The regular monthly meeting of the Town Board of the Town of Enfield was held Wednesday, February10th, 1999 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, N. Y. at 6:30 p.m.. Supervisor Owens presiding. Present: Supervisor, Jean Owens; Town Councilman, Gary Fisher; Town Councilman, Donald Lovelace; Town Councilman, Greg Stevenson. Town Councilman, Tom Drew was absent. Others present, Highway Superintendent, Ron Updike, Bookkeeper, Pat Podufalski and Town Clerk, Alice Laue. Pledge of Allegiance to the Flag - Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag. Privilege of the Floor - Bambi Bowman objected to meeting being changed to the second Wednesday of the month. Peggy Hubbell asked questions about HUD Grants. (1) New grant, if people get what they want, is it a free gift or a low interest loan? Supervisor Owens answered, none of these decisions have been made as to exactly how grant money would be administered. If we receive the grant and the Town Board decides to accept and receive it, there would be a decision by the Town Board as to how that money would be administered. (2) Were previous grants out right gifts or low interest loans? Supervisor Owen’s answered, basically earned at a rate of 20% a year for a five year period If you lived on your property for five years you owed nothing back. If you lived on your property for four years and decided to sell you would have to pay 20% of it back. When grant money is received a lien is placed on property for amount of the grant received for the rehabilitation of their home. After a five year period this signed agreement(lien) is no longer in effect. Correspondence - (1) Letter from Town Attorney, Robert Mulvey regarding the town’s contract to pay Small Cities services. (2) Letter from Finger Lakes Land Trust in regard to their receiving a gift of 26 acres of land on the South side of Iradell Road from William Lower. Subordination Agreement - Floyd A. Peterson, III rd. Supervisor Owens presented Floyd A. Peterson, III rd’s request for a Subordination Agreement of Diminishing Lien. Town Board Meeting Minutes 2-10-99 2 Councilman Fisher requested that the supervisor go back to letter from town attorney on contracts to Small Cities. Question was not that we had to pay legitimate expenses, question was, expenses that we had no knowledge of that we would be charged for including costs of subordination agreements of loans Supervisor Owens answered, she felt we needed legal advice as if in deed charges from the county for administering the grant included investigating subordination agreement requests and the town attorney determined they were in deed reasonable charges to be made and charges assumed by HUD would be made against HUD grant monies. Councilman Lovelace - Money for Subordination Agreement requests should not come out of HUD money or town money. Person requesting subordination agreement should pay bill for it. Councilman Fisher - We should have a requirement that there would be no cost to HUD or the town. Councilman Stevenson - We need continuity in granting Subordination Agreement of Diminishing Liens. Motion made by Councilman Fisher, seconded by Councilman Lovelace that the Town Board of the Town of Enfield subordinate the HUD Diminshing Lien Agreement to the first mortgage, Marathon Capitol Limited Partnership for the property located at 1644 Mecklenburg Road, currently owned by Floyd A. Peterson, III provided that Mr. Peterson pays all associated closing costs incurred and reviewed by the county and or the attorney for the Town of Enfield. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Fisher, Lovelace, Stevenson, yes. Town Councilman Drew was absent. Harvey Hill Bridge - John Lampman John Lampman of the Tompkins County Highway Engineering Department presented the county’s possible rehabilitation plans for Harvey Hill Bridge. Total project cost estimated in the neighborhood of $162,000.00, which does not include cost of design. County to pay initial cost, town to reimburse 20% share when bridge is completed. Schedule - Bids advertised and received, late March, early April. Start work May, perhaps June. Completed in August. Committees - Tompkins county Board Representative Peter Pennimen reported he will be looking into subordination agreement fees. He is getting familiar with his new role and responsibilities. He and Dan Winch are working on library services. County is making progress on jail space study. Councilman Fisher brought up the strewing of recycling materials by recycling service. Town Board Meeting Minutes 2-10-99 3 Enfield Community Council - Joe Schehr Jim Wallace, who runs a basketball program at the Enfield School, has completed a fifth grade basketball program and is starting a fourth grade program. Community Council has been asked to sponsor a Friday night basketball program for adults. There is also a teenage and adult volleyball program. Teen program movement incrementally. Newsletter - New editor for newsletter. Community Council applied for and received a not for profit mailing permit which should cut down on mailing costs. Summer Camp planning has started. Bookkeeper is sending monthly report to Town of Enfield to address Workmens Compensation situation. 1998 Fall Festival netted $1,500.00. Election of Officers held. Officers for 1999 to remain the same. Jane Murphy volunteered to act as the Enfield representative to the Recreation Partnership Progam. This is only a one year commitment. Fire Company - Dennis Hubbell, President President Hubbell presented 1998 end of the year annual report and beginning figures for 1999. Morton Building to be replacing entire roof on fire station. This is warranty work being done at no cost. Problem is with the paint. Fire Company gains a 10 year warranty. Highway Department - Highway Superintendent Ron Updike Superintendent Updike reported he had contacted Beam Mack and there is no concrete date for truck delivery. Beam Mack is looking at week of 2/22/99. Superintendent Updike asked the Town Board for a resolution allowing the town to participate in Cooperative Purchasing of Highway Services with the County. Motion made by Councilman Fisher, seconded by Councilman Lovelace that the Town Board of the Town of Enfield grant authorization to Highway Superintendent, Ron Updike, to participate in the Cooperative Purchasing of Highway Services with the County . Discussion - Vote - Supervisor Owens, yes. Town Councilmen, Fisher, Lovelace, Stevenson, yes. Town Councilman Drew was absent. Highway Superintendent Updike asked the Town Board members to sign the 1999 Authorization to Spend Highway Funds for work on E. Enfield Center Road between S. VanDorn Rd. and S. Applegate Rd. (shimming, 2 1/2 inch cold mix, seal and do shoulders). Double coat of 1 and 1A stone on Aiken Road between Waterburg Road and N. Buck Hill Road. Regravel Tucker Road. General highway repairs to be done on 44.45 mile of highway which includes sluices, culverts, bridges having span of less than 5’ and boardwalks and renewal thereof. Town Board Meeting Minutes 2/10/99 4 Councilman Fisher asked what was planned for Stevenson Hill (Harvey Hill Rd). Superintendent Updike - This summer hoping to get ditching cleaned up, spot patching . Trimming and leveling, then next year a 2 1/2 inch coat. Councilman Fisher concerned about the base breaking up to the point that in another year there may not be a base to put a top coat on. Superintendent Updike asked the Town Board to sign the 1999 Agreement to Spend Town Highway Funds. Motion made by Councilman Stevenson, seconded by Councilman Fisher approve the signing of the 1999 Agreement to Spend Town Highway Funds by the Town Board of the Town of Enfield. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Fisher, Lovelace and Stevenson, yes. Town Councilman Drew was absent. Cemetery Committee - Peggy Hubbell Cemetery Committee doesn’t meet during the Winter Months. Planning Board - Meeting at the Town Hall at the time of this meeting. 1999 Budget Amendments - Supervisor Owens presented and asked for the following 1999 budget amendments. (1) Transfer from Contingency - line 1990.4 - $1450.00 to line A3510.4 Dog Control. (2) Transfer from Contingency - line 1990.4 - $272.00 to line A7320.4 Community Council Supervisor Owens presented documentation from the SPCA for the $1,450.00 dog enumeration. Supervisor Owens requested an additional $272.00 for the Community Council to make up the short fall of monies anticipated Community Council would be receiving from the county. Monthly Bills - Supervisor Owens presented the monthly bills for payment Motion made by Councilman Lovelace, seconded by Councilman Stevenson that the Town Board of the Town of Enfield authorize the supervisor to pay General Fund vouchers #16 - 31, dated 2/10/99, in the amount of $6,220.91. Highway Fund vouchers #5 - 16, dated 2/10/99, in the amount of $11,560.68. Small Cities (HUD) Grant I, voucher #1, in the amount of $252.49. Small Cities (HUD) Grant II, vouchers 1 - 3, dated 2/10/99, in the amount of $2,773.22. Enfield Fire Company voucher SF -#2, dated 2/10/99, in the amount of $35,000.00. Vote - Supervisor Owens, yes. Town Councilmen Fisher, Lovelace, Stevenson, yes. Town Councilman Drew was absent. Town Board Meeting Minutes 2/10/99 5 Budget Admendments (continued) Motion made by Councilman Fisher, seconded by Councilman Stevenson that the Town Board of the Town of Enfield authorize the moving of $1,450.00 from Contingency, line 1990.4 to line A3510.4 Dog Control. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Fisher, Lovelace, Stevenson, yes. Town Councilman Drew was absent. Discussion concerning proposal by Community Council (Supervisor Owens stated that Jane Murphy from the Community Council reported last month that the monies from the county indicated a $272.00 short fall for 1999 contract year of the $3,000.00 anticipated from the county. Community Council was requesting town make up $272.00 difference and are requesting contract payments be made monthly. Councilman Lovelace and Councilman Fisher asked for a cash flow report. These two items were tabled until a cash flow report is obtained. Unfinished Business - Property Acquisition - Discussed the acquisition of 2.7 acres of property adjacent to the old town dump. Motion made by Councilman Lovelace, seconded by Councilman Stevenson that the Town Board of the Town of Enfield accept the proposed property acquisition of 2.7 acres of land adjacent to the old town dump and authorize the town attorney to begin a title search. Tax Map Parcel # 6-2-3.3. Discussion - Councilman Fisher feels there needs justification for town to require additional land. Vote - Supervisor Owens, yes, Town Councilmen Lovelace, Stevenson, yes. Town Councilman Fisher, no. Town Councilman Drew was absent. 1997 Budget Amendments - Councilman Fisher has concerns about these amendments. Supervisor Owens would like the Town Board to know the 1998 Annual Fiscal Report is almost completed. They, bookkeeper and supervisor, met with a representative from the State Comptrollers Office and upon submission of 1998 report a representative from the State Comptroller’s Office would be sent to help complete the 1997 report. Supervisor feels comfortable with having a State Comptroller representative review all the numbers and help complete 1997 report. Town Board Meeting Minutes 2/10/99 6 Councilman Fisher questions the need of using 1997 numbers to complete 1998 report. Supervisor advised State Comptroller’s Office accepting the report with the idea that after the 1997 report is done we could file an amendment with correct starting numbers. 1997 budget amendments tabled. Appointment of Jane Murphy to the Recreation Partnership Program Motion made by Councilman Lovelace, seconded by Councilman Stevenson that the Town Board of the Town of Enfield approve the appointment of Jane Murphy as the Town of Enfield representative to the Recreation Partnership Program for the calendar year 1999. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Fisher, Lovelace, Stevenson yes. Town Councilman Drew was absent. Councilman Greg Stevenson read his letter to the Town Board about the legality of his membership and service in the Enfield Fire Department and his service as a councilman for the Town of Enfield. Voting Machine School Supervisor Owens presented Roger Hubbell’s request to attend the Voting Machine School being held for Voting Machine custodians. Motion made by Councilman Fisher, seconded by Councilman Lovelace that the Town Board of the Town of Enfield pay the expenses of Roger Hubbell’s attending the Voting Machine School for custodians. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Fisher, Lovelace, Stevenson yes. Town Councilman Drew was absent. Audit Auditing of the 1998 General Fund and Highway Fund account books and Town Justice Warden’s books were completed. Town Board Meeting Minutes 2-10-99 7 Adjournment - Motion made by Councilman Lovelace, seconded by Councilman Stevenson that the 2/10/99 regular meeting of the Town Board of the Town of Enfield adjourn. Vote - Supervisor Owens, yes. Town Councilmen Fisher, Lovelace, Stevenson yes. Town Councilman Drew was absent.
