TOWN OF ENFIELD
TOWN BOARD MEETING MINUTES
WEDNESDAY, SEPTEMBER 2ND, 1997
6:30 P. M.
The regular monthly meeting of the Town Board of the Town of Enfield was held
Wednesday, September 2, 1997 at the Enfield Community Building, 182 Enfield Main
Road, Ithaca,NY at 6:30 p.m. Supervisor Mather presiding.
Present: Supervisor, William Mather; Town Councilmen Lanny Clark,Pat Dougherty,
Gary Fisher and Donald Lovelace. Others present,Highway Superintendent,Ron
Updike; Town Clerk,Alice Laue.
Pledge of Alleuiance to the Flag-
Supervisor Mather led the assemblage in the Pledge of Allegiance to the Flag.
Approval of August 6th 1997 regular Town Board Meeting Minutes
Corrections and additions to minutes
Add, Town Councilman Elect(nominated) Pat Dougherty as present both in Public
Hearing minutes and regular Town Board meeting minutes.
Eliminate repetition of line when American flag is lowered to half mast.
Add ,As of July 30th, 1997 44 building permits have been filed versus 30 building
permits filed as of July 30. 1996.
1996 Annual Financial Report
1996 Annual Financial report ,due to the State Comptroller by January 31, 1997,has not
been filed. Supervisor Mather stated he was holding 1996 Annual Financial report,due
to State Comptroller by January 31, 1997,until State Comptroller's Office audits 1995
books and any repercussions from with holding report,will be his responsibility alone.
Resignation of Town Councilman Achilles -
Because of Councilman Fisher's concerns about Councilman Achilles resignation, being
given verbally July 2, 1997 and not in writing and written resignation received August 7,
1997 the following motion was again made. Written letter of resignation states
resignation is effective as of July 2, 1997.
Motion made by Supervisor Mather and seconded by Councilman Clark that the Town
Board of the Town of Enfield accept Councilman Achilles resignation, effective 7/2/97
and that the Town Board of the Town of Enfield approve the nomination of Pat
Dougherty, to fill the unexpired term of Garry Achilles. Term of office ending
December 31, 1997.
Vote: Supervisor Mather, Town Councilmen Clark,Lovelace, Fisher-aye
Town Councilman (nominated) Dougherty -abstained.

Approval of Minutes(cont'd)
Purchase of New Truck
Add-
Labor costs substantial savings. Presently plow 3 1/2 hours with two trucks,cindering
2 1/2 hours with 2 trucks, one truck plowing and cindering 3 1/2 hours. Federal truck
rate per hour$183.68 per run.
With three trucks plowing and cindering at$551.00 per truck, savings per run would be
$196.65. Labor& benefits for same time$88.70, savings of$285.35 per run.
Plow trips past three years.

****PLEASE NOTE- Although a vote was taken on approval of minutes, no motion
was made or seconded. ( Listened to tape 4 times and no motion made). Vote-

COMMITTEE REPORTS
Cemetery Committee - Peggy Hubbell
Work Bee to be held one Saturday morning in September to work in Budd Cemetery.
Discussed idea of soliciting money from people who have relatives buried in cemeteries
to help with costs. Need fifteen bales of straw donated for grass seed planted in
Christian Cemetery.
Fire Department- Rich Neno.
Steadily working on budget.
Twenty-one calls for month of August. 12 EMS calls, 7 Fire calls, 1 MVA, 1 Mutual
Aid,Newfield. Carnival will be held next year.
Courts/Buildings- Supervisor Mather
Meeting to be held Wednesday evening, 9/10/97,during scheduled budget workshop to
discuss Courts and buildings. Judge Poole and Judge Warden to attend.

Infrastructure Committee- Supervisor Mather
Last meeting was spent trying to figure out options on space,buildings, alternatives for
Courts.
Old Business
Rural Roads Classification Law
Motion made by Councilman Clark and seconded by Councilman Lovelace that the Town
Board of the Town of Enfield approve for adoption Rural Roads Classification Law
(attached).
Discussed -corrections(hyphenated words)Town of Caroline changed to read Town of
Enfield,(correction needed to be made twice),Certified mail, returm receipt requested.

Shudaben Road- eported two years ago town accepted Shudaben Road
Highway Superintendent Updike r
from East Enfield Center Road to where turn around is as a town road. Core samples
done,residents brought that section of road up to specifications and Town Board accepted
road.
In transfer of title for right of way(deeded right of way to the Town)there was an
additional (guess of 500+feet)which was not accepted at the time Town accepted road.
Although,when deed came through that additional 500+feet was deeded to the town.
Town accepted road at one distance and got an additional 500+ feet in deed. Land owner,
far end of road,has been questioning Highway Superintendent about building road
additional 500+' to his property. Took letter from Mr. Selman to town attorney for his
judgment and town attorney wrote a letter to Mr. Selman that the town does not feel
obligated to build the additional 500+' of road because there would be no economic
benefit to the town.
Mr. Selman has obtained counsel and is pursuing the building of road.

Superintendent Updike needs another spreader to get through the winter . Spreader cost
possible$5700.00
Equipment reserve balance end of year $53,216.00
$39,340.00 goes into equipment reserve account when next sales tax check is received.
Bid in 1998 to be$3,000.00 -$5,000.00 higher.
Discussed-Need and desperate need of truck but need figures in front of Board'before
going further in debit when Town doesn't know where it is going in the line of buildings.
What does highway department need to get through the winter. Need to look at
alternatives. Possibly establish something with the county and Towns of Ulysses and
Newfield for emergency plowing. Truck and snow equipment available for rent.
Not ready to vote on truck purchase at this time, need to know more about future
expenses(figures).
Playground Liability-
Insurance carrier stated that if town has money directly involved we have liability. Town
pays workmen's compensation,therefore, we have liability. Resolution to problem, make
sure playground is given to somebody. Board needs something.in writing on liability and
ownership.
Monthly Bills-
Motion made by Councilman Clark and seconded by Councilman Lovelace that the Town
Board of the Town of Enfield approve for payment General Fund warrants, #158 - 172,
in the amount of$7488.48, Highway Fund warrants, # 151 - 162,- in the amount
$19674.05 , Small Cities Grant II, (HUD)warrant#11 in the amount of$34,194.00.
Vote: - Supervisor Mather, Town Councilmen Clark, Dougherty, Lovelace-aye
Town Councilman Fisher-abstained.

New Business -
Town Property Abstract
Letter from town attorney stating he is waiting for abstract for town property on East side
of Route#327 and upon obtaining same will order survey of this property. Trying to
clarify who owns what.
Planning Board Resignation ation-
Supervisor Mather read Michelle Humphries letter of resignation from the Town of
Enfield Planning Board and as Deputy Town Clerk. Resignation effective immediately,
September 3, 1997.
Motion made by Councilman Dougherty and seconded by Supervisor Mather that the
Town Board of the Town of Enfield accept the resignation of Miclelle Humphries from
the Town of Enfield Planning Board and as Deputy Town Clerk,effective immediately,
September 3, 1997.
Vote: Supervisor Mather, Town Councilmen Clark, Dougherty,Fisher and Lovelace -
aye. Resignation accepted with extreme regret.
1996 Annual Financial Report
Supervisor Mather again questioned about his not filing the 1996 Annual Financial
Report with the State Comptroller. Report needed to be filed by January 31, 1997.
Supervisor Mather advised that when the State Comptrollers office audit 1995 books he
would file report. Liability for not filing his is liability.
Motion made by Councilman Fisher and seconded by Councilman Dougherty that the
Town Board of the Town of Enfield go into Executive session following the regular
Town Board meeting to discuss with Supervisor Mather his refusal to file 1996 Annual
Financial report with State Comptroller.
Vote: Supervisor Mather, Town Councilmen Clark,Dougherty, Fisher and Lovelace -
aye.
Audit-
Motion made by Councilman Fisher that the Town Board of the Town of Enfield accept
the proposal Ciaschi, Dietershagen„Little, Michelson, firm to audit the 1996 books.
Motion not seconded, waiting to review proposal.
Cookbook Payment
Discussed payment of cookbook. To pay bill when bill received.

Budget Workshop
A workshop on the 1998 Highway Budget was held.
A..diournment-
Motion made by Councilman Lovelace and seconded by Councilman Clark that the Town
Board of the Town of Enfield's regular meeting on September 2, 1997 be adjourned and
that the Town Board of the Town of Enfield move into Executive session.
Regular meeting adjourned at 9:10 p.m.
