The regular monthly meeting of the Town Board of the Town of Enfield was held Wednesday, April 14th, 1999 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, New York at 6:30 p.m. Deputy Supervisor Greg Stevenson presiding. Present: Deputy Supervisor/Town Councilman, Greg Stevenson; Town Councilmen, Gary Fisher and Donald Lovelace. Supervisor, Jean Owens was absent. Others present were Highway Superintendent, Ron Updike; Book Keeper, Pat Podufalski and Town Clerk, Alice Laue. Pledge of Allegiance to the Flag - Deputy Supervisor Stevenson led the assemblage in the Pledge of Allegiance to the Flag. Privilege of the Floor - Peggy Hubbell asked when the Haefle TV contract was up. Councilman Fisher responded December 1999. Joe Schehr spoke about the timely response, professionalism and courtesy shown by the Enfield Fire Company when they responded to a brush fire he had. Approval of the 3/10/99 Regular Town Board Meeting Minutes - Motion made by Councilman Fisher, seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve the adoption of the March 10th, 1999 Regular Town Board Meeting Minutes. Vote: Deputy Supervisor Stevenson, yes. Town Councilmen, Fisher and Lovelace, yes. Supervisor Owens was absent. Correspondence - (1) Assessment Review Committee Meeting Tuesday, May 11th, 1999 at the Enfield Town Hall from 3 - 6 p.m. Regular Town Board Meeting Minutes 4-14-99 2 Reports/Committees - Tompkins County Board Representative Peter Pennimen Update on County Highway Department plans for highway improvements as of 3/16/99. Black Oak Road from Weatherby Road to Connecticut Hill Road., (1/2 mile). Connecticut Hill Road to Black Oak Road to Trumbulls Corners Road, (1 and 3/4 miles) for major repairs. Iradell Road from Halseyville Road to N. Van Dorn Road. Highway Superintendent Updike expressed his concerns about the end of Connecticut Hill Road on Trumbulls Corners Road around to the Town Line, there are no shoulders. Biggs Building back to the County and will go back on the real estate market. Enfield Community Council - Joe Schehr Continuing sports programs. Newsletter - Editor to submit a formulated thought as to what kind of advertising would be used. Summer Camp came in for a great deal of discussion over the month. Revamping the CIT program. Enfield Fire Company No report. Quarterly report due next month. Highway Department - Superintendent Updike Assisted the fire company, at their request, at the Traver fire to stir the debris. Started ditching. Superintendent Updike presented a town map showing roads, municipality, lakes, steams, tax parcels and building. etc. 1992 data used to produce map. A 1999 map is in the process of being generated. Highway Superintendent Updike asked for a resolution from the town board to consign two trucks to the Palmyra auction, Saturday, May 15th, 1999. Superintendent would like to consign the 1964 Brockway truck with Fox Spreader and the 1979 Auto Car, single axle dump truck. Resolution #6 - Truck Consignment to Auction 5/15/99. Resolution made by Councilman Fisher, seconded by Councilman Lovelace. WHEREAS, the Town Board of the Town of Enfield has determined that the 1964 Brockway single axle dump truck #M062478 with the 1980 Fox Cinder Spreader #560- 9-3720-007 and the 1979 Autocar single axle dump truck ,VIN #WA1FVGD088634 are excess to Highway Department requirements, and Regular Town Board Meeting Minutes 4-14-99 3 Resolution #6 cont’d) THEREFORE BE IT RESOLVED, that said 1964 Brockway single axle dump truck with 1980 Fox Cinder Spreader and 1979 Autocar single axle dump truck be consigned to the 14th Annual Palmyra Municipal Surplus Equipment Auction on Saturday, May 15th, 1999, and, FURTHER, the Town Board of the Town of Enfield authorize Highway Superintendent to sign the consignment contract, AND, all net proceeds, after commission is paid, will be deposited in the Equipment Reserve Account. Vote: Deputy Supervisor Stevenson, yes. Town Councilmen Fisher and Lovelace, yes. Supervisor Owens was absent. Adopted. Highway Superintendent Updike asked for a resolution to replace the dump body on truck #19. Body unsafe. Four bids obtained to replace truck body and Marro’s Equipment and Trucks Inc. bid of $7050.00 was lowest bid. Discussed - If anyone locally has had work done by Marro Equipment and Trucks, Inc., warranty, type of body, length of time truck out of service. Where money for purchase of truck body was coming from. Resolution #7 - Bid Acceptance from Marro’s Equipment and Trucks, Inc, for 1986 Mack Truck Body Replacement. Resolution made by Councilman Fisher, seconded by Councilman Lovelace. RESOLVED that the Town Board of the Town of Enfield accept the bid from Marro’s Equipment and Trucks, Inc. for the fabrication of a dump body for the 1986 Mack Truck in the amount of $7050.00, and FURTHER, that $7050.00 be transferred from the Equipment Reserve Account to Equipment Contractual line 5130.4. Vote - Deputy Supervisor Stevenson, yes. Town Councilmen Fisher and Lovelace, yes. Supervisor Owens was absent. Adopted Multi-module Money Highway Superintendent Updike reported that he has $28,754.33 left in Multi-module money that he would like to spend. Resolution #8 - Multi-module Money Resolution made by Councilman Fisher, seconded by Councilman Lovelace. WHEREAS, New York State DOT informed the Town of Enfield that $28,754.33 of the Multi-module grant money received by the Town of Enfield in 1997, remains to be spent, Regular Town Board Meeting Minutes 4-14-99 4 Resolution #8 (cont’d) THEREFORE BE IT RESOLVED that the 1999 Town of Enfield Budget is hereby amended as follows - Multi-module Contractual Line 5112.22 will be increased from 0 to $28,754.33, and Highway Reserve Line for Multi-module money 3505 will be increased from 0 to $28,754.33. Vote - Deputy Supervisor Stevenson, yes. Town Councilmen Fisher and Lovelace, yes. Supervisor Owens was absent. Adopted. Cemetery Committee - Peggy Hubbell Written minutes put in town board members mailboxes. Recreation Partnership - Jane Murphy Jane Murphy read written Recreation Partnership report. Census - Councilman Fisher Materials returned to Census Bureau. A number of errors were found in information sent by Census Bureau. Monthly Bills - Supervisor’s monthly report and monthly bills were presented. Supervisor Owens arrived at 8:45 p.m. Payment of Enfield Community Building phone bills was discussed. Motion made by Councilman Lovelace, seconded by Supervisor Owens that the Town Board of the Town of Enfield authorize the supervisor to pay General Fund vouchers #50 - 65, dated 4/14/99, in the amount of $4,165.03, Highway Fund vouchers #27 - 42, dated 4/14/99, in the amount of $20,454,54, Small Cities (HUD) Grant II voucher #6, dated 4/14/99, in the amount of $7,725.18 and Enfield Fire Company voucher SF1 #4, dated 4/14/99, in the amount of $35,000.00. Discussion - Buying of flowers for funerals not a legitimate town expense. Vote - Supervisor Owens, yes. Town Councilman Lovelace and Stevenson, yes. Town Councilman Fisher voted yes on all vouchers accept General Fund voucher #57 in the amount of $32.40 for flowers purchased by the Cemetery Committee. Regular Town Board Meeting Minutes 4/14/99 5 Unfinished Business - Telecommunication Supervisor Owens presented the proposed Planning Board telecommunication amendment to the Site Plan Review Law. Section 2.1 is applicability of review requirements. Add Item 5 to this section. Item 5 reads. Any communications or other towers of a height of more than 100 feet. Motion made by Councilman Stevenson, seconded by Councilman Lovelace that the proposed language be included in the Site Plan Review Law. After discussing proposed addition to the law, placement of tower/towers it was suggested that the line, 100 feet above ground level be added to this amendment. Vote:- Supervisor Owens, no. Town Councilman Fisher, no, Town Councilman Lovelace, no. Town Councilman Stevenson, no. Amendment tabled for legal opinion. Property Acquistion - tabled. NYSEG Solutions - NYSEG Solutions, one of the first to make an offer to reduce the cost of electrical services to towns. Proposed yearly savings to town is $112.00. No action taken. New Business - Cestero Subordination Agreement of HUD Diminishing Lien. Supervisor Owens presented Emanuel and Holly Cestero’s request for an Subordination Agreement of HUD Diminishing Lien. Motion made by Councilman Lovelace, seconded by Councilman Stevenson that the Town Board of the Town of Enfield subordinate the HUD Diminishing Lien to the first mortgage Tompkins County Trust Company for the property located at 59 South Buck Hill Road, currently owned by Emanuel and Holly Cestero, provided that Emanuel and Holly Cestero pay all associated closing costs incurred in review by the County and or the attorney for the Town of Enfield. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Fisher, Lovelace, Stevenson, yes. Contract Tompkins County Youth Program Supervisor Owens presented the Tompkins County Youth Program contract that needs to be signed so the town can be reimbursed by the county. Contract approval tabled until next town meeting, so the board members can review it. Regular Town Board Meeting Minutes 4/14/99 6 Cayuga Lake Watershed Study Enforcement - Cayuga Lake Watershed Organization would like a resolution to endorse a Watershed Study for Cayuga Lake. Town not a member of this organization. Action - Town not interested. Voting Machine - Supervisor Owens presented a request from the Ithaca City School District for the use of a voting machine on May 18, 1999. Motion made by Councilman Fisher, seconded by Councilman Stevenson that the Town Board of the Town of Enfield authorize the Ithaca City School District the use of a voting machine as an educational opportunity for the children at the Enfield Elementary School, May 18, 1999. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Fisher, Lovelace, Stevenson, yes. Adjournment - Motion made by Councilman Stevenson, seconded by Councilmen Fisher and Lovelace that the regular meeting of the Town Board of the Town of Enfield held Wednesday, April 14th, 1999 adjourn.
