TOWN OF ENFIELD
RURAL ROADS CLASSIFICATION LAW
WEDNESDAY, AUGUST 6TH, 1997
6:30 P. M.
A Public Hearing was held Wednesday, August 6th, 1997 regarding the Rural Roads
Classification Law at the Enfield Community Building, 182 Enfield Main Road, Ithaca,
NY. Supervisor Mather presiding.
Present: Supervisor, William Mather: Town Councilmen Clark,Fisher,Lovelace.
Others present, Highway Superintendent, Ron Updike and Town Clerk,Alice Laue.
After all wishing to speak were heard the public hearing was closed. Public hearing
closed at 6:34 P.M.
REGULAR TOWN BOARD MEETING
TOWN OF ENFIELD
WEDNESDAY, AUGUST 6TH, 1997
6:30 P.M.
The regular Town Board meeting of the Town of Enfield was held Wednesday,August
6th, 1997 at the Enfield Community Building, 182 Enfield Main Road,Ithaca,NY at 6:34
p.m. Supervisor Mather presiding.
Present: Supervisor, William Mather;Town Councilmen,Clark, Fisher and Lovelace.
Others present-Highway Superintendent, Ron Updike and Town Clerk, Alice Laue.
Pledge of Allegiance to the Flag
Supervisor Mather led the assemblage in the Pledge of Allegiance to the Flag.
Approval of the Minutes of the July 2nd 1997 regular Town Board Meeting and the
Minutes of the July 16th 1997 Special Town Board/Planning Board Meeting.
Motion made by Councilman Clark, seconded by Councilman Lovelace that the Town
Board of the Town of Enfield approve for adoption the minutes of the July 2nd, 1997
regular Town Board meeting and the minutes of the July 16th, 1997 Special Town
Board/Planning Board meeting.

Tompkins County Board Representative- Peter Meskill
County working toward budget process. County budget forum to be held September 3,
1997.
E-911 service official August 3, 1997.
Discussed who was responsible for deciding when American Flag is lowered to half mast,
when American Flag is lowered to half mast.
Committees-
Fire Department-Greg Stevenson,Assist. Chief
Operation report for July 1997.
EMS calls 8, MVA's 3, Investigations 2,Brush Fires 2, Wires Down 1, Stand by 1,
Mutual Aid 0, none given or received.
Related Operational Information
Light rescue 642 suffered severe engine damage while responding to an incident. Heavy
rescue 641 running in its place. Repairs are expected to cost$3,000.00. Now that major
fund raising efforts are in the past fire officials will turn attention to preparing their
portion of the proposed 1998 fiscal budget.
Community Council- Joe Schrer
Summer camp average daily attendance was 75. Council is going to do a program
evaluation this winter.
Planning and starting of playground structure completed. Structure to be put on Enfield
Baptist church grounds for one year or possibly more.
Invitation to Community Council Dish-to-Pass Dinner and Performance to be held
Wednesday evening,August 13, 1997 at 6:00 p.m. at the Enfield Valley Grange Hall and
a ribbon cutting ceremony Thursday,August 14th, 1997 at 1:45 p.m. to open the Garry
Achilles Children's Playground was read by Pat Dougherty.
Liability of playground structure was discussed. Community Council member Jean
Murphy stated there was no town liability for playground,possible ownership by Enfield
Baptist Church solution to liability issue. Project insured by Baptist Church.
Consensus-Town Board does not want liability of playground structure or playground.
Supervisor to check with insurance carrier on liability issue for town. Need to find out
liability and ownership of liability.
Cemetery Committee -Peggy Hubbell
Christian Cemetery- Small stones are back. Bigger stones to be put in Friday, August
8th, 1997 and Saturday August 9, 1997, weather permitting. Highway Department
delivered a load of dirt for top soil,after picking a few rocks and waiting awhile grass
seed will be planted. Big improvement. Found one stone that no one knew was there, for
a six year old girl who died in 1860. Working on rules booklet for people with plots in
cemeteries.

Cemetery Committee(cont'd)
Discussed placement of flags on graves. American flags placed before Memorial day and
removed as soon as possible after the 4th of July. Flags are never left more than three
months. Town provides and places American flags on veterans graves.
The following resolution was made

Motion made by Councilman Fisher and seconded by Councilman Lovelace and voted on
as follows:
Vote- Supervisor Mather, Town Councilmen Clark,Fisher, Lovelace -aye.
Privilege of the Floor- Tony Petito
Tony Petito, Town of Newfield property owner on VanOstrand Road would like debris
left on property when Towns of Newfield and Enfield were working on VanOstrand Road
removed from property. Town of Newfield refused to remove debris and Mr. Petito
would like to know what Town of Enfield is going to do about this. Highway
Superintendent Updike stated he feels that the Town of Enfield has cleaned up debris left
by the Town of Enfield. Highway Superintendent Updike to confer with Town of
Newfield Superintendent and Mr. Petito about problem and come up with a solution
agreeable to all parties involved.
Indexing of Minutes- Diane Nelson
Spent twenty hours and completed seven years of indexing and have two years of input
into computer.
Monthly Bills-
Motion made by Councilman Lovelace and seconded by Councilman Clark that the Town
Board of the Town of Enfield approve for payment General Fund warrant, 134 -1157, in
the amount of$34204.76,Highway Fund warrants, 131 - 150,in the amount of
$29,886.08, Small Cities Grant I(HUD)warrant 4 in the amount of$13352.29 and Small
Cities Grant II(HUD)warrants 8 - 10, in the amount of$2262.67.
Discussion-Councilman Fisher questioned the price of the New Holland-Ford bill for
mower parts for sickle mower.
Vote _Supervisor Mather, Town Councilmen Clark and Lovelace -aye
Town Councilman Fisher-abstained.
Old Business -Rescheduling of September 3, 1997 Town Board Meeting
After discussion of rescheduling of September 3rd, 1997 Town Board meeting to allow
Town Board members to attend County Budget forum it was decided not to reschedule
this Town Board meeting and meeting will be held on September 3rd, 1997.

Miscellaneous Correspondence
Quarterly loss report from insurance carrier.
Official map of Town of Enfield for Planning Board to correctly name roads, creeks and
etc.
Primary Day Tuesday, September 9th, 1997.
New Business
Term of Office Change
In order for the Term of Office Change to be placed on the biennial election ballot
November 4th, 1997 a Term of Office resolution need to be made and submitted to the
Board of Election.
Resolution#9 Term of Office
Resolved upon motion by Councilman Clark and seconded by Councilman Lovelace
resolution#9,Term of Office,was made and voted on as follows. (See attached
resolution).
Vote: Supervisor Mather,Town Councilmen Clark, Lovelace-aye
Town Councilman Fisher- nye.
Resolution#10 Junk Car Law Section 6 Board of Appeals
Motion made by Councilman Clark and seconded by Supervisor Mather that the Town
Board of the Town of Enfield approve for adoption Resolution#10,Junk Car Law
Section 6 Board of Appeals. (See attached).
Vote: Supervisor Mather,Town Councilmen Clark,Fisher and Lovelace-aye.
New Truck Bid
Only bid received was from Beam Mack in the amount of$106,661.69 Bond good for
forty five days.
Discussed-
Contracting of snow plowing and cindering.
Labor costs.

Time spent plowing and retracing route to cinder.
Truck rate per run.
Cost of repairs to current trucks from 1994- 1997.
Labor and benefits for same time per run.
Amount of possible down payment and where down payment monies might be found in
budget.
Decided to ask Beam Mack to extend bond, get solid figures or amount of down payment
and to vote on at September 3rd, 1997 meeting.

Motion made by Councilman Lovelace and seconded by Councilman Clark that the
August 6th, 1997 regular Town Board Meeting of the Town of Enfield Town Board
adjourned

Resolution#8 Flag Placement&Removal
RESOLVED,upon motion by Councilman Fisher, seconded by Councilman Lovelace,
that the policy for placing flags in cemeteries maintained by the Town of Enfield is that
flags will be placed prior to Memorial Day and removed after Labor Day. Anyone
wishing to extend this time period makes this their responsibility.

RESOLUTION#9 8-6-97 Term of Office
RESOLVED, upon motion by Councilman Clark,seconded by Councilman
Lovelace that the Town Clerk transmit to the Tompkins County Board of Elections a
certified copy of the text of the following propositions to be submitted to a vote of the
people of the Town of Enfield at the next biennial Town election to be held on November
4, 1997.
1. Shall the term of office of the Town Clerk of the Town of Enfield be changed
from two years to four years commencing January 1,2000?
2. Shall the term of office of the Town Highway Superintendent of the Town of
Enfield be changed from a two years
to four years commencing January 1, 2000?
3. Shall the term of office of the Town of Supervisor of the Town of Enfield be
changed from two years to four years commencing January 1,2002?
Voted on as follows
Supervisor, William Mather-yes
Town Councilmen,Lanny Clark; Donald Lovelace -yes
Town Councilman, Gary Fisher; -no
RESOLUTION#10 8-6-97
Upon motion by Councilman Clark, seconded by Supervisor Mather the following
resolution was made and passed by the following votes.
Vote: Supervisor, William Mather,Town Councilmen Clark, Fisher and Lovelace, aye.
WHEREAS Local Law"A"of 1994,also known as the Enfield Junk Car Law, section six
thereof,allows the Enfield Town Board to establish a Board of Appeals or to hear appeals
itself,and
WHEREAS, the Enfield Town Board has NOT established a Board of Appeals for said
purpose,and
WHEREAS, given the potential for inconsistency and litigation should the Enfield Town
Board act as a Board of Appeals, be it therefore
RESOLVED,that the Enfield Town Board establishes the following procedure.
1. Appellants shall be granted a hearing with Board of Appeals of three persons.
The Town Supervisor
The Code Enforcement Officer not issuing the summons.
A Member of the Town Board.
2. Said Board of Appeals shall convene within ten days of receipt of written
notice of appeal. The Board's decision is final.
3. Should the Appellant be found to be in violation of the law,the Appellant shall
comply within fifteen days of receipt of written notice of the Board's decision or an
appearance ticket shall be issued.
4. All subsequent action shall be handled by the Town Court, or on appeal, by the
Court of proper jurisdiction.
