TOWN BOARD MEETING MINUTES
WEDNESDAY, JUNE 3RD, 1998
6;30 P.M.
The regular monthly meeting of the Town Board of the Town of Enfield was held Wednesday, June 3rd, 1998 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, NY at 6:30 p.m..
Supervisor Owens presiding.
Present:
Supervisor, Jean Owens; Town Councilman, Tom Drew; Town Councilman Donald Fisher, Town Councilman, Greg Stevenson. Others present, Highway Superintendent, Ron Updike; Town Clerk, Alice
Laue, Bookkeeper, Pat Podufalski.
Pledge of Allegiance to the Flag:
Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag.
Approval of the Minutes of the May 6th, 1998 regular Town Board Meeting.
Page four - Privilege of the Floor correct spelling of the word statis to status.
Motion made by Councilman Lovelace and seconded by Councilman Stevenson that the Town Board of the Town of Enfield approve for adoption the minutes of the May 6th, 1998 regular Town
Board meeting.

Town Councilman Fisher arrived at 6:38 p.m.
Approval of the Special Town Board Meeting held May 19th, 1998
Motion made by Councilman Drew and seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve for adoption the minutes of the May 19th, 1998 Special Town Board
meeting.

Committees:
Tompkins County Board of Representative - Peter Meskill
Perimeters set for county budget process. Process won’t give departments any increase above their target. For any increase they would have to put together a special form and justify
the increase.
Livable wage issue withdrawn, needs more work and discussion.
Moving forward on Public Safety Building study.

Community Council - Joe Schehr
Spent the month working on the Summer Camp, hiring process, rewriting the manual. New Summer Teen Program starting
Highway Committee - Councilman Drew
Councilman Drew presented the resolution regarding the acquisitiion of a 10 wheel heavy duty dump truck. Resolution written by Attorney Robert Mulvey. (Resolution on back of page 2).
Motion made by Councilman Drew and seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve the adoption of the resolution regarding the acquisition of a 10
wheel heavy duty dump truck.

Highway - Superintendent Updike
Busy finishing up dust oil. Starting week of 6/8/98 Route #327 construction will start. Chemung Contracting has contract for both grinding the pavement away from the curb and intersections
and paving. Town Highway Department is going to supply one day two truck and one or two days one truck to haul grindings for the town as payment for helping. Grindings to be used
for shoulder stablization. Grinding through the Center where curb is, it has to be milled out 1 1/2” deep to 0 - 4’ out from curb so we can maintain same curb height and there are not
“thumps” going down into the catch basins.
Highway Superintendents School next week 6/8/98 - 6/10/98.
Fire Company - Roy Barriere
Dedication on 5/17 was a success. Approximately 125 people attended. There were three guest speakers, Assemblyman Marty Luster, Tompkins County Board Representatives, Dan Winch and
Peter Meskill.
Carnival Dates - 6/24/98 - 6/27/98. Fireworks Friday night 6/26 and Parade Saturday night 6/27/98.
Car Show Sunday, August 2nd, 1998.
This year Fire Company has 7 new members, Jim Seiger, Jean Owens, Mary Owens, Art Howser, Sue Howser, Lois Park, Don Fisher. 2 new Junior Firefighters, Mike Boynton and Amy Howser.
2 members completed Emergency Medical Technician training, (refresher course).
5 members near completion of Community First Responders Course, 7 nearly completed or enrolled in the Essentials of Firemenship course, a state mandated course for all firefighters.

Month of May had almost 1000 man hours in. Average number of hours every month so far this year.
Memorial garden (hill by pond) dedicated in memory of Harry Willis and all deceased fire company members. Rescue vehicle #642 dedicated in memory of Greg Kirshgessner.
Cemetery Committee- Peggy Hubbell
Busy month of May. Have volunteers who want to work in Rumsey Cemetery. Cemetery no worse than back of Presbyterian Cemetery. Very little vandalism. Working in all cemeteries.
Highway Superintendent Updike asked where Cemetery Committee would like excess to Rumsey Cemetery cut. Highway Superintendent Updike received permission from County Highway to cut
bank to make an excess.
Monthly Bills:
Supervisor Owens presented General Fund, Highway Fund, Small Cities (HUD) Grant II, Enfield Fire Department (SF-1) bills.
Supervisor Owens asked Commemorative Committee Chairperson Councilman Fisher to keep an inventory sheet on cookbook sales. Inventory sheet to show who bought book, when, number bought
and how paid for.
Amended Standard Payment of Town Bills Resolution
Motion made by Councilman Lovelace, seconded by Councilman Drew, Dated June 3, 1998.
The Town Supervisor is authorized to pay the General Fund vouchers, numbered 109 through 126, dated June 3, 1998, in the amount of $5817.74.
The Town Supervisor is authorized to pay the Highway Fund vouchers, numbered 52 through 70, dated June 3, 1998, in the amount of $15,733.93.
The Town Supervisor is authorized to pay Small Cities Grant II (HUD) vouchers numbers 7 through 8, dated June 3, 1998, in the amount of $1974.13.
The Town Supervisor is authorized to pay the Enfield Fire Department voucher numbered
SF-1 #6, dated June 3, 1998, in the amount of $30,000.00.
Discussion - Change of Enfield Fire Department to separate voucher. Special fund not General fund. SF-1 moved from General Fund voucher commencing with the month of June voucher.
SF-1 starting with voucher #6 as June is the sixth month of the budget year.

Unfinished Business:
Site Plan Review Law Draft.
Supervisor Owens presented the draft of the Site Plan Review Law dated 3/12/98.
Town Councilman Stevenson stated that after reading and reading again the draft of the Site Plan Review Law he feels it is not a incredibly restrictive document, overall something good
for our town and he would support it as written.
Motion made by Councilman Stevenson and seconded by Councilman Drew that the Town Board of the Town of Enfield approve the adoption of the Draft of the Site Plan Review Law, dated 3/12/98.
Discussion -
Councilman Drew - Yes, he likes it. No, he doesn’t like more government regulations. Of the people he talked with the number one plea he heard was that we need some type of Site Plan
Review, broad based but efficient, to give us some control and some say as to what is going to happen to the “guy” across the road before they can do something. He likes the way it
stands and will support it. But any amendments to the law to make it tougher, at this point, he wouldn’t support. Planning Board did a fine job putting it together and they need the
ability to have this tool and we owe it to the citizens of the town to have this on the books.
Councilman Lovelace - At present time he can’t back it because people he talked with do not want any type of Site Plan Review. He sees nothing wrong with the document personally,
His vote is for what the people who voted him into office want.
Councilman Fisher - He worked with the Planning Board over a number of months when they were putting this together. There are some things that trouble him about the way it is structured
and some of those were passed by the Planning Board on to the previous Town Board for them to address and they weren’t addressed. i.e. requirement to have a Site Plan Review if you
were to build three buildings on one lot.
Not sure if reciting the Ag & Market Law, page and paragraph, is necessarily the correct way to go because that law could change. And, then this law wouldn’t match with the Ag & Market
Law.
Also, some areas not addressed that should be. i.e. Business establishments that have a large traffic flow. He can’t support law.
Supervisor Owens noted she called Attorney Mulvey and he said it was well written and he didn’t see any legal concerns.
History of Law - Law was put together by the Planning Board with the help of the Circuit Rider and reviewed by the N. Y. State Planning Federation attorney.

Further discussed were people’s concerns of tinkering with document by adding this and that.
Town control of personal lands and how they can operate on their own property.
People not going to spend a lot of money if there is no control of what may go next door to them. Enfield isn’t ever going to raise themselves up without something.
Without sewer and water plants big businesses aren’t going to build in the Town for a number of years.
Town needs to move forward not STAGNAT.
Amendment of law as needed.
Need to enforce laws we have on the books now.
Site Plan Review part of what zoning would be. May need to go back and establish a zoning law.

Equipment Reserve Fund: * EFR refers to Equipment Reserve Fund
Tracking of Equipent Reserve Fund made to note the actual transactions that have taken place.
Presently $52,562.21 exists in account.
Monies received for insurance recoveries, grant recovery from chipper, sale of loader and plow indicate an additional $36,215.00 to be added to ERF account bringing total to $90,000,00.
No money added to ERF account in 1995, although $24,000.00 budgeted. Additional $20,300.00 removed from ERF account, creating a deficit of around $44,300.00. This was covered with
last quarter of 1995 sales tax in 2/96. First year sales tax paid quarterly, therefore, monies budgeted in 1995 weren’t received until 1996.
2/5/96 $40,620.00 transferred to ERF account, leaving a $3680.00 deficit.
8/3/96 $40,000.00 removed to cover a cash flow problem.
11/96 $28,280.54 replaced, leaving $15,400.00 still owed ERF. End of July Board decided not to transfer 1996 budgeted amount. Reason, funds that should have been added in 1995 were
not added in ERF account, therefore, money was not available to do transfer in 1996.
12/31/96 shortage was $15,400.00.
1/8/97 $34,000.00 removed for down payment on loader, $2,000.00 short of actual down payment.
1/2/98 $37,452.00 put in ERF account.
ERF expenditures - flail mower, chain saw, bucket for Drat. Highway Superintendent to have exact figures for next month’s meeting.

Board members would like copies of MBIA and TCTC monthly reports.
Budget Amendment -
Amounts for Traffic Control DA3310.4 and Garage DA 5132.4 lines reported in error for
January 7, 1998 minutes.
Motion made by Supervisor Owens and seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve the amendment of the 1998 budget amendment of 1/7/98 meeting to
read.
Traffic Control line DA 3310.4 $1500.00 to $1200.00.
Garage line DA 5132.4 $2600.00 to $2500.00.

meeting.

New Business -
1996 audit. Audit being copied and will be put in mailboxes.
Supervisor discussed with CPA, Scott Andrews, possibility of the Town needing to do a 1997 financial review so financial reports could be prepared. Cost may possibly be around $4,000.00.

Timeliness of doing this needs some kind of quarantee of being completed and to the Board by Labor Day. Suggested contacting retired Town of Covert bookkeeper to see if she would be
willing to do a financial review for the Town.
Additional revenue, not anticipated in 1997 for sales tax. Received about $20,000.00 more in sales tax revenue than anticipated.
Financial Statement -
Discussed availability of receiving financial statements from Enfield Community Council. Recommended that the Enfield Community Council provide the Town Board with a quarterly Income
Statement and Balance Sheet report. This needs to be made part of the Town records, so it is available to citizens who wish to see it. Fire Department requested to do the same.
Cookbooks - Received reprinted pages. Pages with errors are being removed and replaced with corrected pages. Books available at $7.00 contact Councilman Fisher.
Town Attorney -
Town Attorney was appointed in January 1998 until end of March 1998.
Motion made by Councilman Drew, seconded by Councilman Fisher that the Town Board of the Town of Enfield approve the appointment of Attorney Robert C. Mulvey as permanent attorney for
the Town of Enfield.

Quilt -
Town gave money to do a quilt for the Commemorative ceremony. Quilt was made and raffled. Need to know how this was accounted for, how much money given, what agreement Town had as
far as receiving funds, what proceeds were and where proceeds went.
Supervisor to research this.

Note of Interest -
Jennifer Hubbell, daughter of Jack and Peggy Hubbell graduated from S.U.N.Y. Health Center College of Medicine May 17th, 1998. Jennifer is now, Dr. Jennifer Hubbell.
