The regular monthly meeting of the Town Board of the Town of Enfield was held - Wednesday, January 13th, 1999 at the Enfield Community Building, 182 Enfield Main Road, Ithaca,N.Y. at 6:30 p..m.. Supervisor Owens presiding. Present: Supervisor Owens; Town Councilman, Gary Fisher, Town Councilman, Donald Lovelace; Town Councilman, Greg Stevenson. Town Councilman, Tom Drew was absent. Others present, Highway Superintendent, Ron Updike; Bookkeeper, Pat Podufalski and Town Clerk, Alice Laue. Pledge of Allegiance to the Flag - Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag. Privilege of the Floor - No one wished to speak. Approval of the 12/2/98 regular Town Board Meeting Minutes. Under Privilege of the Floor correct spelling of Sargeant to Sergeant - Satilite to Satelite. Under Approval of the Minutes correct spelling of Commerative to Commemorative. Correct Regualr to Regular. Under Tompkins County Board of Representative correct to read - Budget did include majority of money, and county will find the rest of the money. Insurance - Correct polocies to policies. Add the word comparison after the word summary - Reason for reduction before Capitalization Fee. Add the word the be 40%. Put a comma after word period. Add the word and before every. TCAT Add- Consensus of the town board and Highway Superintendent Updike is that TCAT will not be allowed to turn around at the Town Hall/Highway Department grounds. Motion made by Councilman Lovelace, seconded by Councilman Stevenson that the Town Board of the Town of Enfield approve the adoption of the 12/2/98 regular Town Boarad Meeting minutes as amended. Discussion - Vote - Supervisor Owens, yes. Town Councilmen, Fisher, Lovelace and Stevenson, yes. Town Councilman, Tom Drew was absent. 12/22/98 Joint Board Meeting with the Town of Ulysses and Town of Enfield Additions/corrections Paragraph Four - Correct spelling of excepted to accepted. Motion made by Councilman Stevenson, seconded by Supervisor Owens that the Town Board of the Town of Enfield accept the minutes of the Joint Meeting between the Town of Ulysses and Town of Enfield Town Boards submitted by Town of Ulysses Town Clerk Marsha Georgia, as amended. Discussion - Vote - Supervisor Owens, yes. Town Councilman Fisher, Stevenson, yes. Town Councilman abstained. Town Board Meeting Minutes 1/13/99 3 12/2/99 Public Hearing Minutes - After the question Peggy Hubbell asked, add - No answer was provided. Under Discussed, where ever the word Paragraph appears change that word to Section. Add Councilman Stevenson stated information requested from fire company has always been given to the town board upon request from town board. Motion made by Councilman Stevenson, seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve the adoption of the 12/2/98 public hearing minutes as amended. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Fisher, Lovelace, Stevenson, yes. Town Councilman Drew was absent. 12/30/98 Public Hearing Minutes Last paragraph correct spelling of word Publice to Public. Add, No member of the public was present. Motion made by Councilman Stevenson, seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve the adoption of the 12/30/98 Public Hearing Minutes as amended. Discussion - Vote - Supervisor Owens, yes. Town Councilmen, Fisher, Lovlace and Stevenson, yes. Town Councilman Drew was absent. 12/30/98 Special Town Board Meeting Minutes - Correct spelling of Enfiled to Enfield, seconced to second, 19998 to 1998, presnted to presented, dooing to doing, taxpaayers to taxpayers. Change SSupovisor' Ccontingency to Supervisor's Contractual line. Add - From Contingency Fund 1990.4 before $123995, correct Manaagaement to Management. Correct adddption to adoption, Aamendments to Amendments. Contingency to Contractual, Rrecords to Records, Motiom to Motion, Plane to Plan, add Law after Review, Ssupervisor to Supervisor. Coouncilman to Councilman. Change Disabilities and Liaabilities to Limited Income and after the word taxes add for disabilities and limited liabilities. Motion made by Councilman Stevenson, seconded by Supervisor Owens that the Town Board of the Town of Enfield approve the adoption of the 12/30/98 Special Town Board Meeting Minutes as amended. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Fisher and Stevenson, yes. Town Councilman Drew was absent. Town Councilman Lovelace abstained. 10 Town Board Meeting Minutes 1/13/99 4 Subordination Agreement for Diminishing Lien David and Holl Stevenson Supervisor Owens presented David and Holly Stevenson's request for a Subordination Agreement for a Diminishing Lien. Discussion - Councilman Stevenson - On some past subordination requests some members of the town board have expressed concerns over some specifics of the subordintion requests. The way this subordination request is prepared, objectives of subordination and goal on the part of the home owners is clear and answers questions board has had on previous subordination requests. Counciclman Fisher - When Karl Heck, Tompkins County Planning, was at the last meeting, he indicated that for some of the charges we were having to use the HUD funds for were paying the county to review the paperwork and what county had to do to process the loan subordinations that had been approved by the town. On several occasions, in past discussions, when the board approved the subordination the town board indicated that there would be no expense to the town, and when using HUD funds, which no one on the town board appeared to be aware of, for processing of loan subordination paperwork, ratherthan the purpose HUD grants were obtained, I, as one, am unwilling to support what the county has to do to process subordinations. When contracts were orginally signed people knew what contract was, if they want to modify that, then they should bear the expense of that rather than taking it out of monies that were sent down to do housing rehabilitation. Councilman Lovelace asked Councilman Fisher if he knew what amount the town was being charged. Councilman Fisher - No, that is one of the things we stated we would not pay the bill for until we got a detailed breakdown of what the charges were. Counciclman Fisher asked who was going to pay for the Stevenson subordination. He feels fees should not be coming out of monies granted for housing rehabilitation. Councilman Stevenson - Unfair to switch gears in mid -stream. We have done subordination without asking people to pay out of their own pockets for subordination fees. Supervisor Owens - Request and reasoning why asking for subordination will do nothing except improve their housing and thereby improve the housing stock of this community. At this point as there has been no expense to the HUD Grant or this town, she believes it is appropriate to make improvements and let them take advantage of the lower interest rates. Councilman Fisher - Need a clause in motion that states no HUD monies will be used to process this subordination. Any process expense by the county willl be charged to the individual. Town Board Meeting Minutes 1/13/99 5 Motion made by Councilman Stevenson, seconded by Supervisor Owens that the Town Board of the Town of Enfield approve the granting of the Subordination Agreement of the Diminishing Lien request from David and Holly Stevenson. Pending a positive review from the county attorney. Discussion - Councilman Fisher can not support this motion without the clause that states no HUD monies will be used to process this subordination. Any process expenses by the county will be charged to the individual. Councilman Lovelace in agreement with Councilman Fisher. When board first went into subordination, board said at no cost. Until the last board meeting the board didn't realize there was a cost and if we are going to subordinate on the loan it should not be a problem for the individual we are doing this for, for them to pay the costs. Motion amended to read - Motion made by Councilman Stevenson, seconded by Supervisor Owens that the Town Board of the Town of Enfield approve the granting of the Subordination Agreement of the Diminishing Lien request from David and Holly Stevenson. Pending a positive review by the town attorney and at no cost to the Town of Enfield. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Fisher, Lovelace, Stevenson, yes. Town Councilman Drew was absent. Ward Subordination Request - Tabled for more information. Reports/Committees County Board of Representatives - Dan Winch/ Peter Pennimen Representative Winch noted that the county needs to do their Organization Resolution. Acquifer Study - During budget process Water Resource Council had as a priority the finishing of the Acquifer Study of Tompkins County. It failed through the budget processs to be funded and Don Barber, Supervisor of the Town of Caroline, picked up on it as being an excellent planning tool and that there was a lot of interest in completing this study. During land fill site process about 60% of study was completed. U. S. Geological Survey people willing to do work on a cost sharing bases. Cost approximately $45,000.00 to complete and county share would be $27,000.00. There is a lot of interest from the rural municipalities in seeing the survey completed and they would like the information to use as a planning tool. Representative Winch in favor of HUD Block Grant program for Enfield. Supervisor Owen asked for a resolution supporting the completion of the county wide Acquifer Study. 12 Town Board Meeting Minutes 1/13/99 6 Councilman Fisher - Supposedly this is some thing the county started back in the mid 80's. The county board apparently provided funds initially and then withheld funds for the past 10-12 years, what are the reasons for withholding funds? Answer, original study done during land fill site investigation, and after getting out of the business of looking at sites for land fill, acquifer study was put on the shelf and is just now resurfacing. Motion made by Councilman Stevenson, seconded by Councilman Lovelace that the Town Board of the Town of Enfield go on record as supporting the county funding of the completion of the Acquifer Study done by U.S. Geological Survey. Discussion - Councilman Fisher - Water Resources budget request was deleted from county budget? Who deleted it? Answer, County Board of Representatives Back to reason why deleted and is it only time deleted? Answer, only time brought up since land fill site. Reason deleted, county trying to trim budget and not enough support to keep it in the budget, so there was a motion to delete it. Vote - Supervisor Owens, yes. Town Councilmen Fisher, Lovelace Stevenson, yes. Town Councilman Drew was absent. Representative Pennimen Town of Ulysses approved supporting Acquifer Study completion. Representative Pennimen will support it at the county level. He needs to learn more about the Block Grant program. Enfield Communty Council - Jane Murphy Reviewed Community Council's 1998 calendar of yearly activities. Recreation Partnership Program contract is up this year and Town of Enfield has not had a representative on that board for three years. Community Council wants the board to be aware that when the Community Council did the budget presentation for the town, they didn't have actual confirmed numbers for State and County aid, but have them now. Community Council is asking that the town budget be adjusted basically to reflect the net loss of $272.00 from anticipated $3,000.00 from county. Community Council is getting $2500.00, loss of $500.00, but are getting an additional $228.00 State Aid revenue. Community Council would like to have contract payments made monthly. Discussion - Councilman Lovelace asked if the board could have some idea next month how monthly payments would affect town's cash flow. 13 Town Board Meeting Minutes 1/13/99 7 Councilman Fisher - Need projected cash flow for entire budget. Jane Murphy asked for a resolution to adjust budget. Consensus - Board needs to look at town's cash flow before making any decisions. Community Council asking that the town budget be modified to reflect that the town is going to be getting $272.00 less in aid than Community Council reported at budget time. They want the board to decease the appropriation line and decrease the revenue in another line and increase the appropriation line and increase the revenue line on another line which give a total net loss in revenue of $272.00 for the town. Councilman Fisher - Do we modify it or do we say, we have our budget and we know we are going to get more or less revenue on some of these lines and ignore it? As long as not getting billed for money we don't have, it will balance out. Fulfilling contract and ignore fact we are getting less revenue then anticipated. The reason he stated this is that last year board did budget like that, didn`t adjust line, just showed we had more revenue than we had originally budgeted for and at the end of the year we knew we had a little more in this line and a little less in this line. Basically reason for asking is how are we going to handle it? Councilman Fisher asked for a decision on how to handle this. Supervisor Owens - Contract payments are the same. We know we are going to have a decrease of $272.00 in revenue line, but are not making an adjustment presently on budget line. Fire Department - Dennis Hubbell, President Not prepared to present anything tonight. Next month presenting annual report. Board provided with complimentary reports, one being new slate of officers. Highway Department - Superintendent Updike Exceptional Fall, worked on Bostwick Road until Friday before Christmas. Completed more than anticipated. Got to the point where they can't go any further until Sspring. Cemetery Committee - Peggy Hubbell Didn't meet in January. Budget Amendments for Fiscal Year Ending 12/31/97. Councilman Fisher - Highway Superintendent needs to meet with Sally Alario to discuss highway budget which has some discrepancies in line items before budget amendments acre made Tabled for 1/20/99 Special Board Meeting. 14 Town Boaard Meeting Minutes 1/13/99 Monthly Bills - Supervisor Owens presented monthly bills for payment. Need to add two prepaid bills to General Fund bills, list Bell Atlantic, town barns, A1620.4, $42.33, voucher #14, MCI, town hall, $19.01, A1620.412, voucher #15. Motion made by Councilman Lovelace, seconded by Councilman Stevenson that the Town Board of the Town of Enfield authorize the supervisor to pay General Fund vouchers, 1-7, (void #8) 9-15, dated 1/13/99, for a total of $4,035.28. Highway Fund vouchers, #1-4, dated 1/13/99, for a total of $22,227.12. Enfield Fire Company voucher SF -1, dated 1/13/99, for total of $18,000.00. Discussion - Vote - Supervisor Owens, yes. Town Councilmen, Fisher, Lovelace, Stevenson, yes. Town Councilman Drew was absent. Exemptions - Supervisor Owens asked if there was any further discussion on Exemptions Councilman Fisher - Requirement is to see if board wants to change them Disability Exemptions under 65 years of age. Don't know who there might be out there who has exemption right now. Depends on income level set. Councilman Stevenson - Catagories, broad group of individuals. Motion made by Councilman Stevenson, seconded by Councilman Lovelace that the Exemptions to property tax for Veterans and Senior Citizens in the Town of Enfield be left as they are at this time and no persons with disabillities exemptions be established at this time. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Lovelace and Stevenson, yes. Town Councilman Fisher abstained. Town Councilman Drew was absent. 1999 Organizational Resolution #3 1999 Organizationaal Resolution was reviewed. Policies reviewed and revised. Policy Revisions Policy 100.2 Payroll Activities Motion made by Councilman Fisher, seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve the adoption of the following policy changes: 100.2 A Change an independent payroll service to town bookkeeper. 100.2 C Change the payroll service to a payroll service if used. Town Board Meeting Minutes 1/13/99 E Payroll Schedule - Monthly payrolls paid last business day of the month. Quarterly payrolls paid last business day of quarter. Bi -weekly payrolls paid every other Friday starting with 1/15/99. Discussion - Vote - Supervisor Owens, yes. Town Councilman Fisher, Lovelace, Stevenson, yes. Town Councilman Drew was absent. Haefle Contract - Motion made by Supervisor Owens, seconded by Councilman Stevenson that the Town Board of the Town of Enfield authorize Councilman Fisher, Chairperson of Haefle TV Contract Committee, contact Haefle TV in regards to contract negotiations. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Lovelace and Stevenson, yes. Town Councilman Fisher abstained. Town Councilman Drew was absent.
