TOWN OF ENFIELD
TOWN BOARD MEETING MINUTES
WEDNESDAY, MAY 3rd, 1995
6:30 P. M.
The regular meeting of the Town Board of the Town of Enfield was held
Wednesday, May 3rd, 1995 at the Enfield Community Building, 162 Enfield Main
Road, Ithaca, N. Y. at 6:30 P. M. Supervisor Owens presiding.
Present: Supervisor Owens, Councilman Dougherty, VanNederynen, Achilles and
Clark.
Others Present: Highway Superintendent, Ron Updike, Town Clerk, Alice Laue.
PLEDGE OF ALLEGIANCE:
Supervisor Owens led the assemblage in the Pledge of Allegiance to the flag.
APPROVAL OF MINUTES:
Motion made by Councilman VanNederynen and seconded by Councilman Clark
that the Town Board of the Town of Enfield approve for adoption the April 5th, 1995
minutes of the regular Town Board meeting.
ADDITION OR DELETION TO AGENDA:
Motion made by Councilman Achilles and seconded by Councilman Dougherty to
add the following items to the agenda:
Unfinished Business: Cellular Tower, Enfield Community Building,Resolution Book.
New Business: Recycling Discontinuation.
COMMUNICATIONS:
Letter from Don Franklin, Tompkins County Assessment, advising that Thursday,
May 18th, 1995 from 3:00-6:00 p.m. is Assessment Review for Town of Enfield
residents. Assessment Review to be held at the Town Hail.
Letter from Town of Enfield Planning Board recommending the appointment of
Michelle Humphries to the Town of Enfield Planning Board
Letter from Finger Lakes Land Trust in reference to the Stevenson Forest Preserve.
Dedication to be Saturday, June 17th at 2:00 p.m.

Tompkins County Board Representative - Dan Winch
Mr. Winch thanked the Town Board for the their resolution concerning the Human
Service Building at the'Biggs complex.
Mr. Winch spoke about how the state budget cuts would impact the county budget.
Code Enforcement Officer: Written report.
Tompkins County Intermunicipal Cable Commission - Ted Wixom
Mr. Wixom spoke to the Town Board about what the commission was about and the
duties of the Intermunicipal Cable Commission. (Agenda June Town Board Meeting.)
Bingo - Charles Barbary - Willowood Camp Grounds
Mr. Barbay would like to hold Bingo games, Saturday nights at the Willowood camp
Grounds. (Agenda June Town Board Meeting.)

Enfield Community Council - Written revenue and expense report.
Enfield Fire Company: Larry Stilwell
The Enfield Fire Company Board of Directors would like an informal meeting with
Town Board representative to discuss capitol improvements project. Meeting
tentatively scheduled for Monday, June 5th at 7:00 p.m.
The firemen participated in their annual Adopt-a-Highway program clean up,
Sunday, April 30th.
Highway Superintendent - Ron Updike
The James Noftell lawsuit against the Town of Enfield as the result of an automobile
accident on Enfield Center Road , four years ago, has been settled by Travelers
Insurance Company for the amount of $10,000.00.
Underground fuel tanks have been removed and above ground tanks installed.
No contamination found.
No oil dust to date. Cutting banks, pushing ditches over and widening road on
Bostwick Road.
Planning Board- Bill Mathers
At the last Planing Board meeting we went through the whole permit process, trying
to figure out where we are getting complaints from, what's going on, what works,, what
doesn't work, trying to source what is really going on.

Seems we have a hygenic problem, our system is not clean. Liability issues
involved that are monumental and every municipality that has been taken to task on
them has lost. We have to get our act together. Intent is to clean up the system. trying
to take the minimal necessary steps to make the system work. That says that we are
not trying to impose zoning under a different name or any of that kind of nonsense, it is
"make the system work". That is a very'important concept.
Building Permits- First thing we need'to do is clean up the form. Form not user
friendly. Some of the items on-form don't dearly explain what goes on with other
agencies that inter-act with us, i.e. not clear on driveway pipes. Town roads no
problem, but County and State roads are different issues and different fees are
involved. Needs clarification, separate page, somewhat complicated. Planning Board
wants permission to modify form, bring it back to Town Board and get its approval.
Modify the sequence - House enumeration to occur prior to issuance of permit.
Number assigned before official permit is given to person.
One of the things we would like to write is a revised ordinance, or whatever, where it
is a requirement that house numbers be clearly posted, how high off the ground, how
big the letters and or numbers are.
Highway Superintendent Updike stated that the first thing that needs to happen with
house numbering is placement of driveway pipes.
House numbering process needs to be thought through. Permits need to be visible
from a distance, needs to be large enough with big enough numbers, weatherproof
material, posted on a sign post by numbers that are visible.
Length of Permits - What happens if permit expires and work isn't completed.
Permits are issued for one year. What do you do, what do we want to do?
Consensus - We need a building permit that is weatherproof, numbered,
specifically posted, visible and with a possible house number. Signature process a
separate card.
Water/Sewer: Contacted Health Department, Mr. Ewald. Technically unless multi-
family dwelling over a certain number of units, or a public water supply there is no
control.
Septic System - Current system, f!I out application at Health Dept., Health Dept.
approves engineering, you dig system. Health Dept. inspects, if it passes you bury it.
Roger gets information that is has been approved from Health Dept.
Consensus - Need system that guarantees we obtain --pore information.
Illegal Systems - Unless code enforcement officer goes out on a complaint:and calls
the Health Dept. nothing will occur.
Town needs to decide what they want to do.

Driveway Pipes- Town- You buy pipe, town highway installs it. County and State
you buy the pipe, pay a fee, pay contractor to install. (County gives one load of
gravel.)
20' pipe minimal, recommendation is 30'.
Electrical Inspection - Town regulation stipulates specifically that we go by the NEC
Code. It did not leave room for interpretation, K left room for compliance.
Consensus - If we want to give inspectors latitude, we need to clean up verbiage of
what we have now, giving them authority to do what they are doing. In detail, how are
we going to allow electrical cods interpretatod (literal/local practice interpretation?)
We need to stipulate that, giving authority to these people to do our interpretations.
Tax Roll - When is a house put on the tax rolls? Official year is March 1 st, if
completed and Certificate of Occupancy is issued. if built and taxable it needs to be
taxed and on the tax roll.
As a town we are not clear on what we tell people permits are needed for. Planning
Board, with Town Board permission, will go back, revisit how it is worded, come back
to the Town Board with what is done in other towns and board can decide what to do.
Duty of town to provide health/safety to resident. if there is a driveway built that
does not allow fire equipment access, we could be liable. Legal issue, what does
Town Board want Planning Board to do. Supervisor to check town's legal liability.
Planning Board urges the Town Board to officially adopt a Town of Enfield map.
Town Board need to increase amount of direction to Planning Board.
MONTHLY BILLS:
Motion made by Councilman Achilles and seconded by Councilman VanNederynen
that the Town Board of the Town of Enfield approve for payment General Fund
warrants in the amount of $4,283.84, Highway Fund warrants in the amount of
$16,115.14, Small Cities (HUD) Grant warrants in the amount of $5,926.99 and SARA
Grant warrant in the amount of $197.55.

UNFINISHED BUSINESS:
Bailey Gravel Pit- Supervisor Owens
Spoke with Jim Bailey, DEC in final stages of paper work, expect permit to be
issued but not issued as of yet.
Cellular Tower -
Still Cellular Tower I, company sold, no effect on tower. Councilman
VanNederynen suggested the town write a letter to the Cellular Tower owners
requesting that further changes in ownership, expansion and or closing , etc., be
forwarded in a letter to the Town of Enfield.
Enfield Community Building - Supervisor Owens
No new information to present. No other work being done. Septic system
Councilman Clark to check on. Charlie Hubbell to chuck roof for structural damage,
etc.

Recycling-
Last Saturday Recycling Center open is June 24th. Telling people who use center
about closing when they come in. Posters to be put up at Recycling Center and Town
Hail.
Public Use of Community Center- Councilman VanNederynen
Councilman VanNederynen to contact Gregg Kirchgessener early next week to set
a date for a meeting.
Resolution Book-
Michelie Townley is computerizing resolutions for a ten year period.
Volunteer-
Maryanne Burlew voluntarily repaired the flag for the Town of Enfield.
NEW BUSINESS:
1995 County Youth Contract
Motion made by Councilman Achilles and seconded by Councilman
VanNederynen that the Town Board of the Town of Enfield give authorization to
Supervisor Owens to enter into the 1995 Tompkins County Youth Service contract.
Carried Unanimously
Recreation Partnership Pilot Program
Motion made by Councilman Achilles and seconded by Councilman
VanNederynen that the Town Board of the Town of Enfield give authorization to
Supervisor Owens to enter into the Recreation Partnership Pilot Program contract.
Enfield Community Council to pay $2,500.00 fee.
Carried Unanimously
Polling Districts 1 and 2
Motion made by Councilman VanNederynen and seconded by Councilman Clark
that the Town Board of the Town of Enfield designate the second floor of the Enfield
Community Building as the Polling Districts 1 and 2, but address the parking problem
efficiently as we can before Polling Districts are needed to be used
Lengthy discussion on parkin, accessibility for elderly voters and handicapped,
etc., was held.

D L Consulting Ltd. - Utility bills reclaimers
Motion made by Councilman Dougherty and seconded by Councilman Ciark that
the Town Board of the Town of Enfield authorize Supervisor Owens to enter into a
contract with D L Consulting Ltd.

Appointment-
Motion made by Supervisor Owens and seconded by Councilman Achilles that the
Town Board of the Town of Enfield appoint Michelle Humphries to the Town of Enfield
Planning Board, term expiring December 31, 1998.
Carried Unanimously
ADJOURNMENT:
Motion made by Councilman Achilles and seconded by Councilman Clark that the
May 3rd, 1995 regular Town Board Meeting adjoum.
Carried Unanimously
