Otherwise, the community building cannot be used for Summer Camp. System
has to be installed and inspected before camp starts.
Supervisor Owens presented an estimate from The Pump Guy in the amount of $1900.00.
Supervisor to obtain a second estimate.
Motion made by Town Councilperson Stevenson, seconded Town Councilperson Hubbell
that the Town Board authorize the Supervisor to obtain a second written estimate for a
similar or equal water chlorination treatment system to the existing estimate and that the
lowest of the two estimates be forwarded by the Supervisor to the Tompkins County
Health Department for their written approval, with the approval for the work to
commence immediately after receipt of such written approval from the Tompkins county
Health Department.

Councilperson Hubbell aye. Town Councilperson Gumaer and Town Councilperson
Switzer absent. Motion carried.
Shudaben Road
Supervisor Owens suggested that the Town Board move into Executive Session.
Motion made by Town Councilperson Hubbell, seconded by Town Councilperson
Stevenson that the Town Board move into Executive Session for the purpose of
discussing with the Town Attorney the Shudaben Road issue.
Discussion –
Vote – Supervisor Owens aye. Town Councilperson Stevenson aye. Town
Councilperson Hubbell aye. Town Councilperson Gumaer was absent Motion carried.
Town Board moved into Executive Session at 6:45 p.m. and when Town Councilperson
Switzer arrived at 6:47 p.m. he joined the Executive Session.
Motion made by Town Councilperson Stevenson, seconded by Town Councilperson
Switzer that the Town Board move out of Executive Session.
Discussion –
Vote – Supervisor Owens aye. Town Councilperson Stevenson aye, Town
Councilperson Hubbell aye, Town Councilperson Switzer aye. Town Councilperson
Gumaer was absent. Motion carried. Town Board moved out of Executive Session at
7:04 p.m.
Town Attorney Miller advised – Last 500 feet of road to Burke property not maintained,
not up to specs although it is a town highway. Issue is can the town abandon that
highway and if the town abandons that highway what happens to the three property
owners that are effected? He looked at how the town can abandon that 500 feet of
highway that hasn’t been maintained and it is legal to do so.

Town Highway Law Section 207 Discontinuance of a Highway.
The only way a town can abandon or discontinue maintance of a highway is if the
property owners on both sides of the highway or in this case the three property owners on
the three sides of the road give written consent.
Town Attorney’s opinion is that the town can’t abandon this highway. The town is going
to have too maintain it, bring it up to specs, unless the three effected property owners get
together, come to some agreement that they would share or split the ownership of this
500 feet section. Written permission from the three property owners making a proposal
to the town that they would like the town to abandon the property and they would agree
they would like to take ownership of this property.
Town Attorney proposed that the three property owners sit down and work this out and in
sixty days, present a written proposal to either the supervisor or him. The town would be
willing to consider the proposal.
New York State Code requires every public highway have a turn around for emergency
vehicles, snowplows, etc.
Appointment of Advisory Board to Assessment Review Hearing
First vote did not contain the majority of the votes, therefore, a revote.
Motion made by Town Councilperson Switzer, seconded by Town Councilperson
Stevenson that the Town Board appoint Town Councilperson Gumaer and Larry Lanning
to the Advisory Board to the Assessment Review Hearing.
Discussion – none
Vote- Supervisor Owens aye. Town Councilperson Switzer aye, Town Councilperson
Stevenson aye, Town Councilperson Hubbell no. Town Councilperson Gumaer was
absent. Three ayes, one no vote.
New Business
Tompkins County Youth Services 2003 Contract
Supervisor Owens presented the annual Tompkins County Youth Services 2003 Contract
and requested authorization to sign contract.
Motion made by Town Councilperson Stevenson, seconded by Town Councilperson
Switzer that the Town Board authorize the supervisor to sign the agreement between the
County of Tompkins and the Town of Enfield. Entering into an agreement to participate
in the Tompkins county Youth services Program for the period of January 1, 2003 to
December 31st, 2003.

Councilperson Switzer aye, Town Councilperson Hubbell aye. Town Councilperson

Committees/Reports
Fire Company – Chief Stevenson
Fire Chief Stevenson presented and reviewed the quarterly fire company report.
Tompkins County Legislative Representative – Dan Winch
Assessment Review Hearing May 20th, 2003. Representative Winch to be county
representative to Advisory Board to the Assessment Review Hearing.
County highway department hit hard, no Chips money.
County looking to fill two very important positions this year. Commissioner of Social
Services is retiring and Executive Director of Cornell Cooperative Extension is leaving.
Highway Department
Supervisor and the Board commended Superintendent Miller as an individual and also his
entire department and all those people (Jack Hubbell and Bill Eisenhart) that stepped up
to the plate and volunteered for trash clean up week. Its been a highly successful
program. It could not have taken place without the intensive amount of effort on Dave’s
part as well as the men at the highway department and other people who stepped in.
Presently have taken out eighty some tons of trash-trash. Sent out approximately 320
cubic yards of metal, still working on moving the tires.
Highway Department – Superintendent Miller
Patching potholes, sweeping intersections, finally got spreaders out of dump trucks,
served them. Changed the oil, hauled stones. Tug milled grader patch.
Superintendent Miller has a couple of people interested in the FWD.
Pay for Part Time People
Discussed this previously. Part time people are getting $8.00 and hour, but they get
overtime out of the highway’s eight-hour work day. On an average they make $10.45 an
hour. Instead of hiring a full time employee right now he would like to hire another part
time person. He would like to move the part time person up to $10.00 straight through
and not pay him any overtime until after forty hours.
Motion made by Town Councilperson Stevenson, seconded by Town Councilperson
Switzer that the Town Board approve the payment method for part time highway
employees. Change from the current salary and overtime after eight hours to $8.00 to
$10.00 an hour with overtime after forty hours in a pay period.

Code Enforcement – Clark/Hetherington
Clark – Another busy month, getting busier. Forty phone calls, twelve new building
permits, and several inspections, issued Certificates of Occupancy. Worked with Town
Attorney and Ed on a general junk car law.
Hetherington - Forty-eight phone calls, thirty long distant calls. A lot of interest shown
in junk cars and a lot of complaints regarding landlord disputes.
Town Councilperson Stevenson left at 7:40 p.m.
Regular Business
Supervisor asked for the following budget amendments.
Decrease Contingency A1990.4 by $2,420.00
Increase Planning Contractual A8020.4 by $2,000.00
Increase Bookkeeper Contractual A1220.42 by $100.00
Increase Highway Personal DA5110.1 by $470.00
Motion made by Town Councilperson Switzer, seconded by Town Councilperson
Hubbell that the Town Board approve the following budget amendments.

Correction of Town Clerk’s April 2003 General Fund Warrant
Motion made by Town Councilperson Switzer, seconded by Town Councilperson
Hubbell that the Town Board direct the Town Clerk of the Town of Enfield to amend the
April 2003 General Fund warrant to. Correct the amount of voucher 125 to read $41.49
instead of $41.19 and correct the amount of voucher 130 to read $28.41 instead of
$31.71.

Hubbell aye. Town Councilperson Gumaer was absent. Motion carried.
Monthly Bills/ Report
Supervisor presented the monthly bills for payment.
Motion made by Town Councilperson Switzer, seconded by Town Councilperson
Hubbell that the Town Board of the Town of Enfield authorize the supervisor to pay
General Fund vouchers #12 – 161, dated 5/14/03 in the amount of $18,893.83. Highway
Fund vouchers #47 – 58, dated 5/14/03, in the amount of $7,604.04.

Enfield Volunteer Fire Company voucher #4 SF-1, dated 5/14/03 in the amount of
$89,043.00.

Vote – Supervisor Owens aye. Town Councilperson Switzer aye, Town Councilperson
Hubbell aye. Town Councilperson Gumaer was absent. Motion carried.
Town Clerk Software
The town clerk would like to purchase the Williamson Town Clerk’s software package.
Payments allowed over a two year period.
Motion made by Town Councilperson Switzer, seconded by Town Councilperson
Hubbell that the Town Board authorize the supervisor to sign an agreement with
Williamson for the purchase of the Town Clerk’s software package. Payment of
$1500.00 to be made in the year 2003 and the remainder in 2004.

Hubbell aye. Town Councilperson Gumaer was absent. Motion carried.
Privilege of the Floor
Fredi Shapiro, 53 Enfield Main Road, Thomas Givenjer. 119 Enfield Min Road, Debbie
Burun, Iradell Rd, expressed their concerns regarding the un-safeness of the Enfield Main
Road/Halseyville Road and Route 79 intersection.
Norm and Sally Pure, 264 Gray Rd., Sarah Locke, 274 Gray Rd., Ray Bennett, 271 Gray
Rd., Mark Cushing, 106 Hubbell Drive 9a new Town of Enfield resident) expressed their
concerns about the noise level issue in the Gray Rd., - S. Van Dorn Rd., area. The riding
of ATV’s, motorcycles and dirt bikes being ridden on a neighbor’s property and creating
an over excessive noise level. Question is, what is the town going to do about this?
Water Resources
Sharon Anderson – Watershed Steward gave a LEAPE watershed program presentation.
LEAPE program to be presented in Enfield in the month of June.
Adjournment
Motion made by Town Councilperson Hubbell, seconded by Town Councilperson
Switzer that the regular monthly meeting held May 14, 2003 adjourn.
