TOWN OF ENFIELD ENFIELD
REGULAR TOWN BOARD MEETING MINUTES
WEDNESDAY, NOVEMBER 10, 1999
6:30 P. M.
The regular monthly meeting of the Town Board of the Town of Enfield was held
Wednesday, November 10th, 1999 at the Enfield Community Building, 182 Enfield Main
Road, Ithaca, New York at 6:30 p.m. Supervisor Owens presiding.
Present - Supervisor, Jean Owens: Town Councilman, Gary Fisher, Town Councilman,
Donald Lovelace; Town Councilman, Joe Schehr, Town Councilman, Greg Stevenson.
Others present were, Highway Superintendent, Ron Updike; Bookkeeper, Pat Podufalski,
Town Clerk, Alice Laue.
Pledge of Allegiance to the Flag
Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag.
Privilege of the Floor
Supervisor Owens announced that upon the advice of the Association of Towns’ legal
council, Kevin Crawford, Councilman Stevenson would be recusing himself from talking
about or voting on the fire company budget and contract. Councilman Stevenson has
agreed to do so
Peggy Hubbell asked what was happening with the new HUD Grant?
Supervisor answered. Met with Better Housing and County Planning. Began discussing
the beginning of the grant. A lot of ground work needs to be done. Applications being
sent to those completing survey who showed an interest, to see if they still are interested.
Bambi Bowman and Bertha Hubbell asked for clarification of what Councilman
Stevenson would not be voting on.
Supervisor Owens answered - Councilman Stevenson would not be voting on fire
company budget or contract.
Philip Grover - Would like to put a small windmill on his property and asked if there
were any regulations about putting up towers.
Supervisor Owens answered, if tower is not over 100 feet high there was no problem.

Approval of October 13th, 1999 Regular Town Board Meeting Minutes
Correct on Page two - Harvey Hill Road Bridge. Correct last sentence to read -
Superintendent Updike told Mr. Lampman the only way he would sign off was with a
covenant in it that the bridge will pass the inspection of the state with the way the
abutments are showing. East outflow abutment showing at the old base and he is
concerned whether the stones will remain.
Motion made by Councilman Lovelace and seconded by Councilman Schehr that the
Town Board of the Town of Enfield approve the adoption of the October 13th, 1999
Regular Town Board Meeting Minutes as amended.

Minutes of the October 13th, 1999 Public Hearing.
Motion made by Councilman Lovelace and seconded by Councilman Schehr that the
Town Board of the Town of Enfield approve the adoption of the October 13th, 1999
Public Hearing minutes.
Discussion-
Vote - Supervisor Owens, yes. Town Councilmen Fisher, Schehr, Stevenson, yes.
Town Councilman Lovelace abstained.
Reports/Committees
Tompkins County Representative Peter Penniman/Dan Winch
Representative Penniman spoke about the Economic Development Strategy Plan.
Representative Winch thanked Councilman Fisher for attending the County Board budget
hearing and speaking to the body about his concerns.
HUD Grant - Enfield has benefited from two grants. Community has done well with
these grants. Grant that is being worked on now, is breaking new ground. Assisting low
income residents, who meet the critera, with replacing homes with modulars and or stick
built homes. Grant will be watched over and looked at by the HUD agency.
Recreational Partnership - no report
Enfield Community Council -Jack Kulp, President
Community Council Newsletter editor resigned.
Band Fest - President Kulp asked the town board for permission to hold a Band Fest -
12/18/99 at the Community Building. Oral permission was given by the board.

Enfield Fire Company - Dennis Hubbell, President
Quarterly report was given to board members.
Busy working on OSHA compliance’s. Board of Directors have asked for a time
extention.
Y2K- Emergency Service and Fire Company are ready. Biggest concern is the phone
lines.
Highway - Superintendent Updike
Highway crew finished shoulder work with neighboring towns, Newfield, Caroline,
Ithaca. Put in a couple of driveway pipes, one on Black Oak Rd and one on South Buck
Hill Road, Today finished grading gravel spots and have been patching potholes.
Annual Snow and Ice Contract
Superintendent Updike presented the Annual Snow and Ice Contract from County
Highway. Two year contract, as done in the past. Its for plowing of specific county roads
we plow. We are paid based on the county’s efforts on State highways the previous year.
This year contract reflects a 2.3% decrease. Superintendent Updike has talked with Ward
Hungerford about this and no agreement has been reached. Town’s number of runs this
past winter were identical to the number of runs the previous winter. Contract is signed
every two years, covers 2000 -2002. Same language as before were it explains, if the
town no longer wants to plow county roads to void contract the town has to let the county
know by 1/2001.
Abandonment of Butternut Creek Road
Highway Superintendent Updike read resolution for Abandonment of Butternut Creek
Road written by Town Attorney, Robert Mulvey.
Butternut Creek Road is a seasonal road, closed winter months. Landowner Tom Brown
and Robert Treman State Park would like six tenths (.06) of this road abandoned.
Procedure - Qualified abandonment - Gates can be erected at each end. If a gate, they
have to be a minimum of ten feet openings which have to be chained not locked. Town
still holds right of way, even though its an abandoned road. If road is abandoned and
later if landowner/landowners wants road opened landowner/landowners have to build
road to town specifications. Public Hearing on abandonment of road is handled by
County Highway Superintendent.
Discussed need of something in writing from landowners that they are in agreement with
the abandonment of Butternut Creek Road. Highway Superintendent to look into
something signature wise.

Subpoena
Bulldozer on right of way on Griffin Road for four years. Highway Superintendent would
like this piece of equipment moved. Town is liable if something should happen. After
papers are served and equipment is not moved, equipment owner is liable if something
happens.
Supervisor to talk with owner of bulldozer.
Agreement to Spend Town Highway Funds
Superintendent Updike talked to the State Comptroller’s office. Law has been changed,
money can be transferred from 5110 line in the Highway Budget, if the total amount of
line is on the Agreement to Spend Town Highway funds. Need to edit Agreement to
Spend Highway funds. Amount needs to be changed and initialed by board members.
Amount needs to be changed from $110,000.00 to $106,174.59. Transferring $3825.41
from 5110.4 line to 5141.2 line.
Environmental Management Council -
Barbara Ebert, Environmental Management Council spoke on the need of a representative
from the Town of Enfield appointment to the Environmental Management Council.
Cemetery Committee - Peggy Hubbell
Clarke Marshall finished working in Christian Cemetery for this year.
John Meeker hand dug seven bases in Budd Cemetery. If weather holds he will complete
four bases this week.
Cemetery Chairperson, Peggy Hubbell, asked if the board wanted to transfer money from
the Cemetery Memorial fund to pay John Meeker’s bill of $235.88 or wait until next year
to pay it from the Cemetery fund. John is to proceed with work. Bases not completed are
to be taped off with yellow tape.
Cemetery Clean-up Saturday, November 13th, 1999.
TV Cable Contract - Gary Fisher
To date, Councilman Fisher hasn’t received a copy of the proposed Cable TV Franchise
Agreement. Public Hearing is needed. Public Hearing is to be advertised for 12/8/99 at
6:30 p.m., contingent on receipt of proposal

Motion made by Councilman Fisher, seconded by Councilman Lovelace that the Town
Board of the Town of Enfield authorize the Town Clerk to advertise a Public Hearing on
the proposed Cable TV Franchise Agreement contingent on receipt of proposal for
12/8/99 at 6:30 p.m.

Budget Amendments -
Cemetery Fund Resolution
Resolution to transfer cemetery funds was made by Councilman Fisher and seconded by
Councilman Schehr.
WHEREAS, the Town of Enfield Cemetery Committee has arranged to reset seven (7)
stones in Budd Cemetery, and,
WHEREAS, the cemetery contractual appropriation in the 1999 budget has a balance of
minus one dollar and no cents (-$1.00), now,
THEREFORE BE IT RESOLVED, that $235.88 be transferred from the Budd Cemetery
Account at MBIA to a general fund interfund revenue line. Interfund transfer (Budd
Cemetery) 5031.0 and the cemetery contractual line 8810.4 be increased by $235.88.

Motion made by Councilman Schehr, seconded by Councilman Lovelace that the Town
Board of the Town of Enfield approve the following amendments to the 1999 Town of
Enfield budget.
Transfer from DA 5110.4 $3,825.41 to DA5142.4
Transfer from A1620.411 $200.00 to A1620.412
Transfer from A1620.423 $154.57 to A1620.424
Transfer from A1990.4 $1.00 to A8810.4

Bills/ Reports
Supervisor Owens presented the monthly bills and the monthly Supervisor’s Report.
Councilman Fisher questioned $36,050.00 from Equipment Reserve fund MBIA account
for October, 1999, without board authorization.
Supervisor answered $29,000.00 deducted to meet highway payroll. Equipment Reserve
to be reimbursed in December.
Councilman Fisher - This is the reason for a cash flow statement to reflect cash flow as
requested by Councilman Lovelace in the Spring of 1999.
Supervisor answered - No other options, important men’s payroll be met.
Councilman Fisher asked the question. What is the supervisor going to do about paying
interest on money borrowed.
Monthly Bills -
Motion made by Councilman Lovelace, seconded by Councilman Stevenson that the
Town Board of the Town of Enfield authorize the supervisor to pay General Fund
vouchers # 165-193, dated 11/10/99, in the amount of $6,020.96. Highway Fund
vouchers # 144-157, dated 11/10/99, in the amount of $13,133.46. Small Cities Grant I,
(HUD) voucher #4, in the amount of $7,940.00 Small Cities Grant II, (HUD), voucher #
13, dated 11/10/99, in the amount of $249.64.

Resolution - Equipment Reserve
Resolution made by Councilman Fisher, seconded by Councilman Lovelace.
WHEREAS, Twenty nine thousand dollars ($29,000.00) of Thirty-six thousand, fifty
dollars ($36,050.00) transferred from the Equipment Reserve account on October 19th,
1999 was not previously authorized by the Town Board, now,
THEREFORE BE IT RESOLVED, that the twenty nine thousand dollars ($29,000.00)
will be repaid to the Equipment Reserve by December 31st, 1999 with interest paid on
this twenty nine thousand dollars($29,000.00) computed at five percent (5%) straight
interest from October 19th, 1999 Highway accounts.

Budget 2000
As Councilman Stevenson has recused from voting on the fire company budget the
budget will be voted on in two parts. (1) General Fund and Highway Fund, (2) Fire
Company Budget
Discussion -
Budget Changes - General Fund
Records Management line 1460.41 add $500.00 for purging court records increasing line
to $600.00.
Create line 1670.4 Central Printing and Postings at $600.00.
Decrease line 1670.415 to $1400.00.
Town Barns line 1620.423 street lights change to 5182.4 - $400.00.
Reduce Town Barns (light and power) 1620.423 to $3100.00.
Highway Fund
Councilman Fisher - Highway Superintendent is looking at the possible purchase of a
new or used excavator.
Reduce Equipment line DA5130.2 from $45,000.00 for excavator purchase to -0-.
Increase Equipment Reserve line DA9901 to $40,000.00. Ear mark that $45,000.00 is to
be used for excavator purchase.
Medical Insurance Retirees A9060.82 - $1400.00.
Services to other Governments - DA5148.1 Personal Services -0-. Fuel DA5148.4 -0-.
Create line Brush & Weeds DA5140.1 -0-.
Motion made by Councilman Schehr, seconded by Councilman Lovelace that the Town
Board of the Town of Enfield approve the 2000 Town of Enfield General Fund and
Highway Fund budget as presented.
Discussion -
Vote - Supervisor Owens, yes. Town Councilman Fisher, yes. Town Councilman
Lovelace, yes. Town Councilman Schehr, yes. Town Councilman Stevenson, abstained.
Fire Company Budget - 2000
Discussed the fire company budget in length.
Discussed stipend being taken out of budget and moved to administration.
Reimbursement for all members out of pocket costs What out of pocket costs were -
Mileage on personal vehicles for training, transporting of fire vehicles for service. Does
fire company feel it is going to be using $3,000.00 to cover mileage costs.

Councilman Lovelace would like to see $3,000 reduced.
Councilman Fisher- This is new to the fire company. It is a guess on their part to the
amount. Councilman Fisher assumes not all training mileage is reimbursable.
Councilman Lovelace - It shouldn’t cost anyone over and above what it costs to go to
fires or training which you know you have to go to when you volunteer to be a fireman.
Anything over and above that you should be reimbursed for. He feels $3,000.00 more
than is going to be used for out of pocket expenses.
Councilman Schehr agrees with Councilman Lovelace, specifically change from stipend
to expense. Believes that volunteers that donate their time shouldn’t have to pay
extraordinary expenses.
Councilman Fisher - Need to come to a mutual solution. Reimbursement for equipment
should be budgeted on equipment line. $3000.00 high, number should be in the
neighborhood of $1,000.00.
Loan principal and interest rates $2,000.00 over, reduce to $1000.00.
Councilman Lovelace proposed that the loan be taken down by $1,000.00 and $3,000.00
down to $1500.00.
As the person from the fire company who could answer the questions the town board
members had was not present when the fire company budget was discussed, the fire
company budget was not voted on at the November 10th, 1999 meeting.
HUD Lien
Supervisor Owens presented Elizabeth McFall’s request for a Diminishing Subordination
Agreement Lien.
Motion made by Councilman Stevenson, seconded by Councilman Lovelace that the
Town Board of the Town of Enfield authorize the supervisor to sign the Diminishing
Subordination Agreement Lien for Elizabeth McFall.

Motion made by Councilman Lovelace, seconded by Councilman Stevenson that the
November 10th, 1999 regular meeting of the Town Board of the Town of Enfield
adjourn.
