The regular monthly meeting of the Town Board of the Town of Enfield was held Wednesday, May 6th, 1998 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, New York at 6:30 p.m.. Supervisor Owens presiding. Present: Supervisor, Jean Owens; Town Councilmen, Tom Drew, Gary Fisher, Donald Lovelace, Greg Stevenson. Others present - Highway Superintendent, Ron Updike, Deputy Town Clerk, Dianne McFall. Town Clerk, Alice Laue, absent. Pledge of Allegiance - Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag. Tompkins County Planning Karl Heck, Tompkins County Planning, Ron and Sandra Rice presented the background information leading to why they would like to obtain a Home Equity loan and why a Diminishing Lien Agreement has been requested. Property assessed in 1996 at $22,000.00, Property is now assessed at $69,400.00. Discussed - Town’s liability is reduced by $4,500.00 per year. The Town’s liability is around $8,000.00 at the present time. Dan Winch - Oversight Committee feels an honest mistake was made in 1994 between administrators of mortgage company and HUD. No town liability after July 1999. Resolution - Diminishing Lien Agreement. Motion made by Councilman Drew, seconded by Councilman Stevenson that the Town Board of the Town of Enfield approve the Subordination of the Diminishing Lien Agreement of the Supek/Rice HUD Grant Loan. Subordination of the Diminishing Lien Agreement place Savings Bank of the Finger Lakes as first mortgage holder and the Town of Enfield as second mortgage holder. Town of Enfield will not pay any filing fees. Discussion - Councilman Fisher would like in writing from HUD that they approve the subordination loan. Vote: Supervisor Owens, yes. Town Councilmen, Tom Drew, Donald Lovelace, Greg Stevenson, yes. Town Councilman Fisher, no. Town Board Meeting Minutes 5/6/98 2 Mobile Home/New Construction Home Ownership Lengthy discussion held about the feasibility of a third Small Cities Grant (HUD) to replace mobile homes with modular housing. Discussed - Replacing mobile homes with modular or doublewides. Useful life of modular is about three times that of mobile home or doublewide. If upgrading do it the right way. Don’t want to see town put into a situation where mobile homes are not allowed. Need to give young people a start in life by being able to afford a mobile home. Is this an enactment of an ordinance to prevent people from bringing in mobile homes of less value than a certain amount? Need bottom line of standards of what is considered acceptable for people to live in. Building town’s tax base. Needs investigation. County Planning to continue to look in to feasibility of this. Enfield Planning Board/Site Review Law Present - Chairperson Mike Williams, Virginia Bryant, Rick Chase, Eugene Endres. Draft of Site Plan Review dated 3/12/97 was presented to Town Board in May 1997 after 4/9/97 public hearing. Vote never taken on Site Plan Review Law. Planing Board notified Town Board that when Town Board would like them to work again, to let them know. Discussed - Need of a vote. Inadequate mailing list for survey conducted. Need of a basic Site Plan Review Law Concerns from Public Hearing sent back to Planning Board not resolved. Concerns from previous Town Board of direction to Planning Board that were not resolved, i.e. public gatherings, traffic control. The Town has the ability to make changes as they see fit. Town Attorney’s last input was 12/96 suggesting Environmental Review. Need to start with simple law and then as issues come up, build on law. Town Attorney Mulvey’s opinion - Planning Board is serving it’s purpose. It is an advisory board at this stand point. They have been given a task, complied with it, produced a product and if Town Board is comfortable with product that has been done.,the Town Board can have another Public Hearing and if in the course of the Public Hearing issues come out that Town Board feels needs revisons or Town Board wants to amend local law as drafted, Town Board can redraft it without sending it back to Planning Board. If Town Board wants to make those amendments, then Town Board goes through the process again. Amend law and hold a Public Hearing on final product. New Town Board members need to review draft of purposed law. Town Board Meeting Minutes 5-6-98 3 Bell Atlantic - Underground Cable Problem - The cable is supposed to be buried 30” deep. The cable found buried as little as 2” deep. The shoulders are sometimes left ripped up. Bell Atlantic didn’t do the work, but it has brought the issue to a head. As the Town tried to put a ditch up Harvey Hill Road they ran into road pedestals in the middle of the ditch. Discussed - Right of way. Cable burial is based on center line measurement. When cable was buried 3-4 years ago, road was gravel and burial was supposed to be 23-25’ off the centerline. Now, measuring off the existing road, the pedestals are 21-22’ off the centerline and are right at the property pins,. If Bell Atlantic were to cross the property pins, they would be on a private right-of-way. There is a problem when the Town has to dig around the pedestals. Labor has to be done with a pick and shovel instead of an excavator., which costs the taxpayer more money. Bell Atlantic is responsible, at their cost, to relocate their facilities. They will respond as quickly as possible to a problem situation. They can determine the depth of the cable for us so the Town can pass over it. Previously inspectors were not on the job. With inspectors not there, the contractor does the job the easiest way possible. No one challenges the work being done until there is a problem. A cable locator is now used, not for purpose of excavation but as a locator and is accurate to within a few inches. In a prior situation, Highway Superintendent Ron Updike, reported having to go 28” deep on a job where he had to cross cables. He asked the locator for a ballpark figure on the depth of the cable. He refused to give it to him, citing liability as the reason he couldn’t give him the information. Ron would like to see that information being made available to the Towns. Bell Atlantic asked that the next time he has to get into buried cable he call Al or Tim first and the town won’t be billed. Bell Atlantic wasn’t aware that Enfield had an issue with them. They would like to handle issues as they come up. Town would like to see all cables buried on backside of the ditch. Bell Atlantic wants to be a good neighbor. They want to do what can be done within reason to accommodate the Town’s needs. Please feel free to call. Bell Atlantic will take care of the permit request for work on Harvey Hill Rd. It is their responsibility to get the cable out of the Town’s way Rick Chase, recommended that an inspector be on the work site documenting the work being done and that there be a depth rating specification on the permit. Town Board Meeting Minutes 5-6-98 4 Tompkins County Board Representative Dan Winch Reported on review of the Public Safety Building. There is a need for record storage, court evidence storage, physical space required to administer programs needs to be addressed. Remodeling of jail side of building., interview rooms, separation of different classes of people incarnated. . Foreclosure Auction - Forty-two pieces of property auctioned off in the county for non payment of taxes. Net gain of $198,000.00. Sales Tax Reduction of Clothes - Counties getting together to discuss what they are going to do. Impact of reduction of sales tax on clothing for a week, what is purposed impact on elimination of sales tax on textbooks. County receives 21% revenue from taxes. Impact on municipalities would be a loss of $400,000.00. Will cause impact on all of us - could cause increase in property tax. Question? Is 4% sales tax for county here to stay? No, Sunset on that, it has to be voted on from time to time. Privilege of the Floor - What is statis on Bostwick Road? Highway Superintendent Updike - Haven’t done anything yet. Talked to Mr. White, at top of hill, going to workout an agreement with him for acquiring a little land to take most of the real sharp curve out. Still negotating with Mr. Johnson, who owns land on both sides of road, haven’t come to terms, yet. Heading into dust oil and beginning of summer maintenance, so probably it won’t happen now until sometime in July. Something will be put on to cut the dust for interim. Is monies in? Highway Superintendent Updike - monies are being treated like the Chips Program. We have to spend it, present a voucher and be reimbursed for it. Spring again, and I have been looking at Junk Cars growing in the Town of Enfield. Wonder about new Town Board, are you aware of Junk Car Law? What’s being done about it? We have enforcement officers, but no reports about what is being done. Councilman Lovelace - Since this Town Board came in no reports have been received. Some reports received towards end of last Town Board. Since start of this term not seen anything. Supervisor will request report. Town Board Meeting Minutes 5-6-98 5 Approval of 4/1/98 Minutes Councilman Fisher made a pitch that minutes be read in more detail. March minutes not correct. More accurate, more helpful. Addition or corrections - Page 2 - 3rd paragraph correct Garvin/Prentice to Garvin-Prentice. Enfield Community Council - strike first sentence March and prior. Fifth sentence correct spelling of by councilors to counselors. Strike Board of Directors. Highway Committee - 4th paragraph correct spelling of repairs costs to repairs cost. Strike sentence Specifications of sub-contractors in permit application. Appointments - Last sentence correct Peronnel issue to personnel issue. Motion made by Councilman Drew, seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve for adoption the 4/1/94 minutes of the regular Town Board meeting as corrected. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Drew, Fisher, Lovelace, Stevenson, yes. Councilman Fisher concerned about March meeting minutes which still contain an error. Motion made by Councilman Drew, seconded by Councilman Lovelace that the March 8th, 1998 minutes as corrected be corrected to say - What now says 1998 truck be corrected to say 1988 truck in both instances and where it says 1998 book value it should say 1988 book value of $2,500.00. Vote - Supervisor Owens, yes. Town Councilmen Drew, Lovelace, Fisher, Stevenson, yes. Enfield Community Council - Joe Schrer and Janice Johnson Supervisor Owens passed around documentation of $2500.00 check that was incorrectly deposited in town account. Documentation received from Tompkins County Trust Company is a copy of savings deposit slip, photo copy of check deposited at that time. Town Board Meeting Minutes 5-6-98 6 Joe Schrer - During the month of April, we continued our basketball program and After School program. On the 29th of April met with the United Way to defend our budget request, do not know results, yet. Completed the Enrichment Program for this semester. Janice Johnson is going to tell about Enrichment Program. Janice Johnson - Enrichment Program we run every year which are enrichment activities for elementary school young people. We had three initiatives this year. One initiative, which will be seen in the theme through out several of our programs, is to begin to incorporate families in more of the programs. Schedule a Winter family Day, that we were going to operate in coordination with the Fire Company and the Baptist Church, however, 60 degree weather on the day scheduled didn’t allow program to happen. Second initiative, nothing for young people to do on days off from school - tried two new programs which were some trips. One to the movies where Fall Creek showed a film specially for Enfield. And one trip to the Science Center. 100 young people attended the movie and 66 went to the Science Center. Regular Enrichment Program 55 young people attended. Activities included Art, Drama, Puppets, Kung Fu, Magic, New Games. Some older kids made a movie which when completed will be shown at a Town Board meeting. Lucky to have a gentleman in this community who actually was one of the filmer’s on Star Wars. Sixteen parent volunteers for programs. - Kimberely Mix, Evonne Proctama, Rick Rodgers, Tammy Smith, Alice Linton, Lori Achilles, Stacy Tunison, Betty Otis, Kathleen Smith, Sharon Hubbell, Charleen Nash, Jack Kulp, Debbie Low, Susan Burman. Also received a letter form Enfield Elementary School saying it was a terrific Enrichment Program. It was the fourth time we where able to get an interim from Ithaca College Recreation Dept., who spent 120 hours of free labor. Very pleased with 1998 Enrichment Program. Summer Camp - Joe Schrer Read Enfield Community Council Summer Camp 97-98 Overview. (See back of page 5). Tonia Clate teacher at Belle Sherman School and previous staff members for the past seven years at Stewart Park Camp is 1998 Camp Director. Out of four applicants, she was deemed the most qualified. Teen Program - Joe Schrer Will move into action stage tomorrow morning, 5/9, at 9:00 a.m. Have contracted with the Cooperative Extension for a youth worker. His name is Shawn Bukowitz, we will be working with him through the summer. He will be leaving after that to attend medical school. Met with him 5/7. He wants to see the community. Met last month with Trumansburg and Ulysses Board, we are going to operate some programs in conjunction with them. Operate with in two capacities - Teens broken into an older teens group and a middle school group separate from the older teens. Town Board Meeting Minutes 5-6-98 7 Supervisor Owens asked for a consensus of the board about reimbursement of $2,500.00 to Community Council from Youth Bureau for a 1996 grant. Grant was 50% reimbursement for summer jobs. Majority of Town Boarad members agreed on reimbursement. Fire Company - Councilman Lovelace Councilman Lovelace had a couple of the firemen asking him about the old round table they used to have when they held their card parties. This table has to do with their historic anniversary coming up this year and they have requested him to ask the Town Board for this table back. Motion made by Councilman Lovelace,seconded by Councilman Stevenson that the Town Board of the Town of Enfield give the Fire Company back their round table out of the kitchen. Discussion - What is the value of table? Answer, none. Vote: Supervisor Owens, yes. Town Councilmen Drew, Lovelace, Stevenson, yes. Town Councilman Fisher, no. Supervisor Owens read a letter of invitation to the Enfield Volunteer Fire Company’s Open House being held Sunday, May 17th, 19988 from 1-4 p.m. at the Enfield Fire Station. At 2:00 p.m. a ceremony honor all members of the Fire Company, past and present, will be held. During the ceremony memorial garden will be dedicated in memory of all deceased members who have served the community as members of the Fire Company. To Harry Will who donated the land upon which the first fire station was erected. Also, our Rescue vehicle Enfield #642 will be officially dedicated in memory of Gregory Kirschgessner who was killed by a hit-and-run driver in February of this year. There will be tours of our new, although not completed, addition. Free refreshments, blood pressure screening and, weather permitting, fire truck rides for the children. Highway - Chairperson Tom Drew Met April 29th, the night advertised for opening of bids for a 10 wheel heavy duty dump truck with snowplow. Received one bid from Beam Mack in the amount of $97,500.00. Next step, financing options. Need to consider having a Special Town Board Meeting in two weeks at which time financial options will be presented. At this time we can go ahead with Permissive Referendum if we decide to accept bid. Looking at bond anticipatory note. Town Board Meeting Minutes 5-6-98 8 Councilman Fisher - Need to look at overall budget. What county does with Sales Tax will have some impact. Councilman Fisher would like to discuss Equipment Reserve Fund with Councilman Drew and Highway Superintendent Updike. Motion made by Councilman Drew, seconded by Councilman Stevenson that the Town Board of the Town of Enfield hold a Special Town Board meeting - May 19th, 1998, at 7:30 p.m. at the Enfield Community Building to discuss acceptance or rejection of bid on 10 wheel heavy duty dump truck with snowplow from Beam Mack. Also discuss financing options. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Drew, Lovelace, Fisher, Stevenson, yes. Highway Superintendent Updike Ron has an application for Salt Storage Sheds. which is a coming event. At some point cinders and salt will have to be undercover. Through the Clean Water, Clean Air Bond Act there is monies available for assistance in building such sheds. Town’s share is potentially $2,700.00. Proposal needs to be written and submitted by 6/1/98 or 6/3/98. After discussing time frame of completing project if proposal was accepted, where money would be coming from to pay Town’s share, sharing with another town, the consensus of the Town Board was to let it pass for now. Correspondence - Letter from Dorothy Cole about a speed limit change on Route #79 and Harvey Hill Road was read. Highway Superintendent Updike to call Mrs. Cole. Cemetery Committee - Peggy Hubbell Trying to clean up cemeteries for Memorial Day. Clark Marshall to do next section of Christian Cemetery. Have new trash buckets to put out. County cut down one tree at Rolfe Cemetery and there is another sick one to come down. Talked about little markers for stones completely unreadable. Bob Wells will donate pieces of stones and only charge for engraving which is around $2.50 a letter. Firemen Flags didn’t hold up. Cemetery Committee will be meeting the month on the 4th Tuesday of the month. Councilman Fisher asked question concerning funds in cemetery account of $6,000.00. Answer, Rolfe and Budd Cemeteries in Tompkins County Trust Co. What kind of interest are we earning. 2.5%. Town Board Meeting Minutes 5-6-98 9 Councilman Fisher suggested we keep track of each of these and invest them and allocate the interest on the principle amount so we earn double what we earn now. 5 - 5.5% at least. Negotiate with Tompkins County Trust Company for more interest or keep a journal of principle accounts, combine amounts, invest in MBIA and allocate interest between the two accounts if we can’t get a better interest rate locally. Supervisor to check with Tompkins County Trust Company. Commemorative Committee - Chairperson Cookbooks came in ten days ago. When reading proofs an advertiser’sphone number was wrong on one page. When we got the book, on checking on error found when proofing, found the error had been corrected. One another page, we misspelled a name, talked with Fundcraft and they said to fax them changes and they would reprint changes. I don’t believe they will charge for it since we have to put changed pages in book, it would probably even out. Books bound with plastic spiral. Selling for $7.00, sold five today. Keeping track of who bought books so if there is a change we can get change to them. After length discussion of not following Town Procurement Procedure of obtaining three written bids before purchase of cookbooks, who is going to pay for cookbooks where advertisements in the amount of $2,955.00 where sold the following motion was made. Motion made by Councilman Lovelace, seconded by Councilman Drew that the Town Board of the Town of Enfield accept the bid from Fundcraft for $3,880.34 for the purchase of the Commemorative Cookbook. Discussion of not knowing overrun or under run is. Not knowing the number of books published and shipped, freight costs are not known and you don’t know how many books you actually have to pay for. Unknown variable. Councilman Fisher abstained himself from voting . Vote - Supervisor Owens, yes. Town Councilmen Drew, Lovelace and Stevenson, yes.Town Councilman Fisher, abstained. Budget Amendments - Supervisor Owens asked for a budget amendment to make sure there is enough money in the account to handle payment of cookbooks. She asked for an increase in budget line A7550.4, which is Celebrations, from $1500.00 to $3,88034. To create a revenue line , A2089 Celebrations to read $2,380.34 which is the difference of $1500.00 in the need of $3,880.34. Councilman Fisher asked why are we creating a revenue line? Answer - because you will be getting revenue as books are sold. Town Board Meeting Minutes 5-6-98 10 Councilman Fisher - What you are proposing is putting money in there for the difference in the revenue line, not revenue. That’s not right. Can understand wanting to create a revenue line to show revenue coming in from books, but you don’t put anything in there until books are sold and money is in hand for books. It would be just like transferring any other line that is going to be sort and you know you are going to have an over expenditure. You just transfer the funds from contingency to that line. Supervisor Owens - This is A2089, we can label as Cultural Revenues. It is an estimated revenue. If you increase your expenditure line you have adjusted you budget, so that it no longer balances and you have over stated. Councilman Fisher - No. Because you are taking from Contingency you are reducing Contingency. Reduce the Contingency line and increase another line. Have a budget line, 7550.4 that doesn’t have enough money to make payment, so they are going to transfer money from Contingency to that line. When you do that you are reducing money in Contingency. Question - Where are you going to put the money from sale of books? Councilman Fisher - Then you would create a revenue line, line 2089, which to begin with is not going to have $2,380.34 in. Which is amount Supervisor wants to put in now. Answer - You put it in as anticapated revenue. Trying to balance budget. Councilman Fisher suggested that transfer be made from Contingency line A1990.4 to Celebrations, line 7550.4. Create line 2089 for unanticapated income with a -0- balance . Motion made by Councilman Fisher, seconded by Councilman Lovelace that the Town Board of the Town of Enfield move $2,380.34 from 1998 budget line 29, Contingency Appropriation Account A 1990.4, to increase the 1998 budget line 34 balance to $3,880.34, thus providing sufficient funds to allow approved $1940.17 as the first payment of the cost of the publication of the Town of Enfield Commemorative Cookbook. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Drew, Fisher, Lovelace, Stevenson, yes. Supervisor asked for a motion to transfer $250.00 from Contingency A 1990.4 to Municipal Dues A1920.4. All municipal dues are under that line item. Not enough budgeted. Discussed where dues for individual department needs to be paid from. Motion made by Councilman Lovelace, seconded by Councilman Drew that the Town Board of the Town of Enfield approve the movement of $250.00 from Contingency Fund, A1990.4 to Municipal dues A1920.4. Discussion Vote - Supervisor Owens, yes. Town Councilmen Drew, Lovelace, Stevenson yes. Town Councilman Fisher, no. Town Board Meeting Minters 5-6-98 11 Councilman Drew presented a dummy Supervisor’s report. He couldn’t get what he proposed last month to work as a easy, usable kind of form to use monthly to track it out through the year. He basically did one following Town of Hector’s Supervisor’s report. He retained original budget lines. Supervisor presented monthly Supervisor’s Report to the Board. Bookkeeper produced an improved form. Councilman Fisher asked if budget totalcould be added to report. Answer, yes. After discussion of monthly vouchers that need to be paid. Board suggested that all voucher be alphabetized, account numbers put on vouchers, voucher numbers put on monthly bill statement of Supervisor and numbers be put on vouchers. Discussed if Magistrates dinner was a legimate expense. Motion made by Councilman Lovelace and seconded by Supervisor Owens that the Town Board take 5 minute break while vouchers are renumbered. Vote - Supervisor Owens, yes. Town Councilmen Drew, Fisher, Lovelace, Stevenson, yes. 5 Minute break Questions concerning Negative Revenue. Since not revenue for 1998, how will it been shown on the books and check so it can be traced? What is difference between this and tax money we had to pay back? Answers - Negative Revenue comes off fund balance. Money that didn’t belong to us. Comes out of original starting fund balance the town had. Prior period adjustment. Negative Revenue comes out of General Fund Savings account and is shown on General Fund book as reducing the beginning fund balance from 1/1/98. Check will say - Reimbursement of Community Council funds mistakenly deposited in our account Amended Payment of Town Bills Resolution Motion made by Councilman Lovelace Seconded by Councilman Stevenson Dated May 6, 1998 The Town Supervisor is authorized to pay the General Fund vouchers , numbered #82 through # 108, dated 5/6/98 , for a total of $18,084.62 and the Community Council $2,500.00 reimbursement which is a negative revenue. The Town Supervisor is authorized to pay the Highway vouchers, numbered 34 through 51, dated 5/6/98, in the amount of $12,300.20. The Town Supervisor is authorized to pay Small Cities Grant II (HUD) vouchers, numbered 5 through 6, dated 5/6/98, in the amount of $2,784.35. Discussion - Vote - Supervisor Owens, yes. Town Councilmen Drew, Lovelace, Stevenson, yes. Town Councilman Fisher yes on all vouchers but voucher #98. Town Board Meeting Minutes 5-6-98 12 Meeting - Meeting May 13th, 1998 at 6:30 p.m. at the Town Hall with CPA and Jean. Enfield Community Building/Courts Supervisor had Roger Rumsey, Building Code Officer, look at the room courts would be using as a conference room. Roger’s concern was the need of another window on the back wall. Councilman Stevenson to talk with Roger about need of window. Old Business - Financial Records removed from Town Hall. Councilman Fisher asked what financial records were removed and does clerk have a list? Answer - Bank Statements, checkbook and stubs. Supervisor would like board authority to purchase a small fire resistant box to keep financial records in. Supervisor to check on price. Councilman Stevenson read into the minutes Record Management Officer’s letter regard file cabinet moved to Supervisor’s home. TO: Members of the Enfield Town Board FROM: Alice Laue, Records Management Officer Dated: April 30th, 1998 As requested by the Town Board at the April 1, 1998 meeting I as Records Management Officer went to Supervisor Owens’ home and reviewed the contents of the file cabinet belonging to the town she had there. Please be advised that the contents of the file cabinet were copies of contracts, copies of drafts of minutes, copies of town clerk’s monthly reports, copies of abstracts, etc. Basically the same copies of documents you as a Councilman have and are using as working files. Also, publications that the Supervisor uses for reference material. Please be advised that the file cabinet is a unlockable, unsecure, non fire resistant file cabinet and has been returned to the Town Hall. In regards to the discussion at the April 1, 1998 meeting regarding storage of records in non fire resistant file cabinets, please be advised that the records the Town Clerk uses in day to day operation are stored in a non fire resistant file cabinet. The Town Boarad may wish to rectify this by purchasing a fire resistant file cabinet. Town Board Meeting Minutes 5-6-98 13 Keys Cut for Community Building Who has keys to building , numbered, stamped do not duplicate and were the signed for? Ten keys cut, un-numbered, some stamped do not duplicate, not signed for. To date following people have keys were given out by Supervisor. One in key box Highway Barn. Clerk, Supervisor, Baptist Church, Food Distribution Program, Peggy Hubbell. Suggestions made were that keys be stamped and marked all keys marked do not duplicate. These are reasonable steps to secure building but no fail proof. Fuel Company needs a key. Cookbooks on sale for $7.00. Adjournment - Motion made by Councilman Lovelace, seconded by Councilman Drew that the regular meeting of the Town Board of the Town of Enfield held May 6, 1998 adjourn. Vote: Supervisor Owens, yes.
