The regular meeting of the Enfield Town Board of the Town of Enfield was held Wednesday,August 2nd, 1995 at the Enfield Community Building, 182 Enfield Main Road,Ithaca,New York, 14850. Supervisor Owens presiding. Present: Supervisor,Jean Owens; Councilmen Dougherty}Achilles,VanNederynen, Clark. Others Present: Highway Superintendent,Ron Updike:Town Clerk, Alice Laue: Code Enforcement Officers,Roger Rumsey and Jesse Buchanan. PLEDGE OF ALLEGIANCE: Supervisor Owens led the Assemblage in the Pledge of Allegiance to the Flag. APPROVAL OF JULY 5TH, 1995 MINUTES: Motion made by Councilman Dougherty and seconded by Councilman Clark that the Town Board of the Town of Enfield approve for adoption the minutes of the July 5th, 1995 minutes with the following corrections. Page-1 12995 correct to read 1995. Page 2 -8/2/94 correct to read 8/2/95 Page 2 -COE correct to read CEO orrect fourth sentence to read-To be paid Enfield Fire Company-Paragraph 2 -C for with car show funds and fund raisers plus a$30,000.00 personal account. Paragraph three correct fire hours to fire house. Carried Unanimously ADDITION/DELETIONS: Motion made by Councilman Achilles and seconded by Councilman Dougherty that the following items be added to the August 2nd, 1995 agenda. Committees-Historical Society Unfinished Business-Gravel Pit, Recycling,Mailing of Minutes,SPCA, Carried Unanimously COMMUNICATIONS: a. Ron Belion-Letter of resignation as town representative to the Tompkins County Environmental Management Council and resignation to the Town of Enfield Conservation Advisory Council. b Criminal Justice Services -Notification that the Town of Enfield Courts have been awarded grant funds in the amount of$3,523.00. c.. Town Attorney Robert Mulvey-Letter advising that he has been in communication with Attorney Dubow, attorney for the local cellular company. Letter advised that change in ownership of the tower have not been the result of financial difficulties or behind the scenes transactions. Rather, various utilities have changed due to major corporate changes governed by the Federal Communication Commission. d. SARA-Town of Enfield has been granted a Local Government Improvement Fund grant in the amount of$14,083.00 for an active storage area project. PRIVILEGE OF THE FLOOR: Ernie Jackson-350:Applegate Road asked about Veteran Tax Exemption.and is there a sliding scale deduction and how does it effect this town. COMMITTEES: a. Town County Board Representative Peter Meskill Expressed his appreciation for the Town of Enfield Resolution on Bridges. Newly adopted budget packets will give Highway Department and Engineering more flexibility to decide whether they want spend more money on roads and bridges. No substantail support to do anything different then the current policy. County Department heads preparing budget packets due in the week or early part of next week. b. Code Enforcement Officers-Roger Rumsey and Jesse Buchanan Discussed junk cars on Corner of Podunk and Aiken Road. Roger Rumsey asked for direction of the board on junk cars. Does CEO's police all junk cars in town or go on a complaint basis. Supervisor Owens- At,this point responding on complaint basis. Discussed junkyards. Junkyards regulated by State. If State licensed town can't supersede State regulations. We can contact State asking how often junkyards are checked on. Jesse Buchanan-Complaint on Comer of S.VanDom and Mecklenburg road. Cars are being moved out. One junk car complaint about to go too court. c. Enfield Community Council -art Howser Day camp numbers lower than last year. Children are enjoying camp,more one- on-one. Councilman Achilles asked about leakage in building. Suggested that Greg Kirchgessner be contacted about this. d. Enfield Fire Company -No report. Councilman Dougherty to be liaison to fire company for next two months. 135 e. Highway - superintendent Updike Past month general maintenance. Coat of stone and oil on last mile of Harvey Hill Road. Griffin Road-slight snag with one of the property owners. Superintendent would like to require an additional 25 feet(.14 acres-goes from nothing to nothing with a 25 foot distance in the middle of the road)to help straighten out the road. Talked with town attorney and property owner's attorney. Ken.Baker coming out Friday,August 4th, to find out what Highway Department wants to acquire and then to draw a survey map. Hoping to work this out as cheaply as a driveway culvert or something for this gentleman. Working on Drug and Alcohol policy with the county. Looks like we will be a member of a consortium,to get a better price for the testing for the men. 25%of employees tested annually for alcohol. 50%tested for drugs on a random test. Policy has to be set up by January 1, 1996. Payment for V plow,previously advertised,in the amount of$277.77 has been received and turned over to the town bookkeeper. Cost town about$56.00 to advertise. Superintendent would like$200.00 moved in to the Equipment Reserve Fund from money received for V plow. Motion made by Councilman Dougherty and seconded by Councilman VanNederynen that the Town Board of the Town of Enfield approve the movement of $200.00 from Highway Fund to Equipment Reserve Fund. Carried Unanimously Parking lot at town barns is in extremely bad shape. Asphalt was laid down when Warren Brothers rebuilt Route 327. Superintendent Updike asked the Town Board if they had any objections to the Highway Department putting on a double layer of stone and oil where there is nothing and a single layer of stone and oil over entire area,which would include the last double doors of the town barn and extend to the Fire Company driveway. Approximate cost possibly not to exceed$1500.00. Motion made by Councilman Achilles and seconded by Councilman Clark that the Town Board of the Town of Enfield approve the resurfacing of the Town Barn parking lot,which is to include the last double door of the town barn and extend to the Fire Company driveway. Work to be done by the Town Highway Department. Carried Unanimously Roadside mower is in rough shape. Superintendent Updike would like to buy a flail mower. Town able to purchase a 50 Horse Power,John Deere 90 inch flail mower under state contract. State Contract$2215.00 and a second set of knives$234.36 for a total of$2449.36. Motion made by Councilman Achilles and seconded by Councilman VanNederynen that the Town Board of the Town of Enfield approve the purchase of a 50 horse power,John Deere 90 inch flail mower under State Contract number P010179 for $2215.00 and a second set of knives for$234.36 for a total of$2494.36 from the Equipment Reserve fund. Carried Unanimously Code Enforcement Officer Roger Rumsey asked Superintendent Updike about signage he would like to see signs coming into the Town of Enfield stating that Building and Mobile Home permits are required. Supervisor Owens suggested Superintendent Updike pursue this and contact Code Enforcement Officers. Motion made by Councilman Achilles and seconded by Councilman Clark that the Town Board of the Town of Enfield move into Executive Carried Unanimously Regular session of the August 2nd, 1995 Town Board Achilles and resumed. Motion made by Councilman and seconded by Councilman VanNederynen that the Town Board of the Town of Enfield waive the ten consecutive years of employment for Richard Hubbell for health insurance. Clark,Achilles-aye Dougherty nye f. Planning Board-Michelle Humphries Put off showing of new building permit due to enlarged process of getting Site Plan Review Survey out by August 15th, 1995. Last month no enough board members for an official meeting. Results of Site Plan Review will be presented to the board when results are available. Building permit process to be put together at next Planning Board meeting. g. Commemorative Committee-Councilman Dougherty Commemorative Committee met July 26th, 1995. Cookbook is in good shape. Decided on color of book,topic dividers to contain sketches of town buildings. Will town insurance cover parade? Supervisor to ask this question of town insurance carrier. Commemorative Committee to request a$5,000.00 budget next year. Next meeting August 23rd, 1995. h. Cemetery Committee-Councilman Dougherty Wooden sign for Rumsey Cemetery to be done by August 15th. All four cemetery arches are in. and approved the motion that Kenneth Smith be paid Cemetery Committee made three times a year,Memorial day-$50.00,July 4th,$50.00 and Labor Day$50.00. Rumsey Cemetery deed in process. Christian Cemetery-John Smith recommended that David Ahouse reset the stones. Cemetery Committee recommended that the town,from whatever account is relevant,pay the$218.00 bill due Ken Hover for sanding that is due. Cemetery Committee recommended that the Wilmont Parker family, who live next to Rolfe Cemetery on North Applegate Road and who maintained the front of the Rolfe Cemetery in the past years be granted a free burial plot by the Town of Enfield. Motion made by Councilman Dougherty and seconded by Councilman Achilles that the Town Board of the Town of Enfield grant a free burial plot to the Wilmont Parker family in the Rolfe Cemetery. Carried Unanimously 136 I HISTORICAL SOCIETY: Councilman Dougherty August 16th, 1995 Dish to Pass Picnic at Newhart's Lodge. In October the film The Great White Wave to be shown at the DeWitt Historical Society. MONTHLY BILLS: Motion made by Councilman Achilles and seconded by Councilman Clark that the Town Board of the Town of Enfield approve for payment General Fund warrants,in the amount of$20,531.88; Highway Fund warrants, in the amount of$10,405.30; SARA grant warrant,in the amount of$17.31; and Small Cities grant warrants,in the amount of $37,467.50. Carried Unanimously UNFINISHED BUSINESS a. Bingo -Town Attorney checking to see if 1958 law legally filed. b. Solid Waste Fee Collection- Town Clerk,Alice Laue County Solid Waste Fee contract presented to town board. Clerks have had several meetings,have numerous questions that we have presented to the county and we haven't received answers to our questions. Recommend that we read contract over,wait for county's amended contract before we move on this. Motion made by Councilman Achilles and seconded by Councilman VanNederynen that a resolution on the Tompkins County Solid Waster Fee collection contract be tablyd until further information has been received. Carried Unanimously- Sue c. Telecommunications Initiative Project- Supervisor Owens John Gary has offered to go to the training and come back and train the Supervisor and Town Clerk. d RECORDS INVENTORY- Supervisor Owens Completed all but 125 hours,may be asking the town to try to complete if we can't negotiate more money from SARA grant. e Gravel Pit-No change f Mailing Minutes- Councilman Dougherty suggested minutes be mailed to councilmen. g Privilege of the Floor-Councilman Dougherty asked if Privilege of the Floor could be at the beginning and end of meeting. Supervisor Owens stated she was will to make Privilege of the Floor available for later comers. h SPCA-Dog Enumeration Councilman Dougherty asked about enumeration of dogs. Supervisor Owens quoted that the dog enumeration was dome,but houses had been missed. Councilman VanNederynen suggested that before another dog enumeration is done that a dog enumerator's job description be done and a time limit for enumeration to be done set. I Insurance- Councilman Dougherty asked about insurance coverage for Boy Scouts. Scouts have own insurance through Boy Scout council. Community Council,'Town liability insurance covers Community Building: Community Council has own Workmen's compensation insurance. j. Enfield Community Building - Supervisor Owens 1. Septic Tank Supervisor obtained an estimate on septic tank replacement from Rich Neno of Johnny's Wholesale. Rich Neno gave a price quote at his cost for a 1500 gallon tank of $720.00. Supervisor called George VanVal.en and Ralph Carpenter for estimated concerning the costs fro replacing septic tank,asking them to call Rich Neno to make rue they knew what they were replacing and what was being asked of them. There where concerns about the safety features of having a septic tank where it was located that there would be vehicles driving over it. They are both aware of this and it is part of their estimate,that the tank would be safe from [art vehicle traffic.. safe fro) Health Department returned the town's$135.00 check with a letter stating that as we were only doing a septic tank replacement,not a conversion,we,therefore, where under a"grandfather"situation and if all we do is replace the tank were were fine. Councilmen Achilles and Dougherty expressed concerns about replacing the septic tank with a larger one, concerns about the dry well and drainage field. Motion made by Councilman VanNederynen and seconded by Councilman Achilles that the Town Board of the town of Enfield approve the bid of George VanValen for the replacement of the septic tank(materials and septic tank to be billed to the town) contingent on clarification from the Health Department on size of tank,legalities of replacing septic tank and all it involves. Roll Call Councilman Achilles-Nye Councilman VanNederynen-aye Councilman Dougherty-Nye Councilman Clark-Aye Supervisor Owns-Aye 2. Enfield Community Building Roof Quotes from Charles Hubberll Construction and Conroy Construction on replacing the community building roof were received. Both agreed that there were no soft spots on the roof which identifies the fact that there wasn't any detonated sheathing. Bids are for replacing existing roofing on both parts of the roof. Charles Hubbell Construction Company $6840.00 1 %37 Conroy Construction $8562.00 Both bids suggest we need to look at new gutters and downspouts but are not included in bids. Motion made by Councilman Achilles and seconded by Councilman Clark that the Town Board of the Town of Enfield accept the Charles Hubbell Construction Company bid in the amount of$6840.00 for the replacement of the Enfield Community Building roof.
