HomeMy WebLinkAbout1997-04-02 237 TOWN OF ENFIELD TOWN BOARD MEETING MINUTES WEDNESDAY,APRIL 2ND, 1997 6:30 P. M. The regular monthly meeting of the Town Board of the Town of Enfield was held Wednesday, April 2, 1997 at the Enfield Community Building, 162 Enfield Main Rd., Ithaca,NY, 14850 at 6:30 p.m. Supervisor Mather presiding. Present: Supervisor, William Mather; Town Councilman, Lanny Clark; Town Councilman, Garry Achilles, late. Town Councilmen, Gary Fisher and Donald Lovelace, absent. Others present, Highway Superintendent, Ron Updike, Town Clerk, Alice Laue Pledge of Allegiance- Supervisor Mather led the assemblage in the Pledge of Allegiance to the Flag. Tompkins County Board Representative - Peter Meskill Work on Hines Road bridge possibly starting in May 1997. Road closed during day, open nights. Peter didn't vote for Tourism Development grant program. Note of Interest- Supervisor Mather Town of Enfield Highway Department received$38,000.00 from FEMA for road repair work to Rothermick, Rumsey Hill, Bostwick and Georgia Roads. Committee Reports Community Council- Joe Schrer- 65 children registered in After School program. Community Council is making plans for summer camp. Supervisor Mather, again, expressed the town's commitment to letting the Community Council run their summer camp program at the Enfield Community building. Infrastructure Structure -Supervisor Mather Committee looking at buildings, space needs,estimates, numbers,etc. Cemetery Committee - Peggy Hubbell Estimated cost of fixing small stones in Christian Cemetery$5500.00. Work session April 18th- 5:00 p.m. April 21st Work Bee plans to be laid out. Highway Superintendent Updike reported he contacted Landstrom's pricing fill for cemetery use Fill priced at$50.00 per 15 yard load. Planning Board-Michelle Humphries Site Plan Review Law Public Hearing to be held Wednesday, April 9th, 1997 at the Enfield Community Building at 6:00 p.m. Town Board Meeting Minutes 4-2-97 2 Highway Committee - Ron Updike Working on Drug and Alcohol Policy making sure town has proper reprimand and help if someone tests positive for drugs/alcohol on random sampling. Bringing Employees Manual up to date. Next meeting April 8, 1997. Old Business Junk Cars- Supervisor Mather Need consistency in notice to the public. Steps -Notice of Violation- Sent registered mail. Notice states that there appears to be a violation and directs them what to do. They either have to come in and comply or they have fifteen days to file an appeal. Procedure outlined in 1994 A Junk Car Law. If they don't comply a numbered,three part ticket, official town document, which code enforcement has to physically hand to owner of property/owners agent accompanied with an Affidavit of Service is served.Next is Board of Appeals. Code Enforcement is working through town on certain roads most visible. Blanketing every road in the town during next 60 days. Using unregistered status of a vehicle as determinate as to whether or not it is a junk car. State having difficulty in providing town a list of all registered motor vehicle repair facilities,junkyards,etc. Summer priority. Mobile Homes Identified nine locations that are subject to Mobile Home Park Ordinance Forms in place for compliance. Code Enforcement Officers- Code Enforcement Officers are providing activity sheets, logs by days of what they have done. Monthly Bills Motion made by Councilman Achilles and seconded by Councilman Clark that the Town Board of the Town of Enfield approve for payment Small Cities Grant II warrants, 3-5, in the amount of$11,959.81,General Fund warrants, 50-73, in the amount of$44,294.19 and Highway Fund warrants,42-56, in the amount of$10,789.60. Carried Unanimously 2 %', 8 Town Board Meeting Minutes 4-2-97 3 SEOR Resolutions Supervisor Mather presented the following SEQR resolutions. Resolution#3 -Junk Car Law SEQR Resolution Motion made by Councilman Clark and seconded by Councilman Achilles that the Town Board of the Town of Enfield authorize Town Supervisor Mather to submit a SEQR short form of No Significant Environmental Impact for the 1994 A Junk Car Law. (Attached). Carried Unanimously Resolution#4 -Mobile Home Park Ordnance SEQR Resolution Motion made by Councilman Clark and seconded by Councilman Achilles that the Town Board of the Town of Enfield authorize Town Supervisor Mather to submit a SEQR short form of No Significant Environmental Impact for the 1993 Mobile Home Park Ordinance. (Attached). Carried Unanimously Resolution#5 - Proposed 1997 Site Based Plan Review Ordinance Motion made by Councilman Clark and seconded by Councilman Achilles that the Town Board of the Town of Enfield authorize Town Supervisor Mather to submit a SEQR short form of No Significant Environmental Impact for the proposed 1997 Site Based Plan Review Ordinance. (Attached). Carried Unanimously Resolution#6- 1994 A Junk Car Law Board of Appeals Motion made by Councilman Clark and seconded by Councilman Achilles that the Town Board of the Town of Enfield adopted the attached 1994 A Junk Car Law Board of Appeals resolution. (Attached). Carried Unanimously Town Board Meeting Minutes 4-2-97 4 Highway Department-Highway Superintendent Updike Superintendent Updike requested authorization from the Town Board of the Town of Enfield to seek bids for a new ten wheel dump truck, equipped with snowplow and cinder spreader, with the right to accept or reject any or all bids. Motion made by Councilman Achilles and seconded by Councilman Clark authorizing Highway Superintendent Ron Updike to seek bids on a new ten wheel dump truck equipped with snowplow and cinder spreader, with the right to accept or reject any or all bids. Carried Unanimously Old Loader has been consigned to Palmyra auction. Public Decency Law- Supervisor Mather Supervisor Mather met with Town Attorney Mulvey. Town needs to try not to subject ourselves to litigation for spot zoning. Attorney doing more research, suggested nothing be done on Public Decency Law until he is comfortable with either rewriting a portion of it,pursuing as is, or looking at an alternative. Suggested may want to avoid spot zoning discussion by looking at licensing business in the town that do business in excess of a certain amount of dollars. Note of Interest- SPCA Dog Enumeration to be done June/July. Adjournment Motion made by Supervisor Mather and seconded by Councilman Clark that the regular April 2, 1997 Town Board meeting be adjourned. Resolution 97-4 ' The Town Supervisor is hereby authorized and directed to submit a SEQR short form of no significant impact for the 1993 Mobile Home Park Ordinance. Resolution 97-5 The Town Supervisor is hereby authorized and directed to submit a SEQR short form of no significant impact for the proposed 1997 Site Plan Review Ordinance. Town of Enfield Proud Of Our Past, While Working For Our Future Town of Enfield 168 Enfield Main Road,Ithaca,NY 14850 607-273-8256 Fax 607-277-2639 Resolution 97-6 Whereas Local Law"A"of 1994, also known as the Enfield Junk Car Law, section six thereof,allows the Enfield Town Board to establish a Board of Appeals or to hear appeals itself, and Whereas,the Enfield Town Board has NOT established a Board of Appeals for said purpose, and Whereas, given the potential for inconsistency and litigation should the Enfield Town Board act as a Board of Appeals, be it therefore Resolved that the Enfield Town Board establishes the following procedure. 1. Appellants shall be granted a hearing with a committee of three persons. The Code Enforcement Officer A Member of the Town Board The Town Supervisor 2. Said Board shall convene within ten days of receipt of written notice of appeal. The Board's decision is final. 3. Should the Appellant be found to be in violation of the law, the Appellant shall comply within fifteen days of receipt of written notice of the Board's decision or an appearance ticket shall be issued. 4. All subsequent action shall be handled by the Town Court,or on appeal, by the Court of proper jurisdiction.
