The regular monthly meeting of the Town Board of the Town of Enfield was held Wednesday, June 12th, 2002 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, NY at 6:30 p.m. with Supervisor Owens presiding. Present: Supervisor Jean Owens; Town councilperson Greg Stevenson, Town Councilperson RJ Switzer, Town Councilperson Mark Roach, Town Councilperson Pat Gumaer. Others present were Town Attorney Scott Miller and Town Clerk Alice Laue. Pledge of Allegiance to the Flag – Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag. Communications – Letter from Debbie Teeter, Cornell Cooperative Extension – Farm Field Day August 11th, 2002 at Hardie Farms in Lansing. Letter from Assemblyman Luster in regards to $5000.00 grant for house numbering. Reports/Committees Tompkins County Board Representative Winch Representative Winch spoke about county tax increase, cuts in county budget and cuts in youth programs. Highway Department- Superintendent Miller Cleaned off the intersections, put up some signs, did a little ditching. Graded roads an applied dust oil, hauled gravel, patched potholes and in the process of mowing roadsides. Built a new roof for cinder spreader, put new brushed on the sweeper, put up mailbox across the road and picked up old mattress on VanDorn Rd. and took to recycling. Code Enforcement – Ed Hetherington Issuing permits, some with added stipulations, finding building without permits. Working on outstanding permits. Attended a meeting in Binghamton on vacant property, junkyards, different methods code officer’s use. Town Councilperson Stevenson - Code Officers working on vacant buildings, cataloging structures. Regular Town Board Meeting Minutes 6/12/02 2 Water Quality Committee – Supervisor Owens Met last month with Kate Hackett Tompkins County Planning and the stewardess of the Cayuga Lake Watershed. Looked at what Enfield’s water is about. Economic Development - Town Councilperson Switzer Meeting June 24th, 2002 with Mark Sawyer. Supervisor Owens spoke about hiring intern Wyatt Friday – Cornell student willing to work with Economic Development Committee. Planning Board – No report, no members present. Unfinished Business – Farmer’s Market – Supervisor Owens asked Town Councilperson Gumaer to make a motion regarding a Farmer’s Market in Enfield. Town Councilperson Stevenson asked if there would be any financial expense to the town. Supervisor answered no. Town’s blanket insurance policy would cover liability. Motion made by Town Councilperson Gumaer, seconded by Town Councilperson Stevenson that the Town Board of the Town of Enfield support the Enfield Farmer’s Market, there being no financial expenses to the town. Motion carried unanimously. Featureprice Web Host for the Town Supervisor Owens asked for a motion naming Featureprice as the town web site. Price $25.00 setup fee - $9.95/month service fee paid annually. Motion made by Town Councilperson Switzer, seconded by Town Councilperson Roach that the Town Board of the Town of Enfield approve the purchase of Featureprice as the town’s web site for a minimum of one year at a price of $25,00 for a setup fee and $9.95 service fee to be paid annually. Motion carried unanimously. Recreation Partnership Bylaws Motion made by Town Councilperson Greg Stevenson, seconded by Town Councilperson RJ Switzer that the Town Board of the Town of Enfield approve the adoption of the Tompkins County Youth Bureau Recreation Partnership Bylaws as adopted by the Recreation Partnership Board on April 23, 2002. Motion carried unanimously. Regular Business Budget Amendments Supervisor Owens asked for the following budget amendments to the 2002 General Fund budget. From A1990.4 Contingency $500.00 to DA5110.1 Highway Personnel 380.25 to A1010.4 Town Board Contractual 400.00 to A1220.4 Supervisor Contractual 350.00 to A1220.42 Bookkeeper Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Gumaer that the Town Board of the Town of Enfield approve the following budget amendments – From A1990.4 Contingency $500.00 to DA5110.1 Highway Personnel 380.25 to A1010.4 Town Board Contractual 400.0 to A1220.4 Supervisor Contractual 350.0 to A1220.42 Bookkeeper Discussion – Vote – Supervisor Owens aye’ Town Councilperson Stevenson aye; Town Councilperson Switzer aye; Town Councilperson Roach aye; Town Councilperson Gumaer aye. Motion unanimously carried. Monthly Bills/Supervisor’s Report Supervisor Owens presented the monthly bills for payment. Town Councilperson Roach asked that Phil Grover submit a complete list of what he is doing at the Community Building along with his bill. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Roach that the Town Board of the Town of Enfield authorize the supervisor to pay General Fund vouchers #138 – 165, dated 6/12/02, in the amount of $18,236.38. Highway Fund vouchers #39-50 dated 6/12/02, in the amount of $23,828.90. Regular Town Board Meeting Minutes 6/12/02 4 Resolutions – Highway Superintendent Miller would like to have the following listed as surplus equipment: 1984 GMC One-Ton Dump Truck 1970 Ford Tank Truck 1946 FWD Dump with V plow and wing 1968 Austin-Western Grader Pacer 300 with V plow and wing. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Roach that the Town Board of the Town of Enfield declare as surplus equipment the following. 1984 GMC One-Ton Dump Truck 1970 Ford Tank Truck 1946 FWD Dump with V plow and wing 1968 Austin-Western Grader Pacer 300 with V plow and wing. Discussion – None Vote – Supervisor Owens aye; Town councilperson Stevenson aye; Town Councilperson Switzer aye; Town Councilperson Roach aye; Town Councilperson Gumaer aye. Motion unanimously carried. Highway Superintendent Miller asked a motion to place advertisement for bids to purchase a rubber-tired excavator. Town Board members expressed their concerns about the proper legal language needed to be used in advertisement. Consensus was Town Attorney to handle writing of bid advertisement. Discussed who bids are to be opened by, where opened and when and how marked. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Roach that the Town Board of the Town of Enfield place in the legal section of the Ithaca Journal an ad seeking bids for the purchase of a rubber tired excavator. Motion unanimously carried. Enfield Town Courts Grant Request Resolution Resolution made by Town Councilperson Switzer, seconded by Town Councilperson Stevenson. Whereas, the receipt of funds for the Town Courts of the Town of Enfield would assist in the operation of the courts, and Whereas, these funds would enhance the courts ability to provide suitable and sufficient services to the Town of Enfield, Therefore be it resolved, that the Town Board of the Town of Enfield authorizes the submission of the “Justice Court Assistance Program Grant Application.” Discussion – None Regular Town Board Meeting Minutes 6/12/02 5 Vote – Supervisor Owens aye; Town Councilperson Stevenson aye; Town Councilperson Switzer aye; Town Councilperson Roach aye; Town Councilperson Gumaer aye. Resolution unanimously carried. Public Participation in Town Meetings Supervisor Owens’ asked Town Councilperson Switzer to read the attached Public Participation in Town Meetings resolution. Resolution unanimously carried. Resolution – Adoption of Uniform Rules Relating to the Administration of Public Access to Public Records read by Town Councilperson Roach at Supervisor Owens’ request. Resolution unanimously carried. Intern – Wyatt Friday City and Regional Planning intern Wyatt Friday. Proceeding into second year, has bachelor’s degree from Ithaca College He would like to work with us during the summer. Would be working with Mark Sawyer information gathering for Economic Development Committee. Used Leslie last year and she was a great asset. It would entail paying half of his salary which would be $1400.00 for ten weeks for half time position. Cornell to pay other half time position. Motion made by Town Councilperson Switzer, seconded by Town Councilperson Gumaer that the Town Board of the Town of Enfield approve the hiring of Wyatt Friday as an intern working in a half time position on the Economic Development Committee. Regular Town Board Meeting Minutes 6/12/02 6 Discussion - Talked about the value of the work Leslie did for the town last year and support concept of this program. Meetings – Peggy Hubbell asked that if a scheduled meeting is cancelled a notice be posted on the Community Building door telling of cancellation. Privilege of the Floor Greg Robideau 210 Sheffield Road Spoke about a persistent water drainage problem he has. Neighboring property owner draining water on his property Water drainage is causing erosion and making his property wet and difficult to mow. Mr. Robideau asked for suggestions on how to handle this situation and was advised to contact Tompkins County Soil and Water. Pat Dougherty – 330 Sheffied Road Questioned the three-minute time limit for Privilege of the Floor. She was advised that at any point a board member wishes to call on a member of the public or speak to them during Privilege of the Floor time could be extended. Privilege of the Floor is designed to allow people to talk to the board and express their concerns. Peggy Hubbell – Hubbell Drive A couple of months ago didn’t you say that you didn’t have to approve the minutes and now that resolution talks about approval of the minutes again. Supervisor Owens answered – Town Law - There are no official minutes of the Town until the Town Board approve them, so if we don’t approve the minutes there are no official minutes of the Town Board. That needed to be addressed. Executive Session Motion made by Town Councilperson Roach, seconded by Town Councilperson Gumaer that the Town Board of the Town of Enfield move into Executive Session to discuss a personnel issue and possible land acquisition. Discussion – Vote - Supervisor Owens’ aye; Town Councilperson Stevenson aye; Town Councilperson Switzer aye; Town Councilperson Roach aye; Town Councilperson Gumaer aye. Motion unanimously carried. Moved into Executive Session at 8:00 p.m. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Roach that the Town Board of the Town of Enfield move out of Executive Session. Regular Town Board Meeting Minutes 6/12/02 7 Town Councilperson Stevenson made the motion, seconded by Town Councilperson Roach that Town Attorney Scott Miller write a letter to Jim Dew to inform him that he will receive individual health insurance paid for by the town.upon retirement. Discussion- Vote - Supervisor Owens’ aye; Town Councilperson Stevenson aye; Town Councilperson Switzer aye; Town Councilperson Roach aye; Town Councilperson Gumaer aye. Motion unanimously carried. Adjournment – Town Councilperson Gumaer made the motion, seconded by Town Councilperson Switzer that the meeting adjourn.
