The regular monthly meeting of the Town Board of the Town of Enfield was held Wednesday, June 14th, 2000 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, N.Y. at 6:30 p.m.. Supervisor Owens presided. Present: Supervisor, Jean Owens; Town Councilman, Joe Schehr; Town Councilman, Richard Holley; Town Councilman, Mark Roach. Town Councilman Greg Stevenson was absent. Others present were Highway Superintendent, Ron Updike and Town Clerk, Alice Laue. Pledge of Allegiance to the Flag – Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag. Privilege of the Floor – No one wished to speak. Approval of the April 12th, 2000 Regular Town Board Meeting Minutes Motion made by Councilman Holley, seconded by Councilman Schehr that the Town Board of the Town of Enfield approve the adoption of the minutes of the regular Town Board meeting held April 12, 2000. Discussion – Vote – Supervisor Owens, yes. Town Councilmen Holley, Schehr, Roach yes. Town Councilman Stevenson was absent Approval of the May 10th, 2000 Regular Town Board Meeting Minutes Motion made by Councilman Roach, seconded by Councilman Holley that the Town Board of the Town of Enfield approve the adoption of the minutes of the regular Town Board meeting held May 10th, 2000. Discussion – Vote – Supervisor Owens, yes. Town Councilmen Holley, Schehr, Roach, yes. Town Councilman Stevenson was absent. Reports/Committees Recreational Partnership – written report, oral report to be given next meeting. Regular Town Board Meeting Minutes 6/14/00 2 Highway Department – Highway Superintendent Updike Highway Department struggling to do dust oil. Graveled Rothermich Road and Enfield Center Road, West. Highway Superintendent Updike read Jeff Juber’s letter of resignation from the Town of Enfield Highway Department. Resignation effective June 16th, 2000. Superintend Updike asked the board about advertising this position. Consensus – Position needs to be advertised with the stipulation that applicants must be a Town of Enfield resident. Code Enforcement – Supervisor Owens’ read Chairperson Stevenson’s e-mail to her aloud. No June meeting. E-mail addressed Mobile Home Ordinance materials. Supervisor to write a cover letter explaining the law and requirements to be followed by mobile park owners. Copies of Mass Gathering Ordinance draft was presented to board for their consideration. Fire Department – Councilman Roach read Fire Chief Stevenson’s e-mail to the board. Tompkins County Representative – Peter Penniman County Representative Penniman updated the board on the county’s Public Safety Communication project. Representative Penniman also reported on the jail project. New Business – Shudaben Road Town Attorney Wilson reported to the board on the question of whether the town is required to extend construction of Shudaben Road the remaining 500’ feet to the land now owned by Burke. Attorney Wilson is of the opinion that the town has several options. (1) Leave unimproved on theory that it is not the town’s obligation. (2) Make the improvements based on what the town feels is appropriate and fair. Property owner has the option to improve it himself, but town has obligation to maintain it or litigate the issue. After discussing the options the board feels that they needed to look at cost figures and Highway Superintendent to obtain cost figures. Regular Town Board Meeting Minutes 6/14/00 3 Monthly Bills – Supervisor Owens presented the monthly bills for payment. Motion made by Councilman Holley, seconded by Councilman Schehr that the Town Board of Town of Enfield authorize the supervisor to pay General Fund vouchers #113 – 129, dated June 14th, 2000, in the amount $5,086.49. Highway Fund vouchers #58-75, dated June 14th, 2000, in the amount of $33,207.35. Small Cities (HUD) Grant III voucher #4, dated June 14th, 2000, in the amount of $2,560.30. Program Income vouchers 1 and 2, dated June 14th, 2000, in the amount of $1,498.37. Enfield Volunteer Fire Company voucher #SF6, dated June 14th, 2000 in the amount of $30,000.00. Discussion – Vote – Supervisor Owens, yes. Town Councilmen Holley, Schehr, Roach, yes. Town Councilman Stevenson was absent. Appointments – Supervisor Owens presented the following appointments of people to the position of cemetery caregivers. Roger Laue – Christian Cemetery - $480.00. Jack Allen – Budd Cemetery - $350.00 and Rolfe Cemetery - $700.00. Wayne Snyder – Presbyterian Cemetery - $800.00. Motion made by Councilman Schehr, seconded by Councilman Holley that the Town Board of the Town of Enfield approve the appointment of the following people as Town of Enfield Cemetery caregivers. Roger Laue – Christian Cemetery - $480.00. Jack Allen – Budd Cemetery - $350.00 and Rolfe Cemetery $700.00. Wayne Snyder – Presbyterian Cemetery - $800.00. Discussion – Vote – Supervisor Owens, yes. Town Councilmen Holley, Schehr, Roach, yes. Town Councilman Stevenson was absent. Flood Litigation 2000 Supervisor Owens presented copies of Tompkins County 2000 Flood Hazard Mitigation Program Project Applications from Judith Jones and Lynn and Marjorie Sheldon and copies of Katie Hackett’s, County Planning, e-mail to Ms. Jones to the Town Board members for their information. Guidelines of the project – Purpose of the program is to primarily minimize damages caused by future flood events. Mr. Jones and Mr. And Mrs. Sheldon are asking the town’s assistance in funding. Regular Town Board Meeting Minutes 6/14/00 4 Flood Litigation (cont’d) Ms. Jones project is in regards to a flooding creek that runs behind her property. Project total cost $7,000.00. Mr. and Mrs. Sheldon’s project is in regards to a pond on adjacent property that is seeping on to their property damaging their house. Project total $2,606.03. Supervisor Owens called board members attention to paragraph four of Ms. Hackett’s e- mail in regard to payment obligations. After lengthy discussion of the creek, distance of flooding area from road, distance of creek from Jones property, possibility of road flooding, road is a state road (DOT) not a town road. Town’s right of way around bridges, streams not being cleaned because of environmental concerns, etc. Consensus to the Town of Enfield Town Board was no action to be taken by the board. This is a private matter not a public matter. New York Rural Water Association Town’s application to the New York State Rural Water Association was approved for a water study. Planning Board Resignations – Supervisor Owens read Calvin Rothermich and Ann Chaffee’s letters of resignation from the Town of Enfield Planning Board. Calvin Rothermich’s resignation effective May 16th, 2000. Ann Chaffee’s resignation effective May 17, 2000. Supervisor Owens talked with Gene Endres and he has agreed to extend his resignation date from the Town of Enfield Planning Board to September 10th, 2000. Motion made by Councilman Holley, seconded by Councilman Roach that the Town Board of the Town of Enfield accept the resignation of Calvin Rothermich from the Town of Enfield Planning Board effective May 16, 2000 and Ann Chaffee’s resignation from the Town of Enfield Planning Board effective May 17th, 2000. Discussion – Vote – Supervisor Owens, yes. Town Councilmen Holley, Schehr, Roach, yes. Town Councilman Stevenson was absent. Regular Town Board Meeting Minutes 6/14/00 5 Census Map Census map was posted on the wall for road additions, deletions, address changes, etc. Adjournment Motion was made by Councilman Roach, seconded by Councilman Holley that the regular monthly meeting of the Town of Enfield Town Board adjourn. Discussion – Vote – Supervisor Owens, yes. Town Councilmen Holley, Schehr, Roach, yes. Town Councilman Stevenson was absent.
