The regular meeting of the Town of Enfield Town Board was held Wednesday, March 4th, 1998 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, N. Y. at 6:30 p.m.. Supervisor Owens presiding. Present: Supervisor, Jean Owens; Town Councilmen, Tom Drew, Gary Fisher, Donald Lovelace, Greg Stevenson. Others present, Highway Superintendent, Ron Updike, Town Clerk, Alice Laue and Bookkeeper, Pat Podufalski. Pledge of Allegiance - Supervisor Owens led the assemblage in the Pledge of Allegiance to the Flag. Approval of Minutes of February 4th, 1998 Regular Town Board Meeting. Amend Standard Resolution for the Payment of Town Bills dated 2/4/98 under Grant I HUD to read, abstract dated 2/4/98, commencing with voucher number 1 through voucher number #1, for a total of $114.77. Motion made by Councilman Drew and seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve for adoption the amended minutes of the February 4, 1998 regular Town Board Meeting minutes. Discussion. held, admendment of minutes. before motion made. Vote: Supervisor Owens, Town Councilmen Drew, Lovelace, Stevenson - yes. Town Councilman Fisher abstained. Reports/Committees Tompkins county Board of Representative Dan Winch. Representative Winch reported on TCAT meeting. Enfield would like to see an early morning and afternoon bus service. TCAT Public Hearing to be held in May. D A’s Office received a Victims Advocate Grant. In response to last months question about county plowing of Rte 79 and 327, Representative Winch responded that he had looked into concern and that this problem is all over the county and may be caused by cut of county work force in Highway Department. Community Council - No report. Fire Company - Rich Neno Month of February fire company had 21 Calls,.10 EMS Calls, 6 MVA Calls, 2 Fire Calls. Received Mutual Aid from Newfield once, and responded Mutual Aid to Newfield twice. Town Board Meeting Minutes 3-4-98 2 Fire Company continued Light Rescue Truck 642 dedicated in honor of Greg Kirchgessner. Participated in a mocked car - tractor trailer accident accident extrication training with Trumansburg Fire Company. Highway Committee - Chairperson Councilman Drew Meeting held February 11, 1998 at the Town Hall, major focus was the debate to replace the Highway Superintendent’s 1988 pickup truck. At that time Highway Superintendent Updike present to the committee a mechanical work estimate and body work estimate which gave the committee a basic idea on what the cost would be to rebuild present truck. Committee wanted to show difference between cost of new pickup truck and what repair estimate would be, savings if present pickup wasn’t repaired and how that money could be used toward a new pickup truck and how new pickup truck could be funded, (See attached). Price of new truck with snowplow package, locking differential, running boards, amber beacon, on/off road tires package and roof lamp state bid is $21,367.80. Repair to 1988 Ford 250, 127,000 miles, mechanical base estimate of $4.913.85. Estimate includes new long block, rebuilding of transmission, replacingof front calipers, resealing power steering pump and hoses, etc. (See attached). Body work estimated at $4,441.61. Total estimate $9,355.46. Current maintenance on 1988 truck is $1900.00 yearly. New truck would have three year - 36,000 bumper to bumper warranty which would exclude maintenance items and tires. Estimated maintenance for new truck would be approximately $300.00, saving $1600.00 a year. Total savings, if 1988 pickup isn’t repaired is $10,955.00, better than 50 percent of cost of new truck. Money to come from Equipment Reserve fund which now has a beginning balance of $53,522.14. 1998 budget allocation is $24,000.00, estimated proceeds from auctioning off of 1988 truck approximately $2500.00 - less cost of new truck $21,367.80 leaving Equipment Reserve end balance after purchase of new pickup truck at $58,654.00. Committee, also, decided to ask the Town Board for permission to obtain bids on a ten wheel dump truck, so committee can do homework on financing portion for the least impact on tax rolls. Motion made by Councilman Drew and seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve the spending of the 1998 Equipment Reserve fund allocation of $24,000.00 for a new pickup truck to be purchased on state bid. Highway Superintendent to order same on state bid of $21,367.80. Discussion - Councilman Fisher asked if 1998 Equipment Reserve fund is correct. Estimated yearly cost of $1900.00 maintenance of ‘98 truck, ‘98 truck book value $2500.00. Town Board Meeting Minutes 3-4-98 3 Councilman Fisher asked if condition of Town of Ovid pickup truck, that is up for bid, essentially same truck as Enfield’s, with a new block, new engine (40,000 miles on it) was checked on. Councilman Fisher stated, faced with purchasing of a new $100,000 dump truck ,which was looked at six months ago and looking at purchasing both trucks there was no justification in buying them then, he doesn’t see what has changed. Before deciding to buy a new pickup truck he would like to see a layout on where we are going financially on the purchase of a pickup truck and a ten wheel dump truck. He would like to see both shown side by side. If spending $120,000.00 - $125,000.00 of town’s money he would like to see the board realistically look at the whole package of where money is coming from. Need to prioritize what is more important. Councilman Drew stated Highway Committee to do extensive study of financing possibilities of ten wheel dump truck, which will have to be financed and best financing package needed. Councilman Lovelace - When doing original budget and the decision that a new pickup truck wasn’t affordable board didn’t have facts or figures on cost of repairs/replacement in front of them. More information should have been available at budget time. Councilman Lovelace can’t see putting $5 - $6,000.00 in a vehicle only worth $3 - $000.00 let alone $10,000.00. If information was available before, changes may have been made along those lines in budget. Pickup not worth putting money into. Councilman Fisher asked where money was coming from. Answer, Equipment Reserve fund. Councilman Fisher raised the objection that legally this can not be done. Councilman Drew stated that state comptroller stated it could be done if paying cash. Highway Superintendent Updike asked on what grounds was it illegal. Councilman Fisher - State Law. Highway Superintendent Updike verified what Councilman Drew stated and added that state comptroller stated on a pickup with a five year life time if falls under auspicious that you do not have a problem taking money out of Equipment Reserve fund. Vote: Supervisor Owens, Town Councilmen Drew, Lovelace, Stevenson - yes. Town Councilman Fisher - no. Motion made by Councilman Fisher and seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve the moving of $10,000.00 from Highway Maintenance budget line to be put toward cost of pickup truck. Discussion - Supervisor Owens asked Highway Superintendent if he objected. Highway Superintendent Updike responded he knows extra money was put into Highway Maintenance for this purpose, use when needed. Vote: - Supervisor Owens, Town Councilmen Drew, Fisher, Lovelace, Stevenson - yes. Town Board Meeting Minutes 3-4-98 4 Next Highway Committee Meeting March 11th, 1998 at the Town Hall at 7:00 p.m. Rick Chase has volunteered to join Highway Committee. Committee to start work on ten wheel dump truck cost analysis. Committee would like the Town Board give authorization to Highway Superintendent Updike to request bids for ten wheel dump rack, to give committee time to explore financing options. Second half of year would like effort to be on Road Classification program. Motion made by Councilman Drew and seconded by Councilman Lovelace that the Town Board of the Town of Enfield give authorization to Highway Superintendent Updike to obtain bids for a ten wheel dump truck. Discussion - Councilman Fisher asked where is money coming from? Need pieces before financing. Response - need prices to work with. Vote: Supervisor Owens, Town Councilmen Drew, Lovelace, Stevenson - yes. Town Councilman Fisher - no. Highway Superintendent Updike presented Cooperative Purchasing of Highway Services with County resolution. ( Resolution #3 dated March 4, 1998.) Motion made by councilman Drew and seconded by Councilman Stevenson that the Town Board of the Town of Enfield approve for adoption Resolution #3 - Cooperative Purchasing of Highway Services with County. (attached). Discussion - Vote: Supervisor Owens, Town Councilmen Drew, Fisher, Lovelace, Stevenson - yes. Budget Amendment - Motion made by Councilman Lovelace and seconded by Councilman Stevenson that the Town Board of the Town of Enfield approve the amendment of the Town of Enfield 1998 budget as follows. Transfer $10,000.00 from line 51110.4 Highway Maintenance to line 5130.21 Equipment Reserve fund subset pickup puchase. Discussion - Vote - Supervisor Owens, Town Councilmen Drew, Fisher, Lovelace, Stevenson - yes. Senior Housing - Calvin Criss Mr. Criss presented private funding information for Senior Housing to the board. He also presented a Living center for Seniors for the Town of Enfield petition for signatures. Town Board Meeting Minutes 3-4-98 5 Cemetery Committee - Peggy Hubbell Chairperson Hubbell asked for the appointment of Eric and Mary Rumsey to the Cemetery Committee. Motion made by Councilman Fisher and seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve the appointment of Eric and Mary Rumsey to the Cemetery Committee. Discussion - Vote; Supervisor Owens, Town Councilmen Drew, Fisher, Lovelace, Stevenson - yes. Cemetery meetings held third Tuesday of month, March - December at the Community Building at 7:00 p.m. Booklet when completed will be given to everyone who has or buys a cemetery plot in the Town of Enfield. Last year’s project - 42 stones were reset and caulked. Used 9 cubic yards of cement. Seeding needs to be done. Hopefully will do next section in 1998, and hopefully stones in Budd Cemetery will also be done. Highlight of the project was finding one stone in Christian Cemetery of a six year old girl named Sarah Williamson who died in 1860 that was completely buried. Stone (white) has been reset. Rumsey Cemetery - nothing done yet. Cemetery inaccessible, waiting for County Highway Department to do entrance work. Pat Dougherty reported that Peggy Hubbell was nominated and chosen to receive the first Preserve the Past award given by the DeWitt Historical Society, Friday March 6th, 1998 at 4:00 p.m. Intermunicipal Cable Commission - Supervisor Owens Supervisor Owens has conversed with Ben Curtiss of the Intermunicipal Cable Commission. Town of Enfield only town not a member of commission. Supervisor Owens feels town needs to relook at joining. I.C.C. negotiating a countywide use. Councilman Fisher stated he doesn’t see a need for joining and would be a waste of town money in joining. Supervisor Owens volunteered to attend several meetings to see if there is something there that will benefit the town. Haefele TV, Inc. - Raising basic price April 1, 1998 to $24.00 a month. Town Board Meeting Minutes 3-4-98 6 Sales Tax Elimination - Supervisor Owens read a letter from Tim Joseph, Chairperson, County Budget Committee concerning the elimination of the State Sales Tax on clothing and footwear purchased for less than $100.00. Supervisor Owens to copy letter and place in Town Board members mailboxes. Town Board members are to read and give their imput to Supervisor Owens before March 31, 1998. Monthly Bills - Supervisor Owens presented monthly bills. Standard Resolution for the Payment of Town Bills as amended. Date: March 4, 1998 Moved by Councilman Drew Seconded by Councilman Stevenson The Town Supervisor is authorized to pay the bills/vouchers listed on the General Fund Abstract, dated March 4, 1998, commencing with voucher number 39 through voucher number 65 , excluding $2500.00 from voucher #50 for further documentation, voucher for 1996 audit in the amount of $826.47 moved to Grant II abstract, for a total of $18,299.43. The Town Supervisor is authorized to pay the bills/vouchers listed on the Highway Fund Abstract, dated March 4, 1998 commencing with voucher number 16 through voucher number 22, for a total of $3,275.00. The Town Supervisor is authorized to pay the bills/vouchers listed on the HUD Grant I Abstract, dated March 4, 1998, commencing with voucher number 2, through voucher number 2, for a total of -0-. The Town Supervisor is authorized to pay the bills/vouchers listed on the HUD Grant II Abstract, dated March 4, 1998, commencing with voucher number 3, through voucher number 3, for a total of $826.47. Discussion - Discussed procedure to pay voucher #56. Property Tax Warrant adjustment, in the amount of $91.50. Bookkeeper to contact comptrollers office for advice. Allied Industrial and Empire Airgas to be charged to budget line 5132.4. Vote - Supervisor Owens, Town Councilmen Drew, Lovelace, Stevenson - yes. Town Councilman Fisher - yes on all vouchers except voucher #56 for tax warrant adjustment in the amount of $91.50 listed on General Fund abstract Town Board Meeting Minutes 3-4-98 7. TCAT Resolution Councilman Stevenson presented Proposed TCAT Resolution (Resolution #5). Motion made by Councilman Stevenson and seconded by Councilman Drew that the Town Board of the Town of Enfield approve the adoption of the Proposed TCAT resolution (attached). Discussion - Councilman Fisher not sure critical to all Enfield residents. Many Enfield residents feel that as tax payers they are entitled to TCAT bus service and desire same. Vote - Supervisor Owens, Town Councilmen Drew, Lovelace, Stevenson, yes. Town Councilman Fisher - no. New Business Radio Towers Requested by Town Board members that a member of the Town Planning Board attend the next board meeting to address the proposed radio tower (4) construction on S. VanDorn Rd. and E. Enfield Center Rd. Towers are for a radio station in Lansing. Dog Census - Door to door canvas completed. Notices being mailed to those in noncompliance. Annual Report - Councilman Fisher asked where town was in compliance to annual report to comptroller and if a letter of extension had been written, if report had not been filed. Supervisor Owens responded that someone was in weekly contact with the comptroller’s office, but a letter of extension, that needed to be filed by March 1, 1998, had not been filed but would be a.s.a.p. Town Board Meeting Minutes 3-4-98 8 Adult Entertainment Workshop Councilman Fisher reported on the Adult Entertainment Regulations workshop sponsored by the state, which he attended February 6, 1998. Cannot prevent Adult Entertainment establishment or establishments from locating in your municipality. Licensing doesn’t hold up in court. Ordinance - needs to have an impact study on town done. Bottom line - Can’t close establishment/establishments down. Protected under First Amendment - considered free speech - freedom of expression. Adjournment - Motion made by Councilman Lovelace and seconded by Councilman Drew that the regular March meeting of the Town Board of the Town of Enfield adjourn.
