Pledge of Allegiance to the Flag Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag. Present: Supervisor Jean Owens, Town Councilperson Greg Stevenson, Town Councilperson R J Switzer, Town Councilperson Peggy Hubbell. Town Councilperson Pat Gumaer was absent. Others present were Town Attorney Scott Miller and Town Clerk Alice Laue. Town of Enfield Code Enforcement Law – Law #2 of 2003. A public hearing was held Wednesday, December 10th, 2003 at 6:30 p.m. at the Enfield Community Building, 182 Enfield Main Road, Ithaca, NY. This public hearing was held to hear comments on the Town of Enfield Code Enforcement Law. After all wishing to speak had spoken the public hearing was closed at 6:35 p.m. Regular Town Board Meeting Minutes The regular monthly meeting of the Town Board of the Town of Enfield was held Wednesday, December 10th, 2003 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, NY with Supervisor Owens presiding. Present: Supervisor Jean Owens, Town Councilperson Greg Stevenson, Town Councilperson R J Switzer, Town Councilperson Peggy Hubbell. Town Councilperson Pat Gumaer was absent. Others present were Town Attorney Scott Miller and Town Clerk Alice Laue. Approval of the 11/12/2003 Public Hearing Minutes Motion made by Town Councilperson Switzer, seconded by Town Councilperson Stevenson that the Town Board approve the adoption of the 11/12/03 public hearing minutes. Discussion – Vote - Supervisor Owens aye. Town Councilperson Stevenson, aye, Town Councilperson Switzer aye, Town Councilperson Hubbell aye. Town Councilperson Gumaer was absent. Motion carried. Public Hearing and Regular Town Board Meeting Minutes 12/10/03 2 Approval of the 11/12/2003 Regular Town Board Meeting Minutes Corrections – Page 4 Under Oversight Committee replace the word second with a comma. Page 2, Paragraph 6, Motion made, second line, second word substitute an h for the j. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Switzer that the Town Board approve the adoption of the 11/12/2003 regular Town Board Meeting minutes as amended. Discussion – none Vote- Supervisor Owens aye. Town Councilperson Stevenson aye, Town Councilperson Switzer aye, Town Councilperson Hubbell aye. Town Councilperson Gumaer was absent. Motion carried. Committees/Reports Code Enforcement – Clark/Hetherington Clark – Fairly busy month. Thirty-three calls at home, eleven e-mails. Two certificates of Occupancy inspections, several hours of research, assigned one address, wrote six Certificates of Occupancy, five footer inspections, numerous progress checks, one court visit, several complaints, mainly garbage and junk cars, three framing inspections. Hetherington - Three footer inspections, two foundation inspections, four complaints concerning burning of plastic and garbage. Highway Department - No report. Town Attorney Miller presented Shudaben Road survey to Supervisor Owens to be given to Highway Superintendent Miller. Regular Business Resignation/Appointment Supervisor Owens presented Town Councilperson Gumaer’s letter of resignation as Town Councilperson to the Town of Enfield Town Board. Town Councilperson Gumaer served two out of a four year term and resignation is effective as of December 9th, 2003. Supervisor Owens spoke about the necessity of having a full board and that there were candidates to be suggested to fill this position. Motion made by Town Councilperson R J Switzer, seconded by Town Councilperson Stevenson that the Town Board appoint Lawrence (Larry) Lanning to replace Pat Gumaer as Town Councilperson to the Town of Enfield Town Board for a term ending December 31, 2004. Public Hearing and Regular Town Board Meeting Minutes 12/2003 3 Discussion - Town Councilperson Hubbell would like to see position open to the town so everyone knows there is an opening. Supervisor Owens indicated that the Town Board has the authority to fill this position until the next general election. Vote – Supervisor Owens aye. Town Councilperson Switzer aye, Town Councilperson Stevenson aye, Town Councilperson Hubbell no, Town Councilperson Gumaer was absent. Three ayes, one no, one absentee. Town Clerk administered the Oath of Office to Town Councilperson Lanning. Oversight Committee – GOSC Economic Development Strategic Plan Grant Supervisor Owens asked that the Oversight Committee appointed for the housing rehabilitation for the Governor’s Office for Small Cities at the 11/12/2003 Town Board meeting be appointed as the GOSC Economic Development Strategic Plan Grant Oversight Committee would be the group that would kick off the work with the consultant for the Economic Development Strategic Plan. Committee to consist of County Legislators Pete Pemmiman, Dan Winch, Better Housing for Tompkins County Executive Director Stacey Crawford, one member of Tompkins County Better Housing and the Town of Enfield Supervisor. Supervisor Owens reported that this grant is through the Governor’s Office for Small Cities. She sent RSP’s had two applicants, this is a technical assistance grant from the Governor’s Office and to put Strategic Plan together it requires someone familiar with NYState law as well as the Governor’s Office. Two proposals for services were received, one from Camoin Associates in Saratoga Springs, NY and one from an Austin Texas firm. Recommendation from County Planning is for Camoin Associates. Grant is $9000 from the State, $3,000 from the County and $3,000 from the Town of Enfield. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Switzer that the Town Board approve contracting with Camoin Associates to administer the Governor’s Office Small Cities Economic Development Strategic Plan Grant. Discussion – Town Councilperson Hubbell $9,000 to be spent in three months, what is other $6,000 for? Supervisor Owens $3000 from County Planning In Kind Services. Town of Enfield will be contributing $3000, part of which has already been expended through the meetings with the business community. Vote – Supervisor Owens aye. Public Hearing and Regular Town Board Meeting Minutes 12/10/03 4 Public Hearing – Three Year Fire Protection Contract Supervisor Owens opened the Public Hearing on the Three Year Fire Protection Contract to all wishing to speak. Shirley Hubbell, Bertha Hubbell, Mary Tutton, Bill Mather, Gary Fisher spoke against a three year contract. Gary Fisher questioned the four percent increase. Bertha Hubbell and Bill Mather asked who negotiated with the fire company for the proposed contract for 2004? Chris McConkey and John Baker spoke in favor of the contract. After all wishing to speak had spoken the Public Hearing on the Three Year Fire Protection Contract was closed at 7:30 p.m. Town of Enfield Code Enforcement Law Public Hearing reopened. Jack Rumsey, Robert Holley questioned whether the law was a State Code Law or a Town Law? Alfred Eddy asked if the law had been enforced? Gary Fisher questioned inclusion of Mass Gathering Law in Code Enforcement Law? Shirley Hubbell questioned non-enforcement of Town’s Junk Car Law. Supervisor Owens closed the Town of Enfield Code Enforcement Law Public Hearing. Senior Citizen Exemption Public Hearing. Supervisor Owens opened the Senior Citizen Exemption Public Hearing to anyone wishing to speak. After no one wished to speak the Senior Citizen Exemption Public Hearing was closed at 8:00 p.m. Regular Town Board Business Town of Enfield Code Enforcement Law – Law #2 of 2003. Discussed removing Article Seven, Section 3, Paragraph E. Paragraph that deals with grass and other vegetation. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Hubbell that the Town Board approve the adoption of the Town of Enfield Code Enforcement Law – Law #2 of 2003, but amended it by deleting Article Seven, Section 3, Paragraph E. Discussion - Page 12, Article Eight, Section #1. Need to define what qualifies as obnoxious weeds and vermin. Discussed ending sentence after the word vermin. Motion made to amend amendment to read – Delete Article Seven, Section 3, Paragraph E. Page 12 – Article Eight, Section #1 end sentence after word vermin. Vote – Supervisor Owens aye. Town Councilperson Stevenson aye, Town Councilperson Switzer aye, Town Councilperson Hubbell no, Town Councilperson Lanning aye. Motion carried. Public Hearing and Regular Town Board Meeting Minutes 12/1003 5 Enfield Fire Protection Three Year Contract Supervisor Owens asked for a motion to approve this contract. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Lanning that the Town Board authorize Supervisor Owens to sign the proposed Three Year Fire Protection Contract. Discussion- Comment, Code of Ethics addresses Conflict of Interest in Section Two. Vote – Supervisor Owens aye. Town Councilperson Stevenson aye, Town Councilperson Switzer abstained, Town Councilperson Hubbell no, Town Councilperson Lanning aye. Three ayes, one no, one abstention. Senior Exemption Increases Supervisor Owens proposed increase in Senior Exemptions based on same scale adding $6000 increment to each line. Motion made by Town Councilperson Stevenson, seconded by Supervisor Owens that the Town Board approve increasing the current Senior Exemption limits to $6000 across the board. Discussion – Information needs to get out to the people. Vote – Supervisor Owens aye. Approval for Attending NY City Training School Sandra Small, Ed Hetherington, and Larry Lanning would like to attend the NY City Training School being held February 15th through February 19th, 2004. Motion made by Town Councilperson Switzer, seconded by Town Councilperson Stevenson that the Town Board approve and authorize the attendance of Sandra Small, Ed Hetherington, and Larry Lanning at the NY City Training School. General Fund Payroll Supervisor Owens asked that the General Fund payroll for the month of December 2003 be moved to December 15th, 2003. Motion made by Town Councilperson Switzer, seconded by Town Councilperson Hubbell that the General Fund Payroll ending December 31, 2003 be moved to December 15th, 2003. Public Hearing and Regular Town Board Meeting Minutes 12/10/2003 6 Sprague Insurance 2004 Insurance coverage begins 1/1/2004. There is a nine percent increase bringing the total of the liability insurance to $19,930.95. Motion made by Town Councilperson Switzer, seconded by Town Councilperson Lanning that the Town Board contract with Sprague Insurance as insurance carrier for the Town of Enfield for the year 2004. Public Hearing and Regular Town Board Meeting Minutes 12/10/2003 8 Bills Supervisor presented bills for payment. Motion made by Town Councilperson Switzer, seconded by Town Councilperson Stevenson that the Town Board of the Town of Enfield authorize the supervisor to pay General Fund vouchers #356-390, dated 12/10/03, in the amount of $10,679.87. Highway Fund vouchers #155-165, dated 12/10/03, in the amount of $20,937.57. GOSC (Housing Rehabilitation) Grant I in the amount of $18,463.74. Discussion – none Vote - Supervisor Owens aye. Personnel Manual Personnel Manual does not include updates that were passed at a previous town board meeting. Town Councilperson Stevenson to review manual. Motion made by Town Councilperson Switzer, seconded by Town Councilperson Hubbell that the Town Board approve the adoption of the Personnel Manual contingent upon confirmation that the appropriate language is included Discussion – none Vote – Supervisor Owens aye. Buck Hill Rd., is planning on attending the training school in Rochester January 12th through Janaury 14th, 2004. Peggy Hubbell will also be attending this training school. Discussed how payment was to be made.
