The regular monthly meeting of the Town Bored of the Town of Enfield was held Wednesday,April 3, 1996 at the Enfield Community Building, 162 Enfield Main Road, Ithaca,NY at 6:30 p.m. Supervisor Mather presided. Present: William Mather,Supervisor; Garry Achilles,Lanny Clark, Donald Lovelace, Gary Fisher,Town Councilmen. Others present-Ron Updike,Highway Superintendent, Alice Laue,Town Clerk. Pledge of Allegiance Supervisor Matter led the assemblage in the Pledge of Allegiance. Approval of March.6, 1996 Minutes Motion made by Councilman Achilles and seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve for adoption the March 6,1996 regular Town Board Meeting minutes. Carried Unanimously Committees Tompkins County Representative-Peter Meskill Spoke about E911 memo to supervisors,and mayors updating them on the status of E- 911. Public Safety Committee meeting next week(week of April 8th). Presentation by Gordon Steven's, Chief Jail Administrator,about running out of space at the county jail and looking at a one to one and one-half million dollar renovation. May 4, 1996 -Transportation Services scheduling tour of county roads through out the county for representatives to look at road conditions. Personnel Committee- Don Lovelace Meeting held March 25, 1996 with Ron Updike, Gary Fisher and Don Lovelace present. Discussed Drug and Alcohol policy for town. Evaluation on full time employees, checking to see if other towns are doing evaluations and if so how they are doing them on full-time employees. At this time Highway Superintendent Updike feels he doesn't need to do evaluation for full time employees working for him. Discussed personnel files, formerly kept at the county, now file's kept at town hall. Planning Board-No report Town Board Meeting Minutes April 3, 1996 2 Highway Committee- Gary Achilles Committee is looking at and discussing taking a serious look at road priority and how we are going to deal with it. VanOstrand Road- Supervisor Mather Working with Town of Newfield to restore. Good part of road was washed away during January 1996 flooding. Getting 87 1/2%of cost back through FEMA 406. Road has to be brought back to specifications. Trying to get mitigation funds to help with road repairs and construction. Focusing on known problems-two pipes on Bostwick Road, Hubbell Drive turnaround, Enfield Center. Creek washout effecting 406 Enfield Main Road-Highway Superintendent Updike Problem looked at by FEMA-406 program in conjunction with county because it is their bridge and off their wingwall it washed. When FEMA inspector was here a month ago bridge crew measured everything up. Mitigation Program called 404 is funding for preventive measures. Highway Department-Highway Superintendent Updike VanOstrand Road open. Open as wide as before, now we need to go in and cut brush and push back sides. State law states all seasonal roads be open by April 1, 1996 for travel. Revisiting areas patch January 20th and 21 st. Frost is out, doing massive spot patching. Loader- Working on information-presentation for May Board Meeting. Waiting for state to award state contract and knowing exactly what specs are. This information is now out,not eligible to order until May 1, 1996,which is our next meeting. Various cost on various options-Caterpillar,John Deere, Volvo dealers contacted regarding used machine versus state contract new machine,they can't even touch it. Used machine cost about same as new state contact machine. State contract machine in neighborhood of$90,000.00. Good 4-5 year old used machine would run$90,000.00 to $95,000.00. John Deere bid was awarded state contract on two sizes of loaders 544 and 644 effective May 1, 1996. Repairs to old loader-contacted Syracuse Supply,who sold this particular model, to fix loader,tires,hydraulic,bucket, etc., it would cost$40 to $46,000.00 for a twenty one year old loader. Comparative Committee-Gary Fisher Postage cancellation still available until May 16, 1996. About 200 people in attendance at 175th Birthday Celebration. Next project advertisement for cookbook. Supervisor Mather and Councilman Achilles commended committee on 175th Birthday Celebration, job well done. 191 Town Board Meeting Minutes April 3, 1996 3 Community Council - Paula Feria- Garry Achilles Six week Enrichment program being held at Enfield Elementary School. Meets Wednesday's 3:00-4:00 p.m. 69 children participating. One hour segments. April 17th, 1996 Parenting for Prevention Workshop presented by Bob Fitzsimons to be held from 7- 9:00 P.M. Councilman Achilles reported.Teen Program meeting from 1;00-3:00 p.m. Saturdays. Nineteen teenagers painted basement of Community Building March 23rd. Teens would like to hold supervised Saturday activities. Teem leader, Bonnie Turesik working to get a GED program started in the Town of Enfield Town's Youth Bureau representative Joe Schrer spoke on GED program needs. Need Community Council to be sponsoring organization for GED program. Urged the Town Board to write a letter backing the Enfield parents in their efforts to obtain an equal education for their children and in support of their endeavors to obtain a GED program in the Town of Enfield to the Ithaca City School District Board of Education. Motion made by Councilman Achilles and seconded by Councilman Clark that the Town Board of the Town of Enfield write a letter to the Ithaca City School District Bored of Education expressing their concerns about the problems involving Enfield student and their parents and support their endeavors in obtaining a GED program in the Town of Enfield. (Letter to be drafted and.presented at May Meeting for drafting.) Vote- Achilles,Clark,Lovelace, Mather- Aye Fisher-Nye Fire Department-Roy Barriere Written report(attached.) New fire truck(tanker)arrived late this afternoon. Monthly Bills Motion made by Councilman Achilles and seconded by Councilman Lovelace that the Town Board of the Town of Enfield approve for payment Small Cities Grant(HUD) I warrants 20 and 21 in the amount of$2751.00, Small Cities Grant(HUDO II warrant 20 in the amount of$2371.93, Highway Fund warrants 46- 59 in the amount of$6309.59 and General Fund warrants 80- 121 in the amount of$66959.37. Carried Unanimously Town Board Meeting Minutes April 3, 1996 4 FINANCIAL STATUS DETERMINATION RESOLUTION presented by Councilman Fisher.. Motion made by Councilman Fisher and seconded by Councilman Achilles that the Town Board of the Town of Enfield approve for adoption the following resolution. RESOLUTION:: Whereas numerous expenditures for 1995 were not paid in 1995 and some have not yet been paid: And whereas this results in not knowing the financial status of the town for the year ended 1995 and subsequently the amount of funds that are actually available for use during 1996. It is hereby resolved that the Supervisor shall audit the accounts of all venders whose services were used during 1995 to determine and report to the town board at the May 1996 board meeting any 1995 expenditures outstanding that have not yet been paid and further, the Supervisor shall report to the board all expenditures for 1995 that were paid with funds budgeted for 1996. These expenditures shall be categorized by vendor, amounts paid and date paid,and any amounts reaming to be paid. Further, since payment 1004 bills with 1995 year money may have impacted funds available for 1995 expenditures,the Supervisor shall audit 1994 expenditures to determine the amounts paid with funds budgeted for 1995. These expenditures shall be categorized by vendor, amounts paid and date paid. Further,the Supervisor shall report to the town board at the May 1996 town board meeting the balance in each town account(by account name and account code)as of 31 December 1995 and any subsequent 1995 revenue added and any 1995 expenditures paid as of the May 1996 board meeting. Resolution discussed. Roll Vote-Achilles,Clark,Lovelace,Mather-Nye Fisher-Aye. Old Business- SPCA Contract Resolution presented by Supervisor Mather(See attached). Haefle TV,Inc. note notifying the town board of a.08 basic rate increase. Basic rate of $22.42 to be increased to $22.50. 192 Town Board Meeting Minutes April 3, 1996 5 Fire Department Loan- Supervisor Mather Last year the town board authorized Supervisor Owens to sign papers on behalf of the fire department to obtain a loan at a preferable rate,a lower rate, for the purchase of a fire truck. After some discussion the board approved signing that loan. That loan was rejected and returned to the fire department and it says"As outlined in the material that accompanied your original application package this money is available only to towns, villages, cities, fire districts and counties." They are an incorporated fire department, so the town would have to apply on their behalf. Procedurally it was done wrong. Wanting to correct the procedure the fire department gave to me(Supervisor Mather)the application package for the loan and asked me to complete it. Going through package it was found that item one, line five-Loan amount requested what you were going to use it for was $91,000.00. Supervisor Mather assumed this was for fire truck as part,guessing rest was coming from a trade in. However,on the last page a line for$30,000.00 was found in this loan,in addition to the$91,000.00, for an additional facility. Having set in on these meetings Supervisor Mather could not recall at any time the board authorizing this loan in anyway, shape or form to cover financing of any additional.facility. Supervisor Mather took loan package back to the fire department and asked them about it. They were not pleased. He then received a letter from the fire department that said" In regards to the,low interest application the Board of Directors has decided it would be better at this time to delete the$30,000.00 pertaining to the building and forward the application with only the truck figures." For Supervisor Mather to complete application board approval is needed. Motion made by Councilman Achilles and seconded by Councilman Clark that the Town Board of the Town of Enfield authorize Supervisor Mather to process the loan application in the amount of$91,000.00 for the fire truck. Heated discussion followed. Roll Vote: Achilles, Clark, Loverlace, -Aye Fisher, Mather -Nye. New Business NYMIR, insurance carrier, letter in regards to recommended method of covering the town's liability anytime we contract or someone uses a town facility. Name Change -Letter and petition from Carl D.Newhart requesting that Griffen Road be renamed Newhart Road in memory of Carl and Fran Newhart. HUD Oversight Resolution presented by Supervisor Mather(See attached). 1995 HUD Single Audit Resolution presented by Supervisor Mather(See attached.) Town Board Meeting Minutes April 3, 1996 6 Change of Term of Office Referendum- Councilman Achilles suggested that a referendum changing the term of office of town clerk, highway superintendent,and superintendent to a four year term be thought about and discussed and acted on at the May board meeting. Town Law/Ordinance Depository Resolution presented by Councilman Fisher. Motion made by Councilman Fisher and seconded by Councilman Achilles that the Town Board of the Town of Enfield approve for adoption the following resolution. RESOLUTION -Town Law/Ordinance Depository Resolution RESOLUTION: Whereas at present there is no readily available single depository or compilation of local laws and/or ordinances enacted by the town, and whereas there is a need for the public and town officials to review existing town laws and ordinances from time to time, it is hereby resolved that the Supervisor shall compile an index of town board meeting minutes containing there in passage of a local town law and/or ordinance and shall place a copy of the index'and a copy of all the local laws and ordinances passed in in an appropriate binder in the public area of the town hall nof later than the October 1997 town board meeting. Carried Unanimously Robert Carpenter, Iradell road,expressed interest in a position on the Town Planning Board. He also expressed concerns about the high rate of the Town of Enfield fire protection taxes. Adjournment Motion made by Councilman Achilles and seconded by Councilman Fisher that the April 3, 1996 regular meeting of the Town Board of the Town of Enfield adjourn. The Supervisor is hereby authorized to amend the 1996 contract between the SPCA and the Town of Enfield from the contract amount of $5,712.00 to 5,855.00, an increase of $14$.00. Additionally, the Supervisor is authorized to transfer $143.00 from account A1989.4, House Enumeration to account A3510.4, Animal Control. 2. The Supervisor is authorized to present for payment to the Town Board the necessary adjustment in payment to the SPCA to make the contract current. Background: The contract for 1996 was discussed on 9/6/95 with an amount cif $5,855.00. However when the contract was authorized on 10/4/95, the contract amount was presented and approved for $5,712.00. This correction is to enable the Town to execute a contract acceptable to the SPCA. The Town Board hereby appoints Patricia Dougherty to the HUD oversight committee for the Town of Enfield. Background: As discussed at thet March 1996 meeting, former council member Dougherty has considerable .expertise and interest in the administration of the HUD grants employed by the town. The Town wishes to utilize Mrs. Dougherty's talents and expertise in this area and to gratefully recognize her past contributions in this area. Mickelson, LLP for the purpose of conducting a "Single Audit" for the year 1995. The fee for said audit shall be $3,200.00 as per said firm's correspondence dated 13 March 1996. Background: A requirement of participation in HUD programs is that a federally approved "Single Audit" be conducted of the Town's records for the period during which the Town participated in a HUD program. This audit will be for 1995 and will be funded by the existing Hud grants.
