The regular monthly meeting of the Town Board of the Town of Enfield was held Wednesday, January 8th, 2003 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, NY at 6:30 p.m. with Supervisor Owens presiding. Present: Supervisor Jean Owens. Town Councilperson Greg Stevenson, Town Councilperson R J Switzer, Town Councilperson Peggy Hubbell, Town Councilperson Pat Gumaer. Others present were Town Attorney Scott Miller, Highway Superintendent David Miller and Town Clerk Alice Laue. Pledge of Allegiance to the Flag Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag. Committees/ Reports Highway Department – Superintendent Miller Cindering, plowing, doing basic work. Year 2003 Agreement to Spend Highway Funds. Superintendent Miller asked the Town Board to sign the Year 2003 Agreement to Spend Highway Funds. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Hubbell that the Town Board of the Town of Enfield approve and sign the Year 2003 Agreement to Spend Highway Funds. Discussion- none Vote – Supervisor Owens aye. Town Councilperson Stevenson aye, Town Councilperson Switzer aye, Town Councilperson Gumaer aye, Town Councilperson Hubbell aye. Motion carried. Code Enforcement - Clark/Hetherington Busy issuing building permits, closing out building permits, doing inspections, issuing appearance tickets. Enfield Fire Company – Chief Stevenson Emergency Paging System went down 1/8/2003. Quarterly report due in February. Regular Town Board Meeting Minutes 1/8/03 2 Old Business Local Law #1 of the year 2003 Emergency Towing of Vehicles Supervisor asked for adoption of this law. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Switzer that the Town Board of the Town of Enfield approve and adopt Local Law #1 of the Year 2003, Emergency Towing of Vehicles. Discussion – none Vote - Supervisor Owens aye. Town Councilperson Stevenson aye, Town Councilperson Switzer aye, Town Councilperson Gumaer aye, Town Councilperson Hubbell aye. Motion carried. Shudaben Road The Town Board pursuant to Highway Law sections 207 and 208 authorizes its attorney to secure written approvals of the affected landowners of 500 feet of the Shudaben Road town highway in order to permit the Town to discontinue its maintenance of said 500 feet highway. Landowner Burke has agreed to maintain this 500 feet of the highway at the end of Shudaben Road. Motion made by Town Councilperson Switzer, seconded by Town Councilperson Gumaer that the Town Board of the Town of Enfield approve granting Town Attorney Miller authorization to obtain written approval of landowners on Shudaben Road this affects. Schilling Property Acquisition Completed Schilling Property Acquisition completed December 23rd, 2002. Supervisor Owens reported Gary Schilling extremely fair, settled for a fair price, wanted the Town to have property. Community Arts Partnership Awards Supervisor asked for authorization to sign Community Arts Partnership Awards application. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Gumaer that the Town Board of the Town of Enfield approve and authorize Supervisor Owens to sign the Community Arts Partnership Awards application. Discussion Vote – Supervisor Owens aye. Town Councilperson Switzer aye, Town Councilperson Gumaer aye, Town Councilperson Hubbell aye. Motion carried. Regular Town Board Meeting Minutes 1/8/03 3 New Business Supervisor Owens asked for the following motions. Organizational Resolutions Reviewed 2003 Organizational Resolutions. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Switzer that the Town Board of the Town of Enfield approve the adoption of the 2003 Organizational Resolutions as presented. Discussion – none Vote – Supervisor Owens aye. Town Councilperson Stevenson aye, Town councilperson Switzer aye, Town Councilperson Gumaer aye, Town Councilperson Hubbell aye. Motion carried. Authorization to Attend Association of Towns Annual Meeting. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Switzer that the Town Board of the Town of Enfield approve and authorize the attendance of the following at the Association of Towns Annual Meeting 2/16/03 – 2/19/03. Supervisor Owens, Town Councilpeople Stevenson, Switzer and Gumaer. Code Enforcement Officer Hetherington. And any Town Justices that do so desire. Discussion – none Vote - Supervisor Owens aye. Delegate to Annual Meeting Supervisor asked for authority to represent the Town at the Association of Towns Annual Meeting. Motion made by Town Councilperson Switzer, seconded by Town Councilperson Stevenson that the Town Board of the Town of Enfield approve and authorize Supervisor Owens as delegate for the Town at the Association of Towns Annual Meeting. Regular Town Board Meeting Minutes 1/8/03 4 Audit Meeting Motion made by Town Councilperson Switzer, seconded by Town Councilperson Hubbell that the Town Board of the Town of Enfield schedule the annual Audit Meeting to be held Monday January 15th, 2003 at 6:30 p.m. Discussion – none Vote – Supervisor Owens aye. Town Councilperson Switzer aye, Town Councilperson Gumaer aye, Town Councilperson Hubbell aye. Town Councilperson Stevenson no. 2002 Budget Amendments Supervisor asked for the following 2002 Budget Amendments, Delete Staples voucher #336 in the amount of $113.01. Transfer - Increase A3010.4 Public Safety contractual. By 19.30 Decrease Contingency A1990.4 by 19.30. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Switzer that the Town Board of the Town of Enfield amend the 2002 General Fund warrant for December 11th, 2002 to delete voucher #336, for Staples in the amount of $113.01. Discussion – none Vote – Supervisor Owens aye. Town Councilperson Stevenson aye, Town Councilperson Switzer aye, Town Councilperson Gumaer aye, Town Councilperson Hubbell aye. Motion carried. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Switzer that the Town Board of the Town of Enfield amend the 2002 Budget to zero out an account and enable the books to be closed by decreasing the amount budgeted for Contingency, 1990.4 by $19.30 and increasing the amount budgeted for Public Safety Contractual 3010.4 by $19.30. Monthly Bills/Reports Supervisor Owens presented the monthly bills. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Switzer, that the Town Board of the Town of Enfield authorize the supervisor to pay General Fund vouchers #1 –29, dated 1/8/03, in the amount of $82,592.73. Highway Fund vouchers #1-5, dated 1/8/03, in the amount of $8,174.19. Discussion – Town Councilperson Hubbell questioned the sales tax on the December 2002 Lowe’s bill.
